Abstract:

"The Validity of Knock-for-Knock Clauses in Comparative Perspective." European Review of Private Law 26, Issue 1 (2018): 3–29. http://dx.doi.org/10.54648/erpl2018002.

Full text
Abstract:
Abstract: This article discusses the validity of so-called knock-for-knock clauses, by which parties to offshore oil and gas or maritime contracts agree that each of them will cover its own losses regardless of who caused them. The issue of validity of such clauses and of the liability exclusions they contain is analysed in a comparative perspective between the law of their tradition of origin (common law, especially UK law) and Nordic civil law, where such agreements are also frequently used, namely in the context of oil extraction activities in the North Sea. Based on an assessment of the different criteria used to promote or dismiss knock-for-knock clauses in case law and academic literature, the article reaches the conclusion that the question of whether knock-for-knock clauses should be held valid depends on whose interests are being considered, and that further research is warranted on the efficiency of mechanisms supposed to replace the deterrence effect of tort or contractual liability.

Abstract:
This study aims to categorize the dominant concepts or themes in the study of governance in handling the Covid-19 pandemic in Indonesia. The dominant concept is categorized based on cluster grouping. This study uses a systematic literature review method by collecting various previous studies to find strategies and problems in managing the COVID-19 pandemic in Indonesia. The main data source used is articles from the Scopus database. This research reveals that previous studies on the governance of handling Covid-19 in Indonesia are related to four dominant concepts, namely regional government, economy, impact, and spread. The dominant concept of regional government is related to the role of regional governments in making and implementing policies for handling Covid-19 at the regional level. The dominant concept of the economy is related to the focus of handling Covid-19 which is directed at maintaining economic stability and development carried out through various forms of policies and program activities, both at the national and regional levels. The concept of impact is an effort by the Indonesian government to minimize the negative impact of the Covid-19 crisis on the economy and development. The spread is the Indonesian government's efforts to minimize the spread of Covid-19. The four dominant concepts are interrelated with each other, which confirms that the governance of handling Covid-19 in Indonesia is governance that prioritizes the role of the government, focuses on stability, economic growth, and handling the impact and spread of Covid-19.

Abstract:
Abstract This paper addresses the question of how speakers adapt their gestures according to their interlocutor’s proficiency level in the language of the interaction especially in the specific context of foreign language teaching. We know that speakers make changes in their speech when addressing a non-native speaker, called Foreigner Talk (Ferguson, 1975) to make their speech more comprehensible. However, whether and how gestures are also modified along with speech has hardly been addressed in the literature. In this study, we examined the speech and gesture of future teachers of French in a word explanation task to see what types of adjustments they made when explaining a word to a native speaker and a non-native speaker. We had ten future teachers of French explain the same 12 words to a native and a non-native speaker of French and compared the explanations. We found that the future teachers produced significantly more gestures, significantly longer gestures in duration, significantly more illustrative (iconic and deictic) gestures, and significantly larger gestures when addressing a non-native interlocutor. These results show that native speakers make not only speech adjustments but also gesture adjustments in addressing non-native speakers.

Abstract:
Manual material handling (MMH) is performed in 83% of all U.S. Army enlisted military occupations. Studies that have examined the influence of physical training on MMH can be separated into two types: those that use the same task for testing and training (task-specific training studies) and those that do not (general training studies). Reported relative improvements in maximal symmetric lifting and repetitive lifting are 26% to 99% in task-specific training studies and 16% to 23% in general training studies. Psychomotor learning probably accounts for a large proportion of performance gains in task-specific training while both psychomotor learning and muscle hypertrophy account for gains in general training studies. While both types of training are effective and currently practiced in the military, general training may be useful for improving a wide range of MMH tasks while task-specific training results in larger gains in targeted MMH tasks.

Abstract:
Using straw and herbaceous crops to replace or augment fossil fuels is becoming popular as access to forest biomass becomes environmentally stricter and more expensive. The low bulk density raw biomass is pre-processed and densified into pellets to facilitate handling and use. Dust is generated during collection, baling and debaling, grinding, drying, and densifying processed herbaceous biomass. Abundant literature deals with dust generated during the industrial handling of woody biomass, grains, and other crops like cotton. But the information on handling herbaceous biomass in the open literature is scarce. This paper reviews the available literature on dust generation from handling and processing of herbaceous biomass. Limited available data shows that herbaceous biomass species have a lower ignition temperature than woody biomass. The paper identifies several crucial pieces of information needed to ensure safety in the handling and pelleting of herbaceous crops.

The collective memory, which was scripted in Javanese literature, indicates that pagĕblug happened in the past. However, the public does not know its information since the primary resource is indecipherable, followed by the rapid growth of science and technology. Whereas in Javanese literature, there is knowledge about tracing and handling a pagĕblug. Therefore, This study has three main objectives: (a) Examine the handling of pagĕblug in Java based on primary sources taken from Javanese textual and non-textual archives; (b) Reveal the common thread of continuity in handling pagĕblug cosmologically and physically; (c)Propose a draft of strategy for dealing with pagĕblug in the present. The research conducted in descriptive-qualitative-interpretative, utilizing philological and oral approaches. The data was compiled using blended methods consisting of literature study, source observation, manuscript reading, and interview with experts. The results indicate that Javanese literature contains knowledge of cosmological and physical handling of pagĕblug. Cosmologically, the common thread of continuity in handling pagĕblug in Javanese literature is derived from a concept of respecting human relationships with others, nature, and God. Likewise, physically, it is advised to have a clean and healthy living, even encouragement to self- quarantine for the infected people. The common thread for the continuity of pagĕblug handling potentially can be implemented by the government in formulating disease regulations amid the current Covid-19 pandemic.

Abstract Objectives: To identify the characteristics associated to nipple trauma in nursing mothers and propose a theoretical model explaining in hierarchical levels its determining factors. Methods: a systematic review of the literature based on the search of epidemiological studies of factors associated to nipple trauma in the databases of Medical Literature Analysis and Retrieval System Online/Pubmed, Literatura Latino-Americana and Caribe em Ciências da Saúde (Latin American Literature and Caribbean Health Sciences) and ScienceDirect. The conduct on searching articles occurred until June 2016. Results: 17 articles were selected which investigated 27 variables and found a significant association between 16 of these variables and nipple trauma. The factors associated to nipple trauma reported in two or more studies were: mother of race/color white or yellow, primiparity, inadequate position between mother and child during breastfeeding and handling the infant incorrectly to the mother's breast. Guidance received on handling and positioning the infant during prenatal care was a protective factor against nipple trauma. Conclusions: in the theoretical model explaining the factors associated to nipple trauma in hierarchical levels, the variables classified at the proximal level were the most investigated and were identified as risk factors in selected studies, indicating that in the postpartum care period is an important protective factor against nipple trauma.

A literature review identified 21 studies of back pain in nursing students, indicating a wide range of prevalence rates. A prospective cohort study of nursing students in a United States baccalaureate program followed 119 students who completed the Nordic Musculoskeletal Questionnaire upon beginning the 16 month upper division major and then a year later. There was no statistically significant change in low back pain prevalence over time. While nursing students have intermittent and brief exposure to patient handling activities, nursing schools must nevertheless protect them before they enter the high risk profession of nursing by teaching evidence-based safe patient handling techniques, empowering students to refuse unsafe manual lifts, and ensuring that the clinical settings with which they affiliate have adequate mechanical equipment available.

Abstract:
Introduction: Coronavirus is a collection of viruses that can infect the respiratory system. In many cases, this virus only causes mild respiratory infections, such as flu. However, this virus can also cause severe respiratory infections, such as lung infections (pneumonia). The method is a literature review research in the form of case reports through the search of accredited journal sites such as Scientdirect and Elsevier with the keyword COVID-19 pneumonia in the period of 2015-2020. Research Results: in handling COVID-19 cases each country has its own way which consists of a physical examination, blood laboratory examination, chest CT scan, swab test, urine test, oxygen installation, mechanical ventilation, Extracorporeal Membrane Oxygention (ECMO) ), as well as the administration of drugs Ceftriaxone, Azithromycin, Piramivir, iopinavir-Ritonavir, Nafamostat and Intravenous Immune Globulin (IVIG), each patient differs based on history of illness. Conclusion: every region and every country has its own way of handling COVID-19 cases because until now there has been no definitive treatment or vaccine that can treat cases of COVID-19 that have struck all over the world.

Abstract:
Although the literature contains reports of very high accuracy figures for the recognition of named entities in text, there are still some named entity phenomena that remain problematic for existing text processing systems. One of these is the ambiguity of conjunctions in candidate named entity strings, an all-too-prevalent problem in corporate and legal documents. In this paper, we distinguish four uses of the conjunction in these strings, and explore the use of a supervised machine learning approach to conjunction disambiguation trained on a very limited set of ‘name internal’ features that avoids the need for expensive lexical or semantic resources. We achieve 84% correctly classified examples using k-fold evaluation on a data set of 600 instances. We argue that further improvements are likely to require the use of wider domain knowledge and name external features.

Abstract:
The current paper presents a taxonomy of material-handling-equipment for distribution centers, based on a Systematic Literature Review of previous works on both Material Handling Equipment in real picking-intensive logistics contexts and the Decision Support Systems [DSS] employed to solve this type of problem. The current review work intends to sort the literature on the topic through a Material Handling Equipment taxonomy supported on a Systematic Literature Review. A historical appraisal of the problem is complemented by the corresponding synthesis, conclusions and future research perspectives. The current study presents an overall view of Material Handling Equipments in real picking-intensive logistics contexts and Decision Support Systems employed to solve this type of problem. New research perspectives and future recommendations aim at a more thorough integration with expert systems (or any more efficient hybrid method) for candidate equipment assessment and final selection. This could be done by using MCDM techniques like to Stochastic Multicriteria Aceptability Analysis [SMAA].

Abstract:
Over the past decade, distributed dataflow systems (DDS) have become a standard technology. In these systems, users write programs in restricted dataflow programming models, such as MapReduce, which enable them to scale out program execution to a shared-nothing cluster of machines. Yet, there is no established consensus that prescribes how to extend these programming models to support iterative algorithms. In this survey, we review the research literature and identify how DDS handle control flow, such as iteration, from both the programming model and execution level perspectives. This survey will be of interest for both users and designers of DDS.

Abstract:
The crisis due to COVID-19 can be called turbulence and its handling requires cross-border collaboration because complex problems tend to be overcome through multi-actor collaboration in networks and relationships to obtain common solutions. Collaborative governance is present as an instrument for implementing policies for handling COVID-19 to address the government's limitations in material, technical, and resource matters. Using a qualitative approach, this study aims to identify the implementation of collaborative governance in handling COVID-19 by countries in the world in a threefold perspective. This perspective is a new approach in collaborative governance that has the same basis as the Collaborative Governance Regime theory, but tends to narrow the thinking to three layers that support each other in the form of folds: values (individuals and policies), decision structures (action situations and sub-systems). policy), and context (external variables, stable parameters, and external events). Public values grow from the social context and are articulated in collaborative governance platforms and are important for the government to work on to improve community compliance with government programs. The turbulent COVID-19 situation creates space and decision-making. Each country has different choices, backgrounds, and policies but still bases the process of making and implementing policies on collaborative governance according to their respective preferences. In the folds of policy style and administrative culture, each country has its own dynamics. Countries with sufficient experience in handling outbreaks are able to make administrative adjustments more quickly, which helps speed up the response to the pandemic

Abstract:
The presence of missing responses in assessment settings is inevitable and may yield biased parameter estimates in psychometric modeling if ignored or handled improperly. Many methods have been proposed to handle missing responses in assessment data that are often dichotomous or polytomous. Their applications remain nominal, however, partly due to that (1) there is no sufficient support in the literature for an optimal method; (2) many practitioners and researchers are not familiar with these methods; and (3) these methods are usually not employed by psychometric software and missing responses need to be handled separately. This article introduces and reviews the commonly used missing response handling methods in psychometrics, along with the literature that examines and compares the performance of these methods. Further, the use of the TestDataImputation package in R is introduced and illustrated with an example data set and a simulation study. Corresponding R codes are provided.

Abstract:
The development of safe and effective vaccines for the prevention of infectious diseases associated with high mortality or morbidity is among the most significant accomplishments in medicine. The ultimate goal of eradication of a disease through immunization is an elusive one, having been achieved for only one disease—smallpox. However, a significant reduction in the number of childhood cases of diphtheria, tetanus, pertussis, poliomyelitis, measles, mumps, and rubella has been realized through the use of modern immunizing agents. Recent introduction of vaccines for the prevention of invasive disease caused by Haemophilus influenzae will hopefully provide similar results in the near future. The success of a vaccine in preventing disease is dependent on both the quality of the immunizing agent and the degree to which it is utilized. Obviously, the safest and most effective vaccine in the world will contribute nothing to the decline of a disease without clinicians' efforts to immunize at-risk individuals and without a willingness on the part of these at-risk individuals (or their parents) to receive the vaccine. This critical issue of vaccine utilization deservingly receives attention in the medical literature with some frequency.1,2 Similarly, the quality of vaccines is frequently addressed in publications concerning aspects such as reactogenicity, immunogenicity, and overall efficacy.3-6 One important factor that can influence efficacy, however, is rarely discussed—how vaccines are handled during shipment and storage. Discussions concerning preservation of vaccine potency through proper storage and maintenance of the "cold chain" may seem more pertinent to developing countries of the world, where refrigeration is not readily available and exposure of stored product to extreme environmental conditions can be expected.7-9

Abstract:
During the last decade, digitalization has borne tremendous changes on the way we live and do business. Industry 4.0, the new industrial revolution, is merging the physical, digital and virtual worlds through emerging technologies that collide with each other and create a distinctive paradigm shift. Even though the topic of Industry 4.0, has attracted significant attention during the past few years, literature in this subject area is still limited. The main objective of this paper is to study the current state of the art and identify major trends and research shortcomings. To that end, the authors conducted a methodological literature review based primarily on the SCOPUS bibliographic database. The review returned 49 relative papers dealing with the paper’s subject area. Through a thorough study of the selected papers, four dominant literature categories were recognized and discussed in detail. According to the literature reviewed, it is evident that massive changes are underway for warehouses and intralogistics facilities. Still, despite the intense discussion and appeal of the subject, one of the most important challenges in the scientific area under study, as the literature highlights, is the absence of a matching, to its significance, number of real-life applications. To that end, this paper provides a detailed description of a Cloud-based IoT application drawn from a Distribution Center (DC) that supplies retail home furnishing and sporting goods products to stores in Greece and the Balkan region, with the objective to showcase the feasibility of such an investment, highlight its potential and provide motivation to practitioners to evaluate and proceed in similar technological investments.

Abstract:
The proposed systematic approach for modeling and analyzing mechanical assemblies that require remote handling is based on developing assembly models found in the literature but considering the specific characteristics of the machines that require remote handling. Five assembly models to represent mechanical assemblies are identified and discussed. An important contribution is the definition and modeling of four sequential stages (locate, guide, fit and lock) for the assembly and disassembly of components by means of remote handling. The proposed approach provides a baseline to understand the process of assembly and disassembly by means of remote handling and it can be used to develop innovative assembly features compatible with remote handling.

Abstract:
Exoskeletons are companion devices that help a person to perform various daily activities. These can range from work to medical rehabilitation. The type of activity performed depend on the construction and control of the exoskeleton, so that some devices are for only one arm, others for both, can be driven by motors directly or through cables. Exoskeletons can be driven based on information received from position, force, speed sensors or by using EMG, EEG signals. Exoskeleton wearable devices began to appear around 1980, as an aid in physical work, in the handling of various heavy objects. Over time, they also covered the preventive-rehabilitation medical side, in order to reduce muscle pain or to restore specific movements, attenuated or even missing following accidents or diseases of the muscles. The paper presents an overview of the exoskeletons developed for the human arm.

Abstract:
The study recognized the worth of understanding the how’s of handling censoring and censored data in survival analysis and the potential biases it might cause if researchers fail to identify and handle the concepts with utmost care. We systematically reviewed the concepts of censoring and how researchers have handled censored data and brought all the ideas under one umbrella. The review was done on articles written in the English language spanning from the late fifties to the present time. We googled through NCBI, PubMed, Google scholar and other websites and identified theories and publications on the research topic. Revelation was that censoring has the potential of biasing results and reducing the statistical power of analyses if not handled with the appropriate techniques it requires. We also found that, besides the four main approaches (complete-data analysis method; imputation approach; dichotomizing the data; the likelihood-based approach) to handling censored data, there were several other innovative approaches to handling censored data. These methods include censored network estimation; conditional mean imputation method; inverse probability of censoring weighting; maximum likelihood estimation; Buckley-Janes least squares algorithm; simple multiple imputation strategy; filter algorithm; Bayesian framework; β -substitution method; search-and-score-hill-climbing algorithm and constraint-based conditional independence algorithm; frequentist; Markov chain Monte Carlo for imputed data; quantile regression; random effects hierarchical Cox proportional hazards; Lin’s Concordance Correlation Coefficient; classical maximum likelihood estimate. We infer that the presence of incomplete information about subjects does not necessarily mean that such information must be discarded, rather they must be incorporated into the study for they might carry certain relevant information that holds the key to the understanding of the research. We anticipate that through this review, researchers will develop a deeper understanding of this concept in survival analysis and select the appropriate statistical procedures for such studies devoid of biases.
