Der Vierte Deutsche Männergesundheitsbericht setzt bei einer fundierten Bestandsaufnahme der Situation der Männer zwischen 55 und 74 Jahren an. The historical portion of this chapter presents material about Josquin’s artistic status during the Renaissance, including testimonies by Martin Luther, Hans Ott, and Heinrich Glareanus. Included also is an overview of Josquin’s Masses, with focus on his final Mass—the Missa Pange lingua, composed sometime after 1515 but not published until 1539, after Josquin’s death. However, numerous copies of the Mass existed during and shortly after Josquin’s lifetime. The analysis portion of the chapter discusses Josquin’s imitative technique, extensive use of ostinatos, and paraphrase of Gregorian chant. Performance practices include numbers, types, and placements of singers; meter, tactus, and tempo; text underlay; and musica ficta and music recta.

For all his malaise during these years, he continued to kick up his heels with friends and maintain his reputation as one of the city’s brightest wits and raconteurs. His eclectic assortment of friends durisng this period included composer Ned Rorem; writers Gore Vidal, Tennessee Williams, Truman Capote, and Jack Kerouac; ghost hunter Hans Holzer; and poet Frank O’Hara. He also became romantically involved with the heiress Alice Bouverie (of the Astor dynasty) as well as with painter Harry Martin and poet Kenward Elmslie, with whom he purchased a country home in Vermont.

Wilhelm Dilthey initially studied theology in Germany but later shifted to philosophy and history. He tackled the specific nature of human sciences in relation to natural sciences and initiated a debate on the connection between understanding and explanation in scientific knowledge. In addition to his own school, he exerted influence on fellow philosophers Martin Heidegger, Helmuth Plessner, and Hans-Georg Gadamer. This chapter explores the formation of Dilthey’s philosophical views, including the principle of phenomenality, the theory of human sciences, and the role of inner experience as the main source of cognition in human sciences. It also discusses his later work and his arguments concerning empirical factuality, congealed objectivity, and processual reality. Finally, the chapter examines how ideas similar to those of Dilthey have influenced organizational culture and dynamics.

Wie kommunizieren Marken? Auch wenn die Konsumenten bestens mit ihnen zurechtkommen, wenn sie ihre Kaufentscheidungen treffen, und die Experten in Marketing- und Rechtsabteilungen ganz selbstverständlich mit ihnen arbeiten, bringt uns diese Frage in Verlegenheit. Brühwilers Studie untersucht die Entstehung des modernen Markenkonzepts. Sie setzt ein mit der Verunsicherung der kommerziellen Transaktionen im Rahmen expandierender Kommunikations- und Transportsysteme um 1840. In der Folge entsteht ein flexibles Bezeichnungsformat, das sich an die Medienumgebung anpasst, in Verwaltungsroutinen einspielt und im internationalen Recht verankert wird. Diese Entwicklung wird von Brühwiler am Beispiel der französischen »marques de fabrique et de commerce« untersucht und anhand von Konflikten im Handel und in der Industrie, von politischen und juristischen Kontroversen sowie der Registrierungspraxis empirisch rekonstruiert. Seit dem ausgehenden 19. Jahrhundert eigneten sich Marken nicht mehr zur Identifizierung von Waren. Stattdessen richtete sich ihre Medienlogik nach dem Erfordernis der Unterscheidung von Angeboten am Markt von Grund auf neu aus. Die kommerzielle Kommunikation wurde so vom Verweis auf spezifische Qualitäten und Herkünfte der Ware entlastet. Der Wandel von der Identifizierung zur Unterscheidung konnte jedoch nicht kurzerhand dekretiert werden. Er vollzog sich vielmehr im Zusammenspiel kleiner Verschiebungen: in den Bestimmungen des Rechts, in der Orientierung der Akteure und in der administrativen Fixierung. Die in diesem Buch entwickelte Geschichte erschließt so die Karriere moderner Verlegenheiten im Umgang mit Marken und verweist die theoretischen Verkürzungen des Gegenstands auf eine medienhistorische Dynamik.

The classic foundational status that Hobbes has been afforded by contemporary international relations theorists is largely the work of Hans Morgenthau, Martin Wight, and Hedley Bull. They were not unaware that they were to some extent creating a convenient fiction, an emblematic realist, a shorthand for all of the features encapsulated in the term. The detachment of international law from the law of nature by nineteenth-century positivists opened Hobbes up, even among international jurists, to be portrayed as almost exclusively a mechanistic theorist of absolute state sovereignty. If we are to endow him with a foundational place at all it is not because he was an uncompromising realist equating might with right, on the analogy of the state of nature, but instead to his complete identification of natural law with the law of nations. It was simply a matter of subject that distinguished them, the individual and the state.

Cajal’s last will and testament bequeathed his scientific materials to his disciples at the Cajal Institute and his personal belongings to his family. The mysterious dream book of Santiago Ramón y Cajal was not among the two thousand extant manuscripts; scholars generally assumed that the unpublished work was lost during the Spanish Civil War. In fact, Cajal’s unfinished dream book was not a formal manuscript but, rather, a collection of loose sheets of used paper and notes composed in the margins of newspapers and magazines. It was never formally published as a book. Just before he died, Cajal surreptitiously handed over this material to José Germain Cebrían, who dutifully typed up the scattered diary into a proper manuscript, although Cajal’s calligraphy often was illegible, including numerous errors, deletions, and blank spaces. The dream diary finally surfaced in November of 2014 when Cajal’s work became public domain.

For a long time, his concept of the ‘normative force of the factual’ has been part of the fixed vocabulary of constitutional and political theory. Celebrated as a masterpiece on its publication, his opus magnum ‘Allgemeine Staatslehre’ was quickly translated into all the world’s languages. For Max Weber, Jellinek was the only representative of constitutional theory of worldwide standing. Die Beiträge dieses Sammelbandes informieren eine interdisziplinär ausgerichtete Urheberrechtsforschung und diskutieren anhand der Denkfigur der „Tipping Points“ neue Fragen, die eine vernetzte Gesellschaft an das Urheberrecht stellt.
