Abstract:
This chapter examines the access to combatant status by members of non-state armed groups from a historical perspective. It demonstrates that practically since the time the distinction between combatants and non-combatants had solidified into law, the applicable rules have permitted members of at least some non-state armed groups to benefit from combatant status. At various times in the history of regulation of armed conflicts, these groups have included militias and volunteer corps, armed forces professing allegiance to a non-recognized governmental authority, and national liberation movements. Overall, the historical analysis presented in this chapter suggests that it would be erroneous to interpret the rules on eligibility for combatancy in the context of internationalized armed conflicts in an unduly restrictive manner.

Abstract:
This chapter traces the development of the law of belligerent occupation in order to identify trends relevant to the regulation of internationalized armed conflicts. It observes that despite the general grounding of this body of law in a state-centric paradigm, several isolated developments have contemplated the possibility of non-state actors becoming belligerent occupants of a portion of state territory. Moreover, the chapter highlights that the law of belligerent occupation has undergone a fundamental transformation as part of a general trend of individualization and humanization of international law. Therefore, it is no longer simply a brake on inter-state relations and a protector of states’ interests and institutions. Instead, the law has gradually brought individuals’ interests to the fore, putting persons before institutions and individuals before states. Overall, the chapter uncovers the historical reasons that support an extensive view of the applicability of the law of occupation to modern internationalized armed conflicts.

Abstract:
This chapter examines the historical development of State immunity, from the absolute to the restrictive doctrine that distinguishes between acts jure imperii and jure gestionis. The provenance of the law on the jurisdictional immunity of States is widely held to be the case of Schooner Exchange. Although Schooner Exchange is, generally but not quite accurately, regarded as the authoritative anchor for the classical doctrine of absolute State immunity, Chief Justice Marshall saw immunity as an exception to the absolute jurisdiction of a State within its own territory. The chapter also examines the rationale of State immunity, which is based on the three major attributes of statehood: independence, sovereign equality, and dignity. The sovereignty of a State encompasses its jurisdiction over people and property within its territory. State immunity is a derogation of that jurisdiction. A major justification for State immunity is facilitation of international relations in conformity with international law.

Abstract:
Chapter 9 considers the development of pragmatic scalar modifiers from a historical point of view. The main point is that although the directionality of the semantic change of scalar modifiers can be captured under a general path of semantic change or grammaticalization (i.e. propositional $>$ (textual) $>$ expressive; Traugott 1982), the semantic shift of scalar modifiers is not lexically at random. The chapter argues that semantic change in scalar modifiers is constrained or regulated by their lexical and morphosyntactic properties. At the lexical level, this constraint means that semantic change does not occur if the source meaning does not fit with an expressive mode. At the morphosyntactic level, there is a general constraint that the elements used for expressing a particular CI meaning must form a constituent. Finally, the relationship between syntactic change and semantic change is also discussed.

The content of human rights is usually understood by reference to the legal catalogue of human rights we find developed through international texts. ‘Historical development and contemporary concerns’ examines the key text for human rights today—The Universal Declaration of Human Rights—adopted in 1948 by the UN General Assembly. Since that time many treaties and intergovernmental Declarations have supplemented this proclamation of rights. The treaties are best viewed as providing a framework against which we can legitimately judge the performance of governments. How did this human rights catalogue come about? What roles did the League of Nations and Second World War play?
