On August 29, 2016, the Special Tribunal for Lebanon (Tribunal) sentenced a corporate media enterprise and one of its employees for contemptuously interfering with the Tribunal's proceedings in Ayyash, a prosecution concerning the February 2005 terrorist attack that killed former Lebanese Prime Minister Rafiq Hariri. The contempt decision is significant for two reasons: (1) it adopts an expansive definition of the crime of contempt to restrict a journalist's freedom of expression; and (2) it is the first international judicial decision to hold a corporate entity criminally responsible.

This chapter looks into the years that follow the Liberation of 2000, and the political redistribution of power after the Syrian withdrawal of 2005. The abductions of Israeli soldiers by the IRL and the prisoner exchanges with Tel-Aviv, the conservative Christian comeback on the domestic scene, the bittersweet relations with Prime Minister Rafic Hariri, the attacks of September 11 and the American "War on Terror" as well as the end of the Syrian tutelage on Lebanon, were all factors that were perceived as real threats for Hezbollah and the IRL. In reality, a certain Lebanese context, and regional and international considerations would turn these threats into opportunities for Hezbollah to strengthen its mobilization.

Explosions, armed actions, and other militant phenomena have been a recurrent feature of Lebanese politics. The divided political landscape across sects and party formations in the absence of a strong executive institutional mechanism in the aftermath of a protracted ‘civil’ war and a hashed-up cessation of hostilities in a turbulent regional environment has all contributed to a climate where violent acts are a way to conduct politics. As a result, the struggle over meaning and naming significantly shapes political struggles and the possibility for compromise in the Lebanon. Conflicting claims as to which acts are labeled terrorism, and how this war on words is integral to the different political struggles plaguing the country involving other regional state and non-state actors. This chapter will look at two important battles at managing claims of terrorism, one regarding the assassination of Prime Minister Rafic Hariri and the establishment of an international tribunal, and the other involving a Islamist targeted campaign waged by Hizbullah against “takfiri” groups such as Al Qaeda and ISIS.

This chapter discusses the troubled effort to create, design, and manage a hybrid judicial process in Lebanon after the assassination of former Prime Minister Rafiq Hariri. It shows how that country’s profound domestic divisions rendered the government unable to issue a clear delegation of sovereign authority. The UN Security Council therefore imposed a hybrid tribunal on Lebanon, and its legitimacy has been challenged from the start. Without strong domestic cooperation, the tribunal has been highly constrained, unable to apprehend suspects or conduct extensive outreach in the country. The Special Tribunal for Lebanon thus epitomizes the dangers of a fragile political foundation for shared sovereignty.

This chapter investigates the influence of the long memory behavior in returns and volatility on the market risk for four emerging stock markets during the pre- and post-crisis periods. In this respect, the authors consider four major political events (Tunisian revolution, Egyptian revolution, assassination of Prime Minister Rafik El Hariri, and a series of suicide bombings in Morocco). Using the modified R/S test and GPH test, they show the long memory property in returns and volatility over the two sub-periods. To explore the dual long memory property, the authors apply the joint ARFIMA–FIGARCH specification on the returns and volatility of the four emerging stock markets. The dual long memory property is prevalent in the returns and volatility of the emerging stock markets over the pre-crisis period. During the post-crisis period, the dual long memory process is only detected in the Moroccan market. The authors also display the dynamic behavior of VaR during the two sub-periods. In addition, based on the backtesting test, VaR performed better during the two sub-periods for all countries.
