Abstract:
Bei dem Beitrag handelt es sich um eine Zusammenfassung der von der Martin-Luther-Universität Halle/Wittenberg im Februar 2007 als Dissertation angenommenen Arbeit. Er stellt die in der Forschungsarbeit aufgeworfenen Probleme und Ergebnisse in aller Kürze vor. Gegenstand der Doktorarbeit ist die Ausgestaltung der Zusammenarbeit bei postmortalen Organtransplantationen nach dem Transplantationsgesetz von 1997 (TPG) sowie deren Durchführung in der Praxis. Untersucht wird das Kooperationsmodell der „gemeinschaftlichen Aufgabe“ nach § 11 Abs. 1 S. 1 TPG, daraus resultierende Probleme für die beteiligten Institutionen sowie denkbare haftungsrechtlich relevante Konstellationen bevor ein eigener Lösungsansatz vorgestellt und die notwendigen systematischen Änderungen in Form von Thesen formuliert werden.

Vivian Owusu, a stunning twenty-one-year-old African woman who grew up in Ghana, was about to walk out of the university counseling center when I went to the waiting room to get her for our initial appointment. Her first psychiatric provider had retired a year after meeting her and her next one took a different job six months later, so I was her third psychiatrist in less than a year. Vivian had not shown for her first two appointments with me and now, due to a double-booking error that was my fault, I was thirty minutes late. I apologized and asked if she had time to stay and meet with me. I could see her anger and agitation. “I suppose.” Irritated but still poised, Vivian followed me down the hall to my office. What an unfortunate beginning, I thought, feeling harried. We had been short-staff ed for months and I had been squeezing patients in as best I could, feeling like I wasn’t doing my best work. Vivian settled herself upright on my couch and looked at me coolly. She had big dark eyes, flawless brown skin, beautifully braided hair, a button nose, and a hostile expression. In response to my questions, she told me she was a junior, pre-law. She hadn’t slept for three or four days. Depression had been plaguing her and she had been having thoughts of killing herself. Her expression of hostility briefly showed a trace of sadness. “I don’t trust people,” she said. “I take things personally and I get annoyed.” She often felt emotionally volatile and easily got upset with people if she felt they were rejecting her. I had skimmed her medical record prior to the appointment and saw that she had had multiple emergency contacts with our clinicians and two psychiatric hospitalizations, the second five months earlier. She said she wasn’t having suicidal thoughts currently and would call us if she did. What she wanted from me was a refill of medicines she was taking to help with the depression and anxiety.

Abstract On my last trip to New Orleans, a sergeant got on the train at Anniston and squeezed his bulk into the seat beside me. He was a friendly sort. I learned much of his business, his chance to go to officers’ training camp, his football career at Xavier University, his various jobs before Pearl Harbor. He ran over with praise of his native New Orleans. My tourist’s curiosity about the Creole cuisine fired his language; he described the culinary marvels of all the various gumbos, of Jambalaya (Creole cousin of Hopping-John), of Gombo Zhèbes (a mixture of all the greens on God’s earth), and of the sea foods, until the woman in front threw amused glances at us. He was hastening home on furlough; one of the jobs he anticipated was cooking up some of those fine Creole dishes. I begged off from his hymns of adoration. I had not eaten since above Spartanburg, and we were nearly in Birmingham. I asked him about New Orleans jazz. This was another street that he walked familiarly. His brother, a clarinet player, was a friend of Barney Bigard, and had been in France with Noble Sissle when Barney was there with Duke Ellington. Yes, he knew Sidney Bechet, King Oliver, Kid Ory, Satchmo’, all of them. He looked with greater favor on me; I was a bit more than a traveling schoolteacher now in his eyes. When I spoke of Kid Rena, he corrected my pronunciation but beamed. Maybe I could find Kid Raynyay. I should go to the Fern Dance Hall, on Iberville between Rampart and Burgundy, anytime late at night. Sure I could get in. Just go on in. I’d find plenty my color there, if not my race. If I didn’t find him there, and Rena was known to be irregular, I might have to seek Big Eye Louie, the historic clarinetist. On Derbigny between Columbus and Kelerec, everybody would tell you where Big Eye was; not a soul in that neighborhood but would look out for Big Eye. The sergeant also named his nephew, a hot jazz cat, who could help me find Rena and Louie if these leads failed.
