Full textThe main focus of Master's thesis is on the analysis of the conditions of medical liability where the basic issues of the theoretical and practical application of those conditions are revealed. While analyzing the illegal acts, the main physician's duties are discussed. Whereas, recently the trend has been observed that almost all cases regarding the professional neglect of physicians in the developed countries are based not only on professional mistake of physicians, but also on the improper informing of the patient, particular attention in the paper is paid to the duty of informing the patient. The extent and content of the information provided to the patient, reporting procedures, informing about alternative methods of diagnosis and treatment, the extent of the information about the potential risk are disused. The fault features when examining the cases of medical liability are revealed in the paper. There are revealed issues related both to the compensation of pecuniary damage and non-pecuniary damage. As more and more patients (and their relatives) bring the action for compensation of non-pecuniary damages, greater emphasis goes on discussion of issues of determination of the amount of compensation for non – pecuniary damage and the right of the third party to claim for non – pecuniary damage. Causation determination problems are discussed in the paper as well.

Full textFamily doctors and community nurses, collaborating with families raising children with Down syndrome, encounter quite complicated situations in practice, when they must take care not only for the needs of the disabled child, but for the whole family as well. After the birth of a child with a disability, when the family is confused and experiencing difficult period, there appears a great need of external sensitivity and assistance for the family to adapt to new conditions of its life, because there is no better way to help the child, as to enhance parents’ ability to do it by themselves. Professionals’ collaboration with the family, by helping to orientate in the support system and to find the most suitable ways of support, is the basis for a comprehensive welfare of the child and for mutual satisfaction with quality of services provided.

Full textIn Lithuania PHC reform has been carried out for nearly twenty years. It is very important to assess its benefits and shortcomings, and to acknowledge emerging problems. Research was conducted in 1994 and 2004. Researchers compared positive and negative changes and differences in family physicians’ practices in relation to physicians training (retrained pediatricians, internists and residency trained family physicians), type of PHCC (private or public), urbanization (region center, town, small town or village) and provided services. They evaluated access to services and revealed problems in family physicians’ work. The need for additional research emerged in order to further explore the results and to answer newly posed questions. For that reason new survey was conducted in 2010 with the purpose to assess further changes in family physicians practice over last 15 years of health care reform. It was changed and developed according to shortcomings of previous research and newly emerged questions. The objectives of this research were: 1. Full textAll over the world we observe a tendency for the increase of claims for damages of treatment that will with no doubt come to Lithuania. The establishment of the institute of doctor and patient was influenced by the science of ethics, law and medicine. The fact that these sciences were underestimated when discussing doctors’ liability as well as improper legal regulation and explanation of normative legal acts formed by courts are the main factors that brought “defensive medicine” in practice, that makes a lot of harm to the formation of the health care system financial recourses and puts the patients in the risk of getting additional damage. Thoughtful and attentive doctors’ duties and “defensive medicine” is separated by a hairline which is easy to trespass. The incoherence of the health care legal regulations in Lithuania, the non-existence of united doctors’ ethic code, the unfulfilled concept of diagnosis and treatment bring a danger of emerging new problems in applying the civil liability. A standard of most attentive, careful and qualified doctor treatment is established in court practice. Full textEthical aspects of doctor-patient communication have always been and remain some of the major moral issues of high public development and awareness. The factors characterizing the patient's attitude to the doctor determine the equivalent communication between the patient and the physician, and physician’s awareness, human qualities and quality improvement is one of the priority health care challenges. Delivery of modern health care services must be performed at a level that would not be patient complaints about doctors, but they do not avoid "risky" patients. This paper analyzes the factors which have or may have an impact on doctor-patient relationships, presents recommendations on necessary factors or actions that need to be implemented in order to establish a mutually beneficial doctor-patient communication. Aim of the work: to evaluate doctors opinion regarding the doctors-patients communication peculiarity and ethical aspects of such communication in doctors relationships with patient. Full textOne of the most topical issues of the contemporary civil law is application of professional civil liability to physicians: evaluation of harm done to the patient, selection of the most appropriate causation theory and determination of causation, provability of fault, and, most important, evaluation of illegality of the physician’s actions. In practice, when applying civil liability to the physicians, first of all, questions, whether the actions of the physician were legitimate or not, how to determine the starting point and the criterion for such determination, arise. Supposedly, criteria for evaluation of the physician’s actions are relevant not only to determination of physician’s civil liability a posteriori, but are a priori of great importance to the physicians themselves in their everyday professional life. It is important to the patient as well what duties a physician has to the patient, to what extent they must be exercised and, when exercised, how they should be evaluated. It is analyzed in the Master’s paper the evaluation of illegality of the physician’s actions when applying civil liability, philosophical nature of the main physician’s duties to the patient, historical development, and content. The nature and historical development of the physician’s duties (to respect person’s autonomy, to inform the patient and receive an informative consent for treatment, beneficence duty and patient’s confidentiality requirement) are analyzed invoking main historical sources... Full textAim of the study. To identify and analyze the doctors’ motivation aspects to work at hospitals in the rural areas. Objectives. 1. To identify the main factors that influence the doctors’ decision to work at hospitals in the rural areas. 2. To determine the problems that doctors are facing in their beginning at work in the rural areas. 3. To investigate the doctors’ opinion about the instruments that were used or could be adopted in practice to attract and retain doctors in rural hospitals. Methods. Qualitative study was used to get the information which contains motivating factors for doctors to work at the rural hospitals. Using in-deph semistructured questionnaires were asked 8 residency students and 3 doctors at rural hospitals. Respondents were selected using short (less than 3 years) working period in rural hospital criteria. Results. Lower competition in labor market and higher salaries are the push factors for doctors to choose the rural workplace. Most of the doctors request the hospitals directly for the vacant positions or get the information about available positions from people they know. Rural hospitals attract doctors with higher wages, refund the payment of residency studies and adjust a better working schedule. The incentives of universities should be better developed because there is lack of rural practice possibilities for the students. There is indeed strong influence made by lecturers who spread negative and inadequate approach about rural hospitals... [to full text]

Full textPhysicians have particular relations to pain. They not only as specialists encounter other‘s pain every day, but also can suffer their own pain on some occasions. How they understand this phenomenon is related to their own ways of pain coping and to their reaction to the patients. In our research we tried to estimate how medical students and employed physicians, belonging to different generations and having different educational experience understand pain. The hypothesis was raised, saying that age, theoretical knowledge and working with patients experience can influence the meaning of pain. To test hypothesis Q methodology was used. 44 first year, 35 fifth year medical students and 32 placticizing physicians took part in our investigation and filled in “The Meaning of Pain Questionnaire”, which consisted of 92 different statements – variuos pain descriptions. These statements should reflect the meaning of pain created by Lithuanian culture, because they were collected using such sources: analysis of the Lithuanian literature about pain, individual interviews with 9 persons and material of 3 focus groups. Some statements from Aldrich and Eccleston (2000) questionnaire „Making sense of everyday pain“ were included as well. Statistical analysis was based on factor discrimination. 9 factors (accounts) were discriminated from the answers of participants in each group. It was inferred, that the subjective meaning of pain, which was constructed by medical students and employed... [to full text]

Full textDoctor’s civil responsibility is specific and it aligns with higher standards because people’s health and often life depends on the quality of the doctor’s actions. A doctor’s professional responsibility appears only when certain legal factors are present: unlawfulness, fault, damage and a cause relationship between unlawfulness of actions and the damage. Doctor’s actions are lawful when they comply with attentive, caring, and qualified doctor’s standard. That’s why it is important to answer the question whether the medical treatment was given with maximum effort of attention, caring, and caution while evaluating doctor’s professional responsibility. Patients can seek for compensation of the material or nonmaterial damage when doctors violate the quality and appropriateness of medical care as well as the confidentiality of the patient’s health. The relatives of the patient in certain cases can also seek for the compensation of nonmaterial damage. While discussing lawful acts and Lithuanian court practice it is possible to make a conclusion that a doctor’s actions can violate various patient’s rights. One of the rights is informing the patient – patients have to be informed without any limitations about their diagnosis, treatment, complications, and other important circumstances, except those cases when a patient in a written manner refuses to receive the information about his/her health. Informing the patient is an essential requirement, without this requirement the patient’s... [to full text]

Full textPurpose and objectives of the research. Failure to follow prescribed antibiotic regimen may lead to the emergency of resistant to antibiotic drug therapy bacteria strains. Relatively small number of studies tried to enhance medication adherence in case of antibiotic use, and only few of them resulted in better adherence. Therefore we aimed to explore efficacy of simple pharmacist’s intervention (3-5 min telephone call) in enhancing outpatients' adherence, and also to determine risk factors of non-adherence in our sample. Methods. A total of 66 adult outpatients who received short-term treatment with antibiotics took part in our survey. Almost half of them (n=32, 48.5%) were randomized to intervention group, and were called in 48-72 hours after antibiotic prescribing to inform about possible consequences of non-adherence and to encourage to take antibiotics as prescribed. Results. It was found that one-third of patients (n=22, 33%) were non-adherent to the prescribed antibiotic regimen. Simple pharmacists’ intervention significantly improved adherence (p = 0.001): 28 (87.5%) and only 16 (47.2%) patients in the intervention group and in the control group followed physician instructions, respectively. It was found (p <0.01) that patients who knew how to take their medication, who perceived severity of their condition, as well as those who make decisions related to the treatment together with the physician reported better adherence. Also, there was found a trend (p = 0.128) that... [to full text]
