Abstract:
Research indicates a variety of factors may inhibit the award of federal contracts to women-owned small businesses; however, a dearth of research exists on the topic from the perspectives of women who own small businesses. The purpose of this case study was to identify the capabilities needed by female small business owners in Atlanta, Georgia to win federal contracts. The framework was based on the theory of representative bureaucracy and the effects of gender differences on individuals' entrepreneurial perceptions. Data were collected via semistructured interviews with 6 women who owned small businesses and competed for federal contracts. Results of the thematic data analysis revealed 3 overarching themes: intrinsic factors, extrinsic factors, and contract procurement experiences. Each of these themes reflected qualities fundamental to participants' successful procurement of federal contracts. Significant intrinsic characteristics included adaptability, work ethic, and networking skills. Stakeholders may use study results to foster positive social change by providing women with resources they need to compete for federal contracts. Female entrepreneurs could improve communities by using strategies from this research to reduce unemployment and increase income for themselves and their employees. Social implications include the development of additional training programs to teach women how to complete contract applications, which may increase their participation in federal contract procurement and positively contribute to the economy.

Abstract:
Small business owners are not acquiring U.S. federal government contracts at the government established target rate. The government's small business procurement goals remain unmet, which represents an underutilized source of revenues for many small business owners. The purpose of this multiple case study was to explore strategies of 3 small business owners operating in the Washington, D.C., metropolitan area to acquire federal government contracts to increase profitability. The thematic findings were in the context of the resource-based view as the conceptual framework. The participants answered questions in semistructured interviews and provided organizational documents for review. Triangulation of multiple data sources and the constant comparative data analysis method led to 3 major themes: planning to target both government and commercial civilian customers through a top-down approach; developing core competencies including backgrounds and experiences and staffing choices to improve chances of success in obtaining government contracts; and knowing the company's audience, assets, and niche, which encompassed essential knowledge stemming from education and training oriented toward successful government contract work. Findings included the importance of planning before embarking on a process to bid for government contracts. Application of the findings may lead to a social change of higher small business revenues and lower unemployment, support for innovation, stimulation of the economy, and increased tax revenues to sustain government programs that can benefit society in general

Abstract:
Small businesses miss out on federal contracting opportunities because of the strategies they lack. Both large and small businesses provide supplies and services through contract awards to the U.S. government while spending over $300 billion annually. The purpose of this multiple case study was to explore the strategies of small business owners in the Clarksville, Tennessee and Hopkinsville, Kentucky region who have won federal contracts. Porter's competitive advantage theory grounded this study as the conceptual framework. The data collection process involved face-to-face, semistructured interviews and member checking with 3 small business owners to enhance credibility of data interpretation. Themes that emerged from the study included contractual knowledge, access to resources, measures of success, and sustainability. The study findings may apply directly or indirectly to individuals, organizations, and society. The positive social implications of applying the findings include increased business opportunities for small business owners, which could promote job creation to benefit the federal government and society.

Abstract:
Although the future socio-economic benefits of a new fibre-based ("next generation access", NGA) telecommunications infrastructure seem to be uncontroversial, most countries have to date only undertaken NGA investments on a small scale. Accordingly, a universal NGA coverage appears to be a rather unrealistic objective without government intervention. Indeed, many governments have already initiated diverse subsidy programs in order to stimulate NGA infrastructure deployment. We contend, however, that the current contract practice of fixing ex ante targets for network expansion is inefficient given the uncertainty about future returns on NGA infrastructure-based services and the public authorities' incomplete information about the capital costs of the network provider. This paper puts forward to delegate the choice of the network expansion to the NGA provider. Simple linear profit-sharing contracts can be designed to control the NGA provider's incentives and to put in balance the public objectives of network expansion and limitation of public expenditure. Abstract:
The Office of the Inspector General in the Department of Justice reported cases of government contracting employees accepting bribes totaling over $540 million within a 6-year period. The purpose of this case study was to explore the perceptions of government contracting managers regarding the knowledge needed to mitigate employees' unethical behaviors when administering government contracts. Previous studies on government contracting employees' unethical behaviors focused on employees' behaviors, but lacked data concerning managers' roles in mitigating employees' unethical behaviors. The study's conceptual framework was stakeholder theory. The data were gathered through semistructured interviews conducted with 21 government contracting managers in the mid-Atlantic region of the United States and from company documents. Data from the semistructured interviews and company documents were analyzed, coded, and then grouped into categories using a modified content analysis technique. Key themes suggested that to mitigate government contracting employees' unethical behaviors, these government contracting managers required continued training. These managers also found trust to be vital to dissiminating ethical requirements to employees, and they also reported benefits to conducting ethical government contracting. Member checking of participants' responses strengthened credibility and trustworthiness of these interpretations. Findings and recommendations from this study may contribute to positive social change by improving training and ethical standards in government contracting, which could lead to enhancing societal trust in government contracting organizations.

The purpose of this MBA Project is to provide a comprehensive update of the Navy Contract Writing Guide. The project was conducted with the sponsorship and assistance of the Office of the Assistant Secretary of the Navy for Research, Development, and Acquisition. The now out of date guide was originally written in 1996 in an effort to reduce problem disbursements as related to contract wording and organization. Extensive research, incorporating interviews, websites, periodicals, and texts, was employed to make the guide current. It has been reorganized to address issues and solutions in the same order in which the forms used by contracting officers and administrators have them listed. New issues have been raised since the original writing of this guide and are now incorporated with their recommended solutions. Individuals new to Naval contracting or those who have decades of experience will find the information provided useful to the efficient and effective writing and administration of government contracts.-- p.i.

Abstract:
This thesis analyzes the problem of corruption in the Mexican government procurement system, aiming to provide a mix of legal and policy solutions to combat and prevent it. Comparing the policies and laws that make up the regulatory framework of public procurement in Canada and Mexico, this study seeks to extract the best practices that can improve the Mexican system. This text illuminates how the weaknesses within Mexico’s procurement system has provoked the current exploitation of alternative procurement methods (known as “adjudicación directa” and “invitación a cuando menos tres personas”) to embezzle public resources through fictitious contract awards. Although we have seen a tendency towards including requirements for “transparency” and “accountability” into Mexican procurement law, this on its own is insufficient to combat corruption. Consequently, I argue that procurement units have to enhance these transparency policies by disclosing the rationale behind every procurement and contract award prior to the disbursement of the resources; having competition as the maximum principle to fulfill while doing so. This will allow auditing bodies (and Mexican citizens) to scrutinize the rationale behind these disbursements. The Public Function Secretary could oversee this process to validate the legality and the social benefit justifications claimed by the procurement units prior to utilizing alternative procurement methods.

Past performance ratings of government contractors are becoming a critical pathway to the $300 billion of contract dollars Congress sets aside for small businesses annually. This was a descriptive study exploring leadership strategies small business leaders use to attain positive performance ratings in government contracting, viewed through the lens of the principal-agent theory. The exploration occurred by interviewing 21 small business leaders located within 30 miles of Washington, DC, with favorable performance ratings on at least 3 government contracting opportunities. Clustering themes according to Moustakas's modified van Kaam helped organize, analyze, interpret, and provide meaning to participant accounts of the phenomenon. Findings revealed 5 overall themes: (a) leadership strategies that influence positive performance ratings, (b) behavioral or trait-based attributes of leaders, and (c) understanding bureaucratic dynamics and contract requirements, (d) resource-based capacity as an impediment, and (e) competitive intelligence as a valuable resource. The findings indicated a need for leaders to adapt approaches to contract performance that is appropriate for the situation as agencies implement the procurement process differently. The identification of strategies that positively influence performance ratings may increase the longevity of small businesses participation or excite the proliferation of small businesses aspiring or struggling to increase performance. Findings may also encourage various business leaders within socioeconomic groups to gain access to federal set-asides.

Abstract:
This thesis explores the U.S.-Pakistani relationship in the War on Terror in an effort to better understand the U.S.-Pakistani power dynamic. In particular, this thesis analyzes the United States’ relationship with Pakistan via a Hobbesian understanding of social contract theory: a state’s right to sovereignty. It then utilizes this framework to analyze the U.S. use of drones on Pakistani soil. This paper suggests a protectionist model has been adopted by the United States, thereby making these drone strikes violations of the social contract. As a result, this paper argues that because of this, the United States will have to uphold the state’s responsibility to protect in order to maintain their social contracts with other states.

Privatization has become a central feature of the economic policies of nations in the developed and developing world. Eritrea has also embarked on a privatisation program for the state-owned enterprises. It privatised 39 manufacturing enterprises from 1997-2001 in the hope that the enterprises might be restructured into more efficient, profitable, competent and value creating private enterprises. This thesis assessed the impact of privatisation on the operating efficiency, profitability, employment, wages and tax payment of the Eritrean newly privatised manufacturing enterprises.

This paper analyzes the employment policy of the current Peruvian government. We begin with some considerations on the economic and social context of the period 2011-2015 and specifically on the concept of precariousness in employment. Then we analyze the most important changes in labor and social security matters; finally, we will discuss some proposals for concrete measures regarding the search for solution of the problems addressed.
El presente trabajo se propone analizar la política laboral del actual Gobierno peruano. Empezaremos con algunas consideraciones sobre el contexto económico y social del período 2011-2015 y específicamente sobre el concepto de la precariedad en el empleo. Aerospace Company X (ACX) is a designer and manufacturer of advanced aerospace systems and its primary customer is the United States Government (USG). In order to reduce cost and minimize risk, both parties have embraced a multi-year contracting model in which productions agreements are signed for up to five-year periods. This allows for significant cost savings over single-year contracts while allowing for predictable production levels for ACX and its suppliers. At the time of this research, the company was soliciting bids from suppliers for the next five-year multi-year contract. Since this is a sole-source situation, ACX must substantiate all costs to justify that the pricing is fair and reasonable. Costs of purchased hardware are substantiated through three primary means: competition, commerciality, and cost-price analysis. Competition is preferred because the pricing can be justified by free-market forces. However, due to intellectual property rights or unique capabilities, suppliers are often contracted as sole-source. The supplier then can claim commerciality (i.e. the part is for sale commercially) or submit for a complete cost review of material, labor, and overhead rates. In some cases the supplier will not release this data to ACX and a government agency performs the review. The success of the cost substantiation phase hinges on getting complete and accurate data from suppliers in a timely manner. This thesis explores the challenges of obtaining cost data from suppliers and proposes recommendations that can be applied to general supplier management situations. First, a metric of proposal adequacy is developed and used to score the adequacy of each received bid. These scores are then analyzed to determine if there is any correlation with the existing enterprise ACX supplier rating system. Finally, recommendations for process improvements are made which focused on communication, IT systems, and standard work.

In the past, governments were directly responsible for carrying out projects concerning the construction of public utilities and for delivering public services to people in many areas of social and economic life. However, the budget deficits of governments in countries such as Jordan have required them to seek partners to assist in carrying out these functions. In other words, delivering services to people nowadays often involves contracts being concluded with private sector companies who fund and deliver governmental projects and have the skills and experience to carry out the projects efficiently. When private sector investors decide to enter into contracts with governments, they want to ensure that their investments are protected in case of a dispute with the host government. In this regard, the option to resolve disputes, including the disputes of government contracts, by alternatives to traditional judicial means has increasingly become one of the main incentives for private sector investors considering whether to enter into contracts with governments. This is because Alternative Dispute Resolution (ADR) is more informal, cheaper, faster and easier than the formal procedures which must be adhered to in the court litigation system. Jordan is considered a poor country which has to rely on the private sector to fund its projects but, because ADR is not used in this context, investors may avoid entering into contracts with the Jordanian government, believing that their investments will not be safe. Unlike in Jordan, the use of ADR has been evident in developed countries such as the UK.This thesis argues that Jordan, as a developing country in this area, should look to other countries such as the UK which have more advanced legal systems and legislation, in order to learn from their experience. Therefore, this is a comparative study which will discuss the doctrine of legal transplant and assess whether importing ADR rules and regulations from the UK to Jordan will be an effective way of improving Jordanian laws. Accordingly, this thesis discusses (i) why ADR is not used in government contracts in Jordan and (ii) the role of ADR in settling the disputes of government contracts in the UK. It also (iii) provides solutions and makes recommendations designed to encourage the use of ADR in Jordan, including on whether or not the experience of the UK can be applied in Jordan in this regard.

Small business leaders (SBLs) underutilize billions of dollars of U.S. government funding for small business subcontracting. The role of small business in the United States is important to local economies as well as a major contributor to the U.S. economy. Using the resource-based view as the conceptual framework for this study, the purpose of this qualitative multiple case study was to explore the strategies 5 government support sector SBLs in the mid-Atlantic region used to obtain U.S. government subcontract awards to remain sustainable. The selection criteria for this study consisted of small businesses in the mid-Atlantic region that have obtained subcontracts on prime government contracts. The data collection process included a review of the small business documents and participants' responses to semistructured interviews. The data analysis process included case study analysis and cross-case comparisons using methodological triangulation. Based on the data analysis, themes that emerged from the results of this study included education, experience, and networking related to strategy creation and implementation by the SBLs to obtain subcontracts on prime contracts. The findings of this study may contribute to social change by providing SBLs an opportunity to learn strategies to obtain subcontracts, which could increase organizational opportunities, promote job creation, and help to improve local economies through increases in tax revenues that could help the elderly, children, and others within the community.

Beginning with reclamation projects in the western U.S., the heavy construction industry helped the federal government grow in size and sophistication in the twentieth century. The Morrison-­Knudsen Corporation throughout the twentieth century represented one of the federal government's favored contractors. Following western reclamation projects, the U.S. federal government then used contractors to help move the U.S. economy out of the Depression, prepare for World War II, wage the Cold War at home and abroad, and win the space race. Thus, at key stages in United States history we observe the necessity of the U.S. federal government partnering with the heavy construction industry to achieve its policy objectives at home and abroad. Morrison-Knudsen was once the largest heavy contractor in the United States, participating in the construction of Hoover Dam, Pacific Naval Air Bases, Hanford Engineering Works, the U.S. Intercontinental Ballistic Missile System, and the Vehicle Assembly Building at the Kennedy Space Center.

This thesis explores issues of writing, difference, time, the body and memory through an exegesis and two feature-film scripts: "The Bridge Between", a Chinese single-nation production, and "Swell", an Australian-Chinese international co-production. Through the inclusion of sections of autobiographical narrative interwoven with moments of reflection, analysis and speculation, the exegesis argues for an approach to the creative process of scriptwriting as a combination of theory, engagement with other art practices, and, perhaps most importantly, the life experiences of the writer. Co-production film-making has becoming an increasingly important driver of international feature-film production in recent years. International co-productions may be defined as production arrangements containing a sigificant presence of production elements from two or more national origins. These elements can include a mix of the finacial, technical and creative. Two major categories of international co-productions can be identified: private studio-to-studio single purpose contracts must be distinguished from co-production arrangements of the government-to-government kind. Government-to-government co-production arrangements give producers the option to apply to publicly accountable funding bodies of governments in two or more nations.

The research problem addressed in this study is to determine what affect current labour legislation has on small, medium and micro-enterprises (SMME’s), in particular with regard to the procuring of Government contracts. To achieve this objective a literature study was undertaken to ascertain what knowledgeable people believed was the affects of labour legislation on SMME’s. The literature study included all relevant labour legislation promulgated by the Government since 1994 The literature study was then used to develop a questionnaire to test the degree to which SMME’s, operating in the Municipal areas of East London and King Williams Town, abided by the relevant labour legislation. The empirical results, in general, indicated a strong adherence to labour legislation. Those organisations that had not strictly adhered to labour legislation were, in most instances, not successful in securing contracts offered by Government or parastatals. The results indicated that all the role-players, namely businesses, trade unions and knowledgeable people have valid arguments both for and against labour legislation. Each group, is however, still concerned and suspicious that in one way or another, they will be placed at a disadvantage with respect to the others positions, and this places a serious strain on the South African economy.

The public sector is the biggest consumer of construction works in South Africa. Public sector is known for late payments to its service providers. This led to the study’s problem statement that stipulates that, the construction industry; particularly emerging contractors generally experience late payments from clients and employers. This is due to the fact that emerging contractors are vulnerable to failing as these contractors have limited financial resources and experience. The primary objective of the study was to develop a better understanding of the implications of late payments by the government on emerging construction contractors. The study therefore investigated the experiences of emerging construction contractors in the Eastern Cape. The secondary objectives of the study were: to identify the reasons for late payments by the public sector; determine the payment norms applicable to, and expectations of emerging construction contractors; establish construction contractors’ experiences with government payment methods; and to examine the implications of late payment on emerging contractors and their businesses. The study was conducted within a qualitative research paradigm. The participants were identified through non-probability snowball sampling. The sample consisted of five emerging construction contractors mainly from the Civil Engineering and General Building sectors in the Eastern Cape. The data was collected using semi-structured interviewing and was analysed using Tesch’s qualitative analysis explained by Hesse-Biber & Leavy (2011:201). The key results of the empirical study show that late payments have incapacitating effects on the development of emerging contractors. The conclusion reached from the empirical study includes recommendation that construction industry stakeholders form payment legislation aimed at curbing the delay of payments.

Since the late 1970s, the world has experienced a wave of microeconomic reform that has resulted in the privatisation of many previously State-owned assets, as well as other reforms directed at improving the efficiency of government business enterprises. This dissertation focuses on one important instrument of reform: outsourcing of public-sector service provision. Despite the prevalence of outsourcing, there has been relatively little empirical work analysing the effects of outsourcing at the contract level. This dissertation addresses three important empirical issues related to outsourcing. First, analysis of the magnitude and sources of cost savings associated with outsourcing was undertaken using a present value costing framework. Unlike other studies, this study includes transaction costs and considers how costs change over the life of the contract. The results indicate that savings of 37 per cent were achieved in the first year of contract operation ?savings that were achieved through a combination of reductions in pay and conditions, labour-saving technological change and reductions in inefficiency. Secondly, the dissertation considered why the level of savings achieved fell to 24 per cent following contract variations at the end of year 1. Some evidence indicated that this may have been due to opportunistic behaviour or hold-up: that the contract service provider may have taken advantage of contractual incompleteness and increased its price during the course of contract renegotiations. Although hold-up is an important theme in the literature on contracts, little empirical work has been undertaken in verifying its existence. Thirdly, the impact of contract design on the efficiency of outsourcing arrangements was analysed. It is well known that contract theory predicts a trade-off between incentives and risk. Using the standard principal-agent framework, a simple model is developed to analyse the effects of demand uncertainty on the risk-incentive trade-off. This model is then tested using data from maintenance services contracts at two corporatised water retailers in Melbourne: an environment that is characterised by high levels of both cost and demand uncertainty. Using a general linear regression model, the results obtained indicate that the moral hazard effect dominated the risk premium effect.

The study is about the activities of public entities in international trade, more precisely, about international government procurement. The law of government contracts, in international and municipal law, seeks to balance the stability of contractual relations between the parties and the mutability of the contract which flows from a recognition of the primacy of the public interest. The precise balance struck varies from one legal system to another. Part One of the work looks, firstly, at the recognition, immunities and capacity of public entities in international commercial transactions. Secondly, it treats the conflict of laws rules applicable before national and arbitral jurisdictions. Thirdly, it explores the various possibilities of applicable law, namely the law of the contracting State, the lex mercatoria and public international law. Part Two examines, from a comparative perspective, the notions of "public body", "public contract" and "contrat administratif" in Ameircan, English and French law. The third part explores two main themes. Firstly, the process of procurement in national law, European law, and under the Agreement on Government Procurement; and secondly, the question of the stability of the contractual obligations which can be disturbed by unilateral interventions of the contracting public entity and by external supervening events.

The state of the Tendering Process in South African Government Institutions has become an area of concern in recent years with issues related to transparency, governance and rigid retrospective procedures being cited as impediments to efficiency. In tum, Knowledge Management (KM) and its ability to be applied to all types of organisations to increase efficiency has been popularised extensively. An analysis of KM literature suggested that the principles of KM may be used to increase efficiency and create competitive advantage. This study attempted to identify whether the benefits gained by other organisations through the application of Knowledge Management principles, could be applied to the Tendering Process in South African Government Institutions. The study sought to identify how Knowledge Value Chain by Wang and Ahmed (2005) may be leveraged to create an enhanced Tendering Process. The study then reviewed the Tendering Processes conducted in Australia, United States of America, Malaysia and South Africa and sought to identify the common steps in a tendering process in order to construct a standard tendering process. The Knowledge Value Chain was then applied to this process to create a standard tendering process enhanced by Knowledge Management Principles. The model was compared to the processes currently conducted in two Government institutions and two parastals. The findings indicated that the model is well suited for Government Organisations and would assist in the creation of greater transparency, however the practical implementation of the model is yet unlikely as the model suggest electronic access to information, and the process in South African Government Institutions is predominately paper-based.
