<p>Earthquakes can cause considerable fatalities, injuries and financial loss. The forces of nature cannot be blamed, as the problem lies with the structures in seismic regions that may not have been designed or constructed to a sufficient degree to resist earthquake actions or they may have design flaws. This Structural Engineering Document (SED) concerns reinforced concrete and masonry buildings together with geotechnical aspects and presents in a concise and practical way the state of the art of current understanding of building failures due to earthquakes. It classifies the different types of seismic failure, explains the reasons for each failure, describes good practices to avoid such failures and also describes seismic retrofitting/upgrading procedures for pre-earthquake strengthening and post-earthquake repair and/or strengthening techniques for deficient buildings. Carefully selected photographs and diagrams illustrate the different failure types. This document could be considered as quite unique, as this is the first time such material concerning characteristic seismic failures of buildings has been presented together in one single document. It is intended to be a valuable educational reference textbook aimed at all levels of experience of engineers. This is why, right up to the present, the French public debate has been marked by an entrenched suspicion towards all forms of «communitarism», and by the proscription of the very concept of multicultural politics. But have the policies actually pursued by republican France been consistent with the proclaimed principles? Is it genuinely possible to claim that cultural identities have never been publicly «recognised»? This multidisciplinary investigation proposes to address the ambiguous relations between theory and practice in the Republican management of cultural pluralism.

INFORUM is a research project started more than forty five years ago by Clopper Almon. The focus is on the development of dynamic, interindustry, macroeconometric models to forecast the economy in the long run. Over the last 30 years, the Inforum approach to model building has been shared by economists in many different countries. Researchers have focused much of their efforts to developing a linked system of international interindustry models with a consistent methodology. A world-wide network of research associates use similar methods and a common software obtaining comparable results to produce studies of common interest to the group. Inforum partners have shared their research in an annual conference since 1993. The XXII Inforum World Conference was held in Alexandria, Virginia in September 2014 and this book contains a selection of papers presented during the sessions. All these contributions share an empirical and pragmatic orientation that is very useful for policymakers, business, and applied economists. Some papers are devoted to specific topics (productivity, energy, international trade, demographic changes) and some others are oriented to model building and simulations.

Im Rahmen dieses Zukunftsberichtes sollen Einblicke in aktuelle Forschungsprojekte und Ergebnisse studentischer Forschungsarbeiten der Professur für Marketing der CAU Kiel gegeben werden, die sich mit dem Wandel hin zu nachhaltigerem Konsumentenverhalten beschäftigt. In qualitativen Analysen wird die Einstellung von Konsumierenden zu Themen wie dem Fleischkonsum, der Undurchsichdigkeit inflationärer CO2-Labels, dem Phänomen Flugscham und der Frage nach Nachhaltigkeits-Lehre in der Schule, beleuchtet. Scrivere di Islam. Raccontare la diaspora (Writing About Islam. Narrating a Diaspora) is a meditation on our multireligious, multicultural, and multilingual reality. It is the result of a personal and collaborative exploration of the necessity to rethink national culture and identity in a more diverse, inclusive, and anti-racist way. The central part of this volume – both symbolically and physically – includes Shirin Ramzanali Fazel’s reflections on the discrimination of Muslims, and especially Muslim women, in Italy and the UK. Looking at school textbooks, newspapers, TV programs, and sharing her own personal experience, this section invites us to change the way Muslim immigrants are narrated in scholarly research and news reports. Most importantly, this section urges us to consider minorities not just as ‘topics’ of cultural analysis, but as audiences and cultural agents. Following Shirin’s invitation to question prevailing modes of representations of immigrants, the volume continues with a dialogue between the co-authors and discusses how collaboration can be a way to avoid reproducing a ‘colonial model’ of knowledge production, in which the white male scholar takes as object of analysis the work of an African female writer. The last chapter also asserts that immigration literature cannot be approached with the same expectations and questions readers would have when reading ‘canonised’ texts. A new critical terminology is needed in order to understand the innovative linguistic choices and narrative forms that immigrant writers have invented in order to describe a reality that has lacked representation or which has frequently been misrepresented, especially in the discourse around the contemporary Muslim diaspora.

Recently, public policies of urban regeneration have intensified and multiplied. They are being promoted with the aim to start social and economic dynamics within the local context which is subject to intervention. From the empirical analysis, we realise that such activities are mainly implemented by three subjects or by mixed coalitions (public institutions, actors of the third sector and companies). Within them, each player is moved by a multiplicity of interests and goals that go beyond their own nature – public interest, market and mutualism – and tend to redefine themselves, thus becoming hybrid forms of production of value (social, economic, cultural). By studying a number Italian and Catalan cases, this essay deals with the theory that, under specific conditions and configurations, a collaborative direction – of organization, production and design – would give life to successful procedures, even without the identification of a one-best-way. The collaboration is not simply a choice of operation, but a real production method which mobilises social resources to create hybrid solutions – between state, market and society – to complex issues that could not be faced solely with the use of the rationale of action of one among the three actors. In this framework, the systems of relations and interactions between players and shared capital become an essential condition for the success of every initiative of urban redevelopment, or failure thereof. Such initiatives are brought to life by the strategic role of individuals who foster connections as well as the dissemination of non-redundant information between social networks, and collective and individual actors which would otherwise be separated and barely able to communicate and collaborate with each other. In addition to the functions carried out by knowledge brokers, that have been extensively described in organisational studies and economic sociology, the aforementioned figures act as real social enzymes, that is to say, they handle the available information and function as catalysts of social processes of production of knowledge. Moreover, they increase the reaction speed, working on mechanisms which control the spontaneity.

The Faculty of Political Science of Florence – the oldest school of political and social science in Italy, founded in 1875 by Carlo Alfieri and named after his father Cesare – has a tradition of study that is widely recognised, even abroad, to which the cultural project of this series is related. The first book is dedicated to the research activity carried out by Luciano Cavalli and the profound traces that it has left on Italian and European sociology. Now Professor Emeritus, Luciano Cavalli taught and worked at the "Cesare Alfieri" for many years from 1966 on. Around his commitment as a "pioneer" of sociology in Italy he mustered an array of sociologists, active in different universities, many of whom have opened up new frontiers within the discipline and have successfully cultivated a dialogue with the other social sciences, as the contents of the book clearly illustrate. This extensive collection of essays offers a clear image of the fertile sociological work that burgeoned around the scientific commitment of Luciano Cavalli and was often generated by his own action of cultural stimulus. Today, in a modern market economy, one of the main factors of production is the labor market. The labor market and its mechanisms regulate the levels of employment of the population, supply and demand for labor, the level of wages, and the characteristics of the distribution of labor. To study the labor market, it is necessary to collect statistical data and analyze them. Labor market statistics are an important component of socio-economic statistics. It is closely related to other sections of socio-economic statistics, such as population statistics, statistics of economic sectors, the system of national accounts, etc. The conclusions drawn from the statistical study of the labor market characterize the state and development of the economy and are necessary for making informed economic and social decisions. The main branch of law that regulates relations in the labor market is labor law. It is one of the leading, complex and most important branches of law in the Russian Federation. Conditional probability has been put to many uses in philosophy, and several proposals have been made regarding its relation to unconditional probability, especially in cases involving infinitely many alternatives that may have probability 0. This chapter briefly summarizes some of the literature connecting conditional probabilities to probabilities of conditionals and to Humphreys' Paradox for chances, and then investigates in greater depth the issues around probability 0. Approaches due to Popper, Rényi, and Kolmogorov are considered. Some of the limitations and alternative formulations of each are discussed, in particular the issues arising around the property of “conglomerability” and the idea that conditional probabilities may depend on a conditioning algebra rather than just an event.

This chapter explores a third way in construing modality—rejecting both linguistic accounts and the polycosmism of possible world theory—in the work of Alexis Meinong and Jan Łukasiewicz. Some of Meinong’s non-existent objects are incomplete, so in 1915 he accounts for objective probability (he says possibility) with an idea of degrees of truth: the proposition ‘My draw of a card from the pack tomorrow will be a king’ is neither simply wholly true nor wholly false, regardless of the draw I will actually make tomorrow, but has a degree of truth corresponding to the proportion of kings in a pack, between 0 and 1. Łukasiewicz, inventor of fuzzy logic, visited Meinong in Graz, and in 1913 published his own work on probability, suggesting some propositions are indefinite and have truth values between and 0 and 1; then in 1917 he began to extend this to definite propositions about future contingencies.

This chapter argues for a kind of dogmatism (though not the sort famously defended by Jim Pryor): that you can retain knowledge even if you spend significant time with an argument, find each step compelling, and are unable to expose a flaw. It is uncontroversial that knowledge can survive some such counterarguments: trick arguments that 1=0, paradoxical arguments that nothing moves, perceptual arguments that a rabbit has spontaneously appeared in a previously empty hat. But, debates in the literature on disagreement aside, knowledge can survive such counterarguments even when they concern controversial matters of ethics, politics, religion, science, and philosophy. You often have what would otherwise count as knowledge-level positive support for your controversial beliefs. This support is often not defeated by what turns out to be the rather weak evidence provided by the fact that a counterargument is apparently flawless.

Approximately 1 in 65,000 children develops end-stage renal disease (ESRD) each year with almost 1200 children (aged 0–19 years) in the United States developing ESRD annually. Kidney transplantation is the primary method of treating ESRD in the paediatric population. The special issues in children and adolescents with ESRD include achieving normal growth and cognitive development. This chapter discusses the advances in surgical techniques, patient selection, transplant evaluation/preparing for transplantation, postoperative management (including fluid management in infants and small children), and the evolution of immunosuppressive drugs that have resulted in improved quality of life and a reduction in the mortality rate of children with chronic renal failure.

El RBS-R es una escala que evalúa las conductas repetitivas mediante 43 ítems mediante seis dimensiones distintas de comportamiento repetitivo en los individuos con trastornos del espectro autista y discapacidad: conductas estereotipadas, autolesivas, compulsivas, perseverantes, rituales y restrictivas. Los ítems se clasifican en una escala likert de cuatro puntos, desde 0 que hace referencia a un comportamiento repetitivo que no se produce hasta la puntuación de 3, equiparable a un comportamiento repetitivo muy grave. This entailed a variety of strategies including workshops, a leadership academy designed specifically for NPOs, individual and small group consultations, coaching, and personnel resources including placing graduate student interns and VISTA volunteers. The chapter also summarizes initial recommendations for systems development to create a coordinated system of care in each neighborhood, with a focus on youth development programming for those between the ages of 0 and 18. It ends by describing the youth development strategy that the Skillman Foundation ultimately pursued, as well as efforts to support the alignment of youth programming across the domains of youth development, youth employment, and career-themed education.

The chapter presents a proposition that takes into account a condition relating to the conservation of momentum as well as a condition that reflects Newton's law, which states that every action must have an equal and opposite reaction. This axiom, in turn, implies the conservation of momentum in classical mechanics. In view of Noether's theorem, the constant vector fields which act as Galilean symmetries of the Euler equation are responsible for the conservation of momentum. The chapter shows proof that all solutions to the Euler-Reynolds equations conserve momentum.

This chapter describes the six most widely used generic preference-based measures of health (GPBMs) (also known as multiattribute utility scales): EQ-5D, SF-6D, HUI, AQoL, 15D, and QWB. GPBMs have become the most widely used method for obtaining health state utility values. They contain a health state classification with multilevel dimensions that together describe a universe of health states and a set of values (where full health = 1 and dead = 0) for each health state obtained by eliciting the preferences (typically) of members of the general population. These measures are reviewed in terms of their content, methods of valuation, the scores they generate, and the possible reasons for the differences found. Their performance is reviewed using published evidence on their validity across conditions, and the implications for their use in policy making discussed. The chapter also reviews the generic measures available for use in populations of children and adolescents.

In modern anaesthesia practice, hypnotic drugs, opioids, and neuromuscular blocking agents (NMBAs) are combined. The introduction of NMBAs in particular substantially increased the risk of awareness and recall during general anaesthesia. Hypnotic drugs such as propofol and volatile anaesthetics act through GABAA receptors and have typical effects on the electroencephalogram (EEG). During increasing concentrations of these pharmaceuticals, the EEG desynchronization is followed by gradual synchronization, slowing frequency, and increasing amplitude of EEG, thereafter EEG suppressions (burst suppression), and, finally, isoelectric EEG. Hypnotic depth monitors such as the Bispectral Index™, Entropy™, and Narcotrend® are based on quantitative EEG analysis and translate these changes into numbers between 100 and 0. Although they are good predictors of wakefulness and deep anaesthesia, their usefulness in prevention of awareness and recall has been challenged, especially when inhalation anaesthetics are used. External and patient-related artifacts such as epileptiform discharges and frontal electromyography (EMG) affect the signal so their readings need careful interpretation. Their use is recommended in patients at increased risk of awareness and recall and in patients under total intravenous anaesthesia. Monitors of analgesia and nociception are not established in clinical practice but mostly remain experimental although some are commercially available. Some use EEG changes induced by noxious stimulation (EEG arousal) or quantify the frontal EMG in relation to EEG, while others are based on the sympathoadrenergic stress response. Various other devices are also discussed in this chapter.

Using decomposition methods, we analyse the role of the changing nature of work in explaining changes in employment, wage inequality, and job polarization in Chile from 1992 to 2017. Changes in occupational structure confirm a displacement of workers from low-skill occupations towards jobs demanding non-routine higher skills (professionals and technicians), and to jobs demanding routine manual and cognitive tasks (services and sales). Changes in occupational earnings have had an equalizing effect, with more substantial gains in favour of lower-skill occupations and also at the top of the skill premium. Inequality reductions since the 2000s are explained by a fall in earnings in the top percentiles of the distribution, which have been reallocated most noticeably around the median (2000–06) and the bottom 30 per cent (2006–17). Changes in the returns to education and the relocation of workers towards less-routine occupations have contributed to the inequality reduction.

In this paper we analyse informal work in Mexico, which accounts for the majority of employment in the country and has grown over time. We document that the informal sector is composed of two distinct parts: salaried informal employment and self-employment. Relative to self-employment and formal salaried employment, on average informal salaried workers have lower wages and lower job quality as measured by an index. Education plays a different role in job matches and job transitions, depending on the type of informal employment. Well-educated workers are more likely to use informal salaried work as a stepping stone into formal salaried work, and are less likely to leave the formal sector once there. Less well-educated workers have higher exit rates from formality and shift more across informal sector jobs. For these latter workers there is more evidence that informal salaried work represents jobs of last resort rather than jobs of opportunity.

From the early days of national independence in 1975, the central aim of the educational policy in Mozambique has been to ensure that all school-age children have access to school and can remain there until they have completed their basic education. In the pursuit of this aim, the extension of access to primary education was achieved relatively successfully, given that it reached a net rate of school coverage of almost 100 per cent. However, the impressive increase in school attendance rates has not been accompanied by a corresponding improvement in the quality of learning, and there are worrying signs of a considerable setback in relation to this aspect. Using this observation as a starting point, the study identifies and analyses the variables in the institutional context behind ‘schooling without learning’. The results of the study point to (i) weak state capacity; (ii) excessive dependence on external aid; and (iii) poor community involvement and participation in school management, as being factors with a major influence on the poor quality of education in primary schools.

As the current strategy based on natural resources seems to be failing, we suggest an alternative balanced growth strategy in the context of an effective democratic political system. The municipality of Marituba, Metropolitan Region of Belém - RMB, has suffered environmental impacts due to irregularities in the landfill operation implemented in 2015, which triggered social impacts perceived by all the population, including neighboring municipalities, such as Ananindeua and Belém Protests were carried out by the Movement Outside the Garbage that is constituted by the dwellings of the surrounding neighborhoods to the place where the embankment is located, of owners of commercial activities linked to the tourism and Non Governmental Organizations that interrupted several times the transit of the main route that interconnects the seven municipalities of the RMB and the entrance of the embankment, in order to draw the attention of the municipal public power to the problems that the population would have been facing ever since. From this, the following questions arose: What social impacts would people be making in these protests? Would such problems be directly related to the activities carried out in the landfill? And finally, what are the actions of the public authority and the company that manages the enterprise in the management of these social impacts? The relevance of this study concerns not only the identification of social impacts considering the fragility of this approach in the Environmental Impact Studies and concomitantly in the Reports of Environmental Impacts, but also, from the point of view of the debate about the licensing process of enterprises of this nature and employment and the need for the joint use of environmental and urban policy instruments, considering that RMB municipalities have not yet used sustainable alternatives for the reduction of solid waste produced in their territories, as well as the reduction of environmental impacts caused by dumps , and in the case of Marituba, of the landfill that operates outside the standards established by the Brazilian Association of Technical Standards - ABNT, which is responsible for the management and treatment of solid waste and the National Policy on Solid Waste - PNRSN.

This study sought to examine the main constraints to manufacturing export competitiveness in Tanzania. Using panel data for the period 1997–2018, the study established that supply-side factors dominate demand-side factors in explaining manufacturing export competitiveness. Specifically, the results revealed that foreign direct investment and tariffs have a negative and significant effect on export competitiveness in Tanzania, while infrastructure, total investment, labour productivity, and high institutional quality enhance manufactured exports. The study also showed scope for quality upgrading through technology diffusion as well as deeper integration of Tanzania’s nascent global value chains by building on existing competencies and negotiating deep trade agreements to increase market reach. Accordingly, measures to increase investment in infrastructure, strengthen institutional frameworks, and further develop human capital can boost export competitiveness in Tanzania. In addition, export competitiveness can be enhanced through reduction of tariffs and incentives to use cheaper value-adding intermediate inputs.

Abstract:
De la novela de tema indígena puede decirse que es uno de los filones más visibles de la literatura latinoamericana, y frente a su estudio crítico puede concluirse que se ha consolidado en la obra de autores que, como José Carlos Mariátegui y Antonio Cornejo Polar, son hoy grandes referentes del pensamiento social. Con todo, la apropiación especializada del tema aqueja algunos problemas. Uno de ellos remite a la terminología empleada para describir y clasificar las novelas: no parece haber consenso sobre lo que podría entenderse por indigenismo, y lo mismo puede decirse de otros términos usados para distinguir las novelas según el grado de su proximidad o de su intención reivindicatoria respecto al universo indígena. Pero quizá no sea esa la dificultad cuya solución es más apremiante, pues, para cualquier estudio localizado, siempre será un conveniente punto de partida entender las obras recopiladas como novelas de tema indígena. Más problemático es el alcance de la iluminación crítica o, más exactamente, la manera como esta ha conformado sus corpus. Las novelas colombianas suelen no ser consideradas en los estudios sobre el indigenismo latinoamericano, los cuales se han concentrado en las ficciones que tienen como escenario a las sierras andinas y las tierras bajas de Ecuador, Perú y Bolivia. Pero la vida indígena que tiene lugar en espacios como esos ha sido, también, tema frecuente de la novela colombiana, y e incluso puede decirse lo mismo si apenas se considera la producción de una región particular del país. Los escritores antioqueños, por ejemplo, han publicado novelas de tema indígena al menos desde 1896, y ha ocurrido así hasta nuestros días. El presente libro pretende hacerlo patente, y no solo con la idea de llamar la atención sobre unas obras injustamente excluidas como objeto de la reflexión crítica continental: también lo hace –o sobre todo– con el propósito de aportar inventarios, datos y reflexiones que puedan dar pie a un estudio sistemático de la novela de tema indígena por parte de los mismos académicos colombianos.

Abstract:
Los acuerdos firmados por el gobierno con las FARC-EP, movimiento insurgente que ha tenido como una de sus banderas de lucha la reivindicación campesina en materia de tierras, ha puesto el principal énfasis en el campo. Como simples académicos de la juridicidad colombiana, pensamos que la negativa plebiscitaria solo ha sido un traspié transitorio que podrá ser enderezado, y que –esa es nuestra esperanza–, Colombia se alista a pasar la página de la infame guerra interna que durante los últimos cincuenta años ha asolado nuestros campos y ciudades. Es esta una guerra que, además, ha venido suscitando numerosos conflictos de orden jurídico relacionados con el dominio de bienes inmuebles, motivo por el cual, en el caso de que finalmente prospere la paz, deberán ser tratados y resueltos en el posconflicto, dentro de una macropolítica para su formalización, que deberá brindar los espacios jurídicos adecuados para incrementar la riqueza de vastos sectores poblacionales, pues la realidad es que la propiedad, como medio primario generador de riqueza, deberá representar entre 50% y 60% del patrimonio de las familias para asegurar su prosperidad o al menos su estabilidad económica. Así, la búsqueda de un proceso judicial, que brinde trámite expedito para declarar la pertenencia y sanear títulos con falsa tradición, deber tener firmes efectos positivos colaterales en la reducción de la pobreza. Confiamos, entonces, en que bajo el esquema del nuevo procedimiento oral que acoge el C.G.P. se logre este sentido propósito nacional. De otro lado, en cuanto a los predios rurales, la certeza de titularidad de su dominio resulta ser piedra angular para el desarrollo del sector agropecuario, pues ello apareja sustanciales mejoras en la calidad de vida de los campesinos, puesto que, al incrementarse su patrimonio, tendrán mayores posibilidades de acceder a créditos para financiar inversiones a largo plazo. Todo ello resulta imprescindible si se quiere promover efectivos proyectos productivos y se pretende su verdadera ejecución; con ello, sin duda, se logrará una mayor y más eficiente explotación agrícola, como también la implementación y desarrollo de los necesarios planes y programas de sustitución de cultivos. Teniendo en cuenta todo lo anterior, esto es, pensando en el marco de una Colombia del posconflicto, hoy la Facultad de Derecho de la Universidad Libre de Bogotá se complace en entregar a la comunidad jurídica la presente obra, en donde se recoge el pensamiento y posición jurídica de los docentes del área de Derecho Procesal. El libro que se titula La prescripción adquisitiva consta de siete capítulos, cuya autoría corresponde a sendos docentes del área de Derecho Procesal de la Facultad de Derecho, y en cada uno de ellos se abordan diferentes temáticas relacionas con el proceso de pertenencia. En el primer capítulo, denominado “Introducción al proceso de declaración de pertenencia”, cuyo autor es el Dr. León José Jaramillo Zuleta, se desarrolla el concepto de los derechos reales, sus características, la posibilidad de ser adquiridos a través del proceso de pertenencia y los efectos de dicha declaración; además, se profundiza sobre el alcance social del derecho de propiedad, la función social de la declaración de pertenencia, la declaración de pertenencia vía de acción y de excepción, oponiéndose el autor a esta última forma procesal, considerando que el poseedor demandado en el proceso, por ejemplo, el reivindicatorio, deberá necesariamente hacer uso de la demanda de reconvención para ser declarado propietario del bien por prescripción adquisitiva. El autor igualmente diserta y enfatiza acerca de la necesidad de unificar el proceso de pertenencia, y siguiendo esta línea de pensamiento, toma partido por la derogatoria tácita de la Ley 1561 de 2012, aunque deja a salvo la vigencia de las normas sustanciales de dicha ley, dentro de las cuales incluye las normas sustanciales de la prescripción adquisitiva de las viviendas de interés social contenidas en la Ley 9 de 1989 y las referidas a los predios agrarios. Por último, en dicho trabajo se señala de manera muy precisa cuáles son los bienes que pueden ser objeto de prescripción, quedando absolutamente claro, según su punto de vista, que apoya en referencias históricas, que quedan excluidos los que pertenecen a entidades de derecho público. En el segundo capítulo, denominado “Aspectos sustanciales de la prescripción adquisitiva”, cuyo autor es el suscrito, como indica el título del capítulo, se desarrollan los aspectos sustanciales que regulan este modo particular de adquisición de derechos reales respecto de cosas ajenas, como lo es la prescripción adquisitiva; en él se precisa que los derechos reales, salvo excepciones, son objeto de prescripción adquisitiva respecto de bienes muebles o inmuebles; se indica cuáles son los requisitos para la prosperidad de la pretensión de pertenencia; se hace un estudio acerca de la agregación de posesiones, la interversión del título, la posesión regular y la irregular, la suspensión, interrupción y renuncia de la prescripción adquisitiva, el enfrentamiento legal entre la prescripción adquisitiva y la pretensión de reivindicación, y por último, se hace un estudio de la más importantes reformas al derecho sustancial, en las leyes 9 de 1989, 791 de 2002, 1183 de 2008, 1561 de 2012 y 1564 de 2012.

Abstract:
Sin duda alguna, presentar un libro es un reto, más aún en un tema tan amplio y complejo como es el derecho comercial. No obstante, cuando se nos propuso acometer una tarea de tal magnitud, la aceptamos por esa inclinación que nos conduce a los seres humanos a buscar, investigar, indagar y, esencialmente, a conocer. Desde luego, en aquel momento no podíamos saber a profundidad lo interesante o no que podría resultar la obra que teníamos en las manos y, por tanto, lo que nos impresionaba era su título, la denominación de los capítulos que lo integraban y, principalmente, la trayectoria de sus autores que, de antemano, nos llevaban a presagiar la rigurosidad con la que se acercarían a los temas abordados. Sin más y entendiendo que presentar es dar a conocer algo al público, comenzaremos reflexionando sobre la pertinencia de su título, intentando esclarecer si este refleja su contenido o sólo es una manera de llamar la atención de los lectores. “Estudios contemporáneos de derecho mercantil”, nombre con el cual los coordinadores y los autores decidieron designar la obra, sugiere primordialmente dos cuestiones: la primera se refiere a la categoría de “Estudios”, indicativa en que cada uno de los capítulos que lo integran es el resultado de un trabajo que implicó conocimiento, análisis y, en especial, la comprensión de uno o más problemas para ofrecer respecto a ellos posibles soluciones, ejercitando el entendimiento individual y, a su vez, moviendo la frontera del conocimiento de la ciencia jurídica. La segunda categoría sugiere al lector que los objetos de investigación sobre los cuales se basa el libro se relacionan con temas propios de la actualidad y que, por lo tanto, indagar ellos es importante por cuanto ayuda a la construcción de soluciones a retos que enfrenta la sociedad. Después de haber leído cada uno de los capítulos que componen el libro, podemos afirmar que su título hace justicia, con los objetivos que los doce autores se trazaron, resaltando que, a diferencia de muchos textos del derecho privado, en él se encuentran verdaderos frutos del intelecto y no simplemente un compendio de normativa comentada, por lo cual los lectores podremos observar con rapidez que, sin abandonar las fuentes del derecho, los once estudios presentados rebasan visiblemente la fase descriptiva, logrando situarse en un escenario superior, en el que a partir de preguntas, se sugieren posibles respuestas y, posteriormente, logra corroborarse la hipótesis planteada, es decir, se muestran como auténticos resultados de investigación. Ahora, respecto a la actualidad de los estudios o mejor a su contemporaneidad, cada una de las preguntas planteadas que orientaron las investigaciones, se refieren a temáticas del derecho que están en boga y cuyo aporte a su discusión son de interés para la sociedad, como escenario en el que nacen y se tejen las relaciones entre las personas y que a su vez son reguladas por la normatividad, resultando así de importancia tanto para los estudiantes como para los investigadores, litigantes, jueces e incluso para el ciudadano no relacionado profesionalmente con la ciencia jurídica. Para profundizar un poco en las características intrínsecas del libro, aceptando que presentar también implica hacer referencia a las cualidades de algo o alguien, quisiéramos manifestar por qué la lectura de las páginas que integran el libro resultan de importancia para los grupos a los que se hizo referencia. El derecho mercantil es un área dentro de la ciencia jurídica que, como consecuencia de la clasificación del derecho, en público y privado, parece ajena al diario vivir de las personas y de sus derechos, llegando al punto de que, un ciudadano no instruido en las Facultades de Derecho podría considerarse ajeno a sus disposiciones. Pese a ello, una de las principales cualidades del texto es la comprensión del derecho mercantil como una disciplina en la que el protagonista no es únicamente el empresario, como por lo general suele afirmarse, sino el consumidor, sin que con ello se desconozca que hoy se habla de la existencia del derecho del consumo o del consumidor. Dicha comprensión del derecho mercantil comprende que el empresario o comerciante ejecuta todos sus actos, celebra contratos, se asocia y contrae obligaciones, con el objetivo de organizar, ejecutar su actividad comercial para atraer consumidores que pueden ser, personas naturales o jurídicas, comerciantes y no comerciantes, por lo cual esta disciplina jurídica no puede ser ajena a la regulación que frente al consumidor se expida. Teniendo dicho faro como norte, uno de los capítulos que contiene la presente obra es el escrito por Iván Darío Taborda que con suma contundencia evidencia la necesidad de reglamentar la responsabilidad por servicio defectuoso. Una de las virtudes del mencionado capítulo es la de tomar las disposiciones que regulan el tema, analizarlas meticulosamente, revisar su aplicación y, finalmente, detectar la anomia que existe frente al servicio defectuoso en Colombia. Es de resaltar que, además de retomar las fuentes del ordenamiento nacional, el jurista revisa cómo la Ley ha organizado el objeto de investigación en otros sistemas jurídicos. Además, el capítulo le será sumamente valioso al estudiante, pues ejemplifica el problema, con lo cual se atiende a una de las necesidades que el científico Rodolfo Llinás considera imprescindibles a la hora de enseñar, esto es, logra darles contexto a los conceptos que analiza1, dejando así al abogado en formación en capacidad de recrear el problema y darle posibles soluciones, animando el espíritu propositivo y reflexivo al permitir contradecir o apartarse de la conclusión a la cual el autor arriba.
