Abstract:
In international and national jurisprudence it can be noticed that, under certain circumstances, courts are prone to limit some of the owners' entitlements with regard to their immovable property so as to enable the use of such property by other persons or families as their home. This trend is due to the growing population on the planet, a drastic social stratification, mass migration and etc., on the one hand, and efforts to mitigate problems and growing tensions in society by pursuing appropriate social and legal policies, on the other hand. There are legal loopholes in this area that courts tend to eliminate by extensively interpreting international conventions, sometimes even referring to something that is not stipulated therein. For instance, courts colloquially and in a simplified manner speak of limitations of the ownership right by the right to home. Systematic analysis of the relevant international documents, nevertheless, reveals that this subject matter is indeed covered by three rights: 1. the right to adequate conditions for establishing home; 2. right to respect home and 3. right to protect home. Even though they are neither exhaustively enumerated as such in intentional documents, nor terminologically determined, they make a logical sequence that undoubtedly emanate from the human rights catalogue and court decisions that have been rendered in past seventy years. In the jurisprudence of the European Court of Human Rights and national courts, ownership right has been mainly constrained so as to enable an uninhibited life in the space considered home and so as to prevent eviction from that space. In such circumstances, the court shall give the preference to one of the two fundamental rights: the ownership right or the right to home. This is achieved through the so-called balancing of interests. In order for the outcome of such balancing to be as fair as possible, it is primarily necessary to determine whether a particular space can be considered home. In this respect there often exist certain dilemmas. They are the consequence of the absence of a precise definition, or even of a more widely accepted terminological determination of the notion home. In this paper, this phenomenon is discussed in detail in a broader historical and comparative context. The analysis has revealed that in Europe from ancient times to the end of XVIII century, home was considered a community of persons and goods (univesitas rerum et personarum), and that it consisted of two components: tangible (referring to the space and things) and intangible, spiritual (referring to the connections between community members and their emotional connection to the space). The emergence of liberal ideology, associated with materialism and an individualised concept of law, influenced the change in its perception. In the modern world, and especially in the field of economy, home has been reduced to the living space. Nevertheless, when considering the request to limit the ownership right so as to preserve home, the court shall establish if there are spiritual attachments of the user to the specific living space that justify preferring his/her needs over material interests of the owner. Eventually, provided that the court decides to limit the ownership right, it shall determine how the owner will be compensated for the use of his/her space. As a rule, that burden shall be borne by the person who continues using that space. If, however, that turns out to be impossible, financial means for the use of living space shall be secured by the state from the funds aimed at financing social programs. By way of ratified international conventions, the state is, in general, obliged to do that. Besides, the article also gives an overview of the examples of active legal policies and examples of good practice in comparative law. The legal policy of the Republic of Serbia and its court practice in this respect are also examined.

Article presents the history of contradiction between science and the Bible and how it was solved in Dogmatic Constitution on Divine Revelation Dei Verbum of the II Vatican Council. Since biblical truth was given to us “for the sake of our salvation,” and not in order to teach us natural science or history for their own sake, Sacred Scripture cannot be fairly judged to be in error when it sometimes presents historical or scientific truth in a less complete, less detailed, more popular, or more imprecise (i.e. merely approximate) fashion than would be acceptable in modern texts dedicated formally to those disciplines.

Abstract:
The topic of this article is the contract of lemšat (Lehenschaft) in Serbian medieval mining law. The author discusses the details of this legal and social institution in medieval Serbia by answering the following two questions: What was the scale of transplantation of Saxon law, i.e., how original were the Serbian rules? Who were the lenhavars – the contractors in a special type of lemšat? The results of the investigation show that Serbian lemšat was a contract of the temporary lease of a share in a mining partnership and that the lenhavars were qualified miners, whose employment was occasionally necessary. The results also show that Serbian medieval mining law contained numerous original legal solutions. The applied methods are linguistic, systemic and historical interpretation of the Mining Code of Despot Stefan, as well as the comparative method.

Abstract:
Purpose: The article made in the framework of such a new, but dynamically developing trend for post-Soviet historiography, that is the history of Soviet childhood, aims to identify and study the role and the place of periodicals for children in Soviet educational practices. Methodology: The work also used the methods of historical psychology, in particular, child psychology, in order to identify specific ways of educational impact on target reading group among children. Result: The results of the study are represented not only by potential informational capability description of such a historical source that is poorly studied by domestic and foreign source science, as the Soviet periodicals for children (in particular, the newspaper "Pionerskaya Pravda"), but also by the determination of the Soviet child media space possibilities concerning the education of "militant atheists". The materials of the article can be used in the process of the Soviet history of Russia, the history of religion, the history of childhood teaching, as well as the history and source study of periodicals in the USSR. Applications: This research can be used for universities, teachers, and students. Novelty/Originality: In this research, the model of the Antireligious campaign of the Soviet power during late 1920s and "Pionerskaya Pravda" newspaper is presented in a comprehensive and complete manner.

Despite the short remaining time to rescue unique cultural and personal materials stored on many twentieth- and early twenty-first-century audiovisual and digital storage media, realistic rescue options are starkly limited. Building a rescue apparatus in house, especially to archival standards, requires significant expertise and expense and is often of limited continuing use. Outsourcing digital capture of these materials overwhelms the resources of even well-funded academic libraries and archives, never mind public libraries, small archives, and local historical societies. To address this problem realistically, the University of Wisconsin-Madison Information School has built and documented an in-house rescue installation called RADD (Recover Analog and Digital Data) as well as two self-contained, portable, and shippable rescue kits: PROUD (Portable Recovery of Unique Data) for digital materials and PRAVDA (Portably Reformat Audio and Video to Digital from Analog) for audio and video. All three units are actively rescuing cultural heritage materials, as well as serving training and outreach functions.

Abstract:
To search the roots of historical institutions in deep antiquity is a way which is completely justified and even necessary. However, it so happens that sometimes under new conditions even the most ancient phenomena undergo such strong transformations that their initial characteristics could not be found by simple reading of historical documents of law. One of these phenomena, according to the author, seems to be the institute of the Old Russia’s private audit to be visibly found in the financial life of the Slavs after a deep examination of trade customs and traditions of making deals. Such acts as “Zaklich”, “The Commandment on Bargaining” in Oustav of the Grand Prince Jaroslav Vlademerich of Sudh, article 27 of the section “On Chelyadins” in Pravda Rouskaya and similar provisions included in the Code of Trade Law describe the procedure which makes us admit that private control in Ancient Russia existed.

Diploma thesis explains the development of the metropolitan area of the capital city Prague and also shows the process of urbanization with emphasis into local specifities. Thesis approximates the local urbanization process and its phases through the detail subscription of this phenomenon which is later applied to Europe and also Eastern Europe. This part of thesis describes eastward influence and its specific developmental stages and changes in Prague metropolitan area. Thesis practically shows each of the selected period and phase of development in the metropolitan area with the definitions of key milestones for the development of spatial and architectural layout of the city and its surroundings. Work confronts theoretical assumptions of urbanization and suburbanization under scrutiny of its developmental specifics and historical contexts, and in the final part, case study provides the subjective opinion of the author on the future development of the area according to the historical processes.

Abstract:
This thesis is mainly interested in the legitimation of controversial past actions and/ or decisions. The thesis examines the discursive means used to regain legitimacy in contexts of controversy. The thesis approaches Hassan Nasrallah’s argumentative discourse from an interdisciplinary perspective. It, therefore, proposes a model for incorporating pragmadialectics into the analytical toolkit of the Discourse-Historical Approach (DHA). Moreover, insights from cognitive pragmatics, in particular research related to epistemic vigilance, are incorporated into the model. The main objective of the model is to investigate the construction of in/out-groups through carrying out argumentative analysis. To this end, four speeches delivered by Nasrallah at moments of heightened controversy are analysed based on the proposed model and the procedural steps for implementation. The findings are then discussed in order to evaluate the feasibility of the proposed model and Nasrallah’s retrospective argumentation.

Isto Ã: esse romance permite ao leitor fazer contato com grandes vultos histÃricos, mas, principalmente, com personagens menores â pessoas comuns, sem qualquer relevÃncia para a historiografia oficial. Portanto, o contato com o acontecimento nÃo se faz de forma distanciada, mas Ãntima, e o envolvimento do leitor à bem maior, pois se dà na identificaÃÃo que tem com o personagem de ficÃÃo, atravÃs da verdade pessoal do prÃprio personagem, que se revela em suas aÃÃes. In the historical novel As minas de prata, written by Josà de Alencar, one may notice a clear intent to keep records of historical facts beyond what it was kept in History books. In other words, this novel gives the reader the opportunity to know important historical facts, but, mainly, get to know minor characters â average people, with no relevance to the official historiography. Therefore, the approach to the facts does not happen from a distant perspective, but an intimate one. The reader gets involved in a broader way, since he identifies himself with the fiction characters. Such relationship happens through personal truths the characters convey, revealed through their actions. The making of a hero, with personal pursuits above subjects such as loyalty to motherland and his people, make EstÃcio the main character of the novel, closer to problematic characters of modern times, despite being wrapped in an epic aura and with other characters who serve to enhance other aspects. A meticulous study of the novel reveals the authorâs choice to use a historical fact as an instrument of the nationalization of Brazilian literature in the 19th century. Alencar intended to create peopleâs historical conscience, bridging the gap between the real facts from the past and the reader, in order to engrave in his spirit the nationality pride. By being carried away to the world of one of the characters, the reader feels intimately connected to that character, by participating of the daily life, by being conscious of his countryâs social and political development, by finding his origins, even living with notorious characters from the past â without the detachment that official accounts impose. This approach occurs through the readerâs identification with the passion that moves the characters, revealing their personal truths.

Esta tese focaliza a obra de Neusa Welter Bocchese, artista nascida no Município de Vacaria, Rio Grande do Sul, em 1936, que reside em Antônio Prado, cidade que até hoje é tema de sua produção, iniciada em 1983. Com o objetivo de analisar suas representações da cidade, selecionamos 64 imagens de sua obra, distribuídas em oito grupos, para, sob a perspectiva de Burke (2017), avaliar o papel dessas imagens como evidências históricas e como testemunhos do processo cultural Itália-Brasil e, ainda, em que medida sua obra contribui para a preservação da identidade da região Nordeste do Rio Grande do Sul, considerando os fatores recepção, produção e temática. Olhando de uma perspectiva da história cultural, nossa análise é subsidiada pela metodologia acerca da representação ligada às práticas de leitura proposta por Chartier (2002). Também nos baseamos nos pressupostos teóricos de Stüben (2013), quanto à ideia de região como paisagem literária, aqui transposta para o campo da arte, e de Nora (1993), no que concerne aos lugares de memória, incluindo, ainda, as contribuições da literatura, por meio dos romances de Calvino (1990) e Pozenato (2000). Visto que a identidade é marcada por meios simbólicos, foi possível, a partir do cruzamento das leituras da artista acerca da cidade de Antônio Prado e das leituras que fazemos dos significados de suas representações, identificar que ela explicita o discurso do tombamento, mas, sobretudo, reescreve novos textos a partir do primeiro, sublinhando as diferenças que classificam um grupo cultural regional. Nas representações do vivido por outros, no tempo passado, e do vivido por Bocchese no tempo presente, a artista ora mantém similaridade com a cidade, ora a desmonta, reelaborando-a em novos arranjos, mas sem romper sua ligação com ela. Referindo-se às edificações e aos monumentos, Pozenato (2003) observa que, enquanto permanecem determinadas manifestações que identificam uma cultura, aquela cultura existe, mas na visão política de preservação cultural talvez não fosse necessário conservar o próprio monumento físico, já que a preservação da memória seria suficiente. Assim, podemos inferir que, do mesmo modo que Antônio Prado é lugar de memória, a obra de Bocchese surgida do/no contexto associado à imigração italiana torna-se lugar de memória. Suas representações são interpretações das práticas culturais de um grupo, constituindo-se em outro tombamento, antes mesmo do oficial, pelo IPHAN, em 1989. E, ainda, suas representações presentificam os elementos simbólicos não preservados em outras cidades da RCI, que são, então, materializados em sua obra – testemunho e identidade da regiã
This thesis focuses on the work of Neusa Welter Bocchese, an artist born in Vacaria in 1936, who lives in Antonio Prado, a city that until today is the theme of her production, which begun in 1983. In order to analyze her representations of the city, we selected 64 images of her work, distributed in eight groups, in order to evaluate, from Burke (2017), the role of these images as historical evidences and as testimonies of the Italian-Brazilian cultural process, and to what extent her work contributes to the preservation of the identity of the Northeast Region of Rio Grande do Sul, considering the reception, production and thematic factors. Looking from a cultural history perspective, our analysis is subsidized by the methodology of representation related to reading practices proposed by Chartier (2002). We also draw on the theoretical assumptions of Stüben (2013), on the idea of the region as a literary landscape, transposed here into the field of art and, on Nora (1993), regarding places of memory, including contributions of literature, through the novels of Calvin (1990) and Pozenato (2000). Since identity is marked by symbolic means, it was possible, from the intersection of the artist's readings about the city of Antonio Prado, and the readings we make of the meanings of her representations, to identify that she explicitly explains the discourse of the tipping, but, above all, rewrites new texts from the first, highlighting the differences that classify a regional cultural group. In the representations of what was lived by others, in the past tense, and of the lived by Bocchese in the present time, the artist sometimes maintains similarity with the city, sometimes dismantles it, reworking it in new arrangements, but without breaking its connection with her. Pozenato (2003) observes that, while certain manifestations that identify a culture remain, that culture exists, but in the political vision of cultural preservation it might not be necessary to preserve the physical monument itself, since preservation of memory would suffice. Thus, we can infer that, just as Antonio Prado is a place of memory, Bocchese's work emerged from the context associated with Italian immigration, which becomes a place of memory. Her representations are interpretations of the cultural practices of a group, forming another one, even before the official, by IPHAN, in 1989. Moreover, her representations prestige the non-preserved symbolic elements in other RCI cities, which are then materialized in her work – witness and identity of the region.

Essa proposta de trabalho apresenta um estudo específico sobre a conservação de edificações históricas de madeira. A região sul do Brasil apresenta um grande acervo de edificações em madeira construídas pelos imigrantes europeus que colonizaram a região no final do século XIX e na primeira metade do século XX. No entanto, não existem programas específicos de conservação deste patrimônio. A cidade de Antônio Prado, localizada na serra gaúcha, aproximadamente a 180 km de Porto Alegre, foi escolhida como estudo de caso, por apresentar um conjunto de edificações históricas de madeira construídas por imigrantes italianos. O estudo serviu para diagnosticar os principais problemas patológicos das edificações e propor medidas de preservação para o patrimônio local. Como referencial teórico sobre preservação de patrimônio edificado em madeira foram pesquisadas a cidade de Bergen na Noruega e a Ilha de Chiloé no Chile. A metodologia da conservação preventiva apresenta muitas semelhanças com as características e medidas de proteção da madeira, sendo utilizada como parâmetro para a elaboração de medidas preventivas para o estudo de caso. Por meio dos estudos realizados verificou-se a importância e o potencial da participação da população local nos trabalhos de conservação. Esta condição é explorada sob a forma de divulgação de informações técnicas que tornem a população apta a conservar o patrimônio. Com este propósito, elaborou-se um manual sobre o tema que visa fornecer conhecimento para a prevenção de agentes degradadores e ilustrações com detalhes construtivos adequados para a conservação da madeira. Além das ações preventivas, as medidas de conservação buscam despertar, na comunidade local, a consciência quanto à sua identidade cultural e à responsabilidade com seu patrimônio histórico e artístico.
This proposed work presents a study about the conservation of historic buildings of wood. The southern region of Brazil presents large collection wooden buildings built by European immigrants that colonized the region in the late nineteenth century and the first half of this century. However, there are no specific programs for the conservation of this heritage. The city of Antonio Prado, located in Serra Gaucha, approximately 180 km from Porto Alegre, was chosen as a case of study by presenting a set of historic wooden buildings built by Italian immigrants. The study was used to diagnose the main pathological problems of buildings and propose measures for the preservation of local heritage. As theoretical references about the preservation of built heritage in wood there were surveyed the cities of Bergen in Norway and the island of Chiloé in Chile. The methodology of preventive conservation has many similarities with the features and measures to protect the wood and is used as a paramenter for the development of preventive measures for the case study. Through studies the importance and potential of local participation in conservation work was verified. This condition is explored in the way of dissemination of technical information to make people able to preserve the patrimony. For this purpose, a manual was elaborated on the subject that aims to provide knowledge to the prevention of degrading acting and illustrations with suitable constructive details for wood preservation. In addition to the preventive actions, the conservation measures seek the awakening consciousness in the local community for its cultural identity and for its responsibility to the historical and artistic heritage.

Este estudo contribui para a história da cidade e do porto de Santos (SP) por meio do uso da literatura como documento histórico. Para isso, levantou as condições em que o romance Navios Iluminados (1937) foi escrito, destacou a obra entre outras ficções que têm o porto de Santos como tema e, por fim, interpretou os conteúdos históricos do romance de Ranulpho Prata, comparando-os a outras fontes documentais. A conclusão sugere um novo papel da obra na história literária brasileira.
This study contributes to the history of the city and the port of Santos (SP, Brazil) by using literature as a historical document. To do so, it researched the conditions in which the novel Shinning ships (Navios Iluminados, 1937) was written, highlighted the book among other fictions that have the port of Santos as a theme, and finally interpreted the historical contents of the novel by Ranulpho Prata, comparing them to other documentary sources. The conclusion suggests a new role of this work of art in Brazilian literary history.

In the historical novel As minas de prata, written by José de Alencar, one may notice a clear intent to keep records of historical facts beyond what it was kept in History books. In other words, this novel gives the reader the opportunity to know important historical facts, but, mainly, get to know minor characters – average people, with no relevance to the official historiography. Therefore, the approach to the facts does not happen from a distant perspective, but an intimate one. The reader gets involved in a broader way, since he identifies himself with the fiction characters. Such relationship happens through personal truths the characters convey, revealed through their actions. The making of a hero, with personal pursuits above subjects such as loyalty to motherland and his people, make Estácio the main character of the novel, closer to problematic characters of modern times, despite being wrapped in an epic aura and with other characters who serve to enhance other aspects. A meticulous study of the novel reveals the author’s choice to use a historical fact as an instrument of the nationalization of Brazilian literature in the 19th century. Alencar intended to create people’s historical conscience, bridging the gap between the real facts from the past and the reader, in order to engrave in his spirit the nationality pride. By being carried away to the world of one of the characters, the reader feels intimately connected to that character, by participating of the daily life, by being conscious of his country’s social and political development, by finding his origins, even living with notorious characters from the past – without the detachment that official accounts impose. This approach occurs through the reader’s identification with the passion that moves the characters, revealing their personal truths.
No romance histórico As minas de prata, de José de Alencar, pode-se perceber uma clara preocupação com o registro dos fatos históricos para além do que está gravado nos livros. Isto é: esse romance permite ao leitor fazer contato com grandes vultos históricos, mas, principalmente, com personagens menores – pessoas comuns, sem qualquer relevância para a historiografia oficial. Portanto, o contato com o acontecimento não se faz de forma distanciada, mas íntima, e o envolvimento do leitor é bem maior, pois se dá na identificação que tem com o personagem de ficção, através da verdade pessoal do próprio personagem, que se revela em suas ações. Essa constituição de um herói, com buscas pessoais acima das questões de lealdade à pátria e ao seu povo, torna Estácio, o personagem central da obra, mais próximo de personagens problemáticos da modernidade, apesar de envolto em uma aura épica, e outros personagens servem para acentuar um ou outro aspecto. Um estudo minucioso da obra revela o uso que o autor faz do fato histórico como instrumento de nacionalização da literatura brasileira no século XIX. Alencar pretende criar a consciência histórica do povo, aproximando os acontecimentos reais passados do próprio leitor, de forma a gravar-lhe no espírito o sentimento de nacionalidade. Ao ser transportado para a vida de uma das personagens, o leitor sente-se intimamente ligado a ela, participando dos acontecimentos que se desenrolam, tomando consciência do desenvolvimento político e social de seu país, descobrindo suas origens, convivendo até com figuras ilustres do passado, sem o distanciamento que a história oficial impõe. Essa aproximação se dá através da identificação do leitor com as paixões que movem os personagens, reveladoras de suas verdades pessoais.

A mensagem resultante desse universo visual pode ser utilizada para transmissão de conhecimento acerca do patrimônio local, mas requer um meio eficiente de comunicação para transformar esse potencial em informação clara e precisa, para entendimento e consumo dos usuários. Conforme constatado na analise dos projetos de sinalização visual ambiental do Parque Estadual Serra da Cantareira em São Paulo (Brasil), Güirã-Oga em Misiones, (Argentina) e Jardim Botânico no Rio de Janeiro (Brasil), os sistemas sinaléticos compostos por imagens e textos elaborados a partir da leitura e síntese do repertório local além de informar, direcionar e orientar, ainda provocam no usuário a reflexão crítica sobre as questões do patrimônio, com repercussão positiva para todo sistema. Dessa idéia, deriva a elaboração de diretrizes gerais para projetos de sinalização visual ambiental para parques urbanos Sul-Americanos, com o propósito de irradiar conhecimento sobre as paisagens naturais e culturais dos países da América Latina e em conseguinte, obter os benefícios inerentes como proteção e conservação. The South American urban parks keep both historical and cultural reminiscences that are crystallized in their natural areas, in their monuments, and in their architecture. On the one hand, the message one acquires from this visual universe may be used to transmit knowledge about the local patrimony; however, it requires efficient communication means to transform this potential into clear and accurate information that leads to users\' understanding and consume. As verified in the visual environmental signage projects of Parque Estadual Serra da Cantareira in São Paulo (Brazil), Güirã-Oga in Misiones (Argentina), and of the Botanic Garden in Rio de Janeiro (Brazil), the signal systems - composed of images and texts based on research conducted in those areas and on the synthesis of the gathered information - not only inform, direct, and guide, but also lead users to make critical reflection on questions related to the patrimony, with consequent positive effects on the system as a whole. This idea is the basis from which visual environmental projects for South American urban parks are derived aiming to disseminate knowledge about natural and cultural landscapes of Latin American countries, and as a result, obtain the inherent benefits such as protection and conservation. In order to subsidize the elaboration of guidelines, an analytical basis for the urban parks will be planned based on a comparative analysis of the Parque Metropolitano in Santiago (Chile), Ibirapuera in São Paulo (Brazil), Tres de Febrero in Buenos Aires (Argentina), and Del Prado in Montevideo (Uruguay). The methods and practices chosen to research and analyze the parks comply with Kevin Lynch\'s set of multimedia (1960) used for creating the urban design for American cities.

The Construction of Historical Reality in Jean Froissart's Chronicles Jean Froissart, one of the most famous chroniclers of the Middle Ages, is generally recognized for the literary qualities of his work, less so for the credibility of his account. In my research I have endeavoured to follow those scholars whose aim has been to rehabilitate the author by studying him not on the basis of principles which govern our contemporary understanding of history as an academic discipline, but rather on the basis of conceptual movements which conditioned historical writing in the 14th century, taking into account the traditions upon which medieval conception of history was built. Put differently, this work seeks to examine closely the "historical forge" of Jean Froissart. Clearly, Froissart's historical project falls within a specific discourse on historical genres, on relationships between form and truth which an account of deeds is expected to convey, on the manner in which the authority of a story being told is constructed. It is on the very intersection of this context, on the one hand, and the individuality of the author, on the other, that I based my search for the chronicler's perspectives on the writing of history. Froissart was from the outset concerned with the issues of impartiality and credibility...

AbstractWith the growing interest in digital humanities, the methodology of digital art history is in some respects lagging behind the trend. Given the prospects of the new digital image analysis, computer vision, and visualization methods, a number of questions have arisen as to how exactly the new digital methods can and should be applied to art history. Furthermore, when trying to apply these digital methods to the analysis of Russian art, one encounters a whole new set of questions and challenges. In this chapter, I examine current and potential applications of digital methods to the analysis of Soviet political cartoons published in Pravda during the “Great Patriotic War,” 1941–1945, as well as the study of Russian art history more generally. I especially examine how the combination of quantitative and qualitative analyses of political cartoons enables a deeper understanding that illustrates cultural, historical, and political developments over time.

Rarely would an auteur choose a female protagonist as the lead character for one's debut film. In 1935, Jyoti Prasad Agarwal chose a historical figure of Ahom princess Joymoti as the central character for the first Assamese film. Was it enough to portray an Ahom princess as the lead character, or was it lending the historical figure a new perspective? During the stated period in Assam, the cult of Joymoti had gathered momentum. In this discourse, much emphasis was given on Joymoti sacrificing her life rather than revealing the whereabouts of her husband Prince Gadapani to the state authorities. This chapter seeks to explore how the social status of women was addressed and tackled in the film.

This chapter examines the most interesting as also the least known event of the 1970s when Chandi Prasad Bhatt, pioneer of the Chipko Andolan and M.N. Deshpande , as director general, collaborated to save the Hindu shrine of Badrinath. In 1973, the Birlas, through their charity – the Jayshree trust – had begun constructing a cement and steel structure around the traditional architectural form of the temple. By July-August 1974, because of Bhatt’s intervention in Lucknow and in Badrinath, this work came to a halt. A high powered government committee carefully examined the Badrinath makeover by the Birlas and Deshpande became the man whose report provided a hard-hitting indictment of what the temple had been reduced to. For Chandi Prasad Bhatt, safeguarding the Badrinath temple’s traditional form mattered as much as saving trees. It was a vision that Deshpande shared. Once construction work halted there, Deshpande practically took over matters hand and eventually, it was his planning and foresight which resulted in ensuring that a historic temple shrine was not converted into a kind of Birla temple.

Romain Rolland wrote his first letter to Tagore on 10 April 1919 from Villeneuve, Switzerland, requesting him to sign the historical Declaration of the Independence of the Spirit. Tagore responded immediately. From a formal beginning, they quickly became close friends and exchanged 56 letters and telegrams till 1940. This correspondence also includes Tagore’s crucial letter to Manchester Guardian on 5 August 1926 after the Tagore–Mussolini controversy. Additionally, it includes letters by Rathindranath Tagore, Anil Chanda, and others. Tagore’s last letter was written from ‘Uttarayan’, Santiniketan to Rolland in Vézelay, France on 10 April 1940. The correspondence also has the English translation of Tagore’s poem, ‘Praved’, sent to Rolland expressing the similarities and differences between the two.

This chapter describes and critically reviews all the phases of an enquiry supported by the Museo Nacional del Prado in Madrid on an almost unknown project of a monument for Felipe IV of Spain in the portico of the Basilica of S. Maria Maggiore in Rome designed by Gian Lorenzo Bernini. The process consists of analysis and re-drawing after the existing documents, of modeling of the solid-perspective sacellum and the bronze statue actually made by Girolamo Lucenti, and of presentation and dissemination of the results, in form of video in the exhibition in Madrid and in other visual product to illustrate scientific publications. This process has been didactically divided between digital heritage, the translation of tangible historical-testimonial documents into digital formats, and virtual heritage, the production of original digital contents aimed at visually recreating the unbuilt monument and its perspective deceptive effects.

Studies for the Historical-Critical Analysis of a Historical Center. The Case Study of Castel CamponeschiAim of the paper is the historical-critical study of Castel Camponeschi (aka Castello di Prata), a village at about 25 km from L’Aquila city (Italy), with peculiar urban characteristics –a herringbone pattern– probably founded in the thirteenth century and characterized by important phenomena of modification and stratification. The study roots on the direct analysis of the built heritage through the architectural surveying, realized at multiple scales from the urban settlement to the masonry structures. According to the morphology of the historic center, it could be traced to the process of new settlement foundation that characterized the territory –the border between the Papal State and the Frederic’s Empire first, and then the Angevin kingdom–. The analysis of the village requires both a correlation with the natural and anthropic historical context in which it is inserted and, a specific study of masonry equipments, characterized by the re-used of stone elements from the nearby Vestino-Roman town of Peltuinum.

The modern state administration and its bodies and special organizations should act in the field of the rule of law. It is a term that originates from the Anglo-Saxon legal world, but it is also a category and a principle of the Constitution of Serbia from 2006. The paper points out the different understandings of the rule of law and briefly looks at the position of the administration or the phase in its historical course until its subsumption under the principle of legality. In Serbia, state administration bodies consist of ministries, administrative bodies within the ministry and special organizations. Administrative or special organizations are formed by the state in order to perform professional and related administrative tasks. In order to permanently and unhinderedly perform the professional work of these organizations, they can act authoritatively. Special organizations have numerous and diverse administrative powers. The paper points out both the similarities and differences of special organizations in relation to administrative bodies. A review of the activities and organizational structure of all special organizations (secretariats, institutes, directorates and one center) established by the Law on Ministries from 2020 was performed. It was also pointed out that all institutes: the Republic Institute of Statistics, the Republic Hydrometeorological Institute, the Republic Geodetic Institute and the Intellectual Property Institute are special organizations that provide services to interested parties. In one part of the final considerations, the author states that for special organizations (as part of the state administration) it could be concluded that they really operate in the field of rule of law as an order with positive properties as characterized by the Constitution, it is necessary to strictly respect the principles organization of state administration prescribed by the Law on State Administration: independence and legality; expertise, impartiality and political neutrality, effectiveness in exercising the rights of the parties, proportionality and respect for the parties; publicity of work.

Abstract:
The subject of the study is the cooperation of S. Efremov with Western Ukrainian periodicals as a page in the history of Ukrainian journalism which covers the relationship of journalists and scientists of Eastern and Western Ukraine at the turn of the XIX-XX centuries. Research methods (biographical, historical, comparative, axiological, statistical, discursive) develop the comprehensive disclosure of the article. As a result of scientific research, the origins of Ukrainocentrism in the personality of S. Efremov were clarified; his person as a public figure, journalist, publisher, literary critic is multifaceted; taking into account the specifics of the memoir genre and with the involvement of the historical context, the turning points in the destiny of the author of memoirs are interpreted, revealing cooperation with Western Ukrainian magazines and newspapers. The publications ‘Zoria’, ‘Narod’, ‘Pravda’, ‘Bukovyna’, ‘Dzvinok’, are secretly got into sub-Russian Ukraine, became for S. Efremov a spiritual basis in understanding the specifics of the national (Ukrainian) mass media, ideas of education in culture of Ukraine at the end of XIX century, its territorial integrity, and state independence. Memoirs of S. Efremov on cooperation with the iconic Galician journals ‘Notes of the Scientific Society after the name Shevchenko’ and ‘Literary-Scientific Bulletin’, testify to an important stage in the formation of the author’s worldview, the expansion of the genre boundaries of his journalism, active development as a literary critic. S. Yefremov collaborated most fruitfully and for a long time with the Literary-Scientific Bulletin, and he was impressed by the democratic position of this publication. The author’s comments reveal a long-running controversy over the publication of a review of the new edition of Kobzar and thematically related discussions around his other literary criticism, in which the talent of the demanding critic was forged. S. Efremov steadfastly defended the main principles of literary criticism: objectivity and freedom of author’s thought. The names of the allies of the Ukrainian idea L. Skochkovskyi, O. Lototskyi, O. Konyskyi, P. Zhytskyi, M. Hrushevskyi in S. Efremov’s memoirs unfold in multifaceted portrait descriptions and function as historical and cultural facts that document the pages of the author’s biography, record his activities in space and time. The results of the study give grounds to characterize S. Efremov as the first professional Ukrainian-speaking journalist.
