Abstract:
For years Ronald Dworkin has been a leading academic defender of individual rights. The political and jurisprudential theory underlying his defense has had enormous influence. Defense of the rights of homosexuals has been a prominent theme in his writings. In 1966 he published his well-known critique of Lord Devlin’s critical essay on the Wolfenden’s Committee’s recommendations that sexual relations in private between consenting homosexual adults be de-criminalized (reprinted in 1978b, ch. 10). In recent writings, he has condemned key rulings by American courts that denied certain basic rights to homosexuals. References to the rights of homosexuals are made in many of his works. But nowhere does Dworkin present a developed argument for homosexual rights. He appears to think that support for the rights of homosexuals follows naturally from his political-legal theory. But does it? If so, how? And how adequate is such a defense?

Abstract:
During the last decades there has been a change of attitude regarding the recognition of homosexual rights that is also reflected on their claims for recognition of their right to access to Medically Assisted Reproduction (MAR) or adoption.Although the Greek legislator has shown some signs of progressiveness by adopting laws that ensure the homosexuals’ rights, they have chosen not to include the homosexual couples in the l. 3719/2008 regarding civil partnership. In Greece, discussions concerning the integration of homosexuals in the civil partnership had already commenced during the vote of the relevant law. This discussion has revived after the conviction of our country by the ECHR in the case of Vallianatos and Others vs Greece. For the time being, however, the legal situation in Greece, as far as the homosexuals’ access to MAR or adoption is concerned, entails the following conclusions. Firstly, although the legal right to procreation is established in article 5 §1 of the Constitution, reality differs for homosexuals and especially for homosexual couples in Greece, which do not have access to MAR methods. It is quite common, in practice, for one of the members of a lesbian couple with fertility problems to visit a doctor as a single woman and gain access to MAR methods. On the contrary, homosexual men do not have any chance of having access to MAR methods either as single men or as a couple.Regarding the homosexuals’ access to adoption, Articles 1452 et seq. Civil Code make no specific reference either to the adopters’ sex or to their sexual orientation. So, in principle, it is possible for a single homosexual person to adopt a child. However, homosexual couples do not have the chance to be monitored by the social service in charge. According to articles 1545 et seq. Civil Code the same person’s adoption by more people at the same time is not possible unless they are married. Given the fact that in Greece same-sex marriage is not permitted, there is no possibility for a child’s adoption by a homosexual couple. In view of the above, there is a clear need for modernization of Family Law regarding the protection of the homosexuals’ rights as an attempt to cope up with contemporary social facts.

Abstract:
If he is known for anything other than his writings, James Baldwin is best known for his work as a civil rights activist. What is often overlooked is Baldwin’s work toward uniting two under-represented and oppressed groups: African Americans and homosexuals. With his first novel, Go Tell It on the Mountain, Baldwin began a career of speaking about and for homosexuals and their relationship with the institutions of African-American communities. Through its focus on a sensitive, church-going teenager, Go Tell It on the Mountain dramatizes the strain imposed upon homosexual members of African-American communities within the Pentecostal Church through its religious beliefs.

Abstract:
This article examines the language used by New Zealand judges to describe homosexuality. It analyses the use of such language in judgments delivered after the decriminalisation of homosexual intercourse in 1986, examining the effect that judicial language has on rights claims made by homosexuals. The article argues that a significant number of judges are careless or ill-informed in the language they use to refer to homosexuality and that the language used reinforces and repeats a number of negative stereotypes about homosexuality, constructing it as inferior to a heterosexual norm. This article criticises such careless or prejudiced language as incompatible with New Zealand’s human rights commitments and argues that this language constitutes a barrier to the full enjoyment of citizenship by homosexual New Zealanders.

Abstract:
A large number of countries worldwide have legalized homosexual rights. But for 147 years, since when India was a British colony, Section 377 of the Indian Penal Code defines homosexuality as a crime, punishable by imprisonment. This outdated law violates the fundamental rights of homosexuals in India. Despite the fact that literature drawn from Hindu, Buddhist, Muslim, and modern fiction testify to the presence of same-sex love in various forms, homosexuality is still considered a taboo subject in India, by both the society and the government. In the present article, the continuation of the outdated colonial-era homosexuality law and its impact on the underprivileged homosexual society in India is discussed, as well as consequences to this group's health in relation to HIV infection.

Abstract:
Socrates, Oscar Wilde, Klaus Mann and many other men in history had one thing in common: they loved men. Some of them were lucky and could live a peaceful life regardless, since they either had the respective social standing or lived in societies where homosexuality was at least tolerated. Most others in history, however, were in a rather unfortunate position. To be gay was to be criminal. A conviction for homosexual conduct resulted in years in prison or worse: even today the death penalty can be imposed upon homosexuals in countries where the Shari'a, the Islamic Criminal Code, is interpreted and applied in a strict and conservative way.

Abstract:
This article investigates the question of homosexuality, homosexuals, and homophobia in the Jordanian public debate in the aftermath of an LGBTQIA meeting that was held secretly in Amman in May 2015. The main purpose of the article is to demonstrate the constituents and arguments which reproduce the public discourse on anti-homosexuality and anti-homosexuals and homophobia in Jordan. This purpose is reached by analysing 35 journal articles written in Standard Arabic in Jordanian public and open-access media. The analysis involves the qualitative analysis of the argument, processes, and themes used to represent homosexuality and homosexuals by the discourse producers. The analysis reveals that the question of homosexuality and homosexuals in Jordan can be addressed in terms of seven angles: the public anti-homosexuality and anti-homosexuals’ calls, the (Islamic) religious argument, protecting and reinforcing law and order, the argument of (homo)sexually-transmitted diseases, the calls of pro-homosexuality and pro-homosexuals and LGBTQIA’s rights activists, the homosexuals’ own self-representation, and the neutral scientific account and representation. Keywords: Jordan, homosexuality, homosexuals, homophobia, LGBTQIA, discourse analysis

Abstract:
This paper discusses an attempt to apply historical research directly to the development of a culture of human rights and democracy in Zimbabwe. The research concerns sensitive and controversial issues around sexuality, race, and nationalism that are important in and of themselves. What I would like to argue here, however, is that the method used to design and carry out the research project is at least as interesting. This holds true from the point of view of both professional historians like myself and community activists—two perspectives that are often difficult to reconcile in practice. In this project, “ivory tower” and “grassroots” are brought together in a mutually enriching relationship that offers an alternative model to the methods that currently predominate in the production of historical knowledge in southern Africa.Gays and Lesbians of Zimbabwe (GALZ) is a non-government organization that was founded in 1990. It provides counseling, legal and other support services to men and women struggling with issues of sexuality. It also strives to promote a politics in Zimbabwe that would embrace sexual orientation as a human right. Toward the latter goal it has lobbied government for changes to current laws that discriminate against homosexuals and which expose gay men and women to extortion (so far, in vain). With somewhat more success, it has lobbied the police directly to raise awareness of the extortion issue. GALZ also publishes pamphlets, a newsletter, and other information designed to educate Zimbabweans in general about homosexuality and homophobia. Through these efforts it seeks to challenge popular stereotypes of homosexuals as Westernized perverts who spread diseases and corrupt children. One recent publication included detailed historical research that showed how homosexual practices—including loving and mutual homosexual relationships—have been indigenous to the country throughout recorded history, and probably from time immemorial.

Abstract:

The protection of the rights of sexual minorities in Africa is a controversial issue. It is not unusual to find newspaper reports on gross violations suffered by this minority group. Gays and lesbians are victims of violence, sometimes resulting in death. Sexual minorities in Africa are often confronted with government actions such as those of the Nigerian government that recently submitted to the parliament a Bill to make provisions for the prohibition of relationships between persons of the same sex, celebration of marriage, registration of gay clubs and societies and publicity of same sex relationships. The objective of this study was to suggest possible legal protection and recognition of sexual minority rights under the African human rights system.

Be to, ar pagal Europos žmogaus teisių konvenciją valstybės turi pozityvią pareigą teisę į santuoką užtikrinti ne tik skirtingų lyčių poroms, t.y. neatsižvelgiant į lytinę orientaciją. Homosexuality – sexual orientation which is the opposite of heterosexuality because it is characterized as sexual desire for persons of the same sex. That is why a society often acknowledges it like a deviation from norms and this may sometimes result as an act of discrimination. The Master’s thesis analyses the tendency of the Jurisprudence of the European Court of Human Rights which is related to abolishing the criminalisation of private homosexual relations. It is important because of defending the right to privacy of homosexuals. The Court speaks against criminal prosecution on the ground of sexual orientation and finds that Member States of the Council of Europe should recognize and protect the rights of homosexual persons. Today the discussions about the right to the same-sex marriage are becoming louder and louder. The thesis attempts to ascertain whether the cohabitation of homosexuals falls in the ambit of a family life according to the European Court of Human Rights as well as whether the Member States of the European Convention on Human Rights have a positive obligation to ensure the right to marry for the same-sex couples. Furthermore, the institute of a registered partnership is an alternative form for legalizing homosexual relationships. Thus, it is necessary to identify whether the Court puts an obligation to the Member States to make that opportunity for the same-sex couples in the national legal systems. The right of adoption of homosexuals is a highly... [to full text]

Abstract:
In the last decade several western countries have greatly enhanced the rights of sexual minorities in their societies. Same-sex marriage is now legal in most states in the United States, while about twenty three countries in Europe presently allow same-sex marriage or some form of civil partnership. Africa on the other hand is witnessing a rise in the number of countries further criminalizing sexual minorities and homophobia is rising across the continent. Homosexuality is illegal in 76 countries in the world, 38 of which are in Africa and of these 38, homosexuality is punishable by death in 4. Though a growing discourse, existing literature and scholarly papers till date have rarely focused on the impediments to LGBT rights in the African continent. The few existing literature have looked at LGBT rights in Africa from the policy perspective without taking the popularity of anti-gay laws into consideration as seen in a country like Nigeria where 98 percent of the population supports anti-gay measures. An explorative qualitative research study was used to explore the impediments to LGBT rights in Nigeria and how they can be addressed. Secondary data from verifiable sources and primary data from semi-structured, formal, open ended interviews with individuals deeply informed of the discourse in Nigeria was used for the research. Data retrieved was analysed using thematic analysis to identify recurrent themes from the interview transcripts before a comprehensive discussion and triangulation of both primary and secondary data was conducted. The research found that religious beliefs and the existence of LGBT knowledge gaps are the major impediments to LGBT rights in Nigeria. The research findings suggests that closing these LGBT knowledge gaps through enlightenment will over time repress the strong religious and ideological views held against LGBTs. With the decline of these views, the research suggests that LGBT rights will naturally emerge. The study also developed three testable hypotheses for future studies.

Abstract:
Magister Legum - LLM
For many, the human rights which South Africa has been able to secure for LGBTI (lesbian, gay, bisexual, transgender and intersex) people has been very progressive. However, with the conflation of sexual orientation and gender identity, the assumption of access to human rights for all within the LGBTI and society at large, has led to transsexual people not being able to claim their rights and assert their existence as human beings effectively within our constitutional democracy. Currently, there is a vacuum in South Africa's law of marriage based on its inability to accommodate spouses who married as a 'heterosexual' couple but where the one spouse subsequently undergoes gender affirmation, conforming the relationship to what is perceived as 'homosexual'. On account of this, the Department of Home Affairs are subjecting these couples to compulsory or forced divorces by refusing to have the transsexual spouse recognised within his or her affirmed gender on the marriage certificate. This means that the transsexual spouse either remains married under the Marriage Act and is subject to being recognised as his or her birth-sex, or submits to a compulsory or forced divorce in order to be recognised as his or her affirmed sex on a marriage certificate issued under the Civil Union Act upon them 'remarrying'. This thesis addresses the inequalities and inequities brought about by the Marriage Act. It investigates the history of marriages within South Africa that were prohibited based on characteristics such as race which people have no control over. It looks at how the State, through its departments, has imposed itself on the social relationships people formed subject to its legal terms and conditions. This thesis questions whether the State through its action is acting in a way that is administratively just. It argues that the successfulness of a divorce decree is dependent on at least one party voluntary applying for it. This presupposes the idea that whenever couples who are validly married are forced or compelled to divorce one another that this, in fact, cannot be seen as one of the valid ways in which to obtain a divorce decree legally. Before venturing into the legal aspect concerning this research topic, a theoretical framework will be advanced to position these couples in a greater social context. Subsequently, in order to establish the legal position of these couples, this thesis will draw on the current South African human rights discourse that has been developed by and for the LGBTI community, especially as it relates to the law of marriage. It will also establish the international and foreign human rights discourses that assert or, at least, seek to assert LGBTI human rights broadly. Ultimately, a constitutional analysis will be conducted to establish the position of these couples under the Marriage Act.

Abstract:
This study aims to examine the possibility of legal recognition of new forms of families arising from the union between same-sex. Assuming that society calls for a new structure in the provision of legal relations, and a new structure in the satisfaction of the right claimed, this research aims to draw parallels between the trajectory of the legal rules that govern family relations and new social arrangements that constitute the contemporary family as a result of new concepts established by the society of the century XXI, yet because of the state have the responsibility to adapt the means and ends, in order to ensure the best and full application of the law. Seek to identify the new concept of family, from the art. 226 of the Federal Constitution and Constitutional Principles, attached to the plurality of identifiable social arrangements. Moreover, it presents the concern in establishing these new legal rules of family law in line with the social reality of Brazil, to ensure full access to justice and respect for the principle of equality and freedom in interpersonal relations

This doctoral thesis aims at investigating the ways in which the discursive repertoires on same-sex relationships and the rights of sexual minorities are formed in the legal scope. In May 2011, the Supremo Tribunal Federal (Brazilian Supreme Court), in an unprecedented verdict, recognized same-sex unions as family entity, which set new directions to the homosexual movements in Brazil. Although STF s decision indicates a paradigm shift, it is noticeable that unfavorable notions on same-sex relationships and the rights of sexual minorities are still being spread throughout society. In this sense, trying to delineate how law and legal institutions have contributed to the emancipatory processes of the sexual minorities, the discursive repertoires produced in two legal spheres have been analyzed. Those spheres are namely the STF and the academic legal community, which have influenced to a large extent the ways in which the law and society are conceived. In the first study, lexical (ALCESTE) and textual analyses (critical discourse analysis) showed the similarities and differences between the arguments and justifications used by the STF ministers during the pronouncement of their favorable votes to the recognition of same-sex unions. It has been verified the existence of discursive repertoires that vary from the acceptance and recognition of equality to the idea of tolerance (stand with indulgence), supported by the emphasis on differences. From the results collected in the analysis of the STF ministers votes, a questionnaire, marked by objective and essay questions, was elaborated, in order to progress to two more studies (second and third), which were directed to students and professors of the law course at Universidade Federal da Paraíba. In the second study, students and professors opinions were evaluated in relation to three questions: STF ministers justifications; legal, moral, political and social consequences created by the verdict; possible factors to explain homosexuality. In relation to the STF ministers justifications, a lexical analysis proved the existence of discursive repertoires that, even though they reproduce many antagonisms in the STF ministers decision, they did not present in their content the discourse of tolerance. Regarding the consequences created by the verdict, a bigger percentage of repertoires that highlighted the decision as a legal event that helped the social inclusion of sexual minorities may be pointed out. As for the possible factors which can explain homosexuality, the majority of discursive repertoires highlighted the idea that it is a sexual orientation as any other, not a disease. In the third study, it was observed the importance of the insertion in different social groups in the students and professors opinions on those questions, from psychosocial factors: position in the educational process (student or professor), sex, marital status, and religion. The results from the cross-frequency analyses by Pearson s chi-squared test (χ²) indicated that the different social positions of the individuals influenced their visions on the questions asked, especially in what concerns religion. In conclusion, it may be affirmed that, in Brazilian contemporary scenario, the jurisprudential decisions have become important mechanisms to put into effect the rights of minority groups, in a sense that the formation of legal professionals seems to have become increasingly significant when it comes to deconstructing the processes of social inequality.

Abstract:
The ojective of this PhD dissertation is to show how the victory for the freedom to marry enabled the LGBT community to gear up for a national State-by-State campaign to put an end to second-class citizenship, raise awareness, and educate the American people to a reality that is marked by a long history of discrimination and hostile prejudice against homosexuals, with such hostility often being expressed and disseminated by fundamentalist Christians. We will revisit the historical origins of the culture war against homosexuality to show it still structures the system of government tody, and fuels political polarization, starting from the premise that the breach in the separating wall between Church and State is partly responsible for the numerous institutionnal deadblocks as well as a patchwork system of unegquel laws across the country. the LGBT community's fight for equal rights ultimately turns out to provide a particularly powerful insight into American democracy, and continues to affect the democratic system of checks and balances through various dynamic processes which are bound up with change and with the assertion of religious freedom

Abstract:
This paper analyzes the legal arguments that have been used toallow the gradual introduction of same-sex marriage and civil unions in some Latin American countries. The author makes a critical account of the contentious cases and legislative responses to claims for recognition and protection of human rights of people with a particular sexual orientation. The most representative Latin American countries are analyzed from the point of view of its relevance in comparative terms.

Abstract:
Homosexuals and transgenders in Muslim majority countries go through multiple struggles. In Bangladesh, the governments’ apparent indecision regrading a British colonial rule banning ‘intercourse against the order of nature,’ a problematic stance on fatwa, Islamic laws and, finally, the national abandonment of transgenders tend to shape societal attitudes to and reception of homosexuals and transgenders. This chapter examines some common challenges that young homosexuals and transgenders experience as they migrate from the rural to the urban areas in Bangladesh, particularly the role of religion and how they negotiate the absence of state protection on their rights. As a small segment of them manages to migrate to ‘queer friendly countries,’ this chapter also investigates the struggles of young Bangladeshi homosexuals and transgenders in liberal societies in the ‘queer friendly countries’ where their rights are perceived to be protected.

Abstract:
The historical narrative of the book starts in this chapter through a recap of the primary events in LGBTQ movement history in the United States leading up to the 1990s. The origin of the concept of ‘homosexuals’ in the medical research of the late 1890s, the firing of lesbians and gays during the Cold War for fears of communist association, the founding of Mattachine society, the development of distinctive lesbian and gay subcultures and urban communities in the 1970s, and the rise of AIDS and the LGBTQ community’s response in the form of ACT-UP in the 1980s are all discussed. ACT-UP’s response to the crisis proved to decisive turning-point in LGBTQ history. The chapter ends by presenting data showing that, by targeting the national news media, ACT-UP normalized media coverage of AIDS and LGBTQ issues, leading to increases in coming out.

Abstract:
This chapter examines the various ways journalists and activists who purport to fight for sexual diversity have actually reified sexual conformism through two processes: the demonization of the banlieue’s racialized, non-normative sexualities and the willful denial of the banlieue’s queer potential. In journalism, investigative reports, and interventions on the ground, commentators purporting to represent gay and feminist interests have focused on an uncommonly sexist banlieusard virility, with alleged roots in Islamic cultures. This process fits into a larger, more familiar one, in which immigration from the former colonies has been sexualized, with concerns articulated around men’s machismo and women’s subjugation. In recent years, respect for sexual minorities has constituted a new frontier for campaigns targeting banlieue attitudes and behaviors. In this vein, some campaigns purporting to “defend” have taken the form of attacks. Rhetoric about “saving” banlieue women and homosexuals has exoticized the banlieues as inhospitable and lawless zones worthy of human rights intervention. At the same time that it defines the homosexual victim, this rhetoric also determines the “appropriate” expression of homosexual identity or practices.

WAJIMA, T. "THROMBOCYTOPENIA IN ACQUIRED IMMUNE DEFICIENCY SYNDRGME(AIDS)-RELATED COMPLEXES:RESOLUTION DURING HERPES VIRAL INFECTION." In XIth International Congress on Thrombosis and Haemostasis. Schattauer GmbH, 1987. http://dx.doi.org/10.1055/s-0038-1644145.

Full text
Abstract:
Immune thrombocytopenia has been recognized as a major hematologic manifestation associated with the acquired immune deficiency syndrome(AIDS) and AIDS-related complexes. The mechanism of thrombocytopenia in human immune deficiency virus infection is probably multifactorial.. The role of platelet-associated immuno-globulin(PAIgG)and circulating immune complexes(CIC) in mediating thrombocytopenia is controversial.. We experienced a case in which immune thrombocytopenia in AIDS-related complexes resolved during herpes zoster infection. A 37 y.o. white homosexual male with AIDS-related complexes and thrombocytopenia presented a 4-day history of painful, violaceous, non-pruritic vesicles which started on the right arm and hand, which then progressed to the chest wall, abdomen, back, and left arm. Peripheral lymphadenop-athy and splenomegaly was not noted. On admission WBG 13.5 Hct 40.8, platelet 46,000, Tzanck smear of vesicles revealed herpetic type giant cells. HTLV-III pos., Helper/suppressor T-cell ratio 0.3, Total protein 7.9 gm%, . Alb 3.95gm% IgG 1740 mg%, IgA 157 mg IgM 91.2 mg, Monospot neg., HBsAg Neg., HBsAb pos., HBcAb pos., VDRL neg. Before this admission, immune thrombocytopenia was documented by increased levels of PAIgG, CIC, bone marrow magakaryocytic hyperplasia, peripheral thrombocytopenia with giant platelets, absence of splenomegaly, and response to prednisone. He was treated with Acyclovir 250 mg/m2 1-hr infusion Q8h for 9 days ;to control the spread of his herpes infection. Recovery of thrombocytopenia wasobserved during herpes zo.ster infection. The platelet count rose to 158,000 and sustained over 4- weeks. Duringnormalization of platelet count thelevel of GIC (assayed by Raji cells, reference ranges, less than 12) droppedfrom 300 to less than 12 and PAIgG(fluorescence-activated flow cytometric assay, reference ranges, less than 1.5 RF) was markedly decreased from 90 to 2.9 When herpes infection had subsided the platelet count again decreased. These findings suggestthat PAIgG and GIG were contributing factors to immune thrombocytopenia and that herpes viral infection and Acyclovir altered this immunologically mediated thrombocytopenia in AIDS-related complexes.
