Abstract:
Hire-purchase is a mutual interest contract. Regarding its commutative nature, exchangeable items that are against each other are exchanged in contracting process, so if contract is null or is canceled for any reason according to the contract terms, in the way that transferring possession is impossible, relevant actions will be based on the contract if funds entitled monthly installments are determined in. Therefore, the current paper aims to comparatively study hire-purchase in Iranian and common law. Analytical-descriptive method is applied in the paper. The findings indicate the difference between hire-purchase in Iran and common law is that contract for common law is just utilized for movable properties; while in Iran law it is utilized for both movable and immovable properties. In England law, hire purchase is a specified contract. According to the England hire purchase law and consumer credit law in 1974, hire purchase is a contract in which leased goods are transferred from creditor to the credit receiver instead of using periodic payment. It happens only when the credit receiver fulfills the contract terms. In other words the hire purchase contract used in England law is a hire contract with tenants’ rights of possession, while it has not been explained in the Iranian law.

<p>The Muamalah Hire Purchase Bill (MHPB) was initially prepared by a group of members of the shariah supervisory council of Bank Islam Malaysia Berhad (BIMB) in 1991 and it was later submitted to the Ministry of Domestic Trade and Consumer Affairs in Malaysia and the Central Bank of Malaysia for review. Finally in the year 2000, it was referred to the Attorney General’s Chamber for further examination whether it met the shariah rules and how it could be implemented in Malaysia. However, the Bill could still not be submitted to the Parliament until today for consideration and approval due to certain reasons. The objective of this paper is to discuss the nature of the Islamic hire purchase contract (IHPC) and to compare it with the traditional hire purchase contract (THPC) for purposes to find the difference between the two systems of law. This study attempts to analyze the quantitative as well as qualitative information to identify and evaluate the performance and current state of affairs of finance companies in the field of hire purchase financing in Pokhara. The study reveals that the credit-deposit ratios are very satisfactory. The relationship between total deposit collection and total loan to hire purchase loan is highly significant. The businessperson and professional users are predominantly rushing in utilizing the hire purchase financing due to the easy payment terms. The IRR on hire purchase loan is normally higher than their explicit rate of interest and service charge. Except in few cases, there are loan defaulters in all finance companies. Hire purchase contract in Iran law is known as conditional hire contract which is based on article one of the executive direction. It is a correct, legal and applicable contract which has useful privilege and is used in order to easily and holistically access to economic interest and sustainable development. Therefore it is necessary to explain it in law and Islamic law also to approve its laws and regulations. The objective of this research is to investigate the legal nature of hire purchase in Iran and Islamic law. This research is based on descriptive and library methods. According to the results due to the lack of law records in civil code, hire purchase has not been explained in Iran law and needs to be characterized separately.

Abstract:
Hire purchase agreements that have developed in the realm of society yet have clarity because there is no specific legislation governing the lease-sale agreement. The absence of specific legislation governing the lease resulted in the agreement to experience different views for legal experts both in terms of the definition and the legal consequences arising. This type of research used in this study is a research library with normative juridical approach. Normative research. The results of this study mention: first, the legal construction of a hire purchase agreement did not have legal certainty, because this agreement has legal consequences of changing from the payment of the debt to the payment of rent, when a tort committed by the purchaser. Other than that, construction law hire purchase agreement is null and void, because there are some clauses which are contrary to Article 1266 of the Civil Code and Article 18 of the Consumer Protection Act. Second, the criminal offenses arising from a lease agreement is a criminal offense of extortion, when the withdrawal unilaterally, although financing the vehicle has been registered in the Register of Fiduciary. This is because even though the fiduciary has the right of executor, but the execution must follow procedures for the implementation of a court decision, so businesses must apply in advance to the Chairman of the Court.

Abstract Hire purchase is today one of the most popular modes of consumer finance worldwide, yet it is still in many ways stigmatized and controversial. In this respect, nothing much has changed since the late nineteenth century, when this new way of selling goods spread through the industrialized countries of the West. How unacceptable it was, Louis Bamberger—a pioneer of hire purchase in Switzerland—found out the hard way. In 1883, only months after the opening of his department store in St. Gallen, hundreds of angry people gathered in front of it and started smashing windows and looting. Beginning with this incident, which came to be known as the Bamberger Riot, this article traces the history of hire purchase and the controversy around it in Switzerland before the Great War. Focusing mainly on artisans and shopkeepers, I argue that the sudden emergence of hire purchase in Switzerland fundamentally challenged the market ethic and economic rationality of this section of the urban middle class.

Abstract:
Islamic hire-purchase (Ydrah wa-iqtind) is one of the latest innovative products of Islamic banks designed to meet the current demand and avoid certain risks in the financing of consumer durables and motor vehicles. No wonder, this transaction is not acknowledged in the classical jurisprudence, but contemporary scholars have developed its structure through a careful combination of Yarah and sale contracts. In Malaysia, this concept refers to AI-Ijdrah Thumma Al-Bay'(AITAB) and it has grown in popularity and continuously expanded partly due to the heightened demand by customers. Since its first inception more than 10 years ago, AITAB has been governed by the Hire-Purchase Act 1967 (HPA), but HPA has received much criticism amongst the practitioners and Shadah experts, who assert the insufficiency of HPA to govern the AITAB transaction when dealing with Shadah issues. Consequently, Mu'amalah Hire-Purchase Bill has been proposed to the Malaysian government to overcome certain limitations of HPA. This study aims to examine the Islamic hire-purchase operation and its regulatory framework in Malaysia. Thorough examination and analysis would help identifying potential strengths and weaknesses inherent in the HPA and how the proposed Bill could provide remedies to various impediments, and offer an alternative regulation to govern the Islamic hire-purchase transaction. To illuminate our understanding of the actual operation of Islamic hire-purchase, this study incorporates in-depth interviews together with a questionnaire survey. A total of 46 in-depth interviews have been conducted on Islamic bankers, SharVah advisors, Shadah scholars, economists, legal experts and government officers. This is further complemented by a country-wide questionnaire survey successfully obtained from 203 customers, aiming at eliciting their perceptions and expectations towards Islamic hire-purchase products. The combination of theoretical discussion on Islamic hire-purchase together with the empirical surveys using both qualitative and quantitative methodology have proved to yield a valuable insight into the revaluation of the Malaysian regulatory system of AITAB. The findings of this study reveal the need to incorporate SharTah principles into the existing Hire-Purchase Act 1967, instead of establishing an independent SharTah law to govern the Islamic hire-purchase operation. It also reveals that customers of Islamic financial institutions in Malaysia have positive views of ArFAB.

Abstract:
Unfair exchange is a problem which the consumer who acquires goods under credit agreement may face. The goods may be misdescribed by the supplier or he may charge an excessive rate of interest for the credit allowance made to the consumer or the supplier may insert into the credit agreement provisions which protect him at the expense of the consumer or the supplier may over-secure his interest under the agreement. The principal law which governs credit agreements in Malawi is the Hire-Purchase Act. This Act provides the basic content and form of a credit agreement and prohibits the supplier to insert certain clauses in the agreement and to engage in certain forms of conduct in relation to the agreement. This thesis analyses the Act and argues that although it seeks to ensure that the consumer gets a fair exchange from the agreement, it has a number of weaknesses which undermine achievement of that objective. First, statements made about goods and credit supplied under the agreement, the quality of those goods and sane types of security agreement which may be made in respect of the credit agreement are left to be regulated by other sources of law which are not primarily concerned with consumer protection. Secondly, the form of control created by the Act does not seem to be based on a clear and consistent policy. And third, enforcement of the Act is left to the parties to the credit agreement. The thesis is divided into nine chapters. Chapter 1 is the introduction which outlines issues dealt with in the thesis. The second chapter examines bases upon which common law controls unfair contracts and unfair contract provisions. Chapter three discusses the law which governs the quality of goods supplied under a credit agreement. Chapter 4 looks at provisions of the Hire-Purchase Act which govern credit. The fifth chapter deals with the law relating to security agreements which may be made in respect of credit agreements. Chapter G analyses all the regulatory provisions of the Hire-Purchase Act. Chapters seven and eight explore the possibility of public control of unfair exchange in these agreements. The former discusses how criminal sanctions could be used to re-enforce compliance with standards created by the Act while the latter shows that the whole regime could be made more effective by the introduction of a system of registration of traders who supply goods on credit. Chapter nine sums up all the findings of the thesis.

Il revêt la forme d'un prêt d'argent, d'une ouverture de crédit, d'un crédit-bail ou d'une location-vente. L'affirmation d'une unité conceptuelle et d'une autonomie de ce contrat spécial implique toutefois de dépasser les problématiques liées à son interdépendance avec le contrat financé, au monopole bancaire et ses nombreuses exceptions, et enfin, à la distinction notionnelle professionnel/consommateur. L'unité fonctionnelle apparaît dans l'adaptation des principes du droit commun des contrats par les règles applicables aux contrats de crédit. Le consensualisme, la liberté contractuelle et la force obligatoire des contrats sont confrontés aux mécanismes caractéristiques des contrats de crédit (formalités, devoir de mise en garde, délai de rétractation, interdépendance, remboursement anticipé, déchéance du terme, etc.). Beyond the diversity of legal techniques aimed at performing a credit operation, the credit agreement has its own unique definition. It can take the form of a money loan, a credit opening, a leasing agreement or a hire purchase. However, claiming the existence of a conceptual unity and autonomy for this special agreement implies going beyond the issues related to its interdependence with financed agreements, to the banking monopoly and its numerous exceptions, and to the distinction to be made between professional and consumer. Functional unity is visible in the adaptation of ordinary law of agreements principles through the rules applicable to credit agreements. Consensualism, contractual freedom and the binding force of agreements are confronted with credit agreements' typical mechanisms (formality, duty to warn, period of withdrawal, interdependence, early repayment, repayment by acceleration, etc.). This unity is nevertheless compromised by the acknowledgement of provisions specific to credit agreements granted to consumers

The credit rating measurement is changing from subjective judgment analysis and traditional financial rate scoring method into multi-variables, CAPM based with computerized system dynamic quantities approach. In Taiwan, there are only a small number of financials apply the credit scoring system on personal credit loan and credit card. There is no company to create the consumer installment credit analysis system. In the consumer installment market, the main subject is general consumer. We can not apply market –to-market model to value the consumer. The Default model is using to measure the credit risk of individual consumer. The new development approaches, including Generic Algorithms, Artificial Neural Network, Fuzzy theory, and Grey Theory, are seldom used to create personal credit risk model. The special characteristic of consumer installment market—wide product line but shallow product market, limits the applications of above measuring approaches on personal credit scoring system. We are used to apply subjective method such as 5C or 5P to judge personal credit. In multi-variables analysis the Probit and Logit model are popular in risk measurement model. But their explanation power and estimating coefficient are very similar. We choose only one approach is enough to do empirical research. The database setup is first priority for credit scoring system creation. We need to include not only the personal factor of consumer but also the basic data of customer, the data setup of credit data, the trading process and the connection with the customer. We need all the database can be worked consistence and cross connection with each other. The database setup, the related operation interface, and the integration of new and old system are the main factors to ensure the fluently usage of credit scoring system.

This master thesis deals with lease financing as one of the possible forms to acquire tangible investment goods. Furthermore other possibilities such as credit, hire purchase and cash purchase are evaluated. Based on the offers and other conditions proposed by companies, the objective of our investigation is to judge advantages and disadvantages of the individual financing products and choose the best option for enterprisers. The car was chosen as an example of the tangible investment good. This thesis is divided into two sections. The first theoretical part is focused on the particular possibilities of the financing of the tangible investment good and their tax and law aspects as well as their advantages and disadvantages. The second practical part is based on analysis of the leasing and credit products from following institutions: UniCredit Leasing CZ, a. s., CSOB Leasing, a. s., Credium, a. s. and Commercial Bank, a. s. The conditions and services provided by these companies are compared at the beginning. Calculations are performed for the particular car. The comparison is made from the point of view of all financial costs as well as discounted costs. Finally, all products are compared and evaluated not only according to their financial aspects but also according to other offered conditions and services.

Abstract:
Additive manufacturing, fundamentally, is computerized numerical controls using a specialized printer head as the “tool”. Any new curriculum implementing “additive manufacturing” stands upon the fundamental and advanced work done before in computer numerical controls. Although there certainly is a need for end user laboratories based upon purchased printers, the challenge in designing curriculums that support developing the next generation of additive manufacturing must also include computer numerical controls. The best designers must be able to picture the entire system when developing new systems. During the late twentieth and early twenty-first centuries, the “hands-on” engineering laboratories typical of the post-World War II engineering campus gave way to computerized laboratories and simulation. Traditional engineering assets (lathes, mills, drill presses, etc.) were retired as they aged without replacement in favor of computer laboratories full of PC’s and software. As the 20th century ended, there was a realization that computer simulation is no substitute for “cutting metal” or “making things”. Designers need to understand process in order to communicate with technologists from trade schools and industry. Even a simple engineering drawing can often simply not be created due to process limitations (e.g., a perfectly drawn internal 90-degree angle in a CAD drawing does not occur in nature OR a machine shop). As the four year universities shut down their hands on programs, the two year programs implemented complex computer numerical controls curriculums to train operators for industry. The incredibly expensive equipment needed to do this is funded by state governments trying to attract industry to the state. The four year universities, responsible for creating the next generation of manufacturing machines, do not have access to THIS generations machines. The National Science Foundation and state governments don’t see the need for upper level engineering students to have ready access to machines that cost up to a million dollars each. The universities fortunate to have CNC machines usually keep them locked away from the students for safety of the machines and the students. Technicians make things for the students on the limited number or machines available. There is no understanding of the machines and very little understanding of the processes the machines are doing. An earlier paper by the authors described a way to implement an affordable undergraduate “manual” innovation laboratory. This article describes an affordable way for upper level universities to implement an effective machine design atmosphere for subtractive and additive manufacturing. The students modify existing machines from that earlier laboratory into multi-axis CNC machines. Students have successfully built five axis mills, lathes with live tooling and now a unique metal printing machine. The goal is not to create operators, but to enable designers of the next generation of machines. At the very least, students are immediately useful as design engineers when hired by companies making the most advanced (and expensive) additive/subtractive machines. The emphasis is not on expensive super machines but on very capable simple machines as emphasized in the Toyota Production System. One specific, inexpensive example will be provided for other institutions to utilize. The result has been an affordable laboratory that supports undergraduate students, graduate research students, and the university as a whole while teaching the design and control of computer numerical machines.
