Abstract:
This Study was conducted in Yei River County, Central Equatoria State the Republic of South Sudan from July-December/2012 under the topic: Examining the role of Local Government County Legislative Council in promoting service delivery. The Legislative Council in Yei was established since 2007 inaccordance with the provisions of the Transition Constitution of the Republic of South Sudan, 2011:166, LG Act, 2009:8-29 and Governors’ Decree dated 25/August/2007 with the mandate to enact laws and policies and supervise the Executive to implement its decisions. The study investigated into why there was under performance of Legislative Council in promoting service delivery in Yei River County (YRC) and how can service delivery be improved in YRC. The findings revealed that, the capacity of the Council is low in making appropriate decisions and supervising the Executive to implement its decisions, it lacks the necessary working requirements to facilitate its duties, some of its directives are not implemented by the Executive and negative attitudes towards the work of the Council by some members of the Executive. Despite the difficulties encountered, the Council was able to enact 31 laws, conducted some joint consultative meetings on County projects and the study recommended that, the relevant institutions of Local Government to review the irregularities in the Local Government Act of 2009 to regulate the duties of the Council and to guide the recruitment of the future Councillors, training of the Councillors to improve performance, improve the working conditions of the Council, conduct public awareness on the role of the Council and promotion of exchange programs for further learning purposes. The significance of this study is that, the topic was good according to the participants, the recommendations of the study may be adopted by the Local Government Authorities to address the identified gaps and challenges facing the Council not only in Yei River County but also in other parts of the Country and finally, the report may be used by the University of Fort Hare for further Academic purposes and/or other interested individuals/institutions or organizations of the same or similar objectives.

Abstract:
This study is based on Leadership & Accountability in managing the Constituency Development Fund (CDF), the case of Yei River County (YRC) of Central Equatoria State, Republic of South Sudan (RSS). CDF is one of the initiatives of the government of South Sudan created by a legislation of Parliament to compliment development of the community needs as they expect more from the government of the day. The CDF Act 2007 which was passed by the parliament stipulated structures that govern the operation of the fund in terms of management, leadership and accountability to enhance effective and efficient provision of services to the people. The CDF Act provided that fund allocated to the MPs is to address the challenges that face the communities such as construction of schools, health facilities, water, roads and government facilities but not for personal interest or individual use. The problem that motivated the researcher to explore the performance of the CDF was inadequate service to the community although the government has allocated funds to each constituency channeled through the members of parliament to improve the socio-economic status of the community. The research looked at how the CDF roles, functions, and procedure were applied in the utilization of the funds to ensure efficiency. It analysed and evaluated the effectiveness and efficiency of management of CDF to promote service delivery in the constituencies of Yei, Ottogo, Tore and Mugwo Payams. The study investigated the following questions: How is the Constituency Development Fund (CDF) been managed and utilized by the Members of Parliament (MPs) to promote development in their constituencies? To what extent is the Constituency Development Fund (CDF) used in accordance with the provisions of the CDF Act (2007)? To what extent does the CDF achieve its objective in promoting development to meet the aspirations of the people within the constituencies? And, what is the nature of the relationship between the MPs, the community and the County Local Authority in relation to the CDF? The study also examined the linkage between the various committees formed by the CDF Act 2007 to guide the implementation of the fund as well as the projects at grass-root levels in regards to monitoring and evaluation process. The study used both descriptive and explanatory techniques to guide the researcher in gathering information required on the best of CDF practice in Yei River County which were carried out using interviews, focus group discussion and observation. Twenty (20) respondents comprising of head of departments, women, youth, MPs of both parliaments - the National and the State, chiefs, councilors, CDF committees from the four constituencies mentioned above were interviewed about the use of the CDF. The study reveals that there are no clear linkages between the various committees formed by the CDF Act 2007 to guide the implementation of the fund as well as the projects at the grass-root level in regards to monitoring and evaluation process. In addition to this, less participation of the community in identification, planning, implementation, monitoring and evaluation of the CDF community projects was one of the contributing factors that affected the effectiveness and efficiency of the result. Although creation of CDF has effect in some of the areas of the county, it requires more improvement in the implementation process to increase development in other areas. Based on these findings, the study argues that for the best of the CDF utilization, leadership and accountability which are components of the Public Administration Discipline that enhances efficiency in the public institutions need to be put into practice. Hence, rigorous application of the CDF rules, regulations and procedures is paramount in managing the utilization of the fund allocated for the purpose of development.

This document is a research report (Thesis) on the topic an Investigation in to the Recruitment Procedures in the Public Service a case study of the Ministry of Labour Public Service and Human Resource Development Republic of South Sudan. In line with the objectives, the study established a significant number of policies and legislations that guide recruitment in the ministry and in the South Sudan Public Service. The findings of the study revealed that recruitment procedures exist in the public service of South Sudan amidst challenges. The researcher provided recommendations to the challenges in the last chapter of this thesis. However, there will be a need for further research on some of the issues that affect recruitment in the ministry as provided by the respondents of this study. These issues are discussed in chapter four. Thus recruitment is very important to research on further in the Public Service of South Sudan so as to ensure efficient and effective service delivery through recruiting competent staff.

Abstract:
Local government is an important level of participatory democracy, where communities play an active role not only as the electorate, but also as end-users and consumers, and thereby holding their municipal councils accountable for their actions. Given the above statement, the interim Constitution of the Republic of South Sudan 2011, entrusts local government with the provision of services to communities in a sustainable manner. It also provides for the promotion of social and economic development and the promotion of a safe and healthy environment. This also entails the need for a commitment to service delivery hence, public representatives and public officials must take seriously their obligation to render services to the people that could be in the form of ensuring that refuse gets collected, electricity being supplied and other services rendered which better the general welfare of citizens. There are several definitions of public participation, but it can be defined as a process of empowering citizens by involving them in making decisions on all issues that concern them, which can be political, social or economic. The main aim of this study was to, investigate and identify the nature and extent of integrated participatory planning in Yei River County and the extent to which opportunities for public participation are accessible to the communities. The study sought to investigate: How different stakeholders in the community in Yei River County make use of public participation opportunities during the integrated participatory planning process? As such, the main objectives of the study were to; to assess the existing integrated participatory planning practices in Yei River County, to examine and evaluate how the existing integrated participatory planning practices influence service delivery in Yei River County and lastly to identify the barriers to effective integrated participatory planning in YRC and advance recommendations for improvement. Purposive and snowball sampling methods were used and data was collected from a sample of two hundred and twenty-six (226) public officials, comprising of Local Government officials, County councillors and members of the public. Results from the data collected using open and close-ended questionnaires, showed that public participation is very important in local government planning as it leads to incorporation of public suggestions and interests in the development strategies. The results further showed that public meetings and workshops were the only public participation mechanisms being used by Yei River County. The study therefore recommended among other things that, Yei River County should strengthen public participation in integrated participatory planning by providing adequate skilled human resources and establishing structures, as well as public participation mechanisms at the Payam and Boma levels. It was also recommended that the communities needed to utilise all available mechanisms of participation to ensure maximum participation during the integrated participatory planning processes.

The primary objective was to assess Human Resource Management Practices in the Ministry of Public Service, Central Equatoria State-South Sudan. The objectives of the study were: Identify the key Practices used by the Ministry of Public Service in human resources management in Central Equatoria State. It also sought to establish the challenges faced by the Ministry of Public Service in human resources management practices in Central Equatoria State and to identify employees‟ perceptions on human resources management practices in Ministry of the Public Service in Central Equatoria State and lastly, to determine how and to what extent the Ministry of the Public Service can further improve on human resources management practices in Central Equatoria State. The study used both qualitative and quantitative methodology of data collection. Interviews and questionnaires were used as qualitative and quantitative methods of data collection respectively. The study used twenty five (25) respondents starting from Director General, Department of Administration and Finance, Department of General List of Clerks, Department of Establishments, Department of Pensions, Department of Budgets, and Department of Labour. The results revealed that; the human resource management practices by Ministry of Public Service in Central Equatoria State in the different departments need to ensure efficient and effective human resource management practices reforms, and the recommendations were put forward to assist the public civil servants in different human resource departments in the State.

The question regarding what makes child trafficking persistent in conflict and post-war settings has been subject to intense debate. The human trafficking literature makes general conclusions that trafficking is a by-product of civil wars, and in the process child traffickers exploit the breakdown of the rule of law. As such it is perceived that the governance of the problem of child trafficking can be effective whenever peace and stability is realised and when legal frameworks for protecting children are in place. Prompted by these assertions, I conducted a field study in South Sudan, a country emerging from one of Africa’s longest running and most brutal civil wars fought between the government in Khartoum and Sudanese Peoples Liberation Movement/Army (SPLM/A). The Sudan’s civil wars ended after the signing of the Comprehensive Peace Agreement in 2005. Whilst the termination of the war raised expectations that the international anti-trafficking conventions, treaties and customary laws protecting children would have enforcement powers and would guarantee the rights and safety of the child, the peace failed to deliver on these expectations. Based on empirical data obtained through an intensive micro-level qualitative research conducted in South Sudan over three months, the research findings reveal that a number of challenges pose serious difficulties in enforcing international counter-trafficking legislations and child protection instruments. These challenges are compounded by the interplay of the emerging socio-economic and political development in the post-independent South Sudan.

Water privatisation has been presented as the panacea to addressing the global water crisis. Privatisation of water has heightened the impetus for the explicit recognition of water as a human right. This dissertation seeks to establish the legal status of the right to water under international human rights law. The dissertation further attempts to ascertain the scope and normative content of such a right. In order to answer these questions, this dissertation carries out a detailed analysis of the possible legal basis, scope and normative content of the right to water under international human rights law. The principal question that arises is how a State can ensure compliance with its human rights obligations in the event of involvement of non-State actors such as private corporations in the management and distribution of water services. This dissertation‘s main hypothesis is that although privatisation of water services does not relieve the State of its legal responsibility under international human rights law, such privatisation imposes certain obligations on private actors consistent with the right to water. The dissertation goes beyond articulating normative considerations and looks at implementation at the national level by highlighting good practices on the practical implementation of the right to water consistent with the normative standards imposed by the right. The dissertation‘s key contribution is its development of an accountability model to ensure that States and private actors involved in the provision of water services have clearly designated roles and responsibilities consistent with the human right to water. If properly implemented, the model has the potential to give greater specification to the normative commitments imposed by the right to water in privatisation scenarios.<br>AFRIKAANSE OPSOMMING: Die verergerende skaarste van vars water bronne het aanleiding gegee tot die toename in die hoeveelheid mense sonder volhoubare toegang tot veilige water oor die hele aarde. Die privatisering van water het aanleiding gegee tot 'n verskerpte aandrang om water uitdruklik te erken as 'n mensereg. Hierdie proefskrif poog om die regsstatus van die reg tot water te vestig binne die raamwerk van internasionale menseregte. Die proefskrif probeer verder om vas te stel wat die omvang en normatiewe inhoud van so 'n reg sal wees. Abstract:
When South Africa made the transition to democracy in 1994, led by the charismatic Nelson Mandela, it proclaimed that it would make human rights a centrepiece of its foreign policy. The international community also expected South Africa to play a leading role in promoting human rights around the world, not least due to the country's own history of gross human rights violations during apartheid. However, in the last 20 years, South Africa's track record in protecting human rights has come under scrutiny. Scholars have accused South Africa of turning a blind eye to gross human rights violations, contradicting its stated commitment to human rights. South Africa's responses to gross human rights violations in Libya, Sudan and Zimbabwe have been particularly criticised. This dissertation analyses the scholarly explanations of South Africa's contradictory behaviour in order to identify the strongest explanations on a bilateral level and a multilateral level in the context of South Africa's membership of the United Nations Human Rights Council (UNHRC). Delving into the literature on South Africa's foreign policy behaviour, I argue that South Africa has indeed failed to live up its promise of standing up for human rights. The emphasis on human rights in the country's foreign policy has also diminished over time. Most importantly, I argue that the major explanations of South Africa's contradictory behaviour are solidarity with African, developing and anti-apartheid allies; deterioration of domestic human rights regime which inevitably affects human rights promotion abroad; and South Africa's desire to be a leading conflict mediator that precludes it from criticising gross human rights violators, although there remain questions over South Africa's neutrality as a mediator.

Bibliography: pages 232-241.<br>This study examines the issue of programme evaluation and places it within the context of the Western Cape region of Operation Hunger. Data for this study was collected over a six month period of participant observation at Operation Hunger, during which time a programme evaluation model was developed and implemented. The focus of this study is not so much the evaluation model which was developed, but rather how the model developed from the theory of illuminative evaluation to the Operation Hunger Evaluation Model. In discussing and exploring this process several strands are developed. A central theme is that it is not possible to transpose theory and experience from one context to another without firstly understanding the historical specificity within which programme evaluation developed and secondly, understanding the historical context in which it is to be applied. A second strand identifies five possible evaluation approaches for use in the South African context and applies a model useful in choosing theoretical evaluation approaches for the purposes of application. A final aspect of this study indicates how the theory of the illuminative approach was interpreted and developed into the practice of the Operation Hunger Evaluation Model.

Abstract:
<p>The history of prison reform after 1994 was shaped by the relationship between governance and human rights standards<br>the requirements for both are set out in the Constitution and elaborated on in the Correctional Services Act. Good governance and human rights converge in five dimensions of a constitutional democracy: legitimacy, transparency, accountability, the rule&nbsp<br>of law<br>and resource utilisation. The new constitutional order established a set of governance and rights requirements for the prison system demanding fundamental reform. It de-legitimised the existing prison system and thus placed it in a crisis. This required its reinvention to establish a system compatible with constitutional demands. The thesis investigates whether&nbsp<br>constitutionalism provided the necessary transformative basis for prison reform in South Africa after 1994. The Department of Correctional Services (DCS) senior management failed to&nbsp<br>anticipate this in the period 1990 to 1994. In the five years after 1994 senior management equally failed to initiate a fundamental reform process. This lack of vision, as well as a number of external factors relating to the state of the public service in the period 1994 to 2000, gave rise to a second crisis: the collapse of order and discipline in the DCS. By the late 1990s the state had lost control of the DCS and its internal workings can be described as a mess &ndash<br>a highly interactive set of problems in causal relationships. In many regards the problems beleaguering the prison system were created in the period 1994 &ndash<br>1999. The leadership at the time did not recognize that the prison system was in crisis or that the crisis presented an opportunity for&nbsp<br>fundamental reform. The new democratic order demanded constitutional and political imagination, but this failed to materialise. Consequently, the role and function of imprisonment within the&nbsp<br>criminal justice system has remained fundamentally unchanged and there has not been a critical re-examination of its purpose, save that the criminal justice system has become more punitive. Several investigations (1998-2006) into the DCS found widespread corruption and rights violations. Organised labour understood transformation primarily as the racial transformation of the staff corps and embarked on an organised campaign to seize control of management and key positions. This introduced a culture of lawlessness, enabling widespread corruption. w leadership by 2001 and facing pressure from the national government, the DCS responded to the situation by focusing on corruption and on regaining control of the Department. A number of&nbsp<br>gains have been made since then, especially after 2004. Regaining control of the Department focused on addressing systemic weaknesses, enforcing the disciplinary code and defining a&nbsp<br>new employer-employee relationship. This has been a slow process with notable setbacks, but it continues to form part of the Department&rsquo<br>s strategic direction. It is concluded that the DCS&nbsp<br>has engaged with and developed a deeper understanding of its constitutional obligations insofar as they pertain to governance requirements in the Constitution. However, compliance with&nbsp<br>human rights standards had not received the same attention and areas of substantial non-compliance remain in violation of the Constitution and subordinate legislation. Overcrowding,&nbsp<br>violations of personal safety, poor services and/or lack of access to services persist. Despite the detailed rights standards set out in the Correctional Services Act, there is little to indicate that&nbsp<br>legislative compliance is an overt focus for the DCS. While meeting the minimum standards of humane detention, as required by the Constitution, should have been the strategic focus of the&nbsp<br>DCS in relation to the prison population, the 2004 White&nbsp<br>Paper defines &ldquo<br>offender rehabilitation&rdquo<br>as the core business of the DCS. In many regards the DCS has assigned more prominence&nbsp<br>and weight to the White Paper than to its obligations under the Correctional Services Act. In an attempt to legitimise the prison system, the DCS defined for itself a goal that is required neither&nbsp<br>by the Constitution nor the Correctional&nbsp<br>Services Act. Compliance with the minimum standards of humane detention must be regarded as a prerequisite for successful interventions to reduce&nbsp<br>future criminality. After&nbsp<br>seven years, delivery results on the rehabilitation objective have been minimal and not objectively measurable. The noble and over-ambitious focus on rehabilitation at&nbsp<br>policy level distracted the DCS from its primary constitutional obligation, namely to ensure safe and humane custody under conditions of human dignity Throughout the period (1994 to 2012)&nbsp<br>the DCS has been suspicious if not dismissive of advice, guidance and at times orders (including court orders) offered or given by external&nbsp<br>stakeholders. Its relationship with civil society&nbsp<br>&nbsp<br>&nbsp<br>&nbsp<br>organisations remain strained and there is no formal structure for interaction. Since 2004 Parliament has reasserted its authority over the DCS, not hesitating to criticise poor decisions and&nbsp<br>sub-standard performance. Civil society organisations have increasingly used Parliament as a platform for raising concerns about prison reform. Litigation by civil society and prisoners has&nbsp<br>also been used on a growing scale&nbsp<br>to ensure legislative compliance. It is concluded that prison reform efforts needs to refocus on he rights requirements set out in the Correctional Services&nbsp<br>Act and approach this task in an inclusive, transparent and accountable manner.&nbsp<br>&nbsp<br></p>

Philosophiae Doctor - PhD<br>This research project, in which social welfare constitutes the central focus of study, is undertaken within the broad field of development studies. The basic concern of the study is to determine the role and the place of social welfare in a post-apartheid South Africa. The study therefore seeks to produce some of the policy-making knowledge and a framework for formulating alternative social policies. With the emergence of the post-apartheid South Africa, social welfare as a system, and social policy in particular, finds itself at a water-shed. For many years social welfare has been practised on a racially-differentiated basis. Social policies were firmly rooted in the prevailing political ideology of apartheid. During its formal inception in the 193Q's, the primary objective of social welfare was to solve the Poor White problem. Currently we have reached a critical turning point in the history of our country. The establishment of an inclusive democracy should have a direct impact on the welfare of all citizens. In this new context we have to deal with mass poverty - the basic human needs of many South Africans not being met - and extreme inequalities. Meanwhile we are saddled with different models of welfare based on the fragmented social policies of the past. Various themes pertaining to social welfare are examined with the view to proposing some solutions to the dilemma. Theories of development constitute the frame of reference for the analysis and development of alternative social policies. Applying these theoretical foundations, a special study is made of the emergence and structuring of social welfare in South Africa. In an empirical study the views of stakeholders in the field are gathered using qualitative methodology. Theories of development, the Reconstruction and Development Programme, the idea of social welfare as a system to meet human needs, and the views of stakeholders, form the basis for the development of alternative social policies in the post-apartheid South Africa. Using this conceptual framework and analysis of contemporary realities, certain policy proposals are examined for their appropriateness to address post-apartheid challenges. The study demonstrates that a paradigm shift is absolutely necessary in order to deal with emerging realities in South Africa. This paradigm shift entails that social welfare adopt a developmental approach within an integrated policy framework.

The authors examine and discuss the application of Individual Psychology and Adlerian therapy in two Asian cultures. Starting with Chinese culture, they review characteristics of collectivist culture and how it functions in China. The compatibility of Adlerian psychotherapy in Chinese culture is examined in terms of their views on human nature, inferiority feeling and the inferiority complex, birth order, and therapeutic relationships. A case study is provided to illustrate the application of Adlerian psychotherapy in Chinese culture. The authors then examine South Korean culture in comparison to past histories and current experiences in China, and they describe one of the author's experiences of working cross-culturally.

A key challenge of the Anthropocene is to advance human development without undermining critical ecosystem services. Central to this challenge is a better understanding of the interactions and feedbacks between biodiversity, ecosystem services and human well-being, which interact in dynamic and complex social-ecological systems. These relationships have been the focus of much work in the past decades, however more remains to be done to comprehensively identify and quantify them, especially at larger scales. In this thesis, a social-ecological systems approach is adopted to investigate connections between biodiversity, ecosystem services and human well-being in South Africa. The country’s high levels of biological and socio-economic diversity, as well as its emerging economy make South Africa an interesting case for exploring these connections. Using data from a variety of public sources, and at different sub-national scales, the thesis first identifies and analyses a variety of bundles of ecosystem service use. Based on these bundles, three social-ecological system archetypes were identified and mapped in South Africa, namely the green-loop (high overall use of local ecosystem services), transition, and red-loop (low overall use of local ecosystem services) systems. Further analysis explored the social and ecological drivers of these patterns, and found the distribution of systems mainly influenced by social factors including household income, gender of the household head, and land tenure. Second, this thesis uses human well-being indicators to construct, analyse and map multi-dimensional human well-being bundles. These bundles were found to spatially cluster across the landscape, and were analysed for congruence with the ecosystem service use bundles. Discrepancies in the expected overlap of ecosystem service use and human well-being were highlighted and concur with findings elsewhere and the ongoing debate in the literature on the impacts of time-lags, indicator choice and scale of these interactions. Third, biodiversity in South Africa was analysed by employing an indicator of biodiversity intactness (BII) at the population level. The BII was found to have declined by 18.3% since pre-industrial times. Biodiversity loss was linked to the potential supply of ecosystem services, as well as human well-being patterns. A potential threshold at 40% biodiversity loss was detected, beyond which population abundances decline sharply. Finally, the thesis examines multiple perspectives on ecosystem services in sustainability research, including the social-ecological systems perspective, and discusses the complementarity of the different perspectives in furthering a deeper understanding of the connections between people and ecosystems. The social-ecological systems perspective employed throughout the empirical work presented in this thesis contributed towards cross-cutting insights, the testing of new kinds of data and the development of new approaches, all of which represent important steps towards unravelling the connections between biodiversity, ecosystem services and human well-being, and contributing to the key Anthropocene challenge of sustainable development.<br><p>At the time of the doctoral defense, the following papers were unpublished and had a status as follows: Paper 2: Submitted. This research project focuses on human rights violation in South African correctional centres. The method of research comprises interviews conducted with correctional officials and inmates. It is a case study of one correctional centre in urban and in rural area of the Eastern Cape Province. The researcher hopes that this study will be a basis for further research into the violation of human rights in South African prisons. The findings of the research indicated that the main causes of human rights violation in South African prisons are overcrowding; gangsterism; and non adherence to Departmental policies by correctional officials. Recommendations have been made that: (i) Provision of adequate prison accommodation; (ii) Upgrading training and staff development.

The study analysed how this has impacted on the states constitutional and international human rights obligation and how the resultant problems can be addressed. It examines whether or not privatisation, which is basically aimed at improving service delivery and bringing countries in line with globalisation principles, has actually achieved that objective.

This research article studies the factors that are likely to affect the visible part of human resource development (HRD)– the use of HRD activities in the Legislature Sector. It is argued that the active use of HRD activities as such does not indicate the role HRD plays in a Legislature’s business: rather, one has to pay attention to HRD orientation that captures the paradigm of an organization as regards the development of people. In this empirical study of Legislature Sector, several factors related to the organization, strategy, HRD function, and HRD person are identified as meaningful predictors of HRD orientation. Results imply that the outcomes of HRD are also dependent on factors outside the traditional authority of HRD function. The model that is formed based on the results helps those involved in HRD to understand the inherent linkages and holistic nature of people development in organizations.

These organisations were examined in order to identify the characteristics that distinguish them from each other in as far as service delivery is concerned. The community based organisations were found to be orientated towards mutual-aid and self-help model whilst the Human Service organisations were orientated towards the service model. This study will also highlight the complex nature of Mbekweni which has been approached by different organisations delivering social services. An integrated developmental model is proposed that could form the basis for private voluntary human service organisations. The model is based on: the participation by beneficiaries of services being involved in the decision making process; and the client of this approach being the group or community. The delivery of services would take place in and by groups. An important element in the model would be the inclusion of trained Developmental Workers who would act as enablers, facilitators, educators and resource persons. This model will emphasise factors that could be incorporated in the designing, planning and administration of private voluntary human service organisations operating in black urbanising communities.

During this research project, an attempt was made to understand the role of ecotherapy as a therapeutic model in post conflict healing. The aim was to evaluate the application and significance of ecotherapy as an intervention strategy for post conflict healing for individuals who were exposed to violent encounters during the liberation struggle. Eight respondents (involved in the arms struggle) from Mdanstane Township in the Eastern Cape, were taken through a series of workshops as part of an ecotherapy healing process. The research concluded that all the participants had suffered from some form of traumatic stress because of their exposure to violence and violent experiences. Moreover, on closer examination the situation of ex-combatants proved to be more complex and often volatile, due to the absence of social support, loss of social status, absence of economic, employment opportunities, and the dislocation from their families and communities. Subsequent to the ecotherapy intervention, a positive outlook amongst the participants was recorded. Furthermore, there was an indication of a significant increase in their sense of self-worth and personal development, which influenced the manner in which the participants viewed the world, related to their families or communities and responded to life in general. Essentially, the research findings, conclusions, and recommendations contributed towards a better understanding of ex-combatants and the value that could be derived from ecotherapy as a post conflict healing method for individuals and groups exposed to violence and trauma.

It has become increasingly clear that dealing with present day environmental crises requires a holistic view that takes into account the interactions of social and ecological factors across multiple spatial and temporal scales. An example of where this new paradigm is being operationalized is the study of social-ecological systems. A substantial aspect of this growing research area aims to contribute to a more comprehensive understanding of the links between social-ecological systems, the ecosystem services they generate, and human well-being. This thesis summarizes the first part of a PhD project with the overall objective of unravelling some of these linkages using a mapping approach in South Africa, a country with high levels of social and ecological diversity. In the first paper, I present an approach to mapping social-ecological systems based on different bundles of ecosystem services. Mapping social-ecological systems has so far mainly been achieved by the overlay of separate social and ecological data. Here, I identify characteristic bundles of ecosystem services and use these bundle types as a proxy for different social-ecological systems in South Africa. The emergent pattern shows three distinct and spatially coherent systems that represent an overall low, medium and high level of ecosystem service use amongst households, and differs markedly from maps based on the overlay of social and ecological datasets. This approach not only identifies areas within South Africa where people are especially vulnerable to environmental changes that negatively affect ecosystem services, but also highlights areas in which distinctly different system dynamics operate in close proximity. It is especially in those areas where systems characterized by high and low dependence on ecosystem services lie side by side that nuanced and differentiated decision-making is required to sustainably manage ecosystem services in support of human well-being across all sectors of society. In the second paper I expand on the approach pioneered in Paper I by mapping human well-being bundles in South Africa. Mapping human well-being as bundles allows us to interrogate the trade-offs between different constituents of well-being at the sub-national scale, something that is not possible when measuring human well-being based on indicators or indices that reduce well-being to a single number. This approach also enables us to perform a spatial comparison between the levels of ecosystem service use (identified in Paper I) and human well-being, which signifies an important step forward in the development of quantitative tools for the analysis of the relationship between ecosystem services and human well-being at scales between the local and the national.<br>Governance of ecosystem services under scenarios of change in southern and eastern Africa

The study emanates from the constitutional imperatives with regard to the role of local government in community development. The notion of cooperative governance is envisaged in the South African Constitution which stipulates that all spheres of government must adhere to the principles of cooperative government and must conduct their activities within the parameters prescribed by the Constitution. The purpose is to support and strengthen the capacity of the local governments to manage their own affairs and to perform their functions. The basic values and principles governing public administration entail that: it must be broadly representative of the people of South Africa in order to redress the imbalances. The existing gaps in the legislation on decision making power at the local level of the municipality, be it in a ward committee or sub council, have not been adequately addressed in the post 1994 democratic dispensation. It is in this context that this study seeks to address these gaps and obstacles, and contribute to the design and development of a decentralized cooperative governance model, specifically to the six metropolitan municipalities and also provide a basis for further research. The findings of the research could be adapted as a national policy in the empowering of municipalities through the dispersal of democratic power which is an essential ingredient of inclusive governance. Based on a case study of six metropolitan municipalities, the research is intended to contribute to the development of empirically grounded; praxis and practical guideline in decentralized cooperative governance which can be adopted and institutionalized in public administration. It is believed that a study of decentralized cooperative governance adds value in that it seeks to link decentralized power and local development. Rather than civil society organisations being seen as adversarial, a creative partnership with the state in local development is crucial. This political assimilation is critical in the construction of democracy through fusing the substantive values of a political culture with the procedural requisites of democratic accountability. This serves to fragment and disperse political power and maintain a system of checks and balances with regard to the exercise of governmental power. The capacity for innovation, flexibility and change can be enhanced at the local level, and it is a cliché that local decision making is viewed as more democratic in contrast to central, top-down decision-making processes. A syncretistic model for local government based on the political adaptation of political and inclusive decentralisation is outlined.

The Constitution Act, 108 of 1996 declares that: 'in the Republic, government is constituted as national, provincial and local spheres of government that are distinctive, interdependent and interrelated". Section 41(1)of the above Constitution further states that there shall be cooperation, mutual trust and good faith between these three spheres. They should inform and consult one another on matters of common interest, co-ordinate their legislation, and adhere to agreed procedures. In addition, it is expected that acts of Parliament should establish structures and institutions to promote and facilitate intergovernmental relations, and provide mechanism and procedures to facilitate settlement of intergovernmental disputes. In view of the above, it is evident that co-operative government can be regarded as one of the cornerstones of the new constitutional dispensation in South Africa and intergovernmental relations can be regarded as practical instrument for ensuring co-operative government in the delivery of services by the three spheres of government. The study therefore seeks to assess the impact of intergovernmental relations on service delivery in the Department of Cooperative Governance and Traditional Affairs in Eastern Cape Province from the year 1994-2009. One of CORD's activities is the welfare programme, which started four years ago. It has two features which make it particularly interesting. First, it has introduced a level of welfare into rural areas which has not been there before. Second, it is based on a broad, developmental and holistic approach to welfare — which is what most people agree is needed, but very few actually manage to do. Welfare projects are often well meaning but small in scale, without the ability to help people out of the poverty in which they are trapped. We believe that this welfare programme acts as a catalyst for other development activities — it shows that welfare can be a wedge, a point of entry, for broader community development. It is one model for a more appropriate welfare system for the future. Compared to health, there is very little written material about alternative welfare provision. There have been fewer attempts at model building than there have been in health. And it is possible that some small projects have not been written up for others to learn from. A key aspect of innovative work in the social service and development fields is the training of new kinds of workers. This is almost always based on a recognition that existing professionals (for example, doctors, social workers, irrigation engineers, physiotherapists) •are expensive to train • are difficult to move from city-bases, and • are not necessarily good communicators with the people they are meant to serve. The South African government and the South African Council for Social Work (the body that finally controls professional social welfare) have agreed that there is a need for a new category of welfare worker — an assistant or auxiliary. The rules surrounding their training and supervision are such that, although it is a step in the right direction, it does not go nearly far enough. For example, every two assistants must be supervised by one social worker. In most rural areas there are no social workers, so there can be no assistants. When new categories of workers are trained, they often meet with strong resistance from two sides — existing professionals, and people in communities. In the welfare field, the strongest resistance will probably come from the professionals. We think that this welfare programme shows how the work of the professionals can mesh together with the work of people with less formal training, so that they can help each other to deliver better services to more people. The welfare context The welfare programme needs to be set against the context of existing welfare services in South Africa. The South African welfare system is inappropriate and inadequate — this is recognised by people in government, people working in the private welfare sector, and is certainly recognised at community level. The problems that are very evident are: • welfare spending and social services have been biased in favour of white provision • the system has not been properly planned • there is a heavy bias in favour of urban areas, and a serious neglect of rural welfare • where social work posts do exist in rural areas, they are difficult to fill. • the privatisation of welfare which is being encouraged by government (along with the privatisation of health, education, transport and other social goods) will mean that the well-off people will be able to buy better private services, but poorer people will have less access to even poorer public services. There is an emerging consensus across the country that if the welfare system is to have a contribution to make to the 'new South Africa' it will have to become: • more developmentally oriented • more appropriate to the conditions in which the majority of people live • more concerned with the welfare of the very poor, especially in rural areas • more accessible to people who need the services, and particularly by women and children. These principles are accepted internationally as guidelines for the provision of social services such as heath, welfare and education. In the field of primary health care in South Africa, we have many examples of model schemes which have tried to learn how to provide appropriate, affordable, accessible health services. Many of these have been written about; some indeed are known internationally. All these case studies are vital to the development of better health services in future. In most rural areas, and in the majority of peri-urban informal settlements, we are not talking of a situation where services could be improved by adding more professionals — we have a situation where there is virtually no access to welfare services at all. The interview that follows is presented as a case study of an innovative welfare programme.

The main aim of the study was to investigate the use of CSG by the beneficiaries and the community perceptions thereof on CSG abuse in South African Social Security Agency (SASSA). The objectives were to investigate the use of CSG by the beneficiaries, to identify the weakness in SASSA policy on the granting of CSG, to analyse the community perception about the abuse of CSG and to provide workable solutions to the existing problems of child grant. Structured interviews, questionnaires and literature were used to collect data. The study concluded that SASSA employees and community members believe that beneficiaries are abusing child support grant while beneficiaries believes that child support grant is used properly.

Municipalities that are not financially viable and sustainable will always struggle to deliver basic services to communities. Without sound financial management systems, municipalities will be forced to discontinue their operations. Municipalities, particularly small and rural ones, are not self-sufficient and often rely on grants and transfers to satisfy their immediate short-term goal of providing basic services to satisfy the needs of their communities. Therefore, finance is regarded as an overriding and decisive factor for determining the viability of municipalities. The study seeks to investigate the financial viability of selected urban and rural municipalities in the Eastern Cape. Its key research questions are: Are municipalities able to provide sufficient funds to provide a range of services at an acceptable service level? To what extent do municipalities rely on external funding? Do municipalities have revenue collection capacity and revenue policies? The study asserts that most municipalities lack the required financial resources. They depend mainly on transfers from Provincial Government and equitable share and conditional grants from National Government. Section 152 (1) of the Constitution of the Republic of South Africa, Act 8 of 1996, states, amongst other things, that Local Government should ensure the provision of services to communities in a sustainable manner. The constitution further states that a municipality must strive, within its financial and administrative capacity, to achieve its objectives. The Municipal Finance Management Act, Act 56 of 2003, creates a framework for municipalities to borrow money and determine the conditions for short- and long-term borrowing. The Act assigns clear roles and responsibilities to the various role players involved in local government financial management. According to the Act, an annual budget for a municipality may only be funded from realistically anticipated revenues to be collected. As revenue projections in the budget must be realistic, the Municipal Property Rates Act, Act 6 of 2004, facilitates the collection of revenue in municipalities and establishes a uniform property rating system across South Africa. Property tax is the biggest element of local government tax revenue and is central to municipal finance. The Municipal Systems Act, Act 32 of 2000, amongst its objectives, provides for the manner in which municipal powers and functions are exercised as well as establishes a simple framework for the core processes of planning, performance management and resource mobilisation. The Act also provides a framework for public administration and human resource development. Finally, it also empowers the poor and ensures that municipalities put in place service tariffs and credit control policies that take their needs into account. The research contends that, whilst there is legislation and structures to assist and direct municipalities, it has been established that municipalities do not properly collect rates and taxes due to them to augment their revenue. The study has shown nevertheless that metropolitan municipalities have the capacity to collect revenue for municipal services. This is confirmed by their collection rate which ranges between 94 % and 97 %. There is also the culture of non-payment by communities for services rendered by the municipalities. Rural municipalities are exempted from property tax, while other rural municipalities who have an urban component, have to collect. There is also the question of unemployment and poverty. Consequently, municipalities are not self-sufficient and rely on grants and equitable share to survive. As a result of this lack of self-sufficiency, it is difficult to implement service delivery and also difficult to attract skilled personnel. The study has investigated why some municipalities fail to collect revenue and depend on national grants. The study employed both qualitative and quantitative methods. The findings of the quantitative paradigm have been presented in the form of graphs and charts. The major findings include: All municipalities have limited borrowing capacity; have not exceeded their budgets in terms of their spending; small municipalities have households as their main contributor of revenue collected; metropolitan municipalities get the big slice of their revenue from business; small and rural municipalities rely on grants and transfers and are therefore not financially viable; metropolitan municipalities are, to a great extent, financially viable but lack skills and capacity to utilize their resources for effective service delivery; and all municipalities under-spend their budgets. The study, after elaborating on the findings, makes recommendations on how municipalities should become financially viable.

The post1994 democratic era was accompanied by slogans such as ‘a better life for all ’. These slogans in part stem from the Constitution of the Republic of South Africa, 1996. The Constitution, chapter two, in its discussion on the Bill of Rights states that everyone has the right to quality health care services. The critics argue that the fundamental r right enshrined with in the Constitution in as far as it pertains to healthcare has been violated. The state introduced various interventions, such as human resource capacity development t programs, to turn the dismal state of public health care around. This research focused on the impact and the relevance of the human resource development within the public health sector. The following research question had been formulated to guide the research; is skills development within the state undertaken for compliance sake or is it a focused interventionist approach aimed at improving the skills set of staff to perform effectively and efficiently? The research was qualitative in nature and the case methodology was used. In this regard Tygerberg hospital was used as the case study. A number of findings emanated from the data collection process, amongst other, that the skills development is not workplace specific but rather undertaken for compliance sake. Furthermore, that no individual staff development plans exist. The end result is that the skills development intervention aimed at improving the staff capacity and the state of health service generally is not making any meaningful impact. The major recommendation is that a health audit must be done, which must inform the development of the hospital staff skills development plan. This in turn must be used to develop individual staff f development plans. This alignment of development plans from provincial level to hospitals and then to the individual will result in a more focussed skills intervention and ultimately an improved public health sector.

<p> The purpose of this study was to determine community perceptions of changes in ecosystem services from the restoration of Noisette Creek saltmarsh in North Charleston, South Carolina and to explore the potential impacts of restoring Noisette Creek ecosystems on human well-being. Ecosystem services are human benefits from resources and processes that are supplied by natural ecosystems. These services have been shown to directly affect human well-being in the people using these services. Secondary data were collected at the ZCTA level to create social, economic, and health indicators to assign current levels of well-being in the study area. Three focus groups and 25 q-sorts, using 24 paired statements inspired by focus group data, were conducted to determine community perceptions of restoration and the role of Noisette Creek in influencing human well-being within the community. North Charleston in most well-being indicators scored relatively low compared to Charleston County as a whole and selected ZCTAs within the county, particularly in economic security. The focus group data showed seven main themes surrounding Noisette Creek and its restoration, the most prevalent being access to the creek, sense of community, and awareness of the condition and history of Noisette Creek. Three factors representing three discourses (awareness, ecosystem services, and community) emerged from the 25 q-sorts, all with a mix of individuals from various earned incomes and racial compositions. The general consensus using all three analyses is that the restored ecosystem services provided by Noisette Creek could lead to an overall environmental, social, and economic improvement in the area, and therefore have a positive impact on the well-being of area residents. </p>

<p>In 2007, at its 52nd Conference in Polokwane, the African National Congress (ANC) called for the implementation of a National Health Insurance (NHI) scheme. The announcement resulted in much debate, with critics voicing concerns about the state of the public health system, lack of consultation and the expense of a NHI scheme. However, little attention has been paid to the&nbsp<br>human resource (HR) needs, despite the fact that 57% of recurrent expenditure on health1 is on HR. This research aimed to identify the HR requirements to support the implementation of an effective and equitable health system funded by a NHI in South Africa. An overview of the current burden of disease and distribution of HR is provided. Through interviewing key stakeholders the study attempted to elicit information about factors which will hamper or assist in developing such a health system, specifically looking at the HR situation and needs. The research explores HR&nbsp<br>odels and proposes key HR requirements for implementation of a health system funded by a NHI in South Africa, including skills mix and projected numbers of health workers and&nbsp<br>proposes ways to improve the deficient HR situation. Exploratory qualitative research methods were used comprising in-depth individual interviews, with a purposive sample of key informants, including: public health professionals and health managers (working in rural and urban areas)<br>researchers<br>academics and NGO managers. Key informants were asked to identify literature and research material to support recommendations. The research findings indicate that despite the South African Government&rsquo<br>s expressed commitment to Primary Health Care (PHC), the National Department of Health has continued to support and sustain a clinical model of health service delivery (Motsoaledi, 2010), primarily utilising doctors and nurses. The clinic based services are limited in their ability to reach community level, and, being focused on curative aspects, are often inadequate with regard to prevention, health promotion and rehabilitation services. While the curricula of health professionals have been through some changes, the training has continued to be curative in focus and the clinical training sites have not been significantly expanded to include peripheral sites. While there are many Community Health Workers in the country, they remain disorganised and peripheral to the public health system. The mid level worker category&nbsp<br>has not been fully explored. Finally there are no clear strategies for recruitment and retention of health workers in rural and under-resourced areas. In addition to the continued use of a clinical model, transformation of the health system hasbeen hampered by inadequate numbers of health workers, particularly in the rural and periurban townships and informal settlements. There is no clear strategy for addressing the critical&nbsp<br>health worker shortage in under-resourced areas, particularly rural areas. The last section makes recommendations, which will be submitted to the relevant task teams working on the NHI. It is intended that recommendations arising out of the research will influence the process and decisions about HRH within a NHI funded health system.</p>

The purpose of this mini-dissertation is to investigate the applicability of the King III in local government sphere, as well as to evaluate the impact it is likely to have if its principles and recommendations were to be fully implemented. Local government has been plagued by very serious challenges of poor service delivery and this has been attributed, in the main, to a lack of adequate resources to address backlogs and maintain existing infrastructure. it is therefore very important that all resources are harnessed and channelled to where they are most need, in service delivery. The investigation of the systems and procedures that are in place to ensure prudent financial management and accountability is a worthwhile study. the BMC, is one of two economic hubs of the Eastern Cape. The mini dissertation commences with assessment of governance arrangements that are in place at the BMC against the minimum standards proposed by the King III. It explores the full range of principles proposed in the codes and compares that to practices and procedures at BMC. To avoid a long winded discussion because the principles are close to ten in number; these have been combined and formulated into four broad themes. A consolidated discussion on manifestations on bad governance or poor adherence to good governance in the public sector is discussed in detail. Finally, the impact of various initiatives currently being pursued to promote good governance will be examined, key lessons will be drawn and recommendations for further studies will be made.

The legacy of South Africa’s history has facilitated unequal access to land and water resources. In the Lower Sundays River Valley (LSRV), a predominantly commercial farming area, differential access to land and water has impacted aspects of ecosystem service access and human well‐being for disenfranchised families over time. Despite the social, political and economic reform efforts in the past two decades, severe inertia towards efforts attempting to increase equitable access to land and water has been experienced. As a result, communities have mobilized and claimed their land from the government through the land restitution process. Based on a mixed‐methods approach, this research explores the ways in which access to land and water over time has influenced current levels of human well‐being among disenfranchised families. Provisioning and cultural ecosystem services were identified as key areas of loss as a result of forced evictions from land. Freedom of choice was a central and cross‐cutting theme regarding the ability to change levels of human well‐being. Although the loss of ecosystem services associated with land and water had an impact on households, the ecosystem services which are regarded as fundamental to human well‐being do not seem to have been lost. The study recommends the wide use of freedom of choice as an indicator for well‐being in the LSRV, as well as a consideration of subjective, objective and psychological measures of well‐being with regards to natural resources and ecosystem services access. Key agents in fostering desirable pathways toward equity and sustainability in the LSRV are identified with stakeholders as private businesses; inclusive governance; empowered and skilled individuals, as well as NGOs.

The demise of apartheid and the ushering in of the New Dispensation in 1994 necessitated the dismantling of the old structures of government which divided the people along racial lines and building a united South Africa based on the principles of the new Constitution.Chapter 10 of the Constitution No. 108 of the Republic of South Africa gives guidelines and principles on how Public Administration should be governed. Section 195 provides for the basic values and principles which govern public administration. The Eastern Cape Department of Education is faced with a problem where the basic values and principles which govern public administration in schools had either not been observed or are completely compromised despite the involvement of labour unions. This is evident in the final results of matrics year after year which became a social concern and the national question. The state of affairs is not improving despite the involvement of labour unions and this prompted the National government to intervene through Section 100. This study will try to explore and mitigate this undesirable state of affairs. The involvement of labour unions is a critical question as to whether their involvement enhances proper governance and policy intentions in schools which will enhance service delivery and increase performance and output results. The researcher followed a multi-method approach to benefit from the diversity of opinions and understand the problem better.

Tech.(Human Resources Management)) -- Central University of Technology, Free State, 2014<br>How to address the apparent failure of South African municipalities to deliver service that meets citizens’ expectations, poses a major challenge. The often violent protests that have resulted in deliberate destruction of private and public property, and sometimes fatalities, have been used by the public to demonstrate their dissatisfaction with the poor quality of service received from municipalities. With all these incidents, and no visible solutions yet in place, one can bluntly say that some South African municipalities have failed to deliver quality service to citizens, and they appear to be at a loss of how to change this state of affairs. This study proposes that the poor service delivery of municipalities in South Africa can be attributed to their human resource practices, which have been rendered ineffective by political interference. Borrowing from organisational justice theory, the researcher argues that political interference in human resource management (HRM) in municipalities in South Africa will lead to low employee perceptions of HRM fairness (or justness) (PHF) in the practices of municipalities, and this, in turn, will lead to low levels of employee organisational commitment (EOC) and employee motivation (MOT), conditions which are enough to make municipal employees develop negative or unacceptable employee citizenship behaviour (ECB), which may affect the quality of service delivery (QSD) that municipalities render to customers. This theory was tested using ten (10) emergent hypotheses. The theory was partially validated with empirical data collected from nine municipalities in the Free State province. Key findings of the study point to political interference in the HRM practices of municipalities, employees’ perception of HRM practices of municipalities as largely unfair, and service delivery that does not meet citizens’ expectations. These and other findings are presented and fully discussed in this research report. The report also provides recommendations for practice and further research.

The Republic of South Africa emerged as 'a product of a historical moment' and also as a reaction against imperialism, colonialism, racial discrimination and domination over the majority of black South Africans by the white minority. The democratic dispensation came into being also for the first time in its life in memorial for a long turbulent history followed by the general democratic elections held on 27th April 1994. The 1994 first general election liberated South Africa from the apartheid system and its subsequent primary objective was “… to transform South Africa into a non-racial and democratic society”. The new democratic government now looks politically different from the racist regime because the current government since 1994 has been, and to date still is, a truly and broadly representative of the South African citizens and also a transparent one, whereas the defunct apartheid government was characterized primarily by, among other things, the violation of human rights, denying black South Africans of any rights of basic services, no rights of owning property or land, no freedom of association and speeches and firmly practised discrimination which was detrimental to the majority of the black population groups in this country. United Nation's (UN) millennium development goal number three is aimed at eliminating gender inequality and empowering women. Gender-based violence is recognised as a global public health and human rights problem that leads to high rates of morbidity and mortality, including sexually transmitted infections, depression, post-traumatic stress disorder, substance dependence and suicide. In responding to this international public health and human rights concern, the South African government has adopted numerous public health communication strategies to highlight the plight of women and children. One of the campaigns that are conducted in South Africa is the 16 Days of Activism for No Violence Against Women and Children (16 Days of Activism Campaign). This campaign was introduced in 1999 but the literature review reveals that to date, no studies have focused on its evaluation. As such, the purpose of this study is to evaluate the 16 Days of Activism Campaign with special reference to the Soshanguve community in Gauteng province. This study builds on two theories, namely the excellence theory and the diffusion of innovation theory. Mixed research methods (also called triangulation) was used whereby in-depth interviews were conducted with representatives from the Government Communication and Information System and the Department of Women, Children and People with Disability to establish the promotion strategies used in the campaign and the methods used to assess the effectiveness of the campaign. Furthermore, a self-administered questionnaire survey was conducted within the Soshanguve community to evaluate the promotion strategies and assess the impact of the campaign.This study revealed a high level of reliance on the television, radio and newspapers in the communication strategies. Both government departments acknowledged that they do not have a tool to evaluate the effectiveness of the campaign from the receivers‟ perspective. The Soshanguve community felt that in essence the campaign is relevant but not on time. The residents viewed the study as an important part of creating awareness about the campaign and they believed the campaign helped them to know what to do when faced with gender-based violence so that they can assist those who are affected by it.

International Aid or Official Development Assistance (ODA), especially its implementation and effectiveness, has long been and continues to be a vigorously contested matter amongst the stakeholders in the development arena. The objective of this study is to evaluate the effectiveness of ODA in two municipalities in the Eastern Cape – Buffalo City and Nelson Mandela Metropolitan Municipalities – during the period 2005–2010. This period coincided with the introduction of the Paris Declaration (PD), an intervention intended to improve the ODA or Aid landscape globally. This was also the period during which the so-called service delivery protests in almost all municipalities in South Africa escalated. A diversified methodology including both quantitative and qualitative approaches was used in this study while adhering to the evaluation framework of the Paris Declaration as recommended by the Organisation for Economic Cooperation and Development (OECD). This framework put special focus on the five principles of ownership, alignment, harmonisation, managing for results and mutual accountability. Of particular significance in this study is the special attention paid to the actual beneficiaries on the ground, namely the communities, which is contrary to most existing Paris Declaration evaluations. The research findings suggested that there had been no conscious efforts to implement the Paris Declaration in the two municipalities that were investigated. Furthermore, the prevailing weaknesses in governance, coupled with both administrative and operational paralysis in these two institutions, provided for less than fertile ground for this intervention to thrive.The findings also highlighted that ODA programmes were very poorly known by most stakeholders, especially the communities who were supposed to benefit directly from this assistance. These results also underscored the partisan nature of ODA and how it influenced the perceptions of the various key players. The success and future of ODA programmes in South Africa, particularly in municipalities, will largely rely on “Active Citizenry”. Although ODA’s contribution to South Africa seems negligible in monetary terms, its significance lies among others in the innovations, piloting, risk mitigation, catalytic initiatives and capacity development it introduces or generates and which need to be correctly exploited, implemented and maximised. ODA in South Africa should therefore focus at the local level, the municipalities, which represent the interface between the citizens and the state. To ensure that the ensuing innovations are optimally cascaded down in an organised and effective manner to where they are mostly needed, ODA should preferably operate at the strategic level in municipalities. This would in turn assist in counteracting the current high levels of poverty and inequality in the country. Study findings further suggest that South Africa should cease its current ambivalence regarding ODA and refrain from the so-called “Triangular” ODA in support of the rest of Africa. The demands in it’s own back yard are steadily mounting. This is clearly reflected by the continuous service delivery protests and instability in several municipalities in South Africa.

The study was also aimed at identifying the factors that support or hinder the implementation of the supply chain management within the King William’s Town District Municipality. In order to achieve this objective, interviews and self-administered questionnaires were conducted with various respondents in the municipality. The respondents insured the councillors from the five political parties comprising the municipality, municipal manager and section 57 managers, supply chain practitioners. It would therefore be critical important for the management of the King William’s Town District municipality to take into account the results of this study and its recommendations so as to ensure that there is a proper implementation of the supply chain management system within the municipality.

Abstract:
The Eastern Cape Department of Education has become like a problem child in the Republic of South Africa. It is a cause for concern to both the provincial and national government. This is a department where service delivery is problematic. Schools are not built or renovated and children are taught in dilapidated structures or sometimes under trees. Hardly a week passes without the department making the headlines in the media for the wrong reasons. It is widely accepted that the department is dysfunctional and education is in a crisis. The department has emerged as the number one culprit of engaging in corrupt activities in the province. Public officials in the department have been identified as being at the helm of these corrupt activities. In the 200/10 financial year, the Auditor General issued a disclaimer to the department and highlighted a lack of direction, accountability and a total breakdown of internal control systems and supply chain management within the department. Numerous fraud risk indicators were identified during the audit and underlined by findings that are indicative of fraud and corruption within the department. This unfortunate state of affairs is contrary to the requirements of section 195(1) of the Constitution of the Republic of South Africa which provides for the democratic values and principles governing public administration including inter alia, that: A high standard of professional ethics must be promoted and maintained. Efficient, economic and effective use of resources must be promoted. Public administration must be accountable. This raises several questions about the ethical fitness of public officials in the department as the custodians of the public resources and trust. Though several reasons abound for this unfavourable state of affairs in the department, the researcher has singled out unethical conduct by public officials in the department and its impact on service delivery. The approach followed in this research was to analyse the 2009/10 Department of Education Annual Report and the 2009/10 Auditor General’s Report to the Eastern Cape Department of Education. The analysis confirmed the existence and occurrence of multiple cases of unethical conduct in the department. At the end scientific recommendations are proposed to alleviate this ill.

The study Assess the role of Cooperatives in Poverty Alleviation in the Eastern Cape Case Study of Amathole District Municipality how cooperatives are conducted in the Amathole District Municipality and establishes the perceptions of staff and members of the public about the service rendered by the municipality, and developing the mechanisms that can be used to identify cooperatives activities and how to improve the services rendered by the municipality, and if there are any challenges, they must be resolved. The research was also to look at how the support from government and other government agencies are used to enhance the cooperatives governance. Lastly, the research was to find the best model for cooperative development and what needs to be done to enhance the capacity of the cooperatives. The literature indicates that staff must be equipped with necessary skills; however it is evident that training and development is essential for the members of the cooperative. Questionnaires and interviews were used as a method of collecting data from the respondents. In this study, both qualitative and quantitative methods were used to analyse the data. The research assumption was that cooperative development is a viable tool for economic development of the rural areas. This can help many South Africans and many communities come out of poverty. However, there are limitations that were caused by the inability of government to co-ordinate cooperative development. Despite the role that cooperatives play in South Africa, cooperatives still experience a number of challenges. These challenges are, amongst others, lack of access to finance, lack of access to market, lack of business skills, lack of infrastructural facilities and lack of knowledge about the cooperative. In view of the challenges facing the cooperatives, the government instituted a number of state departments and parastatals for funding and other necessary support. These are DTI, DEDEA (in the Eastern Cape), ECDC, South African Development Agency (SEDA), Department of Labour and municipalities. The objectives of these support institutions are to provide necessary support needed by cooperatives and to ensure that cooperative development is sustainable.

Magister Legum - LLM<br>While the Constitutional Court has repeatedly enforced a duty to meaningfully engage with communities where the provision of basic social services and goods is at stake, uncertainty about the form, extent and quality of community engagement continues to negatively impact on development projects. The much publicised "toilet saga" in the Makhaza informal settlement in the Western Cape is a telling example. This problem is partly attributable to a lack of clarity about the legal foundations and basis of this duty. The research project explores such an approach by clarifying the proper legal and constitutional basis of the right to meaningfully participate in development projects and the delivery of basic social goods, and in so-doing, to place public participation in socio-economic rights on a sound legal and constitutional foundation. The project further seeks to develop a framework or best practice for the practical implementation of this right in the context of urban development projects.

Abstract:
This research sought to understand the perceptions of the township dwellers who are the beneficiaries of the RDP houses in a selected township, Chris Hani block 3 in Mdantsane, East London, in the Eastern Cape. The study specifically sought to establish whether the houses delivered to the residents through the Reconstruction and Development Programme (RDP) adequately meet the basic standards prescribed by the relevant housing policy of South Africa. During the apartheid era black South Africans were marginalised, their development was separate from that of whites and they had no say in what was provided for them, hence they were inadequately housed. On coming into power, the post-apartheid government undertook through legislation to provide sustainable, adequate housing that would address the needs of the historically disadvantaged citizens/poor people of South Africa. The main finding of this study conducted on a sample of ten RDP housing beneficiaries, through personal interviews is that, the RDP is a good programme; however, its implementation is characterised by corruption and greed. The people, whom the programme is meant to benefit, have never been involved in their own development with the results that the houses provided to them, are of a sub-standard quality. The houses do not adequately address the housing needs of the people. The housing policies are also not adequately implemented. It is the author’s hope that the recommendations made by this study, if implemented, will improve the standard of the RDP houses provided to the poor people of South Africa.
