van Asselt, Harro. The Design and Implementation of Greenhouse Gas Emissions Trading. Edited by Kevin R. Gray, Richard Tarasofsky, and Cinnamon Carlarne. Oxford University Press, 2016. http://dx.doi.org/10.1093/law/9780199684601.003.0016.

Abstract:
This chapter offers a cross-jurisdictional analysis of the design and implementation of mandatory emissions trading schemes. It traces the beginning of emissions trading schemes from the sulfur dioxide emissions trading scheme in the United States, which was implemented through the Clean Air Act Amendments of 1990. After initial experiments at a local and regional level, the United States launched the first large-scale, countrywide trading system. This program sought to address the acid rain problem by creating a trading regime for sulfur dioxide emissions. This was the birthplace of large-scale emissions trading systems and from this point onwards, emissions trading schemes began to spread across jurisdictions. The chapter describes how the EU’s speedy adoption of an emissions trading directive in 2003 could be seen as an instance of horizontal borrowing from the United States, spurred by the simple need to keep the costs of reducing emissions down.

Abstract:
The pressure for reduction in science is an artifact of what we call the nomic conception of science (NCS): the idea that the content of science is a collection of laws, together with the deductive-nomological model of explanation. NCS in effect identifies explanation with reduction, thus making no room for the explanatory autonomy of function-analytical explanations. When we replace NCS with something more descriptively accurate, however, we find that the kind of explanatory autonomy of functional-analytic explanations is ubiquitous in the sciences. Key to showing this is a distinction between horizontal and vertical explanation. Horizontal explanations explain the capacities of a complex system by appeal to the design of the system. Vertical explanations, by contrast, explain how a design is implemented in a system. We argue that the distinction between horizontal and vertical explanations provides us with a better picture of the relationship between functional analysis and mechanistic explanation.

Abstract:
HORIZONTES is a tribute to the city Belo Horizonte. The drawings and paintings that make up this tribute were presented in individual and collective exhibitions in art galleries and cultural spaces in the capital of Minas Gerais. The peaces bring scenes from the daily life of the city, its mountains seen in the distance, as well as representing some of its buildings. The creative process begins with drawings and sketches developed on the spot, using graphite pencils, colored pencils, ballpoint pens, a pad of paper and a good shade to protect from the sun. The buildings are drafted on the spot on small sheets of paper, allowing you to choose the best viewing angles and seeking to experience the space, smell the scents, hear the sounds, perceive the warmth and life of each place. The drawings made in the place offer important and necessary information to help organize the perception and better understanding of the object in space. The observation drawing activity involved in this creative process is of great importance, as it is a conventional, personal and individual activity, involving the discovery of forms and their communication. The observation drawings developed at the site are more than just a passive container of the author's eye. They are a powerful medium that influence thinking just as they are influenced by the thinking of the designer. The result seems to represent, more and more, the will and the attempt to paint not only the visible world, but the memory, the history, the winds, the sounds, the smells, the city and the life, with all the symbolic aspect.

Abstract:
Wind-turbine science and technology is outlined, following the work of Betz. Rotor design, blade construction and aspects of electric power generation are described, principally for large horizontal-axis devices, with some mention of vertical axis wind turbines. Hydropower and pumped storage are treated, with mention of Francis and Kaplan turbines. A summary of tidal energy is included. We now go into detail on some aspects of these topics. As these forms of energy come either from the Sun (in an indirect fashion) or from the motion of the Earth and Moon, they are available on an indefinite term into the future.

Hoadley, Ursula, Brian Levy, Lawule Shumane, and Shelly Wilburn. Case Studies of School-Level Governance Dynamics in the Western Cape. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198824053.003.0008.

Full text
Abstract:
This chapter details four case studies of school-level management practices in the appointment process of school principals. The school-level processes are used as a lens through which to refract local governance dynamics, and thereby gain insight into the broader multi-stakeholder contexts within which the principal is embedded. The contrasts between the Western Cape and Eastern Cape provinces provide an ideal opportunity to explore a central theme of this book, namely how ‘good fit’ works—how preferred approaches to policy design and implementation might vary according to the contexts in which they are being undertaken. The chapter suggests that rather than viewing the interaction between hierarchical and horizontal governance as zero-sum, the task for practitioners is to find ways to make more effective the ‘both/and’ balance, with an emphasis on impersonal forms of decision-making.

Full text
Abstract:
This chapter examines the development and operation of the European Union from a comparative politics perspective. It first considers the evolution of the EU, from the signing of the Treaty of Paris in 1951 that established the European Coal and Steel Community (ECSC) to the admission of Lithuania in 2015 as the nineteenth member of the Eurozone, and the UK's decision to leave the EU in 2016. The chapter then explores the process of European integration and goes on to explain what it means to think of the EU as a political system. It also describes the two basic dimensions of the EU system: the vertical dimension (the EU as a ‘regulatory state’) and the horizontal dimension (the design and operation of EU decision-making). The chapter concludes by analysing the ‘missing link’ in the EU system — the lack of genuine democratic politics.

Full text
Abstract:
This chapter analyses the transitional period between the pre- and post-Lisbon periods. It starts by investigating the design of the Lisbon Treaty’s two control regimes, the delegated acts regime and the implementing acts regime. This takes us back to the years just after the turn of the millennium and the negotiations on the failed Constitutional Treaty when the two delegation regimes were first introduced. Once in place, the treaty provisions were not directly operational. The delegated acts regime was to be followed up by an inter-institutional agreement on its practical application, and the implementing acts regime required a new horizontal framework regulation on comitology procedures to become operational. These two issues represented the first institutional battles in the post-Lisbon period. This chapter investigates how the Council, the Parliament, and the Commission each manoeuvred to secure as efficient a position in the control regimes as possible.

Full text
Abstract:
The prime objective of this book is the use microeconomic analysis to guide and provide insight into the generation and adoption of new products. Taking an approach that uses minimal formal mathematics, the volume initially addresses questions of definitions, sources, and extent of product innovation, differentiating between goods and services; hard and soft innovations; horizontal and vertical innovations; original, new to market, and new to firm innovations. The sources of product innovations (e.g. R&D, design, and creativity) are explored empirically, and the extent of such innovations is then pursued using survey and other data. Three chapters are devoted to the theoretical analysis of the demand for and supply of new products and to the determination of firms’ decisions to undertake product innovation. Later chapters encompass empirical evidence on the determination of the extent of product innovation, the diffusion of such innovation, the impact of product innovation on firm performance, price measurement, and welfare, while the final chapter addresses policy issues.

Full text
Abstract:
This book addresses the relationship between EU law and new technologies. Its aim is to address two groups of questions. First, how does EU law approach the relation between science and regulation and what part do conceptions of risk play in this approach; is there a distinctive character to EU law in this domain? And second, what challenges do new technologies pose for the EU internal market and for fundamental principles of EU law, including fundamental rights? Do new technologies represent potential new barriers to freedom of movement? How are EU instruments used to direct and orientate EU policy on new technologies, and how do new technologies shape EU policy, including—but not only—EU policy on privacy and data protection? The book is organized into two parts. The first part, ‘The EU, Scientific Risk, and Regulatory Design’, addresses some of the more horizontal questions, helping us to unpack and to understand the EU’s approach to the regulation of scientific/technological risk and the impact on regulatory design of the close link between the regulation of technology and the internal market. The second part, ‘EU Law and New Technologies—Challenge and Response’, uses different policy fields to exemplify the different ways in which technology and EU policy interact, by posing new regulatory challenges (data protection; internet governance), and by shaping the regulatory response to new challenges (the use of technology for border management and migration control).
