Abstract:
This book is the outcome of a new method of investigating the life experiences of health personnel engaged in paediatric oncology. It brings together the results of individual interviews with each member of the medical, nursing and technical staff in the Paediatric Oncology Department of the University Polyclinic of Padua and the Giannina Gaslini Institute of Genoa. The interviews, prepared using an open questionnaire format, were carried out by qualified personnel, after which the results were analysed and illustrated to the group of health care professionals involved. The two experiences, which are extremely significant in view of the distinction of the two centres of excellence involved, are compared and discussed with a view to making an interesting contribution to the debate on the delicate issues of bioethics implicated in problems connected with the end of life during the developmental stage.

Abstract:
The debate on accountability within the public sector has been lively in the past decade. Significant progress has been made in developing conceptual frameworks and typologies for characterizing different features and functions of accountability. However, there is a lack of sector specific adjustment of such frameworks. In this chapter we present a framework for analyzing accountability within health care. The chapter makes use of the concept of “accountability regime” to signify the combination of different accountability forms, directions and functions at any given point in time. We show that reforms can introduce new forms of accountability, change existing accountability relations or change the relative importance of different accountability forms. They may also change the dominant direction and shift the balance between different functions of accountability. The chapter further suggests that developments in accountability regimes are best analyzed with a combination of top-down and bottom up perspectives and that there is a need to develop research strategies to support this aim.

Abstract:
This chapter examines how depression affects health care decisions, with particular emphasis on patient autonomy, capacity, and competence for decision-making. It first considers the ethical boundaries and psycho-legal criteria for assessing decision-making capacity in the context of medical treatment decisions, attending to issues of autonomy and beneficence as well as the debate over whether paternalistic approaches have a place in our health care system. It then discusses the parameters that help define the debate over paternalism, along with the clinical challenges that accompany the assessment and implementation of these alternative approaches to health care decision-making. The chapter also reviews research exploring the impact of depressive symptoms on decision-making capacity and treatment refusal more specifically. It cites the doctrine of informed consent, the goal of which is to promote patient autonomy and rational decision-making. The chapter concludes with recommendations for a comprehensive approach to decision-making capacity assessment and directions for future research.

Abstract:
The specific context of community mental health care affects the debate surrounding coercion in psychiatry, not by raising radically new questions but by highlighting the complexity of this debate and some of the associated ethical difficulties. This chapter begins by looking at the varying conventional justifications for involuntary treatment and then considers the different mechanisms through which such ‘coercion’ is enforced within the community—from formal compulsion via community treatment orders (CTOs) through to ‘softer’ pressures, such as ‘persuasion’ or ‘interpersonal leverage’. Some commonly accepted ideas surrounding interventions such as ‘incentives’ and ‘threats’ are challenged. The chapter concludes with some broad suggestions as to a how a reformulated ‘decision-making capability and best interests’ approach may be one way to increase the ethical viability of community coercion.

Abstract:
A debate on public goods is urgently needed in health care. Care must be recognized as a social function, as an occupation and, at the same time, as a human right—which imposes binding obligations to comply with precise standards of quality, quantity, suitability, adaptability, and accessibility, among others. It is a complex and invisible task, that may be done as part of a medical treatment, post-surgical recovery process, or permanent support in cases of chronic illness, disability, or mental health conditions. And it tends to be provided mainly in the home, by women, without remuneration. In Latin America, care has not been included in a coordinated and specific public health policy agenda but has been advanced through isolated actions—in many cases highly fragmented and heterogeneous—without a clear awareness of the public nature of care and the associated responsibility of the State. Accordingly, this document takes a gender and rights-based approach. It starts with an analysis of the main definitions of unpaid work in the health sector, and then focuses on initiatives in three Latin American countries (Colombia, Costa Rica, and Uruguay) with regard to measurement, valuation, integration, and recognition in national health systems or policies, in care models, and in time-use surveys. The conclusions propose recommendations aimed at addressing unpaid care as an essential element of social policies in general, and health policies in particular, from a gender and rights-based perspective.
