AbstractIn the landmark case of MacPherson v. Buick, an automobilecompany was held liable for negligence notwithstanding a lack of privity withthe injured driver. Four decades later, in Henningsenv. Bloomfield Motors, the court held unconscionable the standard automobilecompany warranty which limited its responsibility to repair and replacement, even in a case involving physical injury. This suggests a puzzle: if it were soeasy for firms to contract out of liability, did MacPherson accomplish anything?

Abstract:
Mathematical tasks that give students the opportunity to use reasoning skills while thinking are the most difficult for teachers to implement well. Research by Stein and colleagues (Henningsen and Stein 1997; Stein and Lane 1996; Stein, Grover, and Henningsen 1996) makes the case resoundingly that cognitively challenging tasks that promote thinking, reasoning, and problem solving often decline during implementation as a result of various classroom factors. When this occurs, students must apply previously learned rules and procedures with no connection to meaning or understanding, and the opportunities for thinking and reasoning are lost. Why are such tasks so difficult to implement in ways that maintain the rigor of the activity? Stein and Kim (2006, p. 11) contend that lessons based on high-level (i.e., cognitively challenging) tasks “are less intellectually ‘controllable’ from the teacher's point of view.” They argue that since procedures for solving high-level tasks are often not specified in advance, students must draw on their relevant knowledge and experiences to find a solution path. Take, for example, the Bag of Marbles task shown in figure 1.

Abstract:
Mathematics education has been heralded for its leadership role in the U.S. school reform effort (Stein, Grover,&Henningsen, 1996; Grant, Peterson, & Shojgreen- Downer, 1996). Prominent in the reform of mathematics education is the call for students not merely to memorize formulas and rules and apply procedures but rather to engage in the processes of mathematical thinking, that is, to do what mathematicians and other professional users of mathematics do. The revamped mathematics education program is based on engaging students in problem posing and problem solving rather than on expecting rote memorization and convergent thinking. These changes in mathematics education suggest that mathematics teaching must build on students' learning and on their ability to pose and solve problems previously considered too difficult for their age-grade levels (Carpenter&Fennema, 1988; Fennema, Franke, Carpenter,&Carey, 1993).

Full text
Abstract:
There is no Doubt that Sweden, at least from the middle of the seventeenth century to the end of the eighteenth century, belonged to the European countries where legal control of extramarital sex was most extensive. First of all, there was a difference between Protestant and Catholic countries, not in principle but in emphasis and form. The Spanish Inquisition was, for instance, mainly interested in whether people thought that a certain behavior was a sin or not. Religious confessions proved that the sinner realized that he had done something wrong, and he could therefore be treated with a certain mildness afterwards (Benassar et al. 1979; Henningsen et al. 1986). Protestantism, at least in Sweden, tended to be more interested in people's actual behavior, usually leaving the internal spiritual life of the sinner aside. This dichotomy between thought and behavior was of course not total in practice, but it tells us something important about the difference between Catholic and Protestant attitudes towards religious control. Religious homogeneity also explains some of the success of Swedish orthodox Protestantism in creating a system of tight control. There was no escape for dissenters except emigration, since the creed was protected by the civil state.

Abstract:
The newspaper archive is, potentially, the largest untapped source of material concerning the popular belief in witchcraft and magic for the period after the formal cessation of the witchcraft trials in 1736. Several historians have successfully exploited the newspaper archive to examine popular customs in the modern period. However, little use has been made of newspapers to examine magical beliefs in the period defined by the decline of learned belief in witchcraft during the early eighteenth century and the eventual demise of popular belief in witchcraft two centuries later. Writing some fifty years ago, L. F. Newman noted that many witchcraft cases “only appear in the local Press of each district and extensive search is necessary to trace cases.” Newman hoped that his own very brief search would act as a catalyst for more intensive studies. Unfortunately, no one has conducted such work, and our understanding of the extent and influence of witchcraft and magic in the modern period is much the poorer for it. The present discussion, which seeks to begin that task, is based on short searches through various newspapers from around the country, the following up of secondary references, and an extensive, systematic ongoing survey of Somerset newspapers. As Gustav Henningsen has observed, the newspaper has an important advantage over the folklore record in that it “always shows us the tradition in a concrete social context” and also provides a definite chronological basis. The combined exploration of folkloric sources and newspapers provides great potential for the regional study of witchcraft and magic in defined cultural settings.

Full text
Abstract:
The article studies the reflection of Carlist and ‘Liberal’ mythological concepts, formed in 1830s– 1890s in Spain, in the novel Zumalacárregui by Benito Pérez Galdós. There is given a brief overview of some previous research works concerning Galdós´s National Episodes and the novel Zumalacárregui. The paper focuses on the ways of representation of general Tomás de Zumalacárregui (1788–1835) in the novel and shows the processes of creating the myths related to the general. In the 19–20th centuries, Zumalacárregui became a hero for the representatives of three different ideologies: Carlism, Francoism, and Basque Nationalism. It is shown that mythologization of the general began just after his death in 1835. Based on the text of the novel, there are made conclusions concerning the sources that Galdós used when creating it. The writer studied the most relevant memoirs about the First Carlist War. The paper shows how Galdós’s text was influenced by the memoirs of A. Sabatier, Ch. F. Henningsen, F. von Lichnowsky, J. A. Zarátiegui, F. Fernández de Córdoba, and H. Du-Casse. It is also noted that Galdós could have been inspired by some pictures created in the traditions of ‘Carlist visual art’. It is concluded that the writer used both Carlist and ‘Liberal’ myths concerning Tomás de Zumalacárregui. The text of the novel is divided into two parts, ‘historical’ and ‘narrative’. The ‘historical part’, i. e. a general description of the First Carlist War military operations carried out in 1834–1835, is mainly based on Carlist sources. In this part, the general Zumalacárregui is described as a war hero. The ‘narrative part’ mainly refers to ‘Liberal’ sources. The author introduced in this part a fictional character, priest José Fago, being the general’s ‘double’. Through Fago’s moral doubts and hesitations Galdós showed the internal tension of Zumalacárregui.

Full text
Abstract:
Inge Henningsen and Lis Højgaard: The Leaking Pipeline: Snapshots of gendered processes of in- and exclusions in the academic world. Debates on the reasons for the well documented low participation of women in scientific research tend to follow two lines of argument: one that maintains that the low percentage of women in research is a result of few women in recruitment positions and that this will change as more women enter these positions, and one that maintains that a closer look at the statistics does not support this optimism because women’s percentage in recruitment positions is not increasing as the pool of potential female researchers increases, or to put it metaphorically, “the pipeline is leaking women all along” (Alper 1993). This article investigates the mechanisms perpetuating the low participation of women in academic sciences, inspired by Alper’s methaphor. It begins by describing the Danish educational system and structure of science education including gender ratios in the various disciplines. Second it identifies and describes a Danish verion of ‘the leaky pipeline’ from analyses of the ratios of women in science from high school through tenured positions. Finally it illustrates the cultural mechanisms at play in this process, based on the results of three studies. The first two analyze the educational cultures in physics and chemistry, and the third illustrates the gendering mechanisms at work in the institutional culture of medicine. The analysis shows that there is no single cause of the problem and no single point along the career path where women are excluded. Rather more women than men are excluded at all steps on the academic ladder. The problem is no longer manifest exclusion, but rather the working of subtle mechanisms, unintended consequences and the stubborn ingenuity of the symbolic order of gender. The ‘leaks’ are the result of the intersection and interaction of individually mediated negotiations of cultural prescriptions of gendered subjectivity and identities, organizational understandings and procedures embedded in specific university cultures, traditional of different science disciplines, and the systemic logic and political rationale of the education and research system.

Abstract:
