Abstract:
From 26 to 29 June the Ministers of Foreign Affairs of the Movement of Non-Aligned Countries convened at the premisses of the Peace Palace in The Hague to discuss the issue of peace and the rule of law in international affairs. This meeting was the start of a campaign for aDecade of International Law. This was the first occasion that an extraordinary ministerial conference of the Non-Aligned Movement was not held in one of its member countries. The Hague was chosen to underline the historic ties between this city and the (early) development of international law. This year it will be 90 years ago that the First Hague Peace Conference was held on the initiative of Emperor Nicholas II of Russia. This conference (together with the Second Hague Peace Conference of 1907) became a landmark in the history of the codification of international law and especially the development of mechanisms for the peaceful settlement of international disputes between states. The two most important conventions that were adopted at that conference were the Convention with Respect to the Law and Customs of War on Land and the Convention for the Pacific Settlement of International Disputes.

Abstract:
On May 18, 1899, die first Hague Peace Conference was convened in the House in the Woods provided by the Dutch royal family. It was attended by invitation by representatives of twenty-six of the fifty-nine governments that then claimed sovereignty. The hundred delegates included diplomats, statesmen (no stateswomen!), publicists, lawyers, and technical and scientific experts. Unlike earlier peace conferences, which were convened to terminate ongoing armed conflicts, the Hague Conference met in peacetime for the purpose of making law. The conference was called at the initiative of Tsar Nicholas II of Russia with the intentions principally to seek agreements to limit armaments and their consequent financial burdens, and secondarily to improve the prospects for the peaceful setdement of international disputes and to codify the laws of war. Doubtiess, the tsar’s initiative was inspired in part by his grandfather’s earlier success in obtaining the St. Petersburg Declaration of 1868, which prohibited, for humanitarian reasons, the use of explosive projectiles weighing less than four hundred grams. In any event, the Hague Peace Conference pursued a much broader agenda than the meetings at St. Petersburg and was able to draw upon certain preparatory work on the laws of war, including the Geneva Convention on the Amelioration of the Conditions of the Wounded in Armies in the Field of 1864, the draft Project of an International Declaration concerning the Laws and Customs of War produced by the Brussels Conference of 1874, and the Oxford Manual on the laws of war of 1880, which had been adopted unanimously by the Institute of International Law.

AbstractThis article asks when, how, and why states started to use the concept of international community in the shared language of diplomacy and international law. It argues that the concept was accepted to the interstate language as a result of debates over international institutions, which were to acquire a universal character, at the Hague Conferences of 1899 and 1907. The article suggests that conceptual changes in interstate language should be understood as products of rhetorical power struggles, in which some arguments lose the battle while others prevail, some concepts are discarded while others modified. The article suggests a model of conceptual change that explains an innovation in interstate language. First, it draws attention to collective assertive speech acts at diplomatic events that signal changes in international politics. Second, it examines whether such acts implicate conceptual innovations. Third, it posits that the composition of epistemic community assembled at the Hague determines the nature of conceptual innovation. Fourth, it demonstrates how rhetorical interventions into debates at the conference introduce and mould relevant concepts. Fifth, it illuminates how contextualisation of the conference interventions in professional debates helps us understand the polemical nature of arguments and the scope of conceptual innovation.

This thesis examines the body of international law drawn upon during the Nuremberg trials after World War II. The work analyzes the Hague Conventions, the Paris Peace Conference, and League of Nations decisions to support its conclusions. Contrary to the commonly held belief that the laws violated during World War II by the major war criminals were newly developed ideas, this thesis shows that the laws evolved over an extended period prior to the war. The work uses conference minutes, published government sources, the official journal of the League of Nations, and many memoirs to support the conclusions.

La Commissione speciale della Conferenza dell’Aia di diritto internazionale privato, nell’ultima seduta del maggio 2018, ha predisposto una bozza di convenzione relativa al riconoscimento e all’esecuzione delle sentenze straniere in materia civile e commerciale, il c.d. Judgments Project, il quale sarà auspicabilmente adottato nel corso della Sessione diplomatica che si svolgerà all’Aia nell’estate del 2019. Dopo aver esaminato i primi lavori della Conferenza in materia di giurisdizione e di riconoscimento delle decisioni, l’elaborato si sofferma sulle complessità e sulle criticità riscontrate durante la negoziazione – primo fra tutti il tentativo di conciliare i criteri giurisdizionali dei vari Paesi coinvolti – che non hanno consentito di raggiungere l’accordo auspicato. La tesi si focalizza quindi sulla ripresa dei lavori della Conferenza in tema di riconoscimento ed esecuzione delle decisioni a livello globale, evidenziando come la Conferenza in generale – e il c.d. Judgments Project in particolare – possano rappresentare una nuova prospettiva di cooperazione giudiziaria importante anche nell’ottica dei rapporti tra Unione europea e Regno Unito a seguito della «Brexit». La tesi prende quindi in esame l’architettura e l’ambito di applicazione proposti nel Judgments Project, mettendo a confronto i possibili modelli di convenzioni, per poi soffermarsi sulla struttura scelta dai redattori: quella di una convenzione semplice, la quale detta criteri di giurisdizione in via indiretta che, se rispettati, consentono il riconoscimento e l’esecuzione delle decisioni straniere. Nell’ambito di tale struttura, ci si concentra sulla circolazione delle decisioni in specifici settori, che la Commissione speciale ha proposto di escludere dall’ambito di applicazione del Progetto, quali la diffamazione e la privacy, soffermandosi sulle problematiche lasciate aperte dalla loro esclusione. L’elaborato si sofferma inoltre sul tema del mutuo riconoscimento, ossia di quel principio in forza del quale le decisioni di uno Stato contraente vengono riconosciute ed eseguite in un altro Stato contraente. Ci si interroga in particolare sul suo fondamento giuridico-politico, mettendolo a confronto con il principio di mutua fiducia delineatosi in ambito europeo, dove, oltre alla libera circolazione delle decisioni, vigono la libera circolazione di merci, persone, servizi e capitali. Particolare attenzione è dedicata ai criteri indiretti di giurisdizione i quali, se rispettati, consentono il riconoscimento e l’esecuzione delle decisioni ai sensi delle norme del Progetto. Viene quindi analizzata la circolazione delle decisioni riguardanti la materia contrattuale, gli illeciti civili, i contratti di consumo e di lavoro e la proprietà intellettuale, con l’intento di comprenderne il funzionamento operativo a livello globale ed evidenziarne le relative criticità. Infine, vengono affrontati i motivi di diniego del riconoscimento e dell’esecuzione che consentono di derogare al principio del mutuo riconoscimento, quali la violazione dei diritti di difesa del convenuto, la frode, l’ordine pubblico e il contrasto tra decisioni. La ricerca si conclude con lo sguardo rivolto al futuro, interrogandosi sulle prospettive di successo della convenzione e sulla possibilità di procedere, nel corso degli anni, verso l’unificazione delle norme giurisdizionali.
In May 2018 the special commission of the Hague Conference on private international law has prepared a draft convention on recognition and enforcement of foreign judgments relating to civil and commercial matters, the so-called Judgments Project. The Draft will hopefully be adopted by the Conference during its Diplomatic Session in the Hague in summer 2019. The thesis, after examining the first works of the Conference in the field of jurisdiction and recognition of judgments, points out the difficulties encountered during the negotiations: first, the attempt of the Conference to reach an agreement upon the criteria of the different court systems of the countries involved. The significant diversities encountered did not lead to the hoped deal. Therefore, the thesis focuses on the recovery of the Conference works on the subject of recognition and enforcement of judgments from a global point of view. The present work highlights how the Conference in general and the Judgments Project in particular, could be considered as a new prospect of international judicial cooperation also in the relations between the European Union and the United Kingdom after «Brexit». Then, the thesis analyses the architecture and the scope of application envisaged by the Judgments Project, comparing the different models of conventions and pointing out the structure chosen by the negotiators: a simple convention frame, with indirect jurisdiction criteria. If these criteria are satisfied, they allow the recognition and the enforcement of judgments given by a court of other contracting states. Always in this legal frame, the argumentation goes on considering the judgments in the specific sectors that the Conference has decided to exclude from the Project. Accordingly, the Judgments Project shall not apply to matters such as privacy and defamation. The dissertation ponders also the resulting unsolved problems. The principle of mutual recognition of judgments is addressed as well, which is the principle according to which a judgment given by a court of a Contracting State shall be recognised and enforced in another Contracting State. The thesis tries to question the political and legal foundations of this principle, comparing it with EU law, which establishes not only the principle of free circulation of judgments, but also and foremost the four freedoms of the European Single Market (i.e. the free circulation of persons, goods, capital and services). Particular attention is paid to the indirect criteria of jurisdiction. In case these criteria are met, they allow recognition and enforcement of the judgments complying with the rules of the Project. Hence the essay analyses the circulation of judicial decisions relating to different contracts, as civil torts, consumer and employment contracts, and intellectual property with the aim to understand the global working principles and related problems. In the end the thesis considers the grounds for refusing recognition and enforcement of judgments, which allow to derogate from the principle of mutual recognition, such as the violation of the defendant’s rights of defense, fraud, public order and parallel proceedings. The thesis comes to conclusion looking to the future, questioning about the outlook of the success of the Convention and the possibilities, over the years, to reach a solid unification of the jurisdictional rules at the international level.

A tese estuda a evolução histórica do atitude multilateral do Brasil. Parte da noção que o multilateralismo é um aspecto significativo da política externa brasileira, desde as primeiras conferências internacionais dos países americanos, que começam ainda no fim do século XIX. Em tempos recentes, na Liga das Nações, mas sobretudo nas Nações Unidas, a importância das instituições multilaterais só fez crescer. O estudo parte, no ângulo teórico, da perspectiva de que o multilateralismo tem uma lógica própria e que, ao aceitá-la, o comportamento diplomático dos Estados deve naturalmente estar em sintonia com o que aquela lógica impõe. A concepção de John Ruggie apóia a parte teórica da tese e sustenta o seu objetivo central, que é o de procura definir o que seriam constantes do comportamento multilateral do Brasil. Procura-se mostrar que suas origens estariam nas reações que a diplomacia brasileira teve ao Pan Americanismo, se fixaram com nossa participação na II Conferência da Haia, quando, com Ruy Barbosa, defendemos que as instituições multilaterais deveriam estar fundadas na igualdade entre os Estados e com a aspiração a uma participação influente nos processos decisórios internacionais, expresso recentemente com a aspiração a um lugar permanente no Conselho de Segurança das Nações.
The thesis studies the evolution of Brazil´s multilateral attitude. It accepts the notion that multilateralism has been a meaningful aspect of Brazilian foreign policy since the first conferences of American States, a series of international gatherings that began at the end of nineteenth century. From them on, after the creation of the League of Nations and, specially, the United Nations, the importance of multilateral institutions for Brazil has grown consistently. From the theoretical perspective, the thesis accepts the idea that multilateralism is defined by a singular logic and States, when working in multilateral institutions, are bound by that logic. John Ruggie´s conception of nultilateralism supoorts that idea and frames the main goal of the thesis, that is, a investigation of the constant patterns of Brazil´s multilateral behavior. The origins of those patterns could be identified in the diplomatic reactions to the challenges of the Pan American conferences. But, the patterns became more evident during our participation in the II Peace Conference (Hague, 1907) when our delegation, headed by Ruy Barbosa, advocated the understanding that necessary foundation of the multilateral institutions is the equality among States. Another constant is the Brazilian wish to have a more influential participation in the decision making process of the international institutions, as today shown in our aspiration to occupy a permanent seat at the Security Council of the United Nations.

Le droit international encadre l’exercice de la diplomatie des États dans une finalité de prévenir l’insécurité et, par extension, les conflits armés. Le droit de la diplomatie préventive reflète ainsi l’idée que la prévention de risques imminents de dommages matériels graves délimite l’objet d’un principe général de droit international. L’affirmation d’un principe est fondée sur l’analyse inductive des conventions majeures conclues en matière de maintien de la sécurité collective de 1899 à 1945. Elle est vérifiée à la lumière de la pratique de leur application par les Membres de la SdN et, depuis 1945, de l’ONU. Le caractère général de ce principe est déduit d’une étude combinée de la jurisprudence d’un nombre de juridictions internationales dans une variété de domaines du droit international. Les efforts individuels et collectifs de prévention des conflits obéissent donc à un régime juridique général qui organise le système contemporain de maintien de la paix internationale
International law regulates States’ diplomacy for the purpose of preventing insecurity, and, by extension, armed conflicts. Accordingly, the law of preventive diplomacy reflects, in a sense, the idea that prevention of imminent risks of serious material damages defines a general principle of international law. The assertion of such a principle is based on an inductive analysis of the major treaties on collective security concluded between 1899 and 1945. It is verified in light of their application by Member States of the League of Nations and, since 1945, of the United Nations. The general nature of this principle is deduced from a combined study of the jurisprudence of a number of international courts and tribunals in various fields of international law. Those findings support the idea that individual and collective efforts of conflict prevention are subject to the respect of a general legal regime governing the current international system of peace-maintenance and collective security

The primary aim of the present work was to determine the inventories of the radionuclides and stable elements in vitrified high-level waste produced at La Hague and delivered to Germany, which are of importance for long-term safety assessment of final repositories for radioactive wastes. For a subset of these radionuclides and stable elements, the inventories were determined — either by direct measurements or by involving established correlations — and reported by AREVA. This allowed verification of the validity of application of a model approach utilizing the data of burnup and activation calculations and auxiliary information on the reprocessing and vitrification process operated at La Hague. Having proved that such a model approach can be applied for prediction of inventories of actinides, fission and activation products in vitrified waste, the present work estimated the minimum, average and maximum inventories of the radionuclides, which are of importance for long-term safety assessment of final repositories for radioactive waste but were not reported by AREVA for delivered CSD-V canisters. The average and maximum inventories in individual CSD-V canisters predicted in the present approach were compared to the inventories predicted by Nagra for canisters with vitrified waste delivered from La Hague to Switzerland [1]. This comparison revealed a number of differences between these inventories despite the fact that the canisters delivered to Switzerland were produced in essentially the same way and from the common reprocessing waste stock as CSD-V canisters delivered to Germany. Therefore, a further work is required in order to identify the reason for the discrepancy in the present estimation versus the Nagra estimation [1]. Such a work should also address the recommendation by the international peer review of the Safety Report of the Project Opalinus Clay to obtain estimates of the inventories of long-lived mobile radionuclides (such as 14C, 36Cl, 79Se, and 129I), which contribute most to the dose estimates in the radiological safety assessments, if possible, in agreement with other countries with similar waste streams in order for a coordinated set of data to be generated [2]. Since vitrified waste from reprocessing of spent nuclear fuel at La Hague was delivered to several countries — Belgium, France, Germany, Japan, Netherlands, and Switzerland — an international effort can be recommended.

In 2009 and 2010, the Institute for Nuclear Safety and Radiation Protection (IRSN) lead a pilot action dealing with the decommissioning of a workshop located on the site of Areva’s La Hague fuel-reprocessing plant site in Northwestern France. The purpose of the pilot program was to test ways for IRSN and a few local stakeholders (Non-Governmental Organizations (NGOs) members, local elected officials, etc.) to engage in technical discussions. The discussions were intended to enable the local stakeholders to review the operator’s decommissioning application and provide input. The pilot program confirmed there is a definite challenge in successfully opening a meaningful dialogue to discuss technical issues. Three factors influence the extent of the challenge: the knowledge gap between experts and local stakeholders, the conflict between transparency and confidentiality which is inherent with technical topics, and the difficulty for an official expertise institute to hold a dialogue with “outsiders” during an ongoing reviewing process in which it is participating. The pilot program, given its mixed results, also provided valuable lessons for further improvement of stakeholders’ involvement.

Vitrification of high-level waste is the internationally recognized way to optimize the conditioned high level waste to be disposed of. AREVA’s successful operation of AVM at the Marcoule plant, R7 and T7 at the La Hague Plants demonstrates the capabilities and experience of the Group to deploy innovative high level waste (HLW) processing technologies in industrial facilities, in partnership with R&D (CEA) and engineering (SGN)., CEA and AREVA engineering team have continuously improved the hot metallic crucible melter vitrification technology through operational feedback as well as ongoing research and development. They have led the way in the development and implementation of Cold Crucible Induction Melter technology (CCIM). The cold crucible is a compact water-cooled melter in which the radioactive waste and the glass are molten by direct high frequency induction. This technology can handle with highly corrosive solutions and high operating temperature, which offers, among others advantages: • A great flexibility in matrix compositions, • The increase of the industrial glass production capacity, • Increase of melting temperature, • Allow higher wastes loading, • Extend to a wide and varied waste type. In order to take advantage of CCIM, a new project, called “Vitrification 2010”, was launched in 2005 with the objective to put in commercial operation a CCIM in one of the existing active R7 vitrification line in 2010. The main challenge for the project team is to replace the hot metallic crucible melter with the CCIM: • In an existing hot cell which is in operation for 20 years with high level waste solutions, • With respect to the current hot cell’s layout (calciner, through-wall for utility for example...). The paper will illustrate why this event is a major milestone in vitrification and how the “Vitrification 2010” project succeeds in record time and without any impact on the La Hague Plant production.

Abstract:
New trend emerges in the quest for establishing real actual trust between the main stakeholders in the complex cross border family law cases, which is providing for concentration of jurisdiction. The Hague Conference of Private International Law (HCCH) and the European Union (EU) are in forefront of establishing concentrating jurisdiction for those proceedings based on limitation of the number of courts in order to solve two problems: to enhance the predictability and the uniformity of the outcomes in these cases and to re-establish the mutual trust on realistic grounds instead of its current notion as a political decision. Such strategy is welcomed since it starts from the bottom and it tends to elevate the trust between the persons concerned in these proceedings and with that it stretches its prerogatives to the top, which is to enhance the trust between the legal systems. Whether it will succeed it depends again on the modalities of its establishment in the national legal systems. Generally, specialization of jurisdiction is frequently considered to be an important reform initiative in improving the development of a successful judicial system which is why it is recognized as a rapidly growing trend regarding the organization of the judiciary systems worldwide. The article will discuss the concepts of specialization of jurisdiction and its possible implementation in the national legal system of Republic of North Macedonia (N. Macedonia) regarding the complex cross border family law cases.
