Abstract:
Com a insistente omissão da União em regulamentar o plantio, a produção e o transporte da cannabis para fins medicinais, o Superior Tribunal de Justiça firmou o entendimento do cabimento de habeas corpus preventivo em tutelar o direito fundamental à saúde de pacientes que cultivam a cannabis para o tratamento de suas enfermidades e ou doenças, diante das fracassadas tentativas de melhora clínica com os medicamentos convencionais. Inicialmente, a compreensão da Corte Superior era pelo não cabimento deste remédio constitucional por entender que a competência desta matéria pertencia à esfera cível e administrativa. No entanto, a celeuma que se arrasta há alguns anos sobre o poder-dever da União em regulamentar o parágrafo único do artigo 2º da Lei 11.343/2006 (Sistema Nacional de Políticas Públicas sobre Drogas – Sisnad), em razão da divergência do Ministério da Saúde e da ANVISA ao não definirem suas competências nesta regulamentação, bem como as reiteradas impetrações de pedidos de salvos-condutos, fizeram com que o Superior Tribunal de Justiça firmasse nova jurisprudência no sentido de preservar a autocontenção judicial na seara penal. Assim, a impetração do habeas corpus é a medida adequada para afastar a tipicidade penal em relação a conduta de plantar cannabis para fins medicinais, desde que comprovada a necessidade médica do tratamento, evitando-se, assim, criminalizar pessoas que estão em busca do seu direito fundamental à saúde e onerá-las com a burocracia e o alto custo do medicamento, possibilitando que os próprios pacientes ou seus responsáveis cultivem e produzam artesanalmente os medicamentos à base de cannabis sem sofrerem risco de constrangimento e liberdade.

Este estudo objetivou criticar a nova mudança jurisprudencial pelo Supremo Tribunal Federal e pelo Superior Tribunal de Justiça por não mais admitirem o Habeas Corpus substitutivo de Recurso Ordinário em Habeas Corpus, inclusive em função dos precários motivos apresentados, de exacerbado volume de impetrações de habeas corpus, de que com isso estariam sendo desmoralizadas as instâncias ordinárias e de que o habeas substitutivo é inadequado ante a sua falta de previsão no texto constitucional, são esses os argumentos utilizados pelos tribunais superiores para justificarem a mudança de entendimento na sua jurisprudência. Ocorre que, logicamente, isso não resolve em nada o “problema”, apenas o agrava, haja vista que se o advogado perder o prazo de interposição do recurso ordinário, quem sai prejudicado é o jurisdicionado (paciente), com sua liberdade mitigada, em função do transito em julgado da decisão que denegou a ordem nada mais caberá, ficando sujeito a uma decisão (do órgão jurisdicional “a quo”) ilegal que não mais poderá ser analisada. Depois de vários anos de jurisprudência consolidada resolvem agora modificar. Serão interpostos recursos ordinários de habeas corpus, quase que na mesma quantidade de habeas corpus substitutivos, não diminuindo o número de casos nas cortes superiores.

Abstract:
The Writ of Habeas Corpus has been called the Great Writ because its purpose is to prevent the State from incarcerating an individual illegally. Spurred by the U. S. Supreme Court under the direction of former Chief Justice Earl Warren, the use of federal habeas corpus by state prisoners was expanded during the 1960s. This change led to the charge that the Court had deviated from the historical purpose of the writ of habeas corpus. However, the Court under the direction of former Chief Justice Warren Burger and current Chief Justice William Rehnquist has severely curtailed state prisoners' access to federal habeas corpus. This paper reviews the history of the writ of habeas corpus, examines the charge that the Warren Court deviated from the writ's historical purpose, and concludes that a state prisoner's access to federal habeas corpus is a rapidly fading right.

Habeas corpus arrived in the Hawaiian Kingdom in the 1840s and 1850s when it appeared in the kingdom's legislative proceedings, in the 1852 Constitution, and in a published legal decision. However, a description of the transmission and transplantation of a common-law concept to a particular place in the Pacific Ocean does little to explain how people in the kingdom used habeas corpus. Habeas corpus circulated widely in the kingdom between 1852 and 1892. Did the application of the writ in Hawai'i change the conceptual architecture of habeas corpus? Legal historians have several different methods to find out how habeas corpus functioned and how judges, lawyers, and litigants molded the writ's legal identity. Reading the published judicial opinions preserved in print volumes or subsequently digitized in databases provides a window into the way judges construed habeas corpus. The archival records of the legal cases illuminate how local lawyers and ordinary litigants wielded habeas corpus to achieve their goals. In addition to these traditional methods of legal and historical research, computer code identifies conceptual patterns in a digitized corpus of the kingdom's legal decisions. Each of these methods—close reading, archival research, and computational analysis—represent different angles on the operation and legal content of the writ.

У статті розглянуто поняття і сутність однієї із найбільш важливих правових процедур, яка застосовуються в багатьох країнах світу, - "habeas corpus act". Встановлено, що процедура "habeas corpus act" («приведи такого-то до судді») є важливою правовою гарантією для особи, яку затримують за підозрою у вчиненні злочину, завдяки тому, що вирішення питання про утримання особи під вартою відбувається з участю суду у формі видання наказу, який надсилається посадовій особі, відповідальній за утримання заарештованого під вартою. Наказ зобов'язує сповістити про час і причини арешту, а також про необхідність доставити заарештованого до суду. Визначено, що у демократичних державах процедура "habeas corpus act" є одним із найстарших юридичних інститутів і вперше виникла у 1215 році згідно з 39-им пунктом Magna Carta libertarium, підписаного королем Іоанном. Встановлено, що, гарантуючи право особи на свободу та особисту недоторканність, захищене від свавільного обмеження, процедура "habeas corpus act" знайшла своє втілення в багатьох міжнародно-правових документах, зокрема в Загальній декларації прав людини (ст. 9), Міжнародному пакті про громадянські й політичні права (ст. 9), Конвенції про захист прав людини та основоположних свобод (ст. 5), а також у правових системах країн англосаксонського та континентального права. Констатовано, що процедура "Habeas Corpus" не була втілена в українське законодавство у буквальному її розумінні. Проте її основні елементи містяться в Конституції України (зокрема ст. 29), Кримінально-процесуальному кодексі України та інших нормативно-правових документах. Саме положення конституційного законодавства України складають базу для дії і розвитку в країні інституту habeas corpus. Досліджено втілення процедури "habeas corpus act" в законодавстві України крізь призму розкриття основоположних критеріїв інституту habeas corpus, що визначають критерії правомірності і справедливості арешту, основних вимог до процедур, пов'язаних з обмеженням права людини на свободу та особисту недоторканність. Наголошується, що попри те, що право на свободу та особисту недоторканність є одним з визначальних та фундаментальних прав людини, процедура "Habeas Corpus" в законодавстві України в деяких аспектах має і декларативний характер.

O objetivo do presente estudo foi analisar a concessão do uso de liminar em habeas corpus. Buscou-se introduzir inicialmente, o conceito do instituto através da doutrina e da própria legislação constitucional, à construção histórica e desenvolvimento do instituto para chegar à natureza jurídica do habeas corpus. Discute-se ainda o direito tutelado pelo remédio judicial, ou seja, a liberdade e suas características peculiares ao direito de ir, vir, permanecer e circular. A discussão avança para as condições da ação do habeas corpus, tratando finalmente das tutelas provisórias e da procedência de liminar em habeas corpus. Trata-se de um estudo descritivo, histórico e documental. Os resultados levam a crer ser necessária a concessão de liminar em habeas corpus, quando da urgência da medida definitiva e, a demora nos julgamentos. Quando se busca a tutela da liberdade do cidadão, é inadmissível a morosidade jurisdicional.

EMENTA: - "Habeas corpus". Crime de quadrilha ou bando. Interpretação dos artigos 8º e 10 da Lei nº 8.027, de 25 de julho de 1990.- Quando há choque entre dois dispositivos de uma mesma lei, a antinomia não pode ser resolvida pelos critérios da hierarquia ou da sucessividade no tempo, porque esses critérios pressupõem a existência de duas leis diversas, uma hierarquicamente superior à outra, ou esta posterior à primeira. Nesse caso, que é o de mais difícil solução, o que é preciso verificar é se a antinomia entre os dois textos da mesma hierarquia e vigentes ao mesmo tempo é uma antinomia aparente, e, portanto, solúvel, ou se é um antinomia real, e, conseqüentemente, insolúvel.A antinomia aparente é aquela que permite a conciliação entre os dispositivos antinômicos, ainda que pelo que se denomina "interpretação corretiva", ao passo que a antinomia real é aquela que, de forma alguma, permite essa conciliação, daí decorrendo a necessidade de se adotar a chamada "interpretação ab-rogante ", pela qual ou o intérprete elimina uma das normas contraditórias (ab-rogação simples) ou elimina as duas normas contrárias (ab-rogação dupla).Dessas três soluções, a que deve ser preferida - só sendo afastável quando de forma alguma possa ser utilizada - é a interpretação corretiva, que conserva ambas as normas incompatíveis por meio de interpretação que se ajuste ao espírito da lei e que corrija a incompatibilidade, eliminando-a pela introdução de leve ou de parcial modificação no texto da lei.- No caso, a interpretação corretiva é perfeitamente aplicável. Com efeito, atendendo-se a que o artigo 8º da Lei nº. 8.072/90 se dirige à pena e a que o artigo 10 dessa mesma Lei tem inequivocamente como em vigor o tipo delituoso previsto no artigo 14 da Lei nº. 6.368/76, a forma de afastar-se a interpretação ab-rogante - que só deve ser utilizada no caso extremo de inconciabilidade absoluta - será a da conciliação sistemática, mediante a interpretação restritiva de ambos os dispositivos, deixando ao primeiro a fixação da pena inclusive para a quadrilha que se forma para a prática de crime de tráfico ilícito de entorpecentes e drogas afins, e ao segundo a especialização do tipo do crime de quadrilha com essa finalidade."Habeas corpus" indeferido.

La investigación se desarrolló desde la perspectiva del método analítico – sintético, el cual permite trabajar a partir de un objeto de estudio (Habeas Corpus), se procedió metodológicamente desde un tipo descriptivo documental con diseño bibliográfico. A través del diagnóstico del estado actual del Habeas Corpus ante la privación de libertad en centros de adicciones en el Ecuador, se logró determinar que la aplicación del Habeas Corpus en contra centros de adicciones son muy pocos los casos planteados, pues en su mayoría las personas e inclusive muchos profesionales del derecho desconocen el hecho de que esta garantía sea aplicable para estos casos.

The incorporation of habeas corpus and bail in the Cameroonian Criminal Procedure Code has not only entrenched them in law, but has also widened and deepened their scope, with a view to obtaining, as far as possible, the respect for human rights and the rule of law in order to ensure a more functional criminal justice system in Cameroon. The incorporation of habeas corpus and bail in the Cameroon criminal trial process will restrain the arbitrary and illegal use of the powers of the judicial police officers and ensure respect of human rights. Although there are some challenges in the application of habeas corpus and bail such as misuse of the remedies by some overzealous authorities, defiance of court orders in the enforcement of the writ of habeas corpus by administrative authorities, and erosion of confidence in the Judiciary, there is optimism in the conscious efforts being made to ensure that habeas corpus and bail are properly applied so that the Cameroonian Criminal Procedure Code attains its full potential.

Esta investigación, aborda la institución jurídica del habeas corpus, su significado, evolución y desarrollo histórico en el derecho europeo e iberoamericano, y de manera específica, en el derecho ecuatoriano. El habeas corpus, históricamente tiene la finalidad de salvaguardar la libertad de las personas, cuando estas ha sido privadas de manera ilegal o ilegitima de ella, pero también, se ha extendido el alcance de los beneficios del habeas, hasta la protección de la integridad física y varios derechos adicionales de las personas privadas de la libertad. El énfasis de este artículo es la utilización y la desnaturalizacion del habeas corpus en el contexto ecuatoriano, visualizando sus implicaciones jurídico – sociales, desde su registro en el texto de la Constitución de la República del Ecuador en el año 2008. Para ello, se hace un análisis del conocido como caso “Jorge Glass” a fin de identificar cuándo este tipo de habeas corpus se plantea de forma incorrecta.

Abstract:
A criação de associações canábicas vem se disseminando pelo Brasil como a principal estratégia dos usuários/pacientes para conseguirem ampliar o acesso ao uso terapêutico de cannabis medicinal, atualmente um produto caro e restrito nos moldes da legislação brasileira. O pertencimento a um coletivo social que tem no uso, no autocultivo, no estudo da cannabis e no compartilhamento de experiências a sua razão de ser, é um dispositivo que amplia o acesso para o uso terapêutico desta planta, constrói mecanismos para a busca da legalização destas práticas e transforma os velhos estigmas estabelecidos sobre uso de cannabis. No entanto, a construção de uma outra subjetividade para o uso de cannabis, diferente da dicotomia crime x uso farmacêutico-medicinal, parece ser imprescindível para compreender a sua ação como cultura criadora de formas de existência singulares e potentes. Neste estudo qualitativo, se configura uma pesquisa cartográfica a partir das relações de um médico-pesquisador-usuário e consultor em cannabis, que atende pacientes inseridos em uma rede associativa canábica em Minas Gerais e no Piauí. Este estudo procura, nestes encontros com cultivadores/pacientes/usuários/médicos/advogados/ativistas, compreender como este movimento micropolítico, constituído pelas redes associativas de cannabis, opera nas transformações das subjetividades criadas em torno do uso desta planta. O estudo evidencia alguns dispositivos que este movimento produz para transformar a percepção negativa do uso da cannabis, indo em direção à construção de territórios existenciais vitalizantes, fugindo da dicotomia restritiva uso medicinal ou recreativo.

COVID-19 has doubtless generated a great negative impact in the tourism industry. The measures disposed by governments to contain the virus included strict lockdowns and the closure of borders and airspaces, without mentioning the imposition of social distancing. As a result of this, thousands of tourists were stranded abroad, without food or financial assistance. The recovery of the industry is slow, and gradually Europe and the US have returned to a new normal. In Argentina, rather, things have become worse. At the end of June, President Fernandez disposed a new border closure that left thousands of Argentineans stranded again. This case report focuses on the testimonies, fears and expectancies of those stranded tourists.

El habeas corpus constituye una de las garantías jurisdiccionales más relevantes dentro del derecho constitucional ecuatoriano. Se plantea analizar el habeas corpus y el abuso ante las leyes ecuatoriana. Se desarrolló bajo una metodología descriptiva y documental. El habeas corpus en Ecuador, pese a su relevancia como garantía constitucional para la protección de derechos fundamentales, ha experimentado un uso distorsionado que compromete su integridad. El abuso de esta figura, especialmente en su modalidad correctiva, ha generado una desnaturalización de su propósito original, lo que subraya la necesidad de reformas tanto a nivel normativo como judicial. La vulneración del principio de celeridad y la aplicación inconsistente del habeas corpus revelan deficiencias estructurales en el sistema de justicia ecuatoriano, que requieren ser abordadas para garantizar que esta herramienta continúe siendo un mecanismo eficaz de protección de los derechos fundamentales, sin perder su esencia ni ser manipulada para fines ajenos a su naturaleza.

La presente investigación, tiene como objeto central de estudio, el habeas corpus en su forma de ejercicio colectiva. El objetivo principal perseguido fue, determinar si la normativa actual que regula la garantía jurisdiccional de habeas corpus, permite un adecuado ejercicio de la misma, cuando se trata de casos de afectación colectiva de derechos de las personas privadas de libertad. Si bien el habeas corpus ha sido reconocido de larga data en el estado ecuatoriano como una figura efectiva para luchar contra el poder estatal, las detenciones arbitrarias, ilegales o ilegitimas, en la actualidad tanto a nivel regional como nacional, se ha reconocido otras expresiones de la garantía, que permiten un ejercicio más amplio de la misma, claro está, siempre en torno al derecho a la libertad personal. Tradicionalmente, el habeas corpus fue identificado como un recurso individual, de manera que quien crea que ha sido afectado en su libertad personal, podía iniciar una acción en busca de una reparación; sin embargo en la actualidad, es muy importante la discusión sobre la posibilidad de que afectaciones a derechos de los privados de la libertad, se discutan en una audiencia de habeas corpus, no con miras a que se recupere la libertad de los mismos, sino con la pretensión de mejorar las condiciones de su reclusión.

El habeas corpus, como garantía fundeamental del individuo frente a detenciones arbitrarias e ilegales, ha sido históricamente un baluarte de los sistemas democráticos. El objetivo del estudio es dilucidar causas y consecuencias de la desnaturalización del habeas corpus en el Ecuador, para la determinación de su efectividad como garantía constitucional. Es un estudio jurídico, enmarcado en el enfoque cualitativo, paradigma interpretativo y método hermenéutico. La muestra estuvo conformada documentos seleccionados de manera intencional. Los resultados revelan que, a pesar del reconocimiento del habeas corpus como un derecho esencial en la Constitución de 2008, la realidad actual muestra que su aplicación enfrenta desafíos significativos. Se concluye que, El habeas corpus, como herramienta de cuidado de los derechos humanos, ha demostrado ser crucial para salvaguardar la libertad y la integridad de las personas ante detenciones ilegales o arbitrarias. Asked to evaluate strong claims of executive power, the Court has had occasion to consider the origin and scope of habeas corpus, which many scholars see as a product of the Magna Carta. The majority opinion inBoumedienev.Bush(2008) traced the history of the writ of habeas corpus back to the Magna Carta and relied on that lineage to rule that Guantanamo detainees were entitled to petition for habeas corpus, even though Congress had explicitly denied them that right in the 2006 Military Commissions Act (MCA) and the 2005 Detainee Treatment Act (DTA).

Habeas corpus petitioners must navigate the procedural barriers of the Anti-terrorism and Effective Death Penalty Act (“AEDPA”) before courts consider their petitions on the merits. Among the barriers imposed is a general prohibition on “second or successive” habeas petitions, meaning a petitioner who previously filed a habeas petition may not bring another, with limited exceptions. One such exception, recognized by the Supreme Court in Magwood v. Patterson, allows for a second habeas petition after the petitioner obtains a “new judgment.” Magwood and AEDPA, however, left the term “new judgment” undefined. This Note summarizes the history of habeas corpus in the United States, the passage of AEDPA, and the Magwood decision. It contends that the interpretation of “new judgment” adopted by some circuits is impermissibly restrictive of the implied right to petition for habeas relief. Thus, it proposes a simplified interpretation: any judicial change to the original judgment renders a “new judgment,” achieving a better balance between the interests of the petitioner and the state.

The ‘Great Writ’ of habeas corpus has long had an iconic status as the ‘writ of liberty’ which ensured that no person could be detained in prison without being put to trial by a jury of his peers. According to the traditional version, popularised by Whiggish constitutional writers from the late seventeenth century onwards, the English constitution as embodied in the common law had, since time immemorial, striven to protect the fundamental rights of Englishmen and women, which included the right to personal liberty. The common law had supplied the writ of habeas corpus, which secured the provision of Magna Carta, that no freeman be imprisoned save by the judgment of a jury of his peers. In the course of the seventeenth century, the Whig version ran, kings with an absolutist bent sought to undermine ancient liberties, by claiming prerogative powers to imprison without trial, and by appointing supine judges who would not protect people's liberties. It took the triumph of Parliament to restore and perfect them. For William Blackstone, one of the key statutes which secured ‘the complete restitution of English liberty’ was the Habeas Corpus Act of 1679, ‘that second magna carta’. As Blackstone put it: ‘Magna carta only, in general terms, declared, that no man shall be imprisoned contrary to law: the habeas corpus act points him out effectual means, as well to release himself, though committed even by the king in council, as to punish all those who shall thus unconstitutionally misuse him.’

Abstract: This article examines how Chinese women and men used habeas corpus proceedings in California to contest transpacific relations of gender, commerce, law, and power. The first section looks at habeas hearings about runaway or allegedly kidnapped Chinese women already in the United States. The second chronicles how these hearings correlated with and diverged from the habeas proceedings involving the detention of Chinese women immigrants upon arrival. The California judges' approach to these cases mirrored Congress's concern over "the enormous diversity of domestic arrangements" in slavery by the end of the Civil War, when lawmakers introduced monogamous marriage and dependency on a male head of household as the most acceptable conditions for a nonwhite woman's freedom. The habeas proceedings concerning Chinese women thus revealed a Pacific, subnational practice of governance that was consonant with the national trend of reconstructing nonwhite women's sociolegal status in the Civil War era.

I am puzzled by the reference on the first page of his comment to distributive justice. I understand the term to refer to the principles for allocating wealth or other goods across persons, and I do not think those principles are engaged by efforts to balance concerns of security against concerns of civil liberties.When I said that “what counts as justification is no part of habeas corpus,” I did not mean that the detention of a person cannot be challenged by asking for habeas corpus, or that the detention need not be justified. I meant merely that the creation of a right of habeas corpus does not indicate how great a showing of necessity to detain a person the government must demonstrate. Justification is a separate issue from the existence of a right of habeas corpus. Obviously if little or no justification is required, the right becomes nugatory.

The legal history of habeas corpus goes back to the period of the 'Golden Bull' issued by King Andrew II of Hungary. In the development of English law, the Magna Carta Libertatum marked the emergence of the principle before that. The essence of the principle is that deprivation of liberty may be pronounced by a person vested with judicial power and that the person concerned must be brought before a judge in order to be heard by the accused before an arrest can be ordered. The judicial order for arrest is also provided for in the Fundamental Law of Hungary. The principle raises a number of questions of law enforcement in domestic court practice, but also in the context of EU cooperation.
