The Bergendal Collection of mediaeval manuscripts took its inspiration and inception in the nineteen-seventies at the Pontifical Institute of Mediaeval Studies in Toronto. Its guiding light from the beginning was the late Father Leonard E. Boyle, O.P., who taught at the Institute from 1961 to 1984. The author was a student of Father Boyle, and profited from his love for and extraordinary expertise in all things mediaeval, especially in the manuscript sciences of palaeography and diplomatics. In 1984 the present Holy Father Pope John Paul II appointed Father Boyle as Prefect of the Vatican Libr

A single leaf may be a valuable witness to an early manuscript that does not otherwise survive, even when it raises as many questions as it answers. Such is the case of the first fragment in a collection of some 217 leaves and fragments of medieval manuscripts owned by the University of Missouri and housed in the Rare Books Department of the Ellis Library on the Columbia, Missouri, campus. This collection, titled Fragmenta Manuscripta, derives largely from that assembled in the late seventeenth or early eighteenth century by John Bagford (d. 1716), an eccentric shoemaker-turned-bookseller. The texts of papyrus Schøyen MS 2648 (a Joshua codex) and MS 2649 (a Leviticus codex) belong to the Old Greek text tradition of the books of Joshua and Leviticus. But both codices attest not purely to the Old Greek text, but to an already slightly altered text. The Old Greek text of the two codices was already revised towards a Hebrew text, most often the Masoretic text. The two papyri are thus not witnesses for the Old Greek text as it left the hands of the first translators, but for an Old Greek text that was beginning to be revised towards the Hebrew text.

The collection was assembled by William Parkhurst in the first decades of the seventeenth century, and later passed into the hands of the Finch family, at whose seat of Burley-on-the-Hill it was examined in the nineteenth century by Alfred J Horwood of the Historical Manuscripts Commission, and in the early twentieth by the scholar Logan Pearsall Smith, who caused transcripts to be made of some of the material. These were used by later scholars, the manuscript itself being believed to have been destroyed by fire. The circumstances of this fire, and of the manuscript’s mysterious survival and subsequent discovery by I A Shapiro are described, as are its disappearance once again and rediscovery by Peter Beal. The survival was still not widely publicised and, until now, no detailed study of the Burley manuscript has been published.

Full text
Abstract:
Chapter 9 focuses on the second great achievement of 1568: the publication of William Lambarde’s edition of many Old English law codes, and two of the post-Conquest apocryphal confirmations of them, viz a code attributed to William I (Willelmi Articuli) and the Leges Edwardi Confessoris. The edition is shown to have been as much the achievement of Lambarde’s sometime tutor, Laurence Nowell, as of Lambarde. Their study of different medieval manuscripts is reconstructed, and their selection of materials for inclusion (and exclusion) is explained. The edition was heavily influenced by both a twelfth-century amplified version of Quadripartitus which had come into the hands of Archbishop Matthew Parker (and later passed into those of Sir Edward Coke), and by the London Collection of the Leges Anglorum. Both have been continuous threads running through this book since Chapter 3. This chapter makes extensive use of Nowell’s manuscript transcriptions and studies, which have hitherto been largely ignored. It also examines the manuscript collection of William Fleetwood, an MP with interest in English legal history, and of other members of the newly founded Society of Antiquaries, in particular Francis Tate and Robert Cotton. Lambarde’s other publication, notably his Archeion, are also briefly examined for their treatment of the Conquest, as are the two editions of Holinshed’s Chronicles. The chapter concludes with a discussion of the renewed interest late in Elizabeth’s reign in Magna Carta and Modus tenendi parliamentum, both of which had implications for understanding of the Conquest.
