Full textThe topic of this thesis for a master’s degree is ,,The Key Aspects of Copyright and Related Rights Collective Management in a Musical Field”. The development of innovative technologies and the particularity of the internet have determined the changes in the use of music records: the new types of music records uses and the possibility for many persons from any country to get these records easily have emerged. Due to these changes copyright and related rights collective management societies operating in a musical field recently have faced some challenges. The aim of this thesis is to make the analysis of the key aspects of copyright and related rights collective management in a field of online music use, to reveal the collective rights management challenges caused by the internet and to evaluate the present collective rights management situation and the collective rights management reform initiated at European Union level. Full textThe topic of this paper is Collective Management of Performers' Rights. Nowadays and Future Perspective. The issue of the performers' neighbouring rights is relatively new. It emerged at the beginning of the twentieth century, particularly as a result of technical developments when recordings began to be substitute for live performances. Performers have sought to keep control of their performances by claiming rights to protect them. These rights are fundamental: they secure not only an ingome for performers but also foster the maintenance and the development of creation and culture in the interest of society as a whole. Many national laws and certain international normative texts (Rome Convention of 1961, WIPO Performances and Phonograms Treaty of 1996 and European Directives) Performers collecting societies are associations of rightholders. They are set up to collect and distribute royalties for rightsholders on a collective basis. Collective management societies of performers are generally non profit organisations based on collective agreements in certain cases. Full textMaster Paperwork thoroughly overviews technical protection measures of intellectual property and various classifications of them and determines the main differentiation in this work context – i.e. classification to active and passive technical protection measures. This paperwork also deeply analyses legal protection mechanisms of technical protection measures, starting WIPO Copyright, Phonogram producers and broadcasters treaties of year 1996, continuing to European Union directive on the harmonization of certain aspects of copyright and related rights in the information society of year 2001 and finishing the analysis of the national legal regulations of different world countries, including Lithuania. Under the basis of the analysis of the legal information, the author reveals harmonized and incompatible areas between legal protection of intellectual property and technological protection measures and concludes that the legal protection mechanism, which was chosen to regulate the usage and other related actions of technological protection measures, was not correct and did not serve the purpose, because many countries diversely and without seeking primary goals of WIPO treaties interpreted and implemented the provisions of the legal protection of technological protection measures. Full textThe title of this master's thesis is E-publishing: Aspects of Copyright. The purpose of this paper is to examine the current E-publishing copyright legislation, evaluate its compliance with modern-day economical and technological tendencies, compare national and European legislation, suggest the necessary changes or interpretations of current legislation. The term “E-publishing” is considered broadly and analysis includes digital libraries legislation and legal perspectives, which has a significant impact on both public interest and interests of copyright right holders – publishers and authors. Firstly, the national copyright legislation and its relevance to electronic publishing is analyzed – legal differences between tangible and intangible media, including differences between traditional and electronic books, rights exhaustions principle, book lending in libraries, photocopying exception, etc. Adaptations of publishing contracts necessary for E-publishing are suggested. The new wording of Law on Copyright and Related Rights and its compliance with E-publishing is analyzed, focusing on new copyright exemptions, especially reproduction of a work for teaching and scientific research purposes, allowing public libraries to make digital copies of books and make them available to the public by dedicated terminals on the premises of the said institutions. Full textThe dissertation analyses criminal liability for illegal reproduction of literary, scientific, artistic work or object of related rights, distribution, transportation or storage of illegal copies thereof. Conception and attributes of intellectual property, evolution of laws of intellectual property in the world and in Lithuania and legal sources which provides criminal liability for illegal reproduction of literary, scientific or artistic work or object of neighboring rights, distribution, transportation or storage of illegal copies thereof are examined in the dissertation. The dissertation also discusses the elements of crimes prohibited in Article 192 of the Criminal Code of the Republic of Lithuania, examines interpretation and application of Article 192 of the Criminal Code and distinguishes crimes prohibited in Article 192 from administrative offences. Furthermore, the dissertation discusses criminal legal consequences threatening the offender who commits crimes prohibited in Article 192 of the Criminal Code: sanctions according to Article 192 of the Criminal Code and confiscation of property. At the end of the dissertation a new wording of Article 192 and a new Article 1921 of the Criminal Code is proposed.
