Abstract:
When Joseph Smith founded the Church of Christ in April 1830, he also established the framework for councils, the decision-making mechanism of the early Church. Early councils included a group of men holding the priesthood and often included a congregation. They would gather and make authoritative decisions, including if someone accused of wrongdoing was guilty and should receive formal disciplinary action. As the Church grew, Smith further developed this council system. Elders and high priests frequently formed councils, which gradually gave way to bishop's councils. In 1834, high councils began to establish an appellate court where disgruntled Church members could appeal their case. Later, Smith formed other disciplinary bodies and gave them limited jurisdictional authority. Depending on where they lived, Church members utilized different councils. Kirtland and Missouri principally used a bishop and high council, while other outlying congregations relied primarily on elder and high priest councils. Notwithstanding these organizational differences, early Church councils exhibited several consistent patterns. They encouraged individuals to reform their behavior, provided progressive rights to women and children, and inspired confidence in the system, even though Church leaders sometimes disagreed with individual rulings. Although often overlooked, early Church councils played a pivotal role in protecting and developing Church orthodoxy and orthopraxy.

Abstract:
The Swedish state has participated as an elected member of the United Nations Security Council three times and is entering their fourth. The UNSC is an old institution that is not equal to what powers the states within it has. The permanent states, the victors from the second world war, have a more prominent role in the council and do not have to be elected every two years as the other states that want to be a part of the council. The cost of for small states like Sweden to be a part of the council can be quite large, but in financial means and as a time-consuming task for the foreign department. Therefore, it is essential to know if the time spent in the council for a state like Sweden amounts to something in the sense of influence over the outcome. This bears the question if Sweden has used and is using its membership in the UNSC in an effective manner. By looking at the official documentation by the foreign department and interviewing former diplomats about Sweden’s role in the UNSC during these periods this thesis analyses the way that Sweden has acted before. Furthermore, the thesis also looks at the first five weeks in the current period of 2017. The results are analyzed through a theoretical framework of what should be methods to achieve influence in the UNSC. As the analysis shows, Sweden has moved from being a more passive participant to a more active and proactive part of the UNSC. This, however, can come at the cost of changing other states view of the Swedish state in international relations.

This study was conducted in four Qumbu District schools The literature review enabled the researcher to understand the current discourses in terms of learners’ participation in the governance of schools through the Representative Council of Learners Through the methodological application of triangulation, the study produced data on which findings were based and recommendations made Generally, evidence from the collected data reveals issues worth the attention of the researcher and relevant authorities Some of the evidence in this study was that there is need to involve learners in decision making; that the learners who are elected to be members of the RCL should be provided with orientation and training so that they become aware of the content of policy documentations that govern their roles and responsibilities These RCL members are supposed to be considered as potential decision makers and leaders in their schools It is therefore the responsibility of schools and the Department of Education to provide orientation and training for these learners so as to equip them adequately with leadership information and to develop their skills in order for them to be able to play their roles responsibly In concluding, the researcher believes that solutions to the problems identified can be resolved by considering the recommendations for implementation.

Abstract:
This exploratory research is based on an objectivist epistemology with a positivist theoretical perspective that deployed concurrent mixed methods (MMR) design through a quantitative administered survey alongside an in-depth qualitative analysis through interviews exploring the perspectives of leaders on EHS leadership and governance. The research literature review focused on EHS leadership, corporate governance and strongly related topics. This MMR research employed both an expert panel-validated survey and a semi-structured interview protocol which explored 9 themes which emerged from the literature review including EHS/Safety Leadership; Risk Management; Influence and Accountability. Due to pragmatics relating to the number of leaders accessed (N=30) the statistical analysis is limited to descriptive type statistics. Almost all respondents supported the monitoring role of the Board of Directors (BoD), but disagreed that the BoD should play an active role in risk management. Comparisons are drawn between the Oil and Gas and non-Oil and Gas organizations with interesting results especially in matters relating to risk management. Structured thematic content analysis yields that Safety Culture; Leadership; Influence and Accountability were the three leading themes accounting for just over 50% of the responses analysed. Many sub-themes have also emerged and are discussed. A Model of EHS Leadership and Governance was created and is presented which positions themes and factors that influence monitoring of EHS performance and ultimately risk management. The research can be considered as a unique contribution as a relatively small body of currently published work in this subject area, both globally and more so in the GCC.

Abstract:
The IPCC report from 2013 predicts radical temperature changes in the world the coming years, with a melting ice cap in the Arctic as consequence. According to geological research made by institutes and scholars from the Arctic states the Arctic is likely to hold the last remaining oil and gas resources of the world. The melting ice cap opens up for resource exploitation and for new naval transportation routes between Asia and Europe and North America. There is a debate over what geopolitical implications these natural resources and the new transportation routes will get for the surrounding Arctic states since the existing international regulations in some areas are inadequate. This debate is divided into two camps; one side argues that the Arctic states will act cooperatively when exploiting the resources and navigating the new transportation routes, while the other side predicts violent and conflictive state behavior. The objective of this study is to analyze existing and potential conflicts in the Arctic through the perspective of leading international relations theories in order to make projections of potential Arctic developments. As analytical tool the study applies a conflict analysis framework to structure and categorize both the findings and the analytical chapter. In this qualitative and abductive study the data has been collected through mainly official state and private documents and text analysis of these documents have been used as method. The study concludes that a combination of both cooperation and competition is likely to occur in the Arctic in future, but cooperation will be the first alternative of choice for states rather than conflict.

Abstract:
This study analyzes the process of the diffusion of structures and practices in an organizational setting using the theory of new institutionalism as the theoretical basis. The explanation of the diffusion process has been subject to major variations due to epistemological and ontological reasons. Former theories of organizational reality looked at organizations as their sole units of analyses and accounted for the diffusion process accordingly
however, today, it is widely observed and accepted that organizational behavior is shaped by historical and environmental factors. This investigation aims to provide evidence for how certain structures and practices diffuse through organizational settings while others do not. Consequently, a qualitative design was conducted to explore the diffusion process in the case of the Council of Higher Education, a high-level bureaucratic organization in Turkey. Fifteen key informants, present or former university rectors and members of the Council, were interviewed and the accumulated data were analyzed qualitatively. Also, the findings were matched and supported with relevant documents analyzed additionally. The findings drawn from the investigation indicate that the emergence of the Council implicates a pattern visible throughout the history of Turkish higher education. The Council is spotted as an important agent in redefining Turkish higher education and thus creating a new organizational field for it. Yet, highly dynamic and interactive face of today&rsquo
s higher education calls for reconsideration of the Council and its functions. A major conclusion that can be reached in this context is that the issue of legitimacy depends on the satisfaction of several demands and expectations at various levels. Therefore, even a formal and regulative organization, such as the Council of Higher Education is prone to the pressures of the organizational field it operates within and is called upon to redefine its structures and implementations accordingly in order to secure its legitimacy.

Обрана тема є досить актуальною на сьогоднішній день. Про цей факт говорить нещодавнє проведення судової реформи і модернізація Закону України ‘’Про судоустрій і статус суддів ‘’. Створення 30 вересня 2016 року Вищої Ради Правосуддя відбувалося саме в контексті цієї реформи. Сама заміна Вищої Ради Юстиції на Вищу Раду Правосуддя говорить нам про те що даний орган не є ігнорованим в контексті законодавчих ініціатив. Саме Вища Рада Правосуддя виконує роль того органу , який бере на себе формування висококваліфікованого суддівського корпусу. Варто сказати і про важливість даної теми , про що може свідчити хоча б той факт, що Вища Рада Правосуддя не відноситься до жодної з гілок влади і лежить поза системою стримувань і противаг. У 2017 році було реформовано інститут дисциплінарної відповідальності суддів. Саме Вища Рада Правосуддя взяла на себе роль органу який зосередив у себе дисциплінарні повноваження. Раніше такими питаннями займалися Вища рада юстиції та Вища кваліфікаційна комісія суддів і підвідомчість залежала від рівня того суду де обіймав посаду суддя. Також, той факт, що саме Вища рада правосуддя бере на себе роль органу який формує судову гілку влади майже самостійно, підкреслює важливість органу для всієї системи функціонуванння держави.

Abstract:
This article explores the reasons behind the decision by the high clergy and the Crown to advocate a «self-support» policy for the parishes. For those powers, it was more convenient to allow parishes to raise their own revenues instead of finding new sources of income, which could erode tithe collections or put further pressure on the royal treasury, as suggested by some isolated voices during the fourth Mexican provincial council of 1771. However, the predominating trend was to induce the faithful to support their parishes.
El objetivo de este artículo es exponer los motivos del alto clero y de la Corona para reafirmar la política de lo que aquí llamo «auto-sustento» de los curatos. Para esos poderes era más conveniente que cada curato se autofinanciara a tener que buscar nuevas fuentes de ingreso, lo cual podía desembocar en un mayor reparto del diezmo o extraer recursos de la Real Hacienda, como plantearon algunas voces aisladas en el IV Concilio provincial mexicano de 1771. La tendencia fue, por el contrario, garantizar que los fieles sustentaran a cada parroquia.

Abstract:
Through the analysis of photographs of Christchurch men, this thesis will explore and expand the historiography around masculinity in New Zealand. It will argue that how men saw themselves was informed by concepts of power and class, alongside aspects such as physical strength and ideas of manliness. Masculinity was a fluid concept; its interpretation differed across class, race and gender lines. The urban masculine identities found in Christchurch during 1880-1930 demonstrate the complexity of gender construction. They offer another view to that of a New Zealand masculinity steeped in stereotypes of rural, isolated men. Photographs are the central documents within this thesis and the growing field of visual history provides the framework for study. Photograph collections are selected from a variety of sources, including the Canterbury Museum, the Christchurch City Council archives, the Christchurch Club, Christchurch Boys' High School and my own family collection. The selection process centres on presenting collections which offer insight into a variety of settings across Christchurch, and the photographs within this thesis were chosen due to their representation of the collection they came from. Gillian Rose's methodology, which looks at the sites of production, the image, and the audience, shapes the study of the photographs. Read as documents and then situated into the broader contextual understanding of turn of the twentieth century Christchurch, these photographs allow the viewer to read the past with new eyes. This thesis offers a complementary reading of the masculine history of New Zealand. With an analysis influenced by the theoretical underpinnings of gender history, social history and visual history, the photographs show how ideas of masculinity developed in the urban setting of Christchurch. It highlights how ideas of class shaped the power relations of men, how physical settings offered different aspects of masculinity to be portrayed. The relationships between men, as well as those between men and women, demonstrate how masculine ideas were not dictated to by stereotypes, but by a range of at times contradictory imagery.

Abstract:
The motivation for development of energy efficiency and implementation of novel advanced materials applied in buildings can be traced to increasing energy costs in conjunction with an enhanced environmental awareness among people. This doctoral dissertation presents contributions towards sustainable building, where factors such as building technology, energy efficiency in buildings, workers' health issues during construction measures, and certain economic considerations for renovation of buildings have been considered. The research study aims to provide a knowledge base for motivating building owners to renovate buildings based on energy efficiency and improved indoor environment. The initial phase of the research study identifies a detailed description of common drivers, expected in renovation projects by building owners. In the second phase, an information base is identified which may facilitate the bidding processes for decision makers by means of technological, social and economic aspects. The aforementioned information base can also contribute to attentive decisions regarding sustainable renovation and energy saving measures. A strategy was developed within the Renovation Workshop of Riksbyggen, in order to promote energy saving measures concurrent with major renovations in residential buildings. This operational decision support process was applied in a tenant owners' cooperative in Sweden. The objective of this process was to showcase and more importantly to implement energy saving measures, based on knowledge transfer between different parties involved in the renovation project. For the conducted case study, this process was shown to be of great importance when decisions regarding energy saving measures in conjunction with scheduled renovations are being planned. A unique case study was conducted on two of the most commonly used environmental certification programs for buildings in Sweden; Environmental Building (Miljöbyggnad) and GreenBuilding. Following a granted access to a limited database of submitted applications to Sweden Green Building Council, the most common mistakes in these were identified and categorized. This study contributed to further understanding about the level of ability among building consultants, comprehension of environmental certification, and enhancement of the ability to produce high-quality calculations concerning building-related energy usage. In addition, this insight can provide a basis for planning of continuing education of consultants within the field of building technology. For a church building, a study was conducted subsequent to an exchange of an existing electric coil heating system to a hydronic ground source heat pump system. Analyses of the energy demand and energy signature, prior to and after installation were carried out. The replacement of the original heating system with a ground source heat pump system for the church building constitutes a reduced energy consumption level of approximately 66%, at the average outside temperature of -2.30 °C. This study demonstrated that data from a detailed electric bill can be utilized in order to obtain the energy signature of the building and henceforth assess the energy savings. One aspect of the research, examined the decision making process related to sustainable renovation and refurbishment in buildings. The utilized methodology identified three distinct phases in order to instigate an engagement in sustainable renovation, by means of questionnaires and semi-structured interviews. In particular, the attitudes of stakeholders in Sweden, Denmark and Cyprus to sustainable building were studied through three separate case studies. Within the framework of this study, it was identified that building physics and durability are among the most important drivers for energy renovation. The results provided an insight into the renovation process in the aforementioned countries and identified that drivers such as improvement of indoor air quality and elimination of moisture in the building envelope are also of crucial importance. Another aspect of the conducted research highlights workplace accidents occurring within the Swedish construction sector. The purpose of this study was to serve as a useful tool to track the working environments of construction workers in order to reduce health and safety issues within the construction sector. The findings of this research suggest that despite laws, regulations or additional factors that seek to ensure a safe and healthy environment for construction workers, the Swedish construction work force still faces challenges. Moreover, it is identified that construction workers participating in the study call for additional measures to ensure occupational health and safety. Improved knowledge of economic performance and technical results of renovations can contribute to a snowball effect, with more property owners recognizing the value of energy aspects and thus provide an increased level of energy savings.

Дисертацію присвячено теоретичним та правовим проблемам адміністративно-правового забезпечення діяльності господарських судів в Україні. Запропоновано удосконалення визначення таких понять, як "організація господарських судів", "адміністративні правовідносини за участю господарських судів", "функції господарських судів як суб’єктів адміністративного права", "апарат господарського суду" тощо. Проаналізовано положення науково-правових джерел, на підставі яких визначено основні недоліки сучасного адміністративного законодавства у сфері регулювання організації та забезпечення діяльності господарських судів в Україні. З метою подальшого удосконалення національного законодавства і практики його застосування сформульовано пропозиції щодо необхідності внесення відповідних змін та доповнень до чинного законодавства України, зокрема Закону "Про судоустрій і статус суддів", обгрунтовано необхідність прийняття Положення про порядок оцінювання особистих морально-психологічних якостей кандидата на посаду судді, запропоновано розробити Стандартизовану програму підготовки суддів Касаційного господарського суду у складі Верховного Суду тощо.
Диссертация посвящена теоретическим и правовым проблемам административно-правового обеспечения деятельности хозяйственных судов в Украине. Предложено усовершенствование определения таких понятий, как "организация хозяйственных судов", "административные правоотношения с участием хозяйственных судов", "функции хозяйственных судов как субъектов административного права", "аппарат хозяйственного суда" и другие. Обосновано, что значение хозяйственных судов в судебной и правоохранительной системах Украины заключается в: 1) обеспечении ими экономической безопасности и дисциплины, что является неотъемлемой составляющей национальной безопасности государства; 2) создании благоприятных условий для устойчивого и надежного развития хозяйственных правоотношений, защите экономической конкуренции и добросовестности субъектов хозяйствования; 3) защите прав, свобод и интересов участников хозяйственных правоотношений, а также лиц, чьих интересов они касаются; 4) защите корпоративных и связанных с ними прав участников хозяйственных правоотношений, в том числе в отношениях с владельцами хозяйственных обществ; 5) защите прав кредиторов при признании субъекта предпринимательской деятельности банкротом и др. Указано, что функции хозяйственных судов как субъектов административного права – это обусловленные целью осуществления правосудия в хозяйственном судопроизводстве основные направления их деятельности, в которых находят воплощение властные полномочия хозяйственных судов. Функции хозяйственных судов как субъектов административного права делятся на две большие группы по критерию их целевой направленности: 1) административные функции, реализуемые в связи с осуществлением правосудия в хозяйственном судопроизводстве: осуществление подготовительно-организационных действий, предшествующих рассмотрению хозяйственного дела; судебное руководство ходом рассмотрения и решения хозяйственного дела; обеспечение одинакового и правильного применения судами норм материального и процессуального права при рассмотрении хозяйственных дел и др.; 2) административные функции, выполняемые в связи с осуществлением судебного управления (внутриорганизационного или внешнего характера): представительские, контрольные, организационные, обеспечительные функции и функции взаимодействия и судейского самоуправления. Обозначено, что акты административно-правового регулирования можно классифицировать по критерию направления и характера их действия на: 1) международные акты, регламентирующие стандарты и принципы организации и функционирования судов, в том числе специализирующихся на рассмотрении хозяйственных дел; 2) внутринациональные законодательные акты – Конституция и законы Украины; 3) акты толкования административного законодательства – решения Конституционного Суда Украины, содержаще разъяснения отдельных положений Конституции и законов Украины в сфере регулирования административной деятельности хозяйственных судов; 4) организационно-распорядительные и другие административные акты органов судейского самоуправления, касающиеся решения внутренних вопросов деятельности хозяйственных судов, а также вопросов взаимодействия с другими субъектами; 5) административные акты других органов судебной системы, регламентирующие вопросы деятельности аппаратов хозяйственных судов и их взаимодействия с судейским корпусом и другие вопросы в сфере административной деятельности хозяйственных судов. Проанализированы положения научно-правовых источников, на основании которых определены основные недостатки современного административного законодательства в сфере регулирования организации и обеспечения деятельности хозяйственных судов в Украине. С целью дальнейшего совершенствования национального законодательства и практики его применения сформулированы предложения о необходимости внесения соответствующих изменений и дополнений в действующее законодательство Украины, в частности Закон "О судоустройстве и статусе судей", обоснована необходимость принятия Положения о порядке оценки личных морально-психологических качеств кандидата на должность судьи, предложено разработать Стандартизированную программу подготовки судей Хозяйственного кассационного суда Верховного суда Украины и др.
The dissertation is devoted to the theoretical and legal problems of administrative and legal support of activity of economic courts in Ukraine. The paper proposes improvement of the definition of such concepts as "organization of economic courts", "administrative legal relations with the participation of economic courts", "functions of economic courts as subjects of administrative law", "apparatus of economic court" and others. The article analyzes the situation of scientific and legal sources on the basis of which the main shortcomings of modern administrative legislation in the sphere of regulation of organization and provision of activity of economic courts in Ukraine are determined. In order to further improve the national legislation and practice of its application, proposals are made regarding the necessity of making appropriate amendments and additions to the current legislation of Ukraine, in particular, to the Law "On the Judiciary and the Status of Judges", the necessity to adopt the Regulation on the procedure for evaluating the personal moral and psychological qualities of the candidate for the position of a judge, it is proposed to develop a Standardized training program for judges of the Economic Court of Cassation of the Supreme Court, etc.

Les sessions extraordinaires constituent une des innovations majeures de la réforme de 2006 qui a institué le Conseil des droits de l’homme, en tant qu’organe subsidiaire de l’Assemblée générale des Nations Unies. Alors même que le Conseil tient trois sessions régulières chaque année, les sessions extraordinaires permettent aux Etats de réagir face à une situation de crise en organisant un débat, permettant d’évaluer et de qualifier les violations commises et mettant en place des mécanismes d’enquête et de suivi. L’analyse systématique des vingt-six sessions extraordinaires organisées depuis près de douze ans éclaire ainsi non seulement les rapports de force entre les acteurs en présence mais aussi une dynamique nouvelle du droit international public, intégrant le droit international humanitaire et le droit international pénal dans le champ de compétence du Conseil des droits de l’homme
Special sessions are one of the major innovations of the reform that established the Human Rights Council in 2006 as a subsidiary body of the United Nations General Assembly. While the Council holds three regular sessions each year, a special session allows States to respond to an urgent situation by organizing a debate, to assess and qualify violations and also to establish investigative mechanisms. The systematic analysis of the twenty-six special sessions held in nearly a period of twelve years illuminates, not only the balance of power between the actors involved, but also a new dynamic of international law, integrating international humanitarian law and international criminal law into the field of competence of the Human Rights Council

This study focuses on the factors which explain Abu Dhabi Education Council’s (Adec) English curriculum choice in grade ten and eleven public high schools in the United Arab Emirates (UAE). It investigates the challenges its implementation poses for teachers personally and professionally. The study is exploratory and interpretive and is based on the perceptions of 12 male teachers; 6 Arab teachers of English and 6 “native” English speaking teachers at 3 boys’ public high schools in the Abu Dhabi emirate. Data were gathered through lengthy semi-structured interviews with teachers, analysis of Adec curriculum and assessment documentation as well as open, non-participant classroom observations. The findings show the current curriculum, modelled on that used in NSW mainstream schools in Australia up until the end of 2014 is an inappropriate choice for students learning English as a foreign/second language in a school environment where all other subjects are taught in Arabic. This in turn provides a range of challenges for teachers who are unable to implement the course content as it was intended or the learner / learning-centred pedagogical approaches promoted by the curriculum and assessment documentation. The study recommends a realistic assessment of students’ language needs be undertaken as a top priority and, based on these findings, English classes streamed according to students’ language proficiency; with curriculum and assessment designed to reflect the various stages of learning. Ability grouping would enable specialist teachers to target areas of strength and weakness, thus countering the boredom and frustration currently experienced by many students. The study also recommends future stakeholder consultation, an in-depth orientation for newly hired teachers and professional development for incumbent teachers in scaffolded language instruction.

Malgré le peu de fondements écrits consacrés à la justice dans le texte de la Constitution du 4 octobre 1958, le Conseil constitutionnel, en réalisant un travail d’actualisation à partir de la Déclaration des droits de l’homme et du citoyen, a permis l’émergence d’un droit constitutionnel processuel, construit autour de principes directeurs. Ceux-ci peuvent être répartis dans trois catégories : deux principales, selon que l’acteur du procès prioritairement concerné soit le juge ou les parties et une troisième, complémentaire, celle des garanties procédurales, permettant de favoriser les qualités essentielles du juge et de contrôler le respect des droits des parties. Une gradation des exigences du Conseil constitutionnel est discrètement perceptible entre les deux premières catégories de principes, plus facilement identifiable entre celles-ci et la dernière famille. Cette échelle décroissante de « densité » des principes directeurs du procès témoigne d’une véritable politique jurisprudentielle en matière de droit constitutionnel processuel, qui met l’accent sur l’accès au juge, doté des qualités indispensables à l’accomplissement de sa mission juridictionnelle. Toutefois, aussi satisfaisante que soit l’action du juge constitutionnel français à l’égard du droit du procès, celle-ci nécessiterait aujourd’hui le relais du constituant, afin de moderniser le statut constitutionnel de la justice
In spite of a relatively low number of written dispositions dedicated to justice inside of the body of the Constitution of October 1958 4th, the constitutional Council, while updating this text through the Declaration of Human Rights, contributed to the development of a procedural constitutional law, which is structured around guiding principles. Those principles can be classified within three different categories : two major categories depend on the trial actor that is primarily concerned, either the judge or the parties; a third and additional category pertaining to procedural protections, fosters the essential qualities of the judge and secure the protection of the parties’ rights. A gradation of the requirements of the constitutional Council is discreetly perceptible between the first two categories of principles, and more easily identifiable between those first two categories and the last one. This decreasing scale of “density” yoked to the trial guiding principles highlights a genuine judicial policy when it comes to procedural constitutional law, emphasizing access to the judge, whom is given essential qualities in order to achieve its judicial duty. However, the action of the French constitutional judge, as satisfactory as it is towards the rights of the trial, would easily support the intervention of the constituent power in order to update Justice’s constitutional status

La coopération internationale est inscrite sur l'acte constitutif de l'Organisation des Nations Unies du 26 juin 1945. Moyen d'échange et de dialogue entre acteurs internationaux, son objectif a été de trouver des solutions aux difficultés économiques, sociales, culturelles et sécuritaires de l'après-guerre pour sauvegarder la paix du monde. Elle s'est considérablement développée, allant de la forme bilatérale à celle multilatérale, dans tous les domaines et sur tous les continents. Parmi ses nombreux cadres d'échanges, le dispositif français de coopération, avec son assistance technique spécialisée dans tous les domaines, demeure une référence certaine. Il s'est déployé à travers une stratégie de géopolitique internationale où domaines militaire en plus grand et sportif en plus petit en constituent un des traits caractéristiques. La coopération française et internationale ont été un accompagnement décisif pour le continent africain après les indépendances, mais aussi un important moyen stratégique d'influence pendant la Guerre Froide. Le sport et la coopération sportive y joueront leur partition. Pour les Américains, Français, Anglais, Soviétiques et leurs partenaires respectifs, la coopération a été très efficace et a permis de sauvegarder leurs intérêts sur le continent africain. Elle demeure encore aujourd'hui un important moyen de pression sur la scène africaine, influant souvent sur les résultats des échanges et l'efficacité des actions de coopération. Finalement, c'est une coopération internationale de 1960 à 2010, avec ses réussites et ses échecs, d'une taille parfois limitée mais qui reste un moyen de dialogue pour le monde et surtout pour le continent africain engagé sur le difficile chemin de la démocratie. C'est par une approche théorique libérale et une méthode qualitative que cette recherche a été réalisée, sur le principal terrain du Burkina Faso avec ses particularités sociales et son histoire, qui constituent une grille de lecture idéale.

Cette thèse propose une analyse de la « cour royale » égyptienne sous la XXVIème dynastie saïte (664-525 av. J.-C.) à partir des sources majoritairement textuelles (privées et royales) et historiques. Le volume de synthèse se développe autour de trois axes principaux traitant la « cour » dans son acception sociale, telle qu’on l’entend dans la sociologie historique. La première partie est ainsi consacrée à l’étude de la cour comme la Maison du souverain afin d’éclairer l’ensemble des activités qui caractérisent la « vie de cour » et son organisation domestique et qui rendent l’espace curial « privé » ou « officiel ». La deuxième partie examine la cour dans son agencement social et en tant qu’outil de représentation et de communication : ce sont alors le protocole du palais royal et son rôle-clef dans le maintien de l’équilibre social entre les souverains saïtes et leurs sujets (système des faveurs–ḥswt) qui sont analysés. La troisième partie se concentre sur les acteurs sociaux de la Résidence du roi (les courtisans et l’entourage royal) et tente de démontrer les différentes catégories auxquelles appartiennent ces élites et de déceler les modalités de leurs accès au palais et au rang de « courtisan modèle » dans la hiérarchie de la cour. Enfin, l’enquête diachronique suivie tout au long de la synthèse permet de mieux connaître l’impact des emprunts archaïsants dans le système palatin saïte, et par conséquent, d’évaluer la continuité et/ou le changement de ce système par rapport aux modèles traditionnels de la cour pharaonique. This thesis offers an analysis of the Egyptian "royal court" under the XXVIth Saite Dynasty (664-525 BC) based on textual (private and official records) and historical sources. The synthesis develops around three main axes and deals with the "Court" in its social meaning as defined by the historical sociology. The first part, then, concentrates on the study of the court as the House of the sovereign and attempts to identify the activities which characterize the "court life", its domestic organization and which make the curial space "private" or "official". The second part examines the court as a symbol of social order and the outil of representation and communication of the monarchic authority: the protocol of the Royal palace and its key role to maintain the social balance between the Saite kings and their subjects (system of the favours ḥswt) are analyzed here. The third part focuses on the social actors of the Residence (courtiers and royal entourage) and tends to demonstrate the various categories of these elites and to reveal the modalities of their accesses to the palace and to the position of "model courtier" within the hierarchical order of the court. Finally, the diachronic study followed throughout the synthesis allows to better comprehend the impact of the Archaism on the Saite palace institution and consequently to estimate the continuity and/or the changes of this system compared to the traditional models of the Pharaonic court. On the basis of current laws regarding education and referring to legal theory and educational viewpoints, the present study aims to discuss the right of senior high school students attendance to the school council. With the approach of literature review and observational method, the study draws some conclusions as follows: First, senior high school students fundamental rights of education is based on Article 22 of the Constitution. Fundamental right of education is to ensure self-realization of students, meaning to free development of personality. Students to attend school council help to protect fundamental rights of education. Second, students attended to the school council will help achievement of the goals of civic education. Students can learn of human rights, democracy, rule of law values. Moreover, mental development of high school students participate in school council has been enough independent. Third, School Council student representatives must be elected by the democratic, following the principle of multiple participation. Students can participate in the discussion their own rights-related motions. Fourth, I recommend that Senior High School Law and the Vocational School Act must be amended. The school council should include the student representatives.

Abstract The purpose of this study is to explore the operational concepts, strategies, challenges, coping strategies, and reflect of current situation junior high school student council. Also, according to the findings below, suggestions were given to teachers, schools and educational administrations. The methodology of this study is mainly a qualitative survey. The junior high school in Taoyuan County was observed for a year. The qualitative survey is constructed by the focus of interviews, observations, reflective journals, documents and data collection. The major findings are as the followings: 1. Promote student council operating philosophy:service classmates, full participation, empowerment, and to give care. 2. Promote student council strategy: student-centered autonomous activities, activities at school, and organizational cooperation. 3. Three steps of student council: plan for activities, event planning, execution of politics, and development of school self-characteristics. 4. After student council worked, students developed a cooperation climate, and they could learn knowledge about democracy. However, the school climate of students’ self-government is poor. 5. After student council worked, student council should be intergated related curriculum and empower them. 6. The suggestions of school administrators, teachers and students are to keep concerning, supporting, adding insstructors and activits. The major suggestions are as the followings: 1.For the case of school and administrative staff. (1) adjust management. (2) join the professional training. 2. For the case of teachers and students. (1) actively support and participate. (2) make students understand the true meaning of student council. 3. For the educational administrations. The Media High Council (MHC) was put in place by the 2003 constitution of the Republic of Rwanda as amended to today. As article 34 clarifies, the MHC is an independent institution which aims to address issues of media and press freedom. In the same spirit, the law number 30 /2009 of 16/9/2009 determines its mission, organisation and functioning. According to article 2 of this law, the Media High Council is responsible for protection, control and promotion of media and media professionals. Based on normative theories, qualitative methods and thematic analysis, this study has explored the policy formation of the Media High Council and how it has been balancing the seeming contradictory responsibilities of protecting and controlling media from 2007 to 2010.

The purpose of this study is to explore the important order of the American Economic Education Association CEE eighth grade (8th grade) financial education curriculum outline (2013) to provide ideal financial education curriculum content as future Taiwan financial curriculum blueprint. First, through the literature analysis to explore the financial management, financial education, and other countries’ (the United States, Australia, and Taiwan) financial courses, take CEE financial management curriculum outline (2013) as reference to design questionnaires. Second, the target population is junior high school civic teachers in Taiwan, and use variance of analysis and analytic hierarchy process for research. The conclusions are as follows: 1.Different background variables (teaching region, gender, different teaching years, the number of different financial management courses) of junior high school civic teachers on six standard topics of CEE financial education curriculum outline, all background variables are no significant difference. 2.The junior high achool civic teachers on six standard topics of CEE financial education curriculum outline in the order of importance: Saving, Financial Investing, Protecting and Insuring, Earning Income, Buying Goods and Services, and Using Credit. 3.CEE financial education curriculum outline in the order of overall importance: The top three curriculum standards are " Financial Investing --5. This work explores the continuous professional teacher development point system policy and the implications it has on the professional development of teachers. A qualitative study was undertaken in two secondary schools on the West Rand in Gauteng. Data was collected through document analysis, observations and semi-structured interviews. Results indicated that there is a mismatch between what is outlined in the policy and what the teachers are practising. It became evident that the majority of teachers in this study had limited knowledge of the policy although implementation of the policy began in 2014. It was concluded that the point system policy is not contributing effectively to the professional development of teachers in Gauteng.
Hierdie werk ondersoek die deurlopende professionele onderwyser-ontwikkelingspuntstelselbeleid en die implikasies daarvan op die professionele ontwikkeling van onderwysers. 'n Kwalitatiewe studie is onderneem in twee sekondêre skole aan die Wes-Rand in Gauteng. Data is ingesamel deur middel van dokument analise, waarnemings en semi-gestruktureerde onderhoude. Resultate het aangedui dat daar 'n wanverhouding bestaan tussen wat in die beleid uiteengesit word en wat die onderwysers praktiseer. Dit het duidelik geword dat die meerderheid onderwysers in hierdie studie beperkte kennis van die beleid gehad het, hoewel die implementering van die beleid in 2014 begin het. Daar is bevind dat die puntestelselbeleid nie effektief bydra tot die professionele ontwikkeling van onderwysers in Gauteng nie.

Les États européens n'ont, jusque dans les années 90, envisagé leur défense que dans le cadre d'alliances militaires et restaient maîtres de leur défense nationale. La mise en place d'une politique européenne de défense a toujours connu des obstacles, reflets des problèmes de souveraineté. Dans l'Union européenne, l'intégration politique, et en particulier celle de la défense, reste le domaine le plus incertain. Cette thèse de nature essentiellement empirico-descriptive aborde le thème de la défense européenne sous une approche réaliste, en plaçant les États au centre de la construction européenne et en en faisant les acteurs principaux. Depuis 1992, les États tentent de définir une politique européenne de défense mais rencontrent différentes difficultés. En effet, la politique européenne de défense souffre d'un double déficit. Le premier est un déficit institutionnel puisque la P.E.D. est loin d'être une politique commune et se limite à un mécanisme de coopération. Le second est un déficit matériel puisque l'Union européenne n'a pas la puissance militaire pour mettre en oeuvre une éventuelle décision commune. Afin d'évaluer les perspectives d'évolution d'une politique européenne de défense, nous devons étudier les différents défis que les États et les institutions communautaires doivent relever pour combler ces deux déficits. Les défis d'ordre institutionnel concernent les multiples acteurs, États et institutions, qui interviennent dans la définition de la P.E.S.D. Il s'agit de déterminer quelle instance est la mieux à même d'assurer la représentation internationale de l'Union européenne afin de donner l'impulsion politique nécessaire de la P.E.S.D. Les défis d'ordre militaire concernent les moyens que les différents acteurs souhaitent engager afin de concrétiser la politique définie. Toutes ces discussions montrent la justification d'un système européen de défense mais la question est de savoir si les États, acteurs centraux de la construction européenne, sont prêts à relever ces défis.
Up until the 1990's, the European States have solely thought of their security forces inside military alliances as they kept control of their national defense. The putting in place of a European defense policy has always met obstacles, which reflect the problems linked to the preservation of sovereignty. The political integration in Europe remains uncertain, mostly when it comes to common defense. With an empirical and descriptive manner, this thesis depicts the European defense theme in a realistic approach, by placing the States in the middle of the European construction and by giving them the main role. Since 1992, the States tried to lay down a European policy of defense, but they encountered various difficulties. Indeed, the European policy of defense suffers from a double deficit. The first is institutional since the European Defense Policy is far from being part of a common policy and is strictly a cooperation mechanism. The second is a material deficit since the European Union doesn't have a military force to implement a common decision. In order to evaluate the possible evolution of a European defense policy, we had to study the various challenges that the States and institutions must face in order to address those two deficits. The institutional challenge concerns the multiple actors, States and institutions, which intervene in the definition of E.P.S.D. This part will try to identify which institution would be best capable of ensuring the international representation of the European Union and to give the political impetus necessary to the putting into place of the E.P.S.D. The military challenge concern the means that the different actors would engage in order to concretize the policy. Ali these discussions show the justification of a European system of defense, but the question remains as to whether the States, central figures of the European construction, are ready to take up these challenges.

Розглянуто передумови виникнення та розвитку контрольної влади, здійснено її історичний аналіз. Досліджено основні інститути контрольної влади в Україні з метою окреслення їх загальних особливостей: проаналізовано діяльність Конституційного Суду України, Рахункової палати, Уповноваженого Верховної Ради з прав людини. Визначено, що Вища рада юстиції є новим органом для правової системи України, який не мав аналогів в історичному минулому України, а тому врахування досвіду існування схожих органів за кордоном та глибоке теоретичне осмислення її повноважень, порядку утворення та функціонування дає змогу чіткого визначення конституційно-правового та виокремлення загального теоретико-правового статусу Вищої ради юстиції. Доведено необхідність розширення повноважень Вищої ради юстиції України стосовно надання їй права законодавчої ініціативи у сфері судоустрою та статусу суддів. Порядок формування Вищої ради юстиції повною мірою відображує професійне представництво у її складі майже усього спектра юридичних професій і фактично унеможливлює вплив на неї з боку законодавчої, виконавчої та судової влади. Зроблено висновок щодо того, що у сучасній Україні відбуваються державні перетворення, які актуалізуються розвитком держави за європейським шляхом. Одним з аспектів державних змін є посилення дій по боротьбі з корупцією та процесом так званої люстрації влади. Це стосується як органів виконавчої, так і органів судової влади.
Диссертация посвящена общетеоретическому исследованию Высшего совета юстиции как института контрольной власти в Украине. Рассмотрены предпосылки возникновения и развития контрольной власти, осуществлён её исторический анализ. Обоснована мысль о том, что возникновение, развитие и оптимизация института государственного контроля всегда рассматривалась как одна из составляющих становления государственности. Представления о контрольной власти как отдельной ветви власти формируется на основании государственной практики. Контроль является объективным социальным явлением, которое сформировалось в процессе эволюции общества. Без применения контроля общество не может обойтись на пути своего дальнейшего развития, который необходим и может осуществляться, основываясь на анализе существующего состояния и используя новые факторы развития. Сделан вывод о том, что специфика контрольной власти заключается в том, что её органы рассредоточены и независимы, а также каждый из них осуществляет частичную функцию общегосударственного контроля. Исследованы основные институты контрольной власти в Украине с целью определения их общих особенностей: проанализирована деятельность Конституционного Суда Украины, Счётной палаты, Уполномоченного Верховной Рады по правам человека. Определено, что Высший совет юстиции является новым органом для правовой системы Украины, который не имел аналогов в историческом прошлом Украины, поэтому учёт опыта существования подобных органов за рубежом и глубокое теоретическое осмысление его полномочий, порядка создания и функционирования даёт возможность чёткого конституционно-правового определения и выделение общего теоретико-правового статуса Высшего совета юстиции. Как показал опыт работы Высшего совета юстиции в современных условиях развития украинского государства, с учётом потребности гармонизации законодательства Украины с правом Европейского Союза, принципами и стандартами Совета Европы, полномочия Высшего совета юстиции должны быть расширены. Доказана необходимость расширения полномочий Высшего совета юстиции относительно предоставления ей права законодательной инициативы в сфере судоустройства и статуса судей. Порядок формирования Высшего совета юстиции в полной мере отражает профессиональное представительство в её составе почти всего спектра юридических профессий и фактически делает невозможным влияние на неё со стороны законодательной, исполнительной и судебной власти. Сделан вывод о том, что в современной Украине происходят государственные преобразования, которые актуализируются развитием государства по европейскому пути. Одним из аспектов государственных изменений является усиление действий по борьбе с коррупцией и процессом, так называемой люстрации власти. Это касается как органов исполнительной власти, так и органов судебной власти. Определено, что Высший совет юстиции является важным средством обеспечения эффективного функционирования органов правосудия и независимости судей. Имеющиеся новации, а также успешное проведение реформ является гарантией построения правового государства и гражданского общества, являющегося одним из важнейших гарантий соблюдения прав человека в Украине.
The thesis is devoted Theoretical Investigations of the Supreme Council of Justice as an institution of the control of power in Ukraine. The preconditions of occurrence and development control authorities Implemented her historical analysis. The basic institutions of the control of power in Ukraine in order to identify their common features. Among these institutions, analyzed the activity of the Constitutional Court of Ukraine, the Accounting Chamber of the Verkhovna Rada Commissioner for Human Rights. It was determined that the High Council of Justice is a new body for the legal system of Ukraine which does not have analogues in the historical past of Ukraine, therefore, based on the experience of the existence of such bodies abroad and deep theoretical understanding of his powers, the order of creation and functioning enables clear konstitutsiyno legal definitions and the allocation of general theoretical legal status of the High Council of Justice. The necessity of expanding the powers of the High Council of Justice of Ukraine on granting her the right of legislative initiative in the area of the judicial system and status of judges. The procedure for the formation of the High Council of Justice, fully reflects the professional representation in its composition almost the entire spectrum of the legal profession and in fact makes it impossible to influence on it by the legislature, the executive and the judiciary. The conclusion is that in modern Ukraine occur state changes that updated state development on the European path. One aspect of state changes is the strengthening of action against corruption and the process of the so‑called lustration of power. This concerns both the executive authorities and the judiciary.

Abstract:
The invasion by the Boers of Natal set a process in motion that changed the lives of Natal Afrikaners forever. As a group which shared family, cultural, and other ties with the invaders, but were British subjects by citizenship, they had to make a difficult decision: join the Republican forces or remain loyal to the crown. Factors which influenced this decision, amongst others, were the pre-war suspicion of all Natal Afrikaners by the Natal authorities and the prevalence of a general anti-Republican sentiment. Despite the above-mentioned, and the sympathy which existed for the plight of the Republics, very few Natal Afrikaners joined the commandos. Doing that would have meant economic annihilation. This the Natal Afrikaners understood and the majority remained neutral. Matters were complicated when the British Army and the colonial authorities withdrew south, leaving especially the Afrikaners of the Klip River county unprotected. When occupation did not convince the Afrikaners of the area to join, a well-thought out strategy based upon fear and misinformation, brought most into the fray. Duty on these commandoes was generally slack, subversive in nature, and as much as one can expect from people forced into military combat. A small group, however, managed, despite the pressures placed upon them, to remain loyal to Britain. For these loyalists the greatest rewards were in terms of economics and power. In stark contrasts were the economic experiences of the Natal Afrikaners who were somehow, either directly or indirectly, guilty of high treason. All their possessions were systematically looted or destroyed, leaving most of them in an impoverished state. Secondly, through a range of court cases 409 Natal Afrikaners or associated people were convicted of treason, mostly by the purposefully introduced Special Court and special magistrate. The outlined experiences coincided with victimization on socio-political and cultural levels under Martial Law. Afrikaners resident in the southern part of Natal, and especially in Umvoti county, did not suffer directly because of the war but experienced a different kind of war namely a pseudo war in which they were spied upon, viewed with suspicion and under Martial Law harassed. However, these Afrikaners managed to maintain some political power while economically they carried on as before the war. They attempted to use these assets to assist the Afrikaners who had to endure desertion by their own government and Boer occupation. Natal Afrikaners also experienced other aspects of the war normally associated with the Republics. Some were arrested as POWs, while others were deported to concentration camps within the Colony. Furthermore, as a result of the war, relations between Natal Afrikaners and English colonists and Africans suffered. The collective impact and legacy of the war, as well as the shared experiences of suffering under the British, with their Republican brothers and sisters, eventually helped to bring Natal Afrikaners into the broader Afrikaner fold.

“Counseling for Adaptive” is one of the significant projects of “The Twelve-Year Public Education Program”actively promoted by the government. However, some factors, like the pressure that the students confront or the uncertain movement of the policies of educational reform, may more or less affect the adaption of the students. Moreover, the Ministry of Education officially announced “The Program of Integrative System for Instruction, Discipline and Guidance” in August, 1997. Its purpose is to introduce the counseling conceptions of primary prevention, secondary prevention, and tertiary prevention. The idea of carrying out prevention before treatment is substantially focused. The teachers are courage to totally engage in counseling and the community resources are combined with the work. The School Counseling Network is established to provide the sound service of counseling. Therefore, the conception of prevention becomes a significant role in the work of giving student guidance nowadays. The main purpose of the study is to discuss how to decrease the times of counseling the junior high students after the event. In other words, the study focuses on how to actually implement the prevention concepts of counseling in the practical area, such as providing the students the most appropriate attention and caring. The study applies Discriminate Analysis to discuss the aspects of Junior high school students living Adjustment Scale and then develops a scale to be the standard of Junior high school students living Adjustment conditions. The four aspects of the scale are interpersonal adaptation, self-adaptation, family adaptation, and learn to adapt. The finding of the study is that the four aspects are able to predict the level of the student caring degree and effectively reach the goal of prevention before the event and pre-warning after the event.

Abstract The disquiet around parent-school relationships is the focus of this study. During transitioning to high school, the boundaries around this relationship changes. Few studies have addressed these changes, particularly from parents’ perspectives. It is parents’ voices which are central to this study. This dissertation uses the standpoint of parents, which is often absent or silent in educational literature and research. Within a critical and constructivist paradigm, and influenced by Institutional Ethnography, two elementary schools (divergent in race, social class, ethnicity and immigrant status) and one high school are the sites for interviews with 14 parents and 13 educators. 11 parents were re-interviewed after their children entered high school. Four questions were addresses: How has parent involvement come to be understood? How is the parent-school relationship experienced by parents and educators? How and why are decisions made around the transition and school choice process? Do parents’ perceptions align/vary from those of educators? Based on historically constructed notions and assumptions, parent involvement is usually understood as a visible and public demonstration of appropriate and caring parenting ignoring interactions outside of the public’s gaze. Illustrated through Parent Council membership, parent involvement is gendered, classed, culturally related and race, ethnic and immigrant status specific. Some parents had more social, cultural, economic and emotional capital to bring to the transition process, while others were marginalized and had to rely on/trust the education system. School and Board policies and procedures were examined and their varied affects on parents’ experiences and choices analysed. Educators assisted in disseminating assumptions around parent-school relationships and contributed to inequitable parent knowledge, partially as a result of too little training. By examining social, economic and cultural positioning of parents within local school communities, positive parent-school relationships can be nurtured, which political pundits and educationalists have failed to accomplish. During transitioning, organization and social discontinuities contributed to parent and school disconnects and constructed borderlands in the parent-child-school relationship. This study evidenced the fragility of the parent-school relationship, especially during this vulnerable time for parents and thus, reflective questions are presented in hope of initiating a crucial conversation in local school communities.

The purposes of this study was as follows: 1. Analyze the current situation of Hualien County councilor subsidy in Hualien High School and Elementary School. 2. To explore the implementation process and understand application and usage in Hualien High School and Elementary School. 3. To suggest some ways in that policies can improve performance by analysis of the advantages and disadvantages of Hualien County councilor subsidy in Hualien High School and Elementary School. To achieve the purpose of this study , I used interviews method and file analysis method for data collection and analysis. The file source which is applied and download from the webcite of Hualien County Government. The interviewees included seven school administrative staffs, one is the Hualien bureau staff. Throughout the process of literature review and data analysis, the results of this study are summarized as following: 1. The current situation of Hualien County councilor subsidy in Hualien High School and Elementary School is still in the situation of supply and demand imbalance. Some of the subsidies are subsidized by according the public choice theory, such as duplication of subsidized resources, waste of public welfare and other public interests. 2. The personal will of the principal and the importance attached to the development of the school by the members themselves will decide whether or not to win the subsidy to the county councilors. The earlier the application period, the more time is available to execute the procurement case. In terms of geopolitical relations, schools will be more willing to compete with members of their respective constituencies because they are more likely to receive subsidies. In the process, the school are going for the formation of a consensus stage and then apply for members. And when they get subsidies, according to the relevant laws and regulations in order to implement the procurement and paying verification. 3. The Hualien County councilors' benefit has the advantage of being able to take care of aboriginal areas or schools without traditional backgrounds and is of substantial help to the school's needs. The shortcomings of the follow-up to the members of the fight for help, apply for follow-up no news, the hostile camp election station and political and commercial interests of the rigid collusion .

Since 1994 the South African government has implemented principles of equity, redress and social empowerment in broader society and in education. Consequently, corporal punishment was banned in schools and new methods of managing discipline were introduced. Moreover, decision-making power is decentralised to School Governing Bodies on which learner representatives serve in secondary schools. Thus, the latter are also involved in the management of discipline. This study explores the learners' role in the management of discipline in urban secondary schools in KwaZulu-Natal. Current perspectives on school discipline and an overview of the learners' role in discipline management in the South African context were provided. A qualitative investigation used interviews with learners and educators in selected schools to collect data. Findings suggest that learner involvement in discipline can be positive but lack of training and poor communication impede the full deployment of learners in this regard. Finally, recommendations for the improvement of practice are made.

Abstract:
This study deals with the impact of educational policy on the National Senior Certificate: Pre-1994 and Post democracy South African case. The qualitative approach was used in this study, and the research findings were based on the analysis of documents. The transition from apartheid education to the present education system in South Africa has not been without challenges. In the past, South African education reflected the fragmented society in which it was based. Outcomes based education (OBE)/Curriculum 2005 (C2005), since its inception, was riddled with challenges. OBE/C2005 by its nature is complex. It is not user-friendly for developing countries such as South Africa. The aim of this study is to explore the impact of educational policies on the 2008 National Senior Certificate results. Historical-educational research is undertaken with the view of putting the education phenomenon into proper perspective. Venter (1985) is of the opinion that historical education investigation refers to the systematic placing of historical education variables in the spotlight. The general, continual pedagogical and fundamental problems are accentuated against the multiplicity of historical detail. This then makes historical-educational research an orderly (systematic and controlled) process of knowledge enrichment (Venter & Van Heerden 1989:106). The National Senior Certificate was established in terms of National Education Act 27 of 1996. Curriculum 2005 has been described in policy documents as a “paradigm shift” because it represents a radical departure from the previous curriculum in terms of the following: theoretical underpinnings, structure and organisation, teaching and learning process, and assessment (South Africa, Department of Education 1997:1). Pre-1994, the researcher discovered that the education of black people in rural areas in particular and South Africa in general was, in most instances, negatively impacted by policies of the previous government (1948-1953). The apartheid government used poor funding models to ensure that there were low teacher-pupil ratios and teacher qualifications were of unequal standard. Unequal pattern of spending continued well into the post-1994 democratic era. This poor funding model which impacted negatively on rural schools made infrastructural provision in rural areas difficult. Post -1994 democratic dispensation, the researcher discovered that the government have competitive legislative policies in place, but the challenges lay in the fact that those policies were impulsively implemented. Hence the many challenges. This is shown by the frequency of curriculum changes which took place in a very short space of time. Stakeholders played a major role in insuring that schools received quality service by challenging some of the decisions the government was taking. The government has had to take the recommendations into account.

Abstract:
This research is concerned with the complex and contested relationship between the sovereign prerogatives of states and the international imperative of defusing world conflicts. Due to its historical setting following World War Two, the national vs. international staking of claims was framed within the escalating imperial-nationalist confrontation and the impending “end of empire”, both of which were significantly influenced by the role Israel played in this saga. The research looks at the issue of “decolonization” and the anti-colonial struggle waged under the leadership of Egypt’s President Nasser. The Suez War is analyzed as the historical event that signaled the beginning of the final chapter in the domination of the European empires in the Middle East (sub-Saharan decolonization followed beginning in the early 1960s), and the emergence of the United States as the new major Western power in the Middle East. The Suez experience highlighted a stubborn contest between the defenders of the concept of “sovereign consent” and the advocates of “International intervention”. Both the deployment of the United Nations Emergency Force (UNEF) and its termination were surrounded by controversy and legal-political wrangling. The role of UNEF and UN peacekeeping operations in general framed the development of a new concept for an emerging international human rights law and crisis management. The UNEF experience, moreover, brought into sharp relief the need for a conflict resolution component for any peace operation. International conflict management, and human rights protection are both subject to an increasing interventionist international legal regime. Consequently, the traditional concept of “sovereignty” is facing increasing challenge. By its very nature, the subject matter of this multi-dimensional research involves historical, political and international legal aspects shaping the research’s content and conclusions. The research utilizes the experience and contributions of several key participants in this pioneering peacekeeping experience. In the last chapter, recommendations are made –based on all the elements covered in the research- to suggest contributions to the evolving UN ground rules for international crisis intervention and management.
