Abstract:
The ‘selling arrangement’ is a judicial device which removes national law from thescrutiny of European Community law relating to the free movement of goods. National provisions affecting the marketing of products may fall for consideration as ‘selling arrangements’ where the treatment of the domestic and imported goods has been even handed. Measures relating to the substance of the goods remain subject to Community law rules on the free movement of goods. The prime example of the selling arrangement is the advertisement, but in the years since creation, other areas of national activity with respect to the free movement of goods have been enveloped inthe selling arrangement. Certain measures which have related to the conduct of business may also fall for similar treatment as selling arrangements. A recent development would appear tomean that the concept of the selling arrangement may apply where the obligation imposed by the national measure has beenidentified as being general, as opposed to specific in nature. Were this to be so, the selling arrangement would have the potential to break free of the traditional boundaries established for itunder Criminal Proceedings against Bernard Keck and Daniel Mithouard.1

Abstract:
Paul Wittgenstein's one-handedness has typically been framed as a physical limitation at odds with an able-bodied ideology driving musical performance. Contemporary reviews, for instance, frame the pianist's disability as a tragedy heroically transcended during the course of virtuosic performance; others suggest that Wittgenstein successfully "passed" as two-handed. A study of Wittgenstein's numerous one-hand arrangements reveals similar narratives: the pianist often attempted to imitate the sound of two-handed piano music, and many of his own keyboard exercises train his one hand to assume the load of two. The "deficiency" model can be seen most dramatically in three attempts to arrange Witt-genstein's commissions for left-hand piano into a more "normal" performance medium: Sergei Prokofiev's expressed (but abandoned) interest in arranging his left-hand piano concerto for piano two-hands, Alfred Cortot's completed draft of a two-hand arrangement of Ravel's Concerto pour la main gauche, and, most significantly, Friedrich Wührer's highly successful two-hand arrangements of Franz Schmidt's left-hand pieces for Wittgenstein, which explicitly adopt a program of "strengthening" and "filling in" the supposed weaknesses of a disabled performance medium. Yet, despite the stigma it may have accrued, one-handed pianism is but a more prominent, more public example of the "bodily limits" all performers must confront; similar discourse surrounds the deficiencies of small hands or stiff fingers, for example. For the performer's body must negotiate its corporeal finitude with the complex demands of the musical score. As seen here in the career of Wittgenstein, an aesthetics of disabled performance presents this dialectic in heightened microcosm.

Abstract:
A numerical investigation of incompressible flow about transversely oscillating cylinder pairs is performed. Both tandem and side-by-side arrangements undergoing both flow-induced and forced transverse oscillations are considered. A second-order projection scheme is used to solve the 2-D incompressible Navier Stokes equations and a staggered approach is used to couple flow and structural response. Automatic mesh deformation and adaptation are used to handle arbitrary motion of the bodies. Comparisons with experimental results indicate that the present numerical method can capture complex interference and flow–structure interaction phenomena. Specifically, results are presented that demonstrate wake galloping effects, in which a cylinder in the wake of another experiences large flow-induced vibration over a wide range of flow velocities, and the presence of an experimentally observed secondary peak in the flow-induced vibration of rigidly connected cylinders in a tandem arrangement. An explanation of this secondary peak is provided by employing appropriate visualization of the unsteady flow. Results for forced oscillation of a pair of cylinders in a side-by-side arrangement are also presented that show the effect of phase angle on the wake structure behind the cylinder pair.

This doctoral thesis had as its proposal the analysis of local Productive Arrangements of the confectionery sector in the cities of Cerquilho and Tietê and its socioeconomic impacts, reflections on work relations and strategic objectives. The proposal is based on the changes of the economy, the processes of production management, the relations between capital and labor and the human relationship regarding family, professional and personal interactions. The thesis had as general objective of reflection the verification of the impact of the Brazilian crisis in the APL of Cerquilho and Tietê and its consequences in the social areas and sought to identify the externalities that directly or indirectly affected the APL. In order to meet the established objectives, the case study methodology was used, with comparative and documentary analysis, considering a survey of the data. Contributed to the decision making: monitoring research developed by Sebrae SP; Globalized enterprise management models; analysis of comprehensive and specific indicators and interviews. It can be inferred up to the present time, and in accordance with the field and documentary research currently available in the areas addressed that the hypothesis was proven, insofar as the consequences for the organizations belonging to the APL were not different from the organizations outside the APL, that is, closing, unemployment and falling GDP, with all relevant social implications. The research sought to show that the benefits generated by APL extrapolate the improvements observed within the group and gains also appear in social areas. If there is a frustration with the group, it is that the people realized that the gain could be much greater, minimizing the effects of the Brazilian crisis

Churchill, Sara-Anne. "The Tradition of Transcription: Handel Aria Arrangements in the Fifth Book of The Ladys Banquet." Thesis, 2011. http://hdl.handle.net/1807/31721.

Abstract:
Eighteenth-century London was a hotbed for instrumental arrangements, and many of these works were derived from the operas of George Frideric Handel (1685-1759). Thirty-one of his operas, in whole or in part, were arranged for recorder or flute, and there were over seventy keyboard transcriptions of the overtures to these operas. While the transcriptions of Handel overtures have been thoroughly examined, opera aria transcriptions have never received an appropriate level of study and analysis. The Ladys Banquet or The Lady’s Entertainment provides an excellent starting point. Not only does it include numerous opera aria arrangements, but its volumes were re-issued several times, suggesting a wide circulation. Its study raises a number of issues, including publication and authorship of Handel transcriptions, gendered music of the eighteenth century and analysis of opera transcriptions. The Ladys Banquet or The Lady’s Entertainment is a collection of six volumes of keyboard music published by John Walsh in the first half of the eighteenth century. The first two books were issued in 1704 and 1706 respectively, and included many undemanding pieces by fashionable composers such as Jeremiah Clarke (c.1674-1707) and Henry Purcell (1659-1695). The Third and Fourth Books followed in circa 1715 and 1716 and contain predominantly dance tunes and popular songs revised for the keyboard. When, in the early 1730s, the Fifth and Sixth Books appeared, the original four volumes were revised, and included wholly different material than the first editions. The publications of John Walsh are notoriously confusing owing to their lack of publication dates, repeated use of title pages, and misleading advertisements. The Ladys Banquet, as a whole, is especially bewildering because of the reissues of the collection and the changing repertoire. My research focuses on the Fifth Book of The Ladys Banquet, first printed around 1734, due to its abundance of opera aria transcriptions and consistency of content within editions. This document compiles relevant background information and offers a lucid guide to The Ladys Banquet. It provides historical context, examination and discussion of the contents of each volume, with specific details about the music in the Fifth Book, as well as analysis of the Handel aria transcriptions.

Study aims: To determine the related factors of the changes in the living arrangements for the middle and old aged people in Taiwan, especially social support. Methods: Using Taiwan Longitudinal Study on Aging(TLSA) survey data, participants aged over 50 years old in year 1996 were included in this study, and followed up in 2003 and 2007. Social support was classified as emotional and instrumental support. Four types of living arrangements were classified, including living alone, living with spouse, living with family, and living with others. SAS statistical software, version 9.4, and logistic regression analysis were applied to analyze the determinants of living arrangement transitions in 1996~2003 and 2003~2007. Results: Those who with higher instrumental supports will lower the likelihood of living arrangement transition, in middle and old age people, Odds Ratios (ORs) were 0.85 in 1996-2003 and 0.85 in 2003-2007, in middle and old age women, Odds Ratios (ORs) were 0.83 in 1996-2003 and 0.80 in 2003-2007. Those who living with family in 1996 and in 2003, the relationship between instrumental support and living arrangement transitions, the ORs to transit to living alone, were OR=0.62 in 1996-2003 and OR=0.67 in 2003-2007. Male with higher emotional supports, the likelihood of living arrangement transition was elevated, the OR was 1.11 in 2003-2007. Those who living alone in 2003, the relationship between emotional support and living arrangement transition, the OR to transit to living with family was 1.31. Conclusions: Those who with higher instrumental supports were with lower probability to transit their living arrangements and stay in their original living arrangements, especially those who living with family. Those who living alone in 2003, the likelihood to transit to living with family in 2007 was elevated when they got more emotional supports.

In the paper, we use data mining techniques to analyze and retrieve customers’ traveling patterns from the database in the traveling system built in the WWW environment. Our solution procedure consists of two phases. First, we propose three algorithms embedded in the system to arrange the traveling routes and accommodations for customers. Second, we use mining techniques to extract the most interesting knowledge hidden in the database. In the implementation, we provide more convenient services and more useful information than other traditional travel agencies.

Composite materials are common materials using in engineering and the fiber composite laminate is widely used. With various fiber arrangement, the strength of material can be enhanced. Since the carbon nanotube has mechanical properties with high strength and high stiffness, it is appropriately used as reinforcement material. In this study, carbon fiber, epoxy and carbon nanotube are combined by Rule of Mixture and Halpin-Tsai equation, and the fiber direction and price of materials are also considered. The optimum arrangement of fiber direction and material volume fraction are calculated by ANSYS. Finally, the optimum results of cost and weight are compared with typical carbon fiber laminate.

Abstract This dispute primarily stems from the great challenge in antitrust law whether Microsoft engaged in tying arrangement and Windows and IE are two or only one product?Tying arrangements are legal or illegal? It’s a complex problem because tie-in has a dual character. On the one hand, tie-in promotes sales , enhances benefit and protects the goodwill .On the other hand, tie-in has some pernicious effects , such as leverages monopoly power from one market to another, creates barrier of entry , evades the price controls and hinders free competition . Therefore, the purpose of this article is to elaborate tying arrangement from different angels and figure out the standard in the estimation of the law. This article will be proceeded as following: Part Ⅰ remarking the motives and methods of this paper Part Ⅱ discussing the tie-in in the United States, the background of the tying arrangement then the application of antitrust laws to tying arrangement ; analyzing the merits and flaws and the impacts of market Part Ⅲ illustrating how Taiwan’s Fair Trade Law article 10,19,and 24 be exerted in tying arrangement and depicting economic dependence ,a new theory, being applied in practical cases Part Ⅳ drawing a conclusion of former discussions

The arrangement graph is not only a generalization of star graph but is also more flexible than the star graph in terms of selecting the major design parameters: degree, diameter, and number of nodes. The arrangement graph has many properties, such as hierarchical structure, vertex and edge symmetry, simple and optimal routing, and many fault tolerance properties. However, the common problem with the direct network is that the degree of each vertex is not fixed, making it difficult to scale. In this paper we propose an indirect arrangement network. The indirect arrangement networks are to the arrangement graph as the indirect cube-type networks are to the n-cube. The new network is obtained by unfolding the arrangement graph. It is modular and is constructed from (m*m)-crossbar switches, where m=n-k+1. The routing in the indirect arrangement network is simple and the packet is sent to the correct destination without carrying extra routing information. To the best of our knowledge, this is the first in the efforts of coming up with indirect arrangement networks. The performance is analyzed and the analytic results are verified through simulations. It is shown that the two results match each other quite well. The indirect arrangement network can be a good alternative to the indirect cube-type or star-type networks.

Abstract:
This chapter discusses logistic support arrangements. When properly orchestrated, logistics arrangements can be conceived as a decisive instrument of multinational warfare and champion the change from a military coalition to an alliance. Nevertheless, logistics is a low-profile discipline that only comes to light when it fails. In this regard, looking for market-oriented efficiencies should never result in a gap on strategic projection. It is by creating and sustaining superior performance that an organization will dilute costs due to a greater value of its overall activities. Very great attention is paid to short-term cash economy in detriment to long-range military planning benefits. Tactical logistics are well monitored: everyone understands the importance of not running out of fuel during combat and it is not difficult to flag the problem. On the other hand, strategic logistics and its implication on support arrangements are frequently neglected during peacetime.

This chapter deals with legal rules and administrative procedures relating to concrete markets. The author’s principle aim is to make sense of a limited number of juridical sources, inscriptions and literary texts referring to applications for the right to hold markets (ius nundinarum) or for the privilege of immunity (immunitas) from market-taxes. Legal rules governing markets in the abstract meaning of the term are a vast topic. Instead of attempting a general study of this type, this chapter focuses on a handful of legal arrangements that made it possible for buyers or sellers to rescind contracts of sale that had been concluded in marketplaces. Finally, some attention is given to governmental attempts to impose fixed or maximum prices.

Abstract:
This chapter builds on the empirical results presented in Chapters 3 and 4 that consider the relationship between scarcity, variability and cooperation as well as treaty effectiveness. It also builds on Chapter 5, which examines various arrangements and principles (issue linkage, second-order resources strategies, supply-side solutions, demand-side solutions, income transfer—also regarded as ‘benefit transfer’ or ‘side-payments’—and inter-basin linkages) codified in treaties, by considering other arrangements not yet reviewed. Based on these arrangements and principles, the chapter assesses the effectiveness of a sampling of treaties from a handful of basins. The chapter also includes five case studies to infer the various ways riparian states negotiate treaties under conditions of scarcity and variability. The case studies demonstrate that there are a variety of arrangements developed to deal with water scarcity.

The legislative framework for insolvency, namely the Corporate Reorganisation Act, the Composition Act, and the Bankruptcy Act, was introduced in 1962. Until the financial crisis struck Korea and other Asian countries in 1997, however, for several reasons, insolvency proceedings were hardly used by debtors. Cases were mostly settled through private arrangements between the debtor and the creditor, and only a handful of cases went to court.

Abstract:
This chapter describes the land-use and land-arrangement strategies that Chinese migrant and left-behind rice farmers use to manage their farmland and off-farm migration. These include both social and technical strategies – only some of which accord with state expectations – such as leaving behind family members, building houses on farmland, using labour-saving technologies, switching from rice to cash crops, or even abandoning fields. Using specific household cases, the chapter demonstrates how peasants draw on a wide repertoire of available resources to handle their situation. Shedding light on the logics behind these decisions, it argues that, in taking seemingly technical agricultural decisions, farmers are in fact pursuing various long-term and short-term projects that best match their fluctuating current and anticipated future household situation.

Abstract:
This chapter describes the fundamentals of left-handed metamaterials. From Maxwell's equations, constant phase term is originated, and it is revealed that its negative value is chosen in a negative permittivity and negative permeability (DNG) medium whereas its positive value is designated in a DPS medium. The negative phase constant results in a negative phase velocity and negative index of refraction in the medium. Complementary split ring resonator (CSRR) as a valuable metamaterial component is illustrated. The resonant frequencies of the CSRR are associated with the features of their arrangements. CSRR is agitated with the E field of the electric and magnetic wave together with the axis of the CSRR. Consequently, the CSRR presents negative permittivity in a particular frequency band.

Abstract:
In its second module, „Beethovens Werkstatt“ deals with five of Beethoven’s compositions which exist both in their original versions and as authentic arrangements (Piano Sonata op. 14/1 arranged for string quartet, Septett op. 20 and Trio op. 38, Opferlied op. 121b and Bundeslied op. 122 as piano reductions, Große Fuge op. 133 as arrangement for piano for four hands op. 134). To demonstrate Beethoven’s arrangement practices, the original version of each work is synoptically linked with its arrangement in a digital edition called „VideApp Arr“. Through digital tools for comparison the relationships between the two versions can be investigated from different perspectives. It becomes visible how the versions are related to each other both by „invariance“ (text elements with the same structure), by „variance“ (text elements with a similar structure) and, in special cases, also by „difference“ (text elements without corresponding parameters). Each view within the „VideApp Arr“ is generated from the underlying MEI data.

Abstract:

In tied-arch bridges, the way the arch and the deck are connected may become crucial. The deck is usually suspended from hangers made out of steel pinned cables capable of resisting axial forces only. However, a proper structural response, (both in-plane and out-of-plane) may be ensured by fixing and stiffening the hangers in order to resist, additionally, shear forces and bending moments. This paper studies the effect of different pinned and stiffened hanger arrangements on the structural behavior of the tied-arch footbridges, with the intention of providing designers with useful tools at the early steps of design. As a major conclusion, regarding the in-plane behavior, hangers composed of cables (either with vertical, Nielsen-Löhse or network arrangements) are recommended due to its low cost and ease of erection. Alternatively, longitudinally stiffened hangers, fixed at both ends, can be used. Regarding the out-of-plane behavior, and in addition to three-dimensional arrangements of cables, of limited effectiveness, transversally stiffened hangers fixed at both ends are the most efficient arrangement. A configuration almost as efficient can be achieved by locating a hinge at the end corresponding to the most flexible structural element (normally the arch). Its efficiency is further improved if the cross-section tapers from the fixed end to the pinned end.

In ASME Turbo Expo 2015: Turbine Technical Conference and Exposition. American Society of Mechanical Engineers, 2015. http://dx.doi.org/10.1115/gt2015-43616.

Abstract:
A numerical study of turbulent flow through 3×3 multi swirler arrangement has been performed using the realizable k-ε turbulence model on a grid with about 19 million points. All co and alternate co/counter swirler configurations comprised of radial-radial swirler with counter rotating vanes are analyzed. The offset distances of swirler exit from the base wall of confinement of 0.02D and 0.31D are considered where D is the diameter of swirler exit. For both arrangements, a strong jet is issued as the flow exits individual swirl cup. Recirculation is observed at the walls and between each swirl cup along with the formation of central toroidal recirculation zone (CTRZ) at each individual swirler. It is observed that all co swirling arrangement has a stronger more compact individual CTRZ. On the other hand alternate co and counter arrangement produces more swirler-to-swirler interactions. When the offset between swirler exit and base wall of confinement is increased to 0.31D, longer but more compact CTRZ are formed at each swirler cup. The velocity gradient for 0.31D offset case is also higher than that of 0.02D. These differences in the flow field indicate better combustion performance, fuel breakup and flame anchoring for the higher offset case.

Abstract:
Pressure surges and fluid transients, such as steam and water hammer, are events that can occur unexpectedly in operating power plants causing significant damages. The steam hammer normally occurs when one or more valves suddenly close or open. In a power plant, the steam hammer could be an inevitable phenomenon during turbine trip, since valves (e.g., main steam valves) must be closed very quickly to protect the turbine from further damage. When a valve suddenly stops at a very short time, the flow pressure builds up at the valve, starting to create pressure waves along the pipe runs which travel between elbows. Furthermore, these pressure waves may cause large dynamic response on the pipeline and large loads on the pipe restraints. The response and vibrations on the pipeline depend on, one hand, on the pressure waves amplitudes and frequencies of the applied transient loads and on the other hand, on the natural frequencies and dynamic characteristics of the pipeline itself. The piping flexibility or rigidity of the pipeline (piping configuration plus support locations and types), determines how the pipeline will respond to these waves and eventually the magnitude of the loads on the pipe restraints. Consequently, the design of the piping system (pipe configuration and pipe support arrangement) is closely related to the dynamic amplification of applied steam hammer loads. This paper investigates how the pipe support arrangement and the flexibility of the pipeline relate to the dynamic amplification of the piping system due to steam hammer transient loads. The paper examines the correlation that exists, between the applied steam hammer transient spectrum and the pipe frequencies of the pipeline with the dynamic load amplification. Furthermore, it establishes the relation between the dynamic amplification of the pipeline and the pipe support configuration by examining various piping systems from very rigid (many supports) to very flexible (fewer supports). The typical pipe configuration of hot reheat line in a power plant is analyzed for steam hammer due to sudden valve closure (turbine trip) for six cases of closure time (50, 100, 200, 300, 400, 1600 ms). The transient loads on each pipe segment are generated using the PIPENET program and used as an input to CAESAR II stress analysis program to perform a dynamic time history analysis. The dynamic analysis is performed for a range of different pipe support arrangements, from very rigid to a very flexible. The magnitude of the restraint loads from the time history analysis, for each selected pipe support arrangement, is compared with the transient load spectrum associated. The analysis is performed using the PIPENET transient module and CAESAR II pipe stress analysis program, for a range of different pipe support arrangements, from very rigid to a very flexible. The results from the dynamic analysis are compared with the applied transient spectrum, and a dynamic load factor is established for the selected pipe support configuration. The dynamic load factor calculated based on the analysis results is compared with the factor proposed in standard industry practice. The information and the methodology presented in this paper aim to assist the design engineer in the power plant industry to select an optimum support arrangement that will cause the minimum dynamic amplification on the pipeline, thus reducing the steam hammer effects, the size and the cost of pipe supports.

Abstract:
The conversion of ageing tankers is a tempting alternative to newbuildings when FPSO units are planned. The low cost of an already classified hull and an existing pumping facility compensate for the repair and updating costs a conversion may demand. Newbuildings on the other hand allow for improved production plant and storage tank lay-out. The trade offs between conversions and newbuildings are analyzed from the point of view of strength and general arrangement. Converted tankers carry a serious strength drawback since the emptied engine space enhances the high buoyancy region at the stern which significantly increases bending moment amidships. In general one or more cargo tanks must be kept at partial loading to compensate for the increased bending moment. A new building lay-out is analyzed in which the tanker engine space is completely eliminated. Utility systems are resized and placed on the main deck aft of the production plant. Accommodation spaces are also resized and rearranged in order to fit into the reduced deck space available. The gains in strength are quantified and the lay-out implications are discussed in detail. A comparative study is presented between a conversion of a hypothetical tanker and an equivalent new building.

Full text
Abstract:
Flow-induced streamwise oscillation of two tandem square cylinders has been studied by means of free-oscillation testing in a wind tunnel. One cylinder was elastically supported so as to allow it to move in the streamwise direction; the other was fixed to the tunnel sidewalls. Small values of the reduced mass-damping parameter (Cn ≤ 1.63) have been considered. When the upstream cylinder is free to oscillate, there are two excitation regions: the first for reduced velocity, Vr, in the range 2.5 ≤ Vr ≤ 5 and cylinder gap distance to reference-length ratio, s, between 0.3 and 2, is due to movement-induced excitation accompanied by symmetrical vortex shedding, while the second, for 0.75 ≤ s ≤ 1.5 and 4.5 ≤ Vr ≤ 6.5, is due to vortex excitation by alternate Karman vortex shedding, accompanied with unstable limit-cycle oscillation. For wide gap distances over 2.5, an excitation region of the upstream cylinder occurs for 3.5 ≤ Vr ≤ 4.7, which is due to alternate Karman vortex shedding, and resembles the streamwise oscillation of a single cylinder. On the other hand, when the downstream cylinder is free to oscillate for narrow gap distances of 0.3 ≤ s ≤ 0.75, the response characteristics have an excitation region due to alternate Karman vortex shedding from the two cylinders, connected by dead water region between them, for 3.2 ≤ Vr ≤ 5.4. When s is greater than 1, the downstream cylinder experiences buffeting by wake fluctuation of the upstream cylinder.

Abstract:
Inlet temperature is one of the main inputs in all models for analysis of fluid film bearings performance. On the other hand inlet temperature distribution and also oil speed distribution at the inlet is the result of flow phenomena in the gap between bearing pads. These phenomena are complex and in many cases additionally affected by a special bearing design incorporating various arrangements of forced oil supply to the gap between pads. The reason for such arrangements is more efficient introducing of the lubricant cooled in an external cooling system to the oil film. Not much is known about flow phenomena in the gap between the pads and even less if the bearing is fitted with any kind of directed lubrication system. One of those special bearing arrangement is a leading edge groove (LEG) design described by Mikula [1] Experimental results showed that LEG lubricating system in comparison to flooded lubrication caused about 10–20°C drop in maximum temperature in high-speed bearings. But not much is known of potential benefits of using this lubrication method in large low-speed bearings applied in water turbines. There were no attempts of adaptation of this lubrication system to large size bearings. In this case modeling is necessary because of large cost of experiments. Contemporary computer codes of Computational Fluid Dynamics (CFD) enable one to study flow between bearing pads or in lubricating groove and even to build models of a whole hydrodynamic bearing within CFD systems. Some results of modeling lubricant flow in the gap in a bearing with a directed lubrication system are presented in the paper.

Abstract:
Bio-structures owe their remarkable mechanical properties to their hierarchical geometrical arrangement as well as heterogeneous material properties. This dissertation presents an integrated, interdisciplinary approach that employs computational mechanics combined with flow network analysis to gain fundamental insights into the failure mechanisms of high performance, light-weight, structured composites by examining the stress flow patterns formed in the nascent stages of loading for the rostrum of the paddlefish. The data required for the flow network analysis was generated from the finite element analysis of the rostrum. The flow network was weighted based on the parameter of interest, which is stress in the current study. The changing kinematics of the structural system was provided as input to the algorithm that computes the minimum-cut of the flow network. The proposed approach was verified using two classical problems three- and four-point bending of a simply-supported concrete beam. The current study also addresses the methodology used to prepare data in an appropriate format for a seamless transition from finite element binary database files to the abstract mathematical domain needed for the network flow analysis. A robust, platform-independent procedure was developed that efficiently handles the large datasets produced by the finite element simulations. Results from computational mechanics using Abaqus and complex network analysis are presented.
