Abstract:
This chapter identifies epistemic goods in Hooker’s Of the Laws of Ecclesiastical Polity. Hooker de-epistemizes scripture by arguing that it neither claims to provide nor can provide a particular warrant for every act of ordinary life or an immutably binding plan of church governance. This frees us from stressful searching of scripture and encourages us to use reason. Both reason and tradition foster Hooker’s emphasis on community, evident in his sympathy with other churches and with devout adherents of non-Christian religions. He values public worship as an important epistemic good in itself

The ecclesiastical polity, and the laws that governed it, were at the heart of post-Reformation England’s constitution. Yet there was no consensus about where the ecclesiastical polity was located, who made its laws, or how those laws should be enforced; the same theological compromises that helped preserve the peace of the Church rendered religious law incoherent. Famously, Richard Hooker attempted to resolve this incoherence in his Of the Lawes of Ecclesiastical Politie, but he failed to do so, as did all subsequent early modern attempts. This chapter explores the relationship between religious arguments for and against the mitigation of legal penalties for religious nonconformity, and the arguments in Shakespeare’sMerchant of Venicefor and against the moderation of legal rigour. It argues that Elizabethan legal debates overepieikeiaor equity were heavily inflected with the debate over conscientious nonconformity.
