Full textCriminal justice in Artois (1526-1790) can be studied both at te local but also at the international level as the count regularly switched hands from the Habsbourg to the Bourbons. We are going to study the impact of customary law, kept until the Revolution, and the interferences within this law of the central power through numerous proceedings added during three centuries. We can thus see sets of legislative, imperial land royal dispositions trying to make their way through the local system but they were never really implemented. They were the sign of the central power's wish to rule over the county but they clashed with the local cultural realities. Indeed, the local courts of law took no acount of these interferences thus affirming their autonomy and their emancipation, demonstrating, by doing so, the extent of their legal prerogatives.It is all the truer for the municipal magistrates ; in Artois, they ruled over high, intermediate and lower courts of justice even if they were just part of the lower one. The magistrates at the core of this essay sometimes had difficult relationships with the higher courts as when they displayed their power while resisting the periodical pretensions of the royal justices. With their partners from others cities they created zones of influence and a judiciary networking within which they could detect criminals and surrender them to judges. The tracking down of delinquents and criminals was made through letters between many persons and social concord was thus promoted and kept. From then on the municipal courts had within reach a complete paraphernalia of punishments they used according to their education, culture and state of mind of the moment to keep and control the urban populations of the "ggods cities" of Artois under the Ancien Regime. The local magistrates acted ponderously in the enforcement of sentences according to the circumstances within which crimes and offenses had been committed, showing some arbitrariness nonetheless

Full textThis Ph.D. thesis contributes to the new history of European law by proposing the results of in-depth biographical research on the first judges, advocates general and registrar who worked at the European Court of Justice during the first twenty years of its existence (1952 - 1972). Firstly, it sheds new light on the professional and personal trajectories of the Court's pioneers and of those who pronounced some of its most commented judgments, those who laid the foundation of the 'constitutionalization' of the European legal order. Secondly, it leans on the collected biographical data in order to bring to the surface new elements of knowledge on three precise points with regard to a question which political scientists have been interested in for two decades - and which now also historians address: how did the European Court of Justice, from the 1960s onwards, succeed in seriously limiting the Member States' sovereignty, especially by imposing the principle of primacy of European law, without provoking a rebellion by national decision-makers? It first of all analyzes the nomination process of the first judges and advocates general, in order to establish whether governments did, or did not, use the appointment mechanism to curb down ECJ activism. It then studies the members of the Court's views and convictions with regard to European integration and their role in the European Communities. Full textAdmissibility is the heart of the judicial process. It studies the criminalization of international life. It seems to account for the judicial response to the international resentment against the great criminal acts, whatever was the territory of commission.This thesis deals with the notion of admissibility before the ICC. With the creation of the ICC, International Criminal Justice is a new dimension. The practice of the Court is still new. The study is an excuse to investigate the operation of the ICC. States have tried to limit the ability to receive from the Court. They did so based on the principle of complementarity. It compensates the action or inaction of failing states, which have a duty to prosecute international crimes. Article 17 RS sets out exceptions to declare a case admissible before the ICC. Thus, the admissibility of a case which is the subject of an investigation will be accepted only, if it is shown that States did not intend genuinely to carry out prosecutions. And that furthermore, the threshold of gravity of a case is reached. The universal nature of the jurisdiction of the ICC is undermined by the conditions of admissibility. Analyzing the admissibility of competence as a condition rightly, for it is the failure of the state to ensure effective prosecution to justify that the case will be declared by the Court itself, admissible. The requirements for the Court to act, it is clear involvement of the system of admissibility as on the organization of the Court that its relationship with the United States. These are not insignificant. In fact, the system will evolve admissibility. It is characterized by its ability to influence the law. Thus, the decision to receive should encourage States to adapt their domestic law. The viability of the Court, in the long run depends on maintaining a synergy of cooperation with national courts of States Parties and other States. The system of admissibility tends to highlight indicators emerging in the practice of the International Criminal Court. This is especially striking realignment of the roles of international actors and the new relationship established between the States and the Court. The system of admissibility of the Court tends to erode the principle of state sovereignty, without itself being swept by the opposition of sovereign states

Full textAging population is a phenomenon faced by Quebec. In this context, the protection of incapacitated and vulnerable individuals will be increasingly important in the coming years and they should benefit adequate protection from the institution of protective supervision. Considering that the institution of protective supervision is always the result of a court order, the clerk of the Superior Court of Quebec has a fundamental role to play during the judicial process. The judicial officer has jurisdiction to pronounce the judgment of institution of protective supervision. The following study will attempt to verify whether the proven inapt persons are well protected under the actual system whereby the judicial officer has the function and the powers to decide. To do this, a two way analysis will be used. First, the legal framework within which the clerk shall perform its functions will be studied and second, the results and analysis of an empirical survey of clerks of the Superior Court of Quebec will be discussed. This approach should reveal the existing gap between theory and practice.
