The opinions issued by the U.S. Supreme Court in Daubert v. Merrell Dow Pharmaceuticals Inc., General Electric Co. v. Robert K. Joiner, Kumho Tire Co. Ltd. v. Carmichael, and Weisgram v. Marley changed the ground rules for whether a survey is admissible as evidence into a trial. This article provides a history of the criteria used to determine the admissibility of expert reports before Daubert and summarizes Daubert and the three other relevant opinions. It provides examples of how the Daubert criteria are being applied in cases involving survey research and provides recommendations for conducting surveys that are likely to survive a Daubert challenge.

The cellulose based pressboards from four well-known suppliers in China, which areChangzhou HuaDian Insulation Material Co., Ltd (HD), TaiZhou XinYuan Electrical EquipmentCo., Ltd (XY), Hunan GuangXin Electrical Technology (GX) and ShangHai YaZhong TradeDevelopment Co., Ltd (YZ) were analyzed and compared. The guarantee value of Figeholm’spressboard was taken as a reference. Mechanical results show that most pressboards have excellenttensile, compressive and flexural properties except for YZ pressboards. The ply adhesion was alsostudied by simple loading method to verify the bonding effect and only XY pressboard show nosliding. Electrical results show that all pressboards have a similar electrical strength while HD andXY pressboards show relatively lower dissipation factor value. Based on the mechanical andelectrical performance, XY pressboards are considered to be better as compared to others andcompetitive to Figeholm’s products.

By analyzing the relevant patent data, the technological competitiveness of enterprises can be objectively evaluated, and the research and development priorities and the technological advantages and disadvantages of each enterprise in the same field can be compared and analyzed. It is considered to be helpful in judging the patent strategy, innovation ability, and the innovation level of enterprises, which is of great practical significance. Based on the field of the ship-integrated power system as an example, considering the Derwent patent holder code, draw the integrated technical strength of ships in the field of the distribution power system; using the ideas of the Boston matrix to measure the field has the competitive advantage of enterprises; by using the social network analysis method for each enterprise, the core technology of mining, based on the S curve of the technology life cycle, analyzes the enterprise concentration each time in order to predict the future trend of development. It can be found that China Shipbuilding Industry Corporation has the largest number of patents, followed by Fuji Electric Co. Ltd, International General Electric, Daewoo shipbuilding ocean engineering Co. Ltd and so on. Considering the patent quantity and the patent quality, the dominant and productive enterprises in this field can be distinguished. The ship-integrated power system and its related core technologies have been rapidly growing at present. The related technology patents will increase rapidly in the next few years, and more and more enterprises will participate in this field.

Abstract:
This study presents a risk management of the electric energy consumption in Nakhonratchasima industrial, case study in Thai Sanguan Cassava Starch Co.,Ltd. by AS/NZS 4360:2004 risk management standard. The objective of this study is to reduce the risk of electric energy consumption. Based on the risk inspection, the impact analysis of electric energy consumption is applied to manage an occasion risk. The analyzed risks are consumption risks and device risks. The consumption risks are load factor, the ratio of electric energy consumption to production unit and power consumption of each unbalance phase. The device risks are an efficiency of machinery and equipment, water pump usages, lighting system and air condition system. The results show that the use of machinery and equipment is the highest risk. Load factor, the ratio of electric energy consumption to production unit and water pump usages are ranged in medium risk level, while each phase of electric energy consumption, lighting system and air condition system are in low risk level. As a priority result, machine maintenance is an initial management to decrease the electric energy consumption. For reducing the electric energy demand, work schedule has been rearranged to enlarge the load factor. Operator controlling will reduce the ratio of electric energy consumption to production unit. The inverter, which is used to control motor in water pump usages, also reduce the risk of electric energy consumption. Finally, the low impact factor from lighting and air condition system are neglected.

The 70-year-old Frye standards of “general acceptance” were replaced by the Supreme Court's 1993 Daubert criteria of the scientific method, which established the standards for admissibility of evidence in Federal Court. The four Daubert criteria were: 1- Hypothesis testing, 2- Estimates of error rates, 3- Peer reviewed publication and 4- General acceptance ( Daubert v. Merrell Dow Pharmaceuticals, 61 U.S.L.W 4805 (U.S. June 29, 1993)). The present paper starts with the Daubert four factors and then matches them, step by step, to the scientific peer reviewed literature of quantitative EEG (QEEG) in relation to different clinical evaluations. This process shows how the peer reviewed science of the Digital EEG and the Quantitative EEG (QEEG) meet all of the Daubert standards of scientific knowledge. Furthermore, the science and technical aspects of QEEG in measuring the effects of neurological and psychiatric dysfunction also match the recent Supreme Court standards of “technical” and “other specialized” knowledge ( General Electric Co v. Joiner, 1997; Kumho Tire Company, Ltd. v. Carmichael, 1999). Finally, it is shown that QEEG scientific knowledge and QEEG “technical” and “other specialized” knowledge meet the trilogy standards of the Supreme Court rulings in support of QEEG's admissibility as a clinically valid method in the evaluation of the nature and extent of neurological and psychiatric disorders.

The objectives of this research are to analyze the business process in the production division of Greenspan Packaging System Co. Ltd., to evaluate IT of the IT investment, and to give recommendations based on the result of the IT valuation in order to get an efficient budgeting for the company. Methods that were used in this research are analysis of the literature, analysis of the collected data by interviewing and observing the running business processes and the method of analysis that was used is the New Information Economic (NIE). Results achieved in this research are results of the IT evaluation in a form of values on IT that are used in the company in order to assess the alignment between the IT investment with the company’s strategic intentions. Conclusion of this research is the recommendation that given to company can help the company to achieve their vision and mission and also their strategic intentions with the help of recommended IT investment.

CHINT Group Corporation es un holding de origen chino que participa en las industrias de productos de bajo voltaje, y de transmisión y distribución de energía eléctrica. Está ubicada en la posición 15 entre las 100 mejores empresas privadas de China, con un volumen de ventas de aproximadamente 1.800 millones de dólares en 2008 y presente en más de setenta países. Chint Electric Co. Ltd, la división de equipos para transmisión y distribución de energía eléctrica representa el 25% del holding y se encuentra en etapa de internacionalización. El objetivo de la presente tesis es desarrollar un plan de globalización para Chint Electric Co. Ltd, que considere la selección de una estrategia de entrada a América Latina y el plan de negocios que permita su implementación. De acuerdo a ello esta tesis presenta dos secciones. En la primera se evalúan las condiciones de Chint Electric Co. Ltd, para internacionalizarse y se selecciona el país plataforma teniendo en consideración el tamaño del mercado, índices macroeconómicos y del sector eléctrico, resultando Chile el país de entrada recomendado. Para este mercado específico se estudian tanto sus características como potencial de crecimiento. En la siguiente parte se definen las estrategias de entrada más alineadas con los intereses estratégicos de la empresa, evaluando exportación directa, licenciamiento, adquisición, alianza estratégica y greenfield, resultando tener estas dos últimas mayor coincidencia con lo requerido por Chint Electric Co. Ltd. De estos dos modos, el presente estudio desarrolla greenfield considerando aspectos estratégicos así como el plan de negocios asociado a la implementación, con énfasis en el plan de marketing. Se seleccionaron como segmentos objetivos la industria de generación eléctrica y la de la gran minería que representan en conjunto el 42% del mercado chileno de transformadores. Se considera la implementación de dos oficinas, una en Santiago enfocada al mercado de generación y otra en Antofagasta dedicada a la gran minería. Las líneas de productos a comercializar definidas fueron transformadores de poder medianos, switchgear, servicio de montaje de dichos equipos y servicio técnico de postventa. Se realizó el análisis financiero mediante el cálculo del valor presente de los flujos de caja descontados del plan de negocios, a una tasa de descuento de aproximadamente 15% obtenida mediante WACC a un horizonte de 10 años, estimando las ventas con tasas crecientes de penetración acorde a la mejora en el posicionamiento de marca y el desarrollo de nuevos proyectos, arrojando un VAN negativo de aproximadamente USD$ 1.400.000 y una TIR de 6% lo que hace a esta alternativa inviable desde el punto de vista financiero. Es factible viabilizar la alternativa Greenfield considerando nuevas líneas de productos en el análisis o aumentando el horizonte de evaluación, lo que permitiría a Chint Electric co. Ltd reforzar el nivel de control tanto en la gestión como en la cartera de clientes y posicionar la marca en América Latina como un competidor de nivel global.

En las últimas décadas, las empresas chinas han tenido un desarrollo vertiginoso. Adquirieron tecnología y know-how a partir de joint ventures realizados con empresas globales, y en la actualidad están buscando oportunidades en nuevos mercados. Una de estas empresas es CHINT Group Corporation, líder en China en las industrias de productos de bajo voltaje y de transmisión y distribución de energía eléctrica, con una facturación anual de US$ 1.800 millones en 2008. El objetivo del presente estudio es elaborar un plan de globalización de entrada a América Latina para CHINT T&D, la unidad de negocios de CHINT Group Corporation encargada de proveer equipos para transmisión y distribución de energía eléctrica y servicios relacionados, y que representa el 25% de las ventas totales del holding. Dicho plan de globalización incluye la selección de un país para ingresar al continente y la selección y desarrollo de una estrategia de entrada al mismo. A partir de la consideración de parámetros específicos del sector eléctrico, factores macroeconómicos y tamaño de mercado, Chile resultó ser el mercado de entrada recomendado, y para éste se presentan sus características y potencial de crecimiento. Respecto al modo de ingreso al país, se evaluaron las opciones exportación directa, licenciamiento, adquisición, greenfield y alianza estratégica; siendo estas dos últimas las que auguraban mejores resultados potenciales y mostraban una mayor adhesión con la estrategia de internacionalización de la compañía. El presente estudio profundiza en la alternativa de alianza estratégica incluyendo las condiciones de ésta, selección del socio estratégico para CHINT T&D, y un plan de negocios para su implementación. Tomando en consideración los factores críticos de éxito del mercado chileno y la condición actual de CHINT T&D para satisfacerlos, se propone como socio estratégico a Enerplan Ltda, empresa de origen chileno que provee servicios de mantenimiento de equipos de alta tensión y con una facturación de US$ 100 mil en 2009. Las principales condiciones propuestas para la alianza establecen un aporte de capital del 50% compartiendo riesgo en igual proporción, operación del negocio a cargo de CHINT T&D y contratación de ejecutivos locales para la dirección. Tanto desde el punto de vista estratégico como financiero, el presente estudio mostró como resultado que es viable el ingreso a América Latina a través de Chile bajo la modalidad propuesta. La evaluación económica mediante el método de flujos descontados a valor presente, en un horizonte de 10 años y utilizando una tasa de descuento de 15,2% obtenida mediante método WACC, arrojó un VAN positivo de 740 mil dólares. La TIR obtenida para el proyecto es de 21,8%.

The tort of negligence originated as a remedy for property damage and physical injury. However, recovery of compensation for psychiatric injury and pure economic loss, in cases where they were not caused by physical injury or property damage, has proved difficult. Duty of care for psychiatric injury is contingent upon whether the claimant is a primary or secondary victim. This chapter discusses the policy reasons for limiting duty of care for psychiatric injury, the mechanisms by which the law limits duty of care for psychiatric injury, the meaning of ‘pure economic loss’, and the development of the Hedley Byrne & Co Ltd v Heller & Partners Ltd (1964) principle of liability for negligent statements. The chapter also examines the ‘thin skull’ rule, which applies to psychiatric injury in the same way as to physical injury.

This chapter examines the circumstances in which the courts will make a specific performance order. Particular attention is given to the decision of the House of Lords in Co-operative Insurance Society Ltd v. Argyll Stores (Holdings) Ltd [1998] AC 1. It also considers the question whether English law should develop a more liberal approach to the availability of specific performance and recognize the existence of a general right to specific performance.

Tohoku Electric Power Co., Inc. and Mitsubishi Heavy Industries, Ltd. have begun a joint development program on key technologies for a next generation gas turbine which aims for a combined cycle efficiency over 55%. Under the program, advanced cooling technologies, better heat resistant materials and thy low NOx (DLN) combustion technologies are being developed. For verifying high temperature technologies, turbine testing is going to be performed using the HTDU (High Temperature Demonstration Unit) at Takasago Machinery Works, Mitsubishi Heavy Industries, Ltd. This paper describes the general description of the HTDU facility and plans for testing a turbine at a firing temperature of 1500°C.

Abstract:
This paper describes results from an experimental study of the effect of an electric field on nucleate boiling and the critical heat flux (CHF) in pool boiling. A dielectric liquid of AE-3000 (AGC Co. Ltd) was used as working fluid. A heating surface was polished with the surface roughness (Ra) of 0.05 μm. A micro sized electrode, in which the slits were provided, was designed in order to generate non uniform electric field and to produce electrohydrodynamic (EHD) effects with the application of high dc voltages. The obtained results confirmed the enhancement of CHF since the EHD effects increased the CHF to 82 W/cm2 at the voltage of −3000 V, which was four times greater than CHF for the pool boiling. The usual traveling wave on the bubble interface induced by the Kelvin-Helmholtz instability was modified by adding the EHD effects.

With research and technology (R&T) development activities for the next generation SuperSonic Transport (SST) being pursued globally over the past few years, the options to proposed airframe and engine concepts appears to be converging. The United States, the Europeans, and the Japanese are all engaged in developing the technologies needed for a future SST that is environmentally compatible and economically practical. Boeing and McDonnell Douglas are part of the team under an R&T contract with the National Aeronautics and Space Administration to develop critical components and enabling materials that will allow industry to make a production decision by 2003. Europe’s three main aircraft manufacturer’s — i.e., Aerospatiale, British Aero-space, and Deutsche Aerospace — comprise the European Supersonic Research Program (ESRP). A primary Japanese effort called the Hypersonic Transport Propulsion System Research (HYPR) project consists of a consortium of four international engine manufacturers and the National Japanese Laboratory. The manufacturers are: Ishikawajima-Harima Heavy Industries Co. Ltd., the Kawasaki Heavy Industries Co. Ltd., Mitsubishi Heavy Industries Co. Ltd., and General Electric Aircraft Engines Company, USA. A recent study by the Japan Aircraft Development Corporation (Reference 1) also addressed the technology requirements for the next generation SST. There are basically three major challenges that must be met before a new SST can become a reality. They are the technical, environmental, and economic challenges. The technical challenges of the propulsion system primarily reduce the development of new materials capable of sustaining higher temperatures and vibration (high and low frequency) over longer exposure times as well as capable of being produced at reasonable costs. Low emission combustors and low exhaust jet noise are the primary environmental challenges, which are a technical challenge in themselves. The economic challenge is to produce an aircraft and propulsion system that allows the manufacturers to recover development and manufacturing costs as well as realize a reasonable Return-On-Investment (ROI). In addition, Life Cycle Costs (LCC) must not be substantially above future subsonic airliners in order to justify premium fares the public would be willing to pay for the time savings of long-distance flights and still be profitable to the airlines.

New high temperature materials and improved blade cooling techniques have led 10 design of advanced models of industrial gas turbines with inlet or “firing” temperatures of 2350 degrees F. and higher. All major vendors now offer large new commercial gas turbine-generators, with outputs of 150 megawatts and higher, based on these new designs. These new turbine units offer higher overall performance and fuel efficiencies, with promise of better reliability and availability, as well as lower operating and maintenance costs. EPRI began to assess the durability of early models of these advanced gas turbines (AGT) in 1991, by closely monitoring their performance during electric utility operation. The durability surveillance program, involving several AGT installations outlined below, will be described. However, only the first two sites involving GE units have produced a substantial operating history for discussion. The latter two sites have only recently had new AGT units installed by ABB and Siemens respectively. At the time of this writing, those new units are still being readied for utility operation. Their operating history under the durability surveillance program will be monitored, and discussed in a future paper. • General Electric Gas Turbine Model MS7001F in peaking service at Potomac Electric Power Co. Station H at Dickerson, Maryland. • General Electric Gas Turbine Model MS7001FA in baseload service at Florida Power & Light Co. Martin Plant at Indiantown, Florida. • ASEA Brown Bovert Gas Turbine Model GT 24 initially in peaking service at Jersey Central Power & Light Co.(now GPU GenCo) Gilbert Station at Milford, New Jersey. • Siemens Gas Turbine Model V84.3A in peaking service at Kansas City Power & Light Co. Hawthorn Station at Kansas City, Missouri. The purpose is to determine the prospects for improved unit life cycle costs as a result of higher levels of performance, availability, reliability, and mantainability achieved by adding these engines to the industry fleet. This paper will describe the initial results from the Durability Surveillance studies, including observations from unit maintenance inspections as well as the output of advanced diagnostics and monitoring systems.

Electric Power Development Co., Ltd has been constructing Ohma Nuclear Power Plant aiming to start commercial operation in Nov. 2014. Ohma Nuclear Power Plant is located in Ohma-town, Aomori Prefecture and is a landmark power plant in which Mixed Oxide fuels can be loaded in the full core of the reactor. Hitachi-GE Nuclear Energy Ltd. and Kajima JV, both have extensive experience of nuclear power plant construction, are the main contractors of this project and supply the entire engineering, manufacturing of all major components, and execute the construction and commissioning for the reactor building. Ohma-town is located at the northernmost part of Aomori Prefecture bordering Tsugaru strait, where is exposed to severe cold and constant strong wind in winter. Such severe weather conditions make the construction very hard, however, Hitachi and KAJIMA tries to complete the project on schedule and on budget applying highly reliable advanced construction technologies, such as open-top and parallel construction method, all whether construction method, and large scale modularization technology. The groundbreaking (acquisition of the first construction permission) was already completed in May 2008. Its civil work steadily progressed, and the rock inspection was completed in Oct. 2009. Base mat will be completed in July 2010, and both building work and mechanical work go into full swing after installation of RCCV lower liner module.

Thermal transients during start-up and shutdown of a heavy-duty gas turbine stress the hot gas path components and reduce their effective life due to low-cycle fatigue. Experience has shown that stress-related cracking and wear is more extensive on gas turbines in cyclic service that start and stop more frequently, than machines in baseload service that operate more continuously. The start-up schedules of most engines in peaking duty are generally designed to minimize the time to reach full load. Rapid loading is not a critical element for many gas turbine users, who would prefer alternate start-up schedules that could extend component life, by as much as a factor of three. It is the fuel controls that dictate thermal energy input to a combustion turbine during start-up and shutdown. Therefore, experiments performed on the rates of acceleration and deceleration led to modified fuel controls for a natural gas-fired combustion turbine (General Electric Model MS7001B), Unit 41 at the T. H. Wharton Plant of Houston Lighting & Power Co. The results may be generalized and applied to other gas turbines and control systems, using different fuels. Specific findings relate to quicker ignition, more gradual initial warm-up, a lower acceleration for a soft start, and lower deceleration during fired shutdown. Additionally, new minimum fuel settings enhanced running reliability during load-shedding operation with water injection for NOx control. The results are described and illustrated in detail to demonstrate the new start-up and shutdown sequence. Subsequently, one HL&P unit was permanently modified for check-out, and across-the-board updating of other units is planned.
