This essay offers an investigation on the debated question of Radbruch’s supposed turn from positivism to non-positivism after World War II. It also intends to check whether this turn can be attributed to different balancing proposals among the main elements of Radbruch’s legal philosophy. To do that, three main questions must be answered: (i) whether Radbruch was a positivist before the war; (ii) what was his position after the war; and (iii) what was the relationship between the turn in his thought and the weight he gives to the two main dimensions (or principles) of his philosophy, namely “material correctness” (or “justice”) and “legal certainty”.

Abstract:
This study tries to discuss the tensions that occur between legal experts in formulating basic values that become the right legal objectives. Figures that are used as a comparison in the perspective of this legal objective are Gustav Radbruch and Hans Kelsen. Through a conceptual and case approach, this study tries to examine the concept of law based on contextual cases that occur in society, namely the application of the threshold in elections. In this study, the application of the threshold in elections is used as a measuring tool to determine legal objectives as stated by Gustav Radbruch and Hans Kelsen. The results of this study indicate that Gustav Radbruch sees and tends to the value of justice as a legal goal, like what Hans Kelsen found. The difference between Gustav Radburch's justice and Hans Kelsen lies in how to measure and realize this justice. This research is expected to be able to help academics and legal practitioners to dig deeper into the philosophical objectives of law in order to create laws that can answer the needs of society.

What is the relationship between Nazism and natural law—the notion of universal standards, which arise from either God, revelation, nature, rationality, or morality, and which human-made statutes cannot break? In 1946, in the wake of World War II, Gustav Radbruch, one of Germany's most respected Social Democrats and legal philosophers, published his influential article, “Statutory Injustice and Suprastatutory Law,” which grappled with a pressing issue of postwar justice. Should courts deem judges criminally responsible for having earlier convicted defendants, and often sentenced them to death, based on denunciations by family, neighbors, or rivals, denunciations that the Nazi regime had encouraged but that a fair-minded government must condemn? As a matter of jurisprudence, Radbruch set forth his famous formula, which declared that judges must adhere to positive or statutory law, except in rare circumstances in which such law violated fundamental principles of justice. In his words, “[P]ositive law, secured through legislation and power, prevails, even if it is substantively unjust and inexpedient, unless the tension between positive law and justice reaches such an intolerable level that the law as ‘false law’ must yield to justice.” As a matter of history, Radbruch excused Nazi-era judges who had missed his jurisprudential point, because they had succumbed to the legal theory of positivism that had long permeated German legal thinking. “Positivism,” Radbruch wrote, “with its belief that ‘law is law’ rendered the German judiciary defenseless against arbitrary and criminal laws.”

According to German legal philosopher Gustav Radbruch, laws that are substantively unjust to an intolerable degree should not be regarded as legally valid, even if they were promulgated according to stipulated procedure. Radbruch’s Formula (as his position has been termed) contradicts the central tenet of legal positivism, according to which the existence of laws does not necessarily depend on their merit.1 While some legal positivists suppose that legal invalidity based on the content of particular laws is a central tenet of natural law theory,2 natural law theorists such as John Finnis opine that the lex injusta non est lex3 maxim has been no more than a subordinate theorem of classical natural law theory.4 In Finnis’s view, unjust laws give rise to legal obligation “in a legal sense.”5

The juxtaposition of views of these philos-ophers is dictated by the specifics of the issues raised by them, and also by the similarities of their ethical model. The article's conclusion is to demonstrate that it is impossible to propound a total and permanent separation of morality and law on the grounds of the theories of the discussed think-ers, because morality according to them is the main method of validation of law.

Gustav Lambert Radbruch (1878-1949) and Hermann Kantorowicz (1877-1940) were undoubtedly two of the greatest legal scholars in Germany in the first half of the twentieth century; for some of this time arguablythegreatest. It is a happy coincidence that they both attended the seminar of the criminologist Franz von Liszt in Berlin at the same time in 1903. Although very different in temperament and not always in agreement, they were immediately drawn to each other, highly respectful of each other's undoubted intellect, never jealous of the other's achievements but always altruistically supportive. Though together for only four months initially, they maintained regular contact through letters and quickly forged a close and life long friendship.

Este artigo faz uma análise substancial acerca da concepção do direito em Gustav Radbruch, procurando destacar, dentre outros aspectos, a “injustiça extrema”. É peremptório afirmar que para o grande jurista alemão, a questão da obediência à lei não se resolve pela força, como afirma a tradição. A pergunta essencial não é por que obedecer à “lei injusta”, mas porque se apoia na “lei injusta”, obedecendo-a. Ora, tudo isto significa a rigor, que a positividade no direito se contenta com a validade formal das normas jurídicas, quando todo o problema se situa numa esfera mais profunda, correspondente ao valor ético do direito. Inclusive, a ausência de justiça não aflige apenas o sistema jurídico, mas outros sistemas sociais apresentam injustiças gritantes.

Abstract After the Second World War, the Allies began a program of legal prosecution of war criminals who were to be sentenced in fair and public processes. However, these processes soon evoked vivid criticism, and by no means simply from former National Socialists. The Heidelberg Circle of Jurists (‘Heidelberger Juristenkreis’) is an example of a heterogeneous lobby group including victims of National Socialism as well as supporters of this ideology demanding amnesty for German war criminals between 1949 and 1955. Numbering forty high-ranking judges, lawyers, politicians, professors and church representatives, the Circle had access to a vast network and had a considerable impact on Allied and German war-crimes policy. On the basis of new source material, this article examines the Circle’s evolution, its apparently contradictory composition, its argumentation and its aims, by focusing on three of its members, the former minister of justice of the Weimar Republic and legal philosopher Gustav Radbruch, the internationalist Erich Kaufmann and the Nuremberg lawyer Hellmut Becker.

The legal philosopher Gustav Radbruch regarded legal certainty as one of the three fundamental pillars of law alongside justice and purposiveness. Nowadays, legal certainty is commonly recognised as a central requirement for the rule of law – a principle which protects from the arbitrary use of the state power. Analysis of the terms ‚rule of law’ and ‚legal certainty’ encouters many difficulties because of their ambiguity. However, despite their imperfections, these and other terms which describe and create contemporary political and legal reality serve as a point of reference for the assessment of existing and newly introduced regulations. They also constitute useful criteria for the comparison of the social orders in the international community. The main aim of this article is to analyze the way that legal certainty is perceived in the literature of legal theory and in the decisions of the court. The first part of the paper is devoted to the terminological issues. The second part focuses on the two aspects of legal certainty, on the process of creation and application of law. The final part presents the arguments justifying the legal certainty which, in particular, secures individual freedom and expresses respect for the individual autonomy.

The legal philosophy of the 20th century has contributed to the development of international criminal law by rethinking fundamental legal concepts and theories concerning the nature of international law, its relation with national laws, the connection between the law and the State, and the very idea of responsibility. This was achieved, in the first place, through the reflection of Hans Kelsen, who put forward the idea of a system of enforceable criminal norms at the international level, directed at individuals and having a positive legal foundation. In the years immediately following the Second World War, a number of legal theorists and, in particular, Gustav Radbruch, argued in favour of a necessary connection between law and morality, on whose basis it could be claimed that the worst atrocities were punishable even when allowed by state norms, and even in the absence of positive international norms. In the last decade, the practice of international criminal law, through ad hoc tribunals and the International Criminal Court, has stimulated theoretical reflections on a variety of further fundamental issues, like impartiality, judicial truth, justification of punishment, side-effects of prosecution and transitional justice.

AbstractThe article explores the key components of the political project of West Germany and the role of the Rechtsstaat within it. It shows how the German Federal Republic developed a specific reading of the rule of law as an order founded on basic rights as supra-legal values and judicial authority, which had to be defended even against democratic government. This did not signify a departure from the constitutional theory of the Weimar period, as constitutional lawyers such as Gustav Radbruch and Carlo Schmid claimed at the time. Instead, the decisive innovations in constitutional thought stemmed from the Weimar era. Judicial review and basic rights had been instruments in a political and legal struggle over the social question and the boundaries of democratic decision-making in the 1920s. They had been invoked by conservative lawyers such as Carl Schmitt and been the subject of a substantial critique mounted by social democrat interpreters of the Weimar Constitution such as Hermann Heller and Franz Neumann. As such the Rechtsstaat, which is so strongly associated with the renewal of German democracy, carries with it a tradition of legal thought which systematically and successfully expanded judicial power to the detriment of the legislature and democratic action.

Law is a set of words that are systematically linking an authoritative text, according to Gustav Radbruch, it should contain three (3) elements, namely fairness, certainty and expediency. The application of the authoritative text in social life was an absolute authority of a judge in resolving a civil case. The judge, in the checking-hearing-deciding a case, not only expected to return the case to the original state (restitutio in integrum) before the advent of the dispute, but should attempt made every effort to not create new disputes or disputes derived from the subject matter examined. Therefore, it becomes very important role of the paradigm for a judge in deciding the case in order to fulfill a sense of justice. Therefore, deciding the case in a precise sense of justice will be a judge most important role. Nowadays, the meaning of "justice" in Civil Procedure Code only limited to the authority of the power of the parties bound by the principle of consensualism and the principle of freedom of contract. <p class="Standard"><span lang="EN-GB">The academic character of the article is connected with the attempt to answer the question asked in the title: Utopia without the law – is it possible? The theoretical arguments provided by the author lead to an affirmative answer to this question and allow for formulating the following thesis: there is no utopia without the law. The law is not only present in utopias, both positive and negative ones (anti-utopias and dystopias) but also, to a great extent, determines their existence and functioning. As a result, it links utopian thinking to reality. Any answer to this question is possible and justifiable in the academic discourse. According to the author of this article not only the law is present in the utopia but the law in the utopia must exist. The essence of the law in utopias is justice, but there is not justice in utopias without wisdom. The Bible, Roman law and philosophical and legal reflection were the sources of an approach to law for the creators of utopia. Referring to the views of such thinkers as: Plato, Immanuel Kant, Rudolf von Ihering, Gustav Radbruch, Karl R. Popper, Bronisław Baczko, the author states that the law is an integral part of both worlds: the utopian world and real world. So, there is not utopia without the law as an idea of jusctice, implemented into the social life of the people who are intelligent beings.</span></p>

This research is based on the problem of isbat nikah request which was rejected by the Ponorogo Religious Court through a determination with case number 402 / Pdt.P /2018/PA.Po. The purpose of this research focuses on the study of the legal interpretation paradigm of judges for rejection of marriage wives which is then analyzed based on the perspective of critical legal studies. This type of research is normative legal research which includes library research with descriptive analysis method. While the data collection technique is a documentation analysis study. The findings of this study: first, the legal interpretation used by the panel of judges in this determination is a systematic interpretation. Meanwhile, the method used by the panel of judges in this case used grammatical interpretation. This can be seen from the basis of legal considerations that the judge rejected the request for marriage is the hadith of the Prophet Muhammad regarding the existence of a marriage guardian as narrated by Ibn Hibban, Article 20 and Article 23 KHI, Article 1 paragraph (2) PMA No. 30 of 2005, Article 2 paragraph ( 1) Law No. 1 of 1974 concerning Marriage. Second, from the perspective of critical legal studies, the panel of judges uses a posivistic paradigm, namely not making any legal breakthroughs. This happens because the law is deemed capable of answering cases, the judge then does not grant marriage requests in order to prioritize the value of legal certainty over the value of justice and the value of benefit. This judge's decision contradicts Gustav Radbruch's standard priority theory, which is the first priority order of justice, second benefit and third legal certainty.
 Penelitian ini berangkat dari problem permohonan isbat nikah karena menikah siri yang ditolak oleh Pengadilan Agama Ponorogo melalui Penetapan dengan nomor perkara 402/Pdt.P /2018/PA.Po. Tujuan penelitian ini memfokuskan kajian pada paradigma interpretasi hukum hakim atas penolakan isbat nikah yang kemudian dianalisis berdasarkan perspektif studi hukum kritis. Jenis penelitian yang digunakan adalah penelitian hukum normatif yang termasuk studi kepustakaan (library research) dengan metode analisis deskriptif. Sedangkan teknik pengumpulan data adalah studi analisis dokumentasi. Temuan dari penelitian ini: pertama, Interpretasi hukum yang digunakan majelis hakim dalam penetapan ini adalah Interpretasi sistematis. Sedangkan metode yang digunakan majelis hakim dalam perkara ini menggunakan interpretasi gramatikal. Hal ini dapat dilihat dari dasar pertimbangan hukum hakim menolak permohonan isbat nikah adalah hadis Rasulullah tentang harus adanya wali nikah yang diriwayatkan oleh Ibnu Hibban, Pasal 20 dan Pasal 23 KHI, Pasal 1 ayat (2) PMA No 30 Tahun 2005, Pasal 2 ayat (1) UU No 1 Tahun 1974 Tentang Perkawinan. Kedua, Dilihat dari perspektif studi hukum kritis, majelis hakim menggunakan paradigma posivistik yaitu tidak melakukan terobosan hukum. Hal ini terjadi karena undang-undang dianggap telah mampu menjawab kasus, hakim kemudian tidak mengabulkan permohonan isbat nikah demi mendahulukan nilai kepastian hukum daripada nilai keadilan dan nilai kemanfaatan. Keputusan hakim ini berseberangan dengan teori prioritas baku Gustav Radbruch yang dengan urutan prioritas pertama keadilan, kedua manfaat dan ketiga kepastian hukum.

This study focuses on adjudication of the judges of MK in which in the tradition of law research, it is called law propositions. It means that based on ideal scientific activities of law science, this study enables to cover several activities: inventories, interpreting, systemizing, and evaluating rules of law, both written and unwritten. According to Gustav Radbruch, of all four activities, interpreting and systemizing are more important.
 Idealization of such a scientific activity will just get the precision of its verification when it has been completed try an empirical research through deep interviews with the judges of MK. All this time, the writer’s has not conducted distillation or construed the law hidden behind the texts of law. This paper is the writer's initial observation or his preliminary research. Based on religious and law norm of the material of adjudication of judicial review of MK, this study is still normative. According to the writer, the characteristics of the adjudication of the judges of MK is a crucial point or a hard case because it deals with the sensitive areas covered several dimensions such as religion, human right, nationalistic politics. The writer argues that such a kind of crucial adjudication is not proper if the judges only rely on the procedures of formal law, but it needs an innovation or rule of breaking as a form of law innovation (rechtsvinding), indeed rechtsvinding plus. Abstract:
The dissertation substantiates the possibility of applying the idea of law as a tool for defining the limits of legal interference in an economic system. Adopting the concept of law based on the Economical Analysis of Law it advocates the belief that the implementation of the idea of law consisting of three values – advisability, justice and legal safety – is the most optimal and effective instrument in determining the limits of legal regulations with regard to a liberal market economy. One can conclude then, that the idea of law can very well be described as a general cultural axiological system, especially with regard to the economic and legal culture. It is a system of values that determines the processes of internalization and institutionalization of norms and above all legal and moral ones. The law is a factor that determines and organizes the social life and it determines for the same reason the art and limits of economic activities. It cannot therefore be enacted in isolation from economic and axiological questions. As Gustav Radbruch observes, the law, as well positive as the natural law is a cultural phenomenon and can be looked into only in connection with values and always with reference to them. The positive law must embody and implement the idea of law. And although it is indisputable that no ideal legal or economic system can be completely fulfilled, the striving toward those ideals is an obligation for any society. Resigning and giving up the ideal does not simply mean the preservation of the status quo, but it results in regression and in repeating of former dysfunctions and/or other negative solutions.

Salah satu Putusan Praperadilan yang dianggap kontroversial adalah Putusan No. 04/Pid.Prap./2015/PN.Jaksel tanggal 16 Februari 2015 yang diajukan oleh Pemohon Kom.Jen Polisi Drs. Budi Gunawan melawan Komisi Pemberantasan Korupsi (KPK) yang telah menetapkan Pemohon sebagai tersangka tindak pidana korupsi. Hakim tunggal Sarpin Rizaldi dalam perkara Praperadilan tersebut mengabulkan gugatan yang diajukan Pemohon dan mengalahkan KPK. Kepastian hukum secara normatif adalah ketika suatu peraturan dibuat dan diundangkan secara pasti karena mengatur secara jelas dan logis. Jelas dalam artian tidak menimbulkan ke ragu-raguan (multi-tafsir) dan logis dalam artian menjadi sistem norma sehingga tidak berbenturan atau menimbulkan konflik norma. Permasalahan yang dikaji diantaranya Bagaimana dasar hukum hakim Praperadilan Sarpin Rizaldi memutuskan perkaranya dan Apakah putusan Praperadilan No. 04/Pid.Prap/2015/PN.Jaksel telah susuai dengan tujuan hukum yaitu keadilan, kepastian hukum dan kemanfaatan. Metode penelitian yang akan dipergunakan adalah melalui pendekatan yuridis normatif, spesifikasi penelitian menggunakan deskriptif analisis, data yang digunakan adalah data sekunder yang meliputi bahan hukum primer, bahan hukum sekunder, bahan hukum tertier, yang kemudian dianalisis secara kualitatif. Berdasarkan hasil penelitian diketahui bahwa langkah hakim Praperadilan melakukan rechtsvinding sudah tepat dan memang sudah seharusnya demikian, karena salah satu beberapa alasan perlunya melakukan penemuan hukum oleh hakim telah terpenuhi yaitu peraturan tidak ada, atau peraturannya ada tapi kurang jelas. Bahkan tanpa alasan-alasan tersebut pun, seorang hakim tetap dianggap melakukan penemuan hukum (dalam arti sempit) yaitu ketika ia menemukan kecocokan antara maksud atau bunyi peraturan perundang-undangan dengan kualifikasi peristiwa atau kasus konkritnya.

This research is a study of the legal reasoning of how capable of realizing justice, legal certainty and benefit proportionately. Therefore the examined was how the point links between legal reasoning with the purpose of the law, as well as what is the meaning of the law (the ontological aspect) and what is the method to achieve it (epistemological aspect).Research proves that there is a link between the point of law raised by Gustav Radbruch, namely: justice, legal certainty, and the benefit with the aksiologis of models of legal reasoning advanced by Shidarta. With regard to the activity of the legal reasoning that is capable of realizing justice, legal certainty, and benefit proportionally; found that all the arguments of yuridik which is a legal ruling made by establishing practical law was supposed to interpret the law as positive norms within the system of legislation that pay attention to the principles of truth and justice universal or moral, the behavioral pattern of the terlembaga, and the symbolic meanings of social actors.Whereas the epistemological aspects of the law which is its method is deductive reasoning patterns doctrinal-in order to be empowered in order to achieve legal certainty and fairness as well as simultaneously using inductive reasoning patterns nondoktrinal-so are empowered to achieve benefit. In welcoming 2019 concurrent general elections, the General Election Commission issued PKPU No. 20 of 2018, one of which banned former convicts of corruption from becoming legislative candidates on the grounds that corruption is an extraordinary offense that is commonly practiced by legislators both individually and in congregation. The regulation is stated in Article 4 paragraph (3) PKPU No. 20 of 2018 concerning Nominations for Members of DPR, Provincial DPRD and Regency / City DPRD. However, the regulation was canceled with the issuance of Supreme Court decision No. 46 P / HUM / 2018. Based on this, the limitation of the problem of this research is how to measure the aspects of the legal objectives behind the decision No. 46 P / HUM / 2018 which are more pro-corrupt so that they can understand the judge's decidendi ratio in canceling the prohibition of ex-convicts from becoming legislators. This type of research is normative legal research with a statutory approach and conceptual approach. The theoretical basis in the presentation of research results is the theory of legal goals by Gustav Radbruch namely justice, certainty and usefulness which is compared with Islamic law. The results of this study indicate that the Supreme Court's consideration overturned PKPU No. 20 of 2018 because it is considered contrary to Article 240 of Law No. 7 of 2017 concerning General Elections and Article 12 of Law No. 12 of 2011 concerning Formation of Laws and Regulations. The Supreme Court's considerations in the a quo ruling contain the three legal objectives. However, it is more inclined to legal certainty, so it does not reflect the value of justice that lives in the community. The cause of not achieving the values of justice that live in the community in the a quo decision is because the basis for testing the regulation is Law No. 7 of 2017 concerning General Elections does not prohibit such matters, even though the nomination rules on the executive body namely the President and Vice President require that they do not have a bad track record. Likewise when viewed from Islamic law which requires legislative candidates called ahlul ahli wal aqdi must have a fair way which means having integrity and a good image in the society.

Analizuję z perspektywy penologicznej różne aspekty teoretyczne prawa w działaniu ze szczególnym uwzględnieniem prawa karnego i środków profilaktycznych chroniących dobro dziecka. W pracy uwzględniam w szczególności teoretyczne poglądy na prawo Georga Jellinka, Gustava Radbrucha i Pierre’a Bourdieu. Podkreślam, że brak pogłębionej analizy penologicznej prowadzonej polityki kryminalnej, i w szczególności, pracy kuratora może mieć negatywny wpływ na jej efektywność jako środka zapobiegania przestępczości i patologii społecznej.

Menurut Pasal 1 angka 8 Peraturan Pemerintah No. 23 Tahun 2010 tentang Pelaksanaan Kegiatan Usaha Pertambangan Mineral dan Batubara, divestasi saham adalah jumlah saham asing yang harus ditawarkan untuk dijual kepada peserta Indonesia.Upaya divestasi saham ini dilakukan sepenuhnya oleh pemeritah pusat tanpa melibatkan pemerintahan daerah yang menjadi daerah eksplorasi perusahaan tambang.Berlakunya sikap pemerintah pusat kepada pemerintah daerah yang tidak mencerminkan tujuan hukum dalam upaya divestasi saham perusahaan tambang . Penulisan Paper ini menggunakan metode penelitian hukum normatif yaitu dengan meneliti pada data sekunder bidang hukum yang ada sebagai data kepustakaan dengan menggunakan metode berpikir deduktif dan kriterium kebenaran koheren. Untuk menganalisisnya permasalah ini penulis menggunakan teori tujuan hukum dari Gustav Radbruc dikaitkan dengan sistem hukum yang dikemukakan oleh Lawrence Friedman. Penulis menemukan bahwa Norma hukum yang ada pada dasarnya tidak mengehendaki pembagian yang tidak adil akan tetapi di dalam norma-norma hukum yang lain terdapat ketentuan mengenai tindakan-tindakan khusus yang dapat dilakukan pemerintah pusat khususnya di dalam bidang pertambangan yang dapat dijadikan celah pemerintah pusat dalam memonopoli divestasi saham. Upaya hukum juga pada dasarnya mengupayakan sikap pemerintah pusat yang berimbang kepada pemeritnah daerah untuk memajukan masyarakat daerah.Penulis menyarankan bahwa legislatif harus membentuk undang-undang yang mengatur lebih detail mengenai divestasi saham yang dilakukan pemerintah pusat dimana juga megedepankan pemerintah daerah. Jika keuangan pemerintah daerah tidak mampu melakukan upaya divestasi saham perusahaan tambang seharunsya pemerintah wajib meberikan hibah divestasi sahamnya, walaupun pemerintah kehilangan sahamnya tetapi pada prinsipnya hibah tersebut digunakan untuk kemakmuran rakyat di daerah.
