Der Verfasser geht in seiner Untersuchung der Frage nach, welche Rechtsgarantien den in Guantánamo Bay auf Kuba gefangengehaltenen Personen zustehen. Er erläutert die tatsächlichen Verhältnisse, untersucht den Rechtsstatus der betroffenen Personen und prüft, welches Recht auf sie anwendbar ist. Im Mittelpunkt stehen dabei die Regelungen des humanitären Völkerrechts, insbesondere des III. Genfer Abkommens, und die einschlägigen Menschenrechtsvorschriften. Der Verfasser erläutert das Verhältnis, in dem beide Bereiche zueinander stehen. Der Autor kommt zu dem Ergebnis, daß die Verbringung der Gefangenen nach Guantánamo Bay sie nicht vogelfrei macht. Dies gilt insbesondere für die Habeas-corpus-Rechte, denen sich die Studie widmet. Die Rechtmäßigkeit einer Freiheitsentziehung muß grundsätzlich überprüfbar sein. Dies gilt für Kriegsgefangene - die überdies hinsichtlich bestimmter Haftbedingungen zu privilegieren wären - ebenso wie sonstige Personen. Zwar kann unter bestimmten Bedingungen das Habeas-corpus-Recht begrenzt und sogar außer Kraft gesetzt werden; der Verfasser hält diese Bedingungen jedoch nicht für gegeben.

In the last ten years some writs of habeas corpus have been filed, in Brazil and in other countries, on behalf of great primates. It is a matter of constitutional order and one more instrument utilized for activists for the recognition of the Animal s Rights. This slope, even if generates many controversies, is coming neatly bigger in the past few years, as we can verify throughout the doctrinal and jurisprudential production. The sentience always have been the central element inside the debates evolving the rela-tionship between humans and other animals. Scientific progress that have finding the impressive genetic closeness among us and the great primates, boosted the requests of habeas corpus on behalf of the latter. The grant of the order and, consequently, the admission of rights to the animals generates countless questionings. If the humankind proceeds in the path of the emancipatory trajectory and after receiving all human be-ings in their moral community, could receive , what seems to be the last frontier, the animals, many questionings should be subject of analysis, that already derives from the own grant of the writ to the anthropoids. So, what animals, which rights, what cri-teria to concede them, what judicial instruments must be used to protect them, what is the consequence for humans of the acknowledgment of the Animals Rights and what criteria should be utilized in a conflict of interests between human animals and nonhu-man animals, are some of the largely complex questionings that will be subject of re-flection in the present work
Nos últimos 10 anos vem sendo impetrados, no Brasil e em outros países, habeas corpus em favor de grandes primatas. Trata-se a ação constitucional de mais um ins-trumento utilizado por ativistas para o reconhecimento dos Direitos Animais. Esta ver-tente, ainda que geradora de polêmicas, vem nitidamente crescendo ao longo dos últimos anos, como se verifica através da produção doutrinaria, legislativa e jurispru-dencial. A senciência sempre foi elemento central dentro dos debates envolvendo a relação humanos e demais animais. Os avanços científicos que constataram a im-pressionante proximidade genética entre os nós e os grandes primatas impulsionaram as demandas de habeas corpus em favor deles. A concessão da ordem e a conse-quente admissão de direitos aos animais geram inúmeros questionamentos. Caso a humanidade continue na sua trajetória emancipatória e, depois de acolher todos os seres humanos em sua comunidade moral, acolha, o que parece ser a última fronteira, os animais, várias questões deverão ser objeto de análise, que já derivam da própria concessão do writ aos antropoides. Assim, quais animais, quais direitos, qual critério para concedê-los, quais instrumentos jurídicos para protegê-los, qual a consequência para os humanos do reconhecimento dos Direitos Animais e qual critério a ser utilizado em conflito de interesses entre animais humanos e animais não humanos, são algu-mas das altamente complexas questões que serão objeto de reflexão no presente trabalho

This dissertation focuses on pointing Rhetoric as theoretical and methodological reference in the production and analysis of legal discourse. For this particular purpose, the study of legal discourse is presented from the New Rhetoric angle, analyzing the power of persuasion through argumentation by means of the argumentative strategies of Perelman and Tyteca (2005): quasi-logical arguments, arguments based on an appeal to reality and arguments that stablish the structure of reality. The corpus encompasses two Habeas Corpus and respective judgments and enables the identification of the arguments used to persuade, as well as their intensity and possible results of whether the audience was convinced. The study points out the adequacy of the arguments listed in the Treaty of Argumentation to the legal discourse analysis. Finally, the reasonable use of the argumentative strategies proved itself to add consistency to the persuasive discourse, allowing the judge to reach well-founded decisions, being more equitable and just
A presente dissertação tem por escopo apontar a Retórica como referencial teórico e metodológico na produção e análise do discurso jurídico. Para tanto, o estudo do discurso jurídico foi realizado sob o prisma da Nova Retórica, analisando o poder de persuasão por meio da argumentação. Foi adotada a divisão dos argumentos apresentada por Perelman e Tyteca (2005), em especial os argumentos quase lógicos, os baseados na estrutura do real e os que fundam a estrutura do real. A análise do discurso jurídico foi restrita a duas petições de Habeas Corpus e respectivos acórdãos, possibilitando a identificação e intensidade dos tipos de argumentos utilizados na persuasão e a apuração de prováveis resultados decorrentes ou não do convencimento do auditório. O estudo aponta que os argumentos descritos no Tratado da Argumentação são adequados para análise do discurso jurídico e observou-se que o uso razoável das técnicas argumentativas oferece maior consistência ao discurso persuasivo, tornando as decisões mais bem fundamentadas e, por isso, mais justas e equânimes.

Abstract:
El Proceso Constitucional de Hábeas Corpus, es una institución jurídica de trascendental importancia para el desarrollo de una sociedad, toda vez que se trata de una acción de garantía que procede en los casos en que se violen o amenacen los Derechos Constitucionales por acción o por omisión de actos de cumplimiento obligatorio. Siendo la libertad individual su razón de ser. Si bien esta Institución se encuentra presente en el desarrollo de los pueblos del mundo, sin embargo, no tienen una evolución idéntica ni sus mismos caracteres, aun cuando guarden similitudes. La acción del Hábeas Corpus tiene una literatura impresionante, sobre todo en Inglaterra y en los Estados Unidos de América. En la actualidad, es usada como medio de asegurar el control judicial del Ejecutivo, fundamentalmente en caso de extradición e inmigración, pero es utilizable en otras áreas del poder, tales como detención e internamiento bajo poderes de emergencia o cuando es limitada o restringida la libertad en pacientes mentales.

A instituição do Tribunal do Júri é reconhecida constitucionalmente, sendo um de seus pilares a soberania dos vereditos. Dessa maneira, partindo-se dessa premissa constitucional, o presente estudo busca verificar a (im)possibilidade de reforma de sentença absolutória, proveniente de resposta afirmativa ao quesito genérico, nas decisões do Conselho de Sentença e a possível violação do art. 5º, XXXVIII, “c”, Constituição Federal. O método é o indutivo; o marco teórico é a Teoria Garantista de Luigi Ferrajoli. Conclui-se que o parquet não pode recorrer da decisão dos jurados que absolvem o réu com base em quesito genérico, segundo entendimento do Supremo Tribunal Federal.

Abstract:
Uno de los fenómenos de estudio que ha motivado a sociólogos, antropólogos, psicólogos y, en general, a investigadores interesados en las interacciones humanas y los alcances de la comunicación lo constituye el Análisis de Subjetividad Colectiva. Las redes sociales son actualmente la principal plataforma para “escuchar” modos de pensar, actuar y sentir (PAS) entre usuarios en la Web con una infinidad de retos computacionales para determinar información útil. Por ello, analizar el sentimiento como un aspecto del lenguaje usado para expresar los estados mentales y emocionales o “estados privados”, que no pueden ser directamente observados, representa un aporte significativo para analizar la subjetividad colectiva. El presente artículo compara el desempeño de modelos de aprendizaje de máquina clásico, aprendizaje profundo y modelos basados en lexicones con el fin de establecer una metodología para analizar los PAS de las comunidades de habla hispana que puedan contribuir al análisis de subjetividad colectiva. Con este propósito, se utiliza un corpus de Twitter proveniente de la competencia TASS2019 para el idioma español. El enfoque de aprendizaje profundo obtuvo los mejores desempeños con los artículos de los principales periódicos en los 32 departamentos de Colombia.

Abstract:
La finalidad de mi investigación actual es mejorar la práctica educativa de la enseñanza del francés como segunda lengua extranjera, particularmente, la capacitación en comprensión oral y pronunciación mediante la utilización de la canción francófona en el aula. Además, demostrar que con las canciones se puede facilitar la adquisición de competencias en un idioma y también descubrir la realidad multicultural francófona. Al realizar actividades con canciones durante el curso, con las cuales se logra motivar al estudiante para que piense en situaciones cotidianas, buscamos despertar su imaginación, apelar a sus sensaciones y descubrir sus pensamientos para continuar con el proceso de desarrollo de destrezas. Nos propusimos utilizar un corpus de canciones francófonas que pudiera interesar al alumnado de Enseñanza Secundaria y que se adaptase al aprendizaje de los contenidos y destrezas que deben adquirir. Para ello, elaboramos una guía pedagógica con los materiales y fichas pedagógicas que consideramos necesarios para conseguir la finalidad que deseamos. El agua representa un tema esencial en el contenido del programa del grupo de control. Así que pretendamos abordar este tema mediante la canción “c’est de l’eau” del grupo”Les Enfantastiques”, una canción sencilla y a la vez con considerable vocabulario del tema conforme el nivel A1 de nuestros estudiantes. A través las actividades elaboradas para dicha canción podemos practicar vocabulario relacionado con este tema y trabajar varios objetivos tal como: Objetivos comunicativos. - Hablar de la importancia del agua para la salud y nuestro organismo. - Hablar de las actividades relacionadas con el agua. - Hablar de la representación del agua en el planeta y nuestro cuerpo. Objetivo cultural: - la hidrografía de Francia y sus principales ríos y mares. La literatura madrileña de finales del siglo XIX cuenta con un número significativo de obras en las que la ciudad de Madrid cobra protagonismo como escenario literario de primer orden. El punto inicial de la presente investigación se basa en el estudio terminológico y traductológico de esta literatura ambientada en el Madrid del período comprendido entre los años 1870 y 1900, centrándose en el marco social y lingüístico de Madrid y basando el análisis en un corpus de cuatro obras de finales del siglo XIX: Cuadros al Fresco, de Tomás Luceño (1870), la Gran Vía, de Felipe Pérez y González (1886), la Verbena de la Paloma, de Ricardo de la Vega (1894) y la Revoltosa, de José López-Silva y Carlos Fernández Shaw (1897). Igualmente, dicha cuestión se centra en posibles técnicas de traducción (del español al inglés), mediante la explicación de diversos fragmentos elegidos de estas obras. La metodología empleada es la recopilación de aspectos terminológicos y sintácticos y establecer comentarios y propuestas de traducción. Todo ello arroja resultados distintivos del Madrid de finales del siglo XIX y establece ciertas conclusiones: la necesidad del estudio de la literatura madrileña del período, su lengua y propuestas de traducción al inglés que faciliten su comprensión y traducción de todas las obras citadas. Como conclusión, este estudio pone en relieve la literatura de Madrid, su importancia e idiosincrasia y la necesidad de establecer dichas pautas de traducción de estas cuatro obras clásicas, cumbre del ámbito literario madrileño.

Abstract:
This study examines the effectiveness of a data-driven learning (DDL) approach in enhancing the understanding and use of gender-neutral language among Japanese university students learning English. Twelve undergraduate economics majors who are intermediate English learners participated in this study. The study focused on 12 English terms traditionally characterized by gender-specific usage but increasingly replaced with gender-neutral alternatives. Using the LECS Online corpus, the participants engaged in hands-on, investigative tasks, analyzing and comparing gender-specific and gender-neutral terms. Pre- and post-tests were conducted to assess the effectiveness of the DDL approach. The results revealed a significant reduction in gender-specific expressions and incorrect word choices, and an increase in the use of gender-neutral terms. These findings highlight the importance of active engagement and practical application in language learning. Reflective writing indicated that, while students recognized the shift toward a gender-neutral language, ingrained stereotypes and traditional language habits continued to influence their perceptions. This suggests that linguistic changes alone may be insufficient to alter deep-seated gender biases; a comprehensive educational approach that includes historical and social context is necessary. Incorporating DDL strategies into language curricula can foster a deeper understanding of contemporary language use and its social implications, promoting gender inclusivity and linguistic equity.

Publicación resultado en el marco del proyecto: Conflictividad socioambiental, victimización a la organización social y afectación al territorio: reconfiguración de la violencia en el departamento de Santander tras la firma de los acuerdos de paz entre el gobierno nacional y la guerrilla de las Farc (2017-2022). Colombia como Estado social de derecho, contempla distintos mecanismos para garantizar que todos y todas gocemos de los derechos fundamentales. Es por ello, que, a través de la Constitución Política de 1991, se consolidan una serie de dispositivos, que permiten a la ciudadanía hacer valer, respetar y garantizar los derechos individuales y los colectivos. En este sentido, en el capítulo 4 de nuestra constitución política se incluye el apartado de protección y aplicación de los derechos, que contempla los siguientes: la acción de tutela, la acción de cumplimiento, las acciones populares y de grupo. Así mismo, en el artículo 15 el habeas data, en el artículo 23 el derecho de petición y en el artículo 30 se refiere el habeas corpus. El presente documento es el resultado de un esfuerzo mancomunado entre el Instituto de Estudios Políticos de la UNAB y la Corporación Integrada para la Defensa de los Derechos Humanos, Sociales, Políticos, Culturales y Empresariales CORPOINDH que materializa el interés por brindar herramientas prácticas a los liderazgos sociales para el fortalecimiento de sus capacidades de defensa de los derechos humanos y empoderamiento frente a las instituciones estatales. En esta cartilla explicaremos de manera práctica y concisa cada uno de estos mecanismos anteriormente mencionados, buscando que se convierta en una herramienta útil para que los y las ciudadanas interpongan directamente las acciones correspondientes en caso de necesitarlas. Es clave mencionar que para hacer uso de la mayoría de estos mecanismos de protección no se requiere un abogado y que es indispensable en el marco de nuestros deberes que todos y todas tengamos apropiados conceptos básicos de nuestra constitución política y conozcamos nuestros derechos. Esperamos que este aporte sirva como insumo para el trabajo local y constituya un camino común de fortalecimiento territorial a la defensa de los derechos humanos y por sobre todo, a la profundización de las capacidades de liderazgo presentes en los espacios comunales y vecinales.

The US Army Corps of Engineers (USACE) maintains breakwaters in Milwaukee Harbor. USACE’s Engineering With Nature® (EWN®) breakwater demonstration project created rocky aquatic habitat with cobbles (10–20 cm) covering boulders (6–8 metric tons) along a 152 m section. A prolific population of Hemimysis anomala, an introduced Pontocaspian mysid and important food source for local pelagic fishes, was significantly (p < .05) more abundant on cobbles versus boulders. Food-habits data of alewife (Alosa pseudoharengus) and rainbow smelt (Osmerus mordax) provided evidence that H. anomala were a common prey item. Night surveys and gill netting confirmed O. mordax preferred foraging on the cobbles (p < .05) and consumed more H. anomala than at the reference site (p < .05). H. anomala comprised a significant portion of the diets of young-of-the-year (YOY) yellow perch (Perca flavescens), YOY largemouth bass (Micropterus salmoides), and juvenile rock bass (Ambloplites rupestris) caught on the breakwater. The natural features’ construction on the breakwater increased the available habitat for this benthopelagic macroinvertebrate and created a novel ecosystem benefiting forage fish and a nursery habitat benefiting nearshore game fish juveniles. These data will encourage the application of EWN concepts during structural repairs at other built navigation infrastructure.

The impacts of Harmful Algal Blooms (HAB), often caused by cyanobacteria (Figure 1), on water resources are increasing. Innovative solutions for treatment of HABs and their associated toxins are needed to mitigate these impacts and decrease risks without introducing persistent legacy contaminants that cause collateral ecosystem impacts. This technical note (TN) identifies novel opportunities enabled by Additive Manufacturing (AM), or 3D printing, to produce high surface area advanced material composites to rapidly prototype sustainable environmental solutions for aquatic nuisance species control. This innovative research explores deployment of 3D-printable polymer composite structures containing nano-scale photocatalysts for targeted open water treatment of HABs that are customizable to the site-of-concern and also retrievable, reusable, and sustainable. The approach developed to control cyanobacteria HAB events has the potential to augment or replace broadcast, non-specific chemical controls that otherwise put non-target species and ecological resources at long-term risk. It can also augment existing UV-treatment HAB treatment control measures. The expected research outcome is a novel, effective, and sustainable HAB management tool for the US Army Corps of Engineers (USACE) and resource managers to deploy in their HAB rapid response programs. The research will provide a framework for scale-up into other manufacturing methods (e.g., injection molding) to produce the devices in bulk (quickly and efficiently). Research for this project title “Mitigation of Harmful Algal Bloom Toxins using 3D Printed Photocatalytic Materials (FY21-23)” was sponsored by the US Army Engineer Research Development Center’s (ERDC) Aquatic Nuisance Species Research Program (ANSRP).

Abstract:
Harmful and toxic algal blooms (HABs) are a well-established and severe threat to human health, economies, and marine and freshwater ecosystems on all coasts of the United States and its inland waters. HABs can comprise microalgae, cyanobacteria, and macroalgae (seaweeds). Their impacts, intensity, and geographic range have increased over past decades due to both human-induced and natural changes. In this report, HABs refers to both marine algal and freshwater cyanobacterial events. This Harmful Algal Research and Response: A National Environmental Science Strategy (HARRNESS) 2024-2034 plan builds on major accomplishments from past efforts, provides a state of the science update since the previous decadal HARRNESS plan (2005-2015), identifies key information gaps, and presents forward-thinking solutions. Major achievements on many fronts since the last HARRNESS are detailed in this report. They include improved understanding of bloom dynamics of large-scale regional HABs such as those of Pseudo-nitzschia on the west coast, Alexandrium on the east coast, Karenia brevis on the west Florida shelf, and Microcystis in Lake Erie, and advances in HAB sensor technology, allowing deployment on fixed and mobile platforms for long-term, continuous, remote HAB cell and toxin observations. New HABs and impacts have emerged. Freshwater HABs now occur in many inland waterways and their public health impacts through drinking and recreational water contamination have been characterized and new monitoring efforts have been initiated. Freshwater HAB toxins are finding their way into marine environments and contaminating seafood with unknown consequences. Blooms of Dinophysis spp., which can cause diarrhetic shellfish poisoning, have appeared around the US coast, but the causes are not understood. Similarly, blooms of fish- and shellfish-killing HABs are occurring in many regions and are especially threatening to aquaculture. The science, management, and decision-making necessary to manage the threat of HABs continue to involve a multidisciplinary group of scientists, managers, and agencies at various levels. The initial HARRNESS framework and the resulting National HAB Committee (NHC) have proven effective means to coordinate the academic, management, and stakeholder communities interested in national HAB issues and provide these entities with a collective voice, in part through this updated HARRNESS report. Congress and the Executive Branch have supported most of the advances achieved under HARRNESS (2005-2015) and continue to make HABs a priority. Congress has reauthorized the Harmful Algal Bloom and Hypoxia Research and Control Act (HABHRCA) multiple times and continues to authorize the National Oceanic and Atmospheric Administration (NOAA) to fund and conduct HAB research and response, has given new roles to the US Environmental Protection Agency (EPA), and required an Interagency Working Group on HABHRCA (IWG HABHRCA). These efforts have been instrumental in coordinating HAB responses by federal and state agencies. Initial appropriations for NOAA HAB research and response decreased after 2005, but have increased substantially in the last few years, leading to many advances in HAB management in marine coastal and Great Lakes regions. With no specific funding for HABs, the US EPA has provided funding to states through existing laws, such as the Clean Water Act, Safe Drinking Water Act, and to members of the Great Lakes Interagency Task Force through the Great Lakes Restoration Initiative, to assist states and tribes in addressing issues related to HAB toxins and hypoxia. The US EPA has also worked towards fulfilling its mandate by providing tools and resources to states, territories, and local governments to help manage HABs and cyanotoxins, to effectively communicate the risks of cyanotoxins and to assist public water systems and water managers to manage HABs. These tools and resources include documents to assist with adopting recommended recreational criteria and/or swimming advisories, recommendations for public water systems to choose to apply health advisories for cyanotoxins, risk communication templates, videos and toolkits, monitoring guidance, and drinking water treatment optimization documents. Beginning in 2018, Congress has directed the U.S. Army Corps of Engineers (USACE) to develop a HAB research initiative to deliver scalable HAB prevention, detection, and management technologies intended to reduce the frequency and severity of HAB impacts to our Nation’s freshwater resources. Since the initial HARRNESS report, other federal agencies have become increasingly engaged in addressing HABs, a trend likely to continue given the evolution of regulations(e.g., US EPA drinking water health advisories and recreational water quality criteria for two cyanotoxins), and new understanding of risks associated with freshwater HABs. The NSF/NIEHS Oceans and Human Health Program has contributed substantially to our understanding of HABs. The US Geological Survey, Centers for Disease Control and Prevention, and the National Aeronautics Space Administration also contribute to HAB-related activities. In the preparation of this report, input was sought early on from a wide range of stakeholders, including participants from academia, industry, and government. The aim of this interdisciplinary effort is to provide summary information that will guide future research and management of HABs and inform policy development at the agency and congressional levels. As a result of this information gathering effort, four major HAB focus/programmatic areas were identified: 1) Observing systems, modeling, and forecasting; 2) Detection and ecological impacts, including genetics and bloom ecology; 3) HAB management including prevention, control, and mitigation, and 4) Human dimensions, including public health, socio-economics, outreach, and education. Focus groups were tasked with addressing a) our current understanding based on advances since HARRNESS 2005-2015, b) identification of critical information gaps and opportunities, and c) proposed recommendations for the future. The vision statement for HARRNESS 2024-2034 has been updated, as follows: “Over the next decade, in the context of global climate change projections, HARRNESS will define the magnitude, scope, and diversity of the HAB problem in US marine, brackish and freshwaters; strengthen coordination among agencies, stakeholders, and partners; advance the development of effective research and management solutions; and build resilience to address the broad range of US HAB problems impacting vulnerable communities and ecosystems.” This will guide federal, state, local and tribal agencies and nations, researchers, industry, and other organizations over the next decade to collectively work to address HAB problems in the United States.

Freshwaters can experience growths of toxin-producing cyanobacteria or harmful algal blooms (HABs). HAB-producing cyanobacteria can develop akinetes, which are thick-enveloped quiescent cells akin to seeds in vascular plants or quiescent colonies that overwinter in sediment. Overwintering cells produce viable “seed beds” for HAB resurgences and preventative treatments may diminish HAB intensity. The purpose of this literature review was to identify (1) environmental factors triggering germination and growth of overwintering cells, (2) sampling, identification, and enumeration methods, and (3) feasibility of preventative algaecide treatments. Conditions triggering akinete germination (light ≥0.5 μmol m-2s-1, temperature 22-27℃) differ from conditions triggering overwintering Microcystis growth (temperature 15-30℃, nutrients, mixing). Corers or dredges are used to collect surficial (0-2 cm) sediment layers containing overwintering cells. Identification and enumeration via microscopy are aided by dilution, sieving, or density separation of sediment. Grow-out studies simulate environmental conditions triggering cell growth and provide evidence of overwintering cell viability. Lines of evidence supporting algaecide efficacy for preventative treatments include (1) field studies demonstrating scalability and efficacy of algaecides against benthic algae, (2) data suggesting similar sensitivities of overwintering and planktonic Microcystis cells to a peroxide algaecide, and (3) a mesocosm study demonstrating a decrease in HAB severity following preventative treatments. This review informs data needs, monitoring techniques, and potential efficacy of algaecides for preventative treatments of overwintering cells.
