Full textThe Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement) of the World Trade Organization (WTO) was created to partially replace the exceptive rule which is present in the Article XX b) of the GATT, which was perceived by the Members as the outcome of the search for a balance between trade and food safety. However, the most obvious effect of this partial substitution was the creation of a dual system for the treatment of measures relating to the life and health of human and animals, and plant conservation. This is explained by the scope of the SPS Agreement, which is narrower than that of Article XX b) of the GATT, hence, this agreement does not handle all SPS measures that were in the jurisdiction of Article XX b) of the GATT. Therefore, Article XX b) of the GATT, far from being obsolete, is still in force and is subject to judicial interpretations of great transcendence. The two existing systems, which operate in parallel, present fundamental dissimilarities. Consequently, the legal instruments parts of this dual regime tend to move away from each other, as the most important of their differences is their nature itself. This leads us to believe that SPS measures related to the SPS Agreement represents the struggle of two values -the food safety and free trade; whereas the measures which remain exceptions are an example of good understanding and a genuine conciliation effort. Thus, in order to verify the existence of the dual scheme and to assess its contributions, the work is divided into three parts. The first is used to identify the place that the SPS Agreement occupies in the WTO, a historical-legal report on the creation of the SPS Agreement will be done. Then, the second part of the work presents the contributions of the agreement to the legal system of the WTO. Finally, the third part is to find the legal consequences of the innovations introduced by the SPS Agreement. This analysis will tell us about the nature and effects of the SPS Agreement. But above all, it will highlight the elements that can be improved to give to this agreement what should be its distinguishing characteristics: its nature of exceptional agreement and its capacity to facilitate reconciling trade liberalization and food security.

Full textThis thesis deals with scientists facing occupational risks due to radioactivity in France, from 1901 to 1967. Scientists are indeed at the same time victims of the dangers of radiations, experts on the hazardous substances and in charge of the organisation of protection. My study explores their role in the process of risks management and regulation and confronts it to the daily scientific practices in laboratories, through the examples of several laboratories in distinct scientific disciplines: the Laboratoire Curie, at the Radium Institute of Paris during the interwar period and the Laboratory of Nuclear Chemistry, the Laboratory of Nuclear Physics and the Laboratory of Biophysics of Strasbourg, after 1945. This history is thus part of an History of Sciences and Medicine, but is also closed to central topics of an History of Environmental Hazards, especially when it comes to risks in the workplace due to toxic substances. It also takes into account gender issue in the setting of regulation and protection against radiations

Full textIn this manuscript we propose the modelling of a learning organization, using an experience feedback, applied to the authorities’ management of sanitary alarms. This manuscript is composed of two parts:The first part introduces the problem, presents the actors and brings the theoretical concepts and the field analyses for the model’s development. The first chapter relates to a description of the organization in place with the identification of the dangers and the risks. Some great crises and sanitary alarms related to the food are described. The question of the improvement of the management of these alarms and crises arises. A possible answer to that question is proposed with ‘learning’ as feedback between the management of risks and the prevention of risks. The second chapter defines the concepts of organization and learning. Organisational learning and the Learning Organization are studied. These concepts are put in relation to the risk and with the organizations which deal with the dangers and risks. From there, the concept of experience feedback is retained for an in-depth analysis. The third and final chapter of the first part of the manuscript is devoted to the concept of experience feedback and its contribution to this work is justified. The second part relates to the development of the contribution of the thesis and the presentation of a concrete implementation of the theoretical proposals. The fourth chapter presents the modelling of the Learning Organization for the management engineering of the sanitary safety of food. The modelling schematically summarizes the manuscript, each phase of modelling corresponds to a part of the manuscript. The presentation of the. . . (sic)

Full textThis thesis considers the occupational health of public officials in slaughterhouses in its multi-dimensionality. It provides an analysis of work in the public sector, not only from its institutional framework, but also from the many interactions, often interdependent, between the activity, the organizations and the trajectory of food safety policy. It undermines both the presumption of quality at work in the public sector and the strong tightness of this sector. It shows how pain is negotiated, between daily activity and occupational disease reporting and reclassification schemes. From the 2000s, a growing proportion of officials in slaughterhouses suffered from musculoskeletal disorders. MSDs are an opportunity for middle management to negotiate with slaughterhouses, but also to state the "real work" of slaughterhouse agents. The agenda setting of the occupational health of the agents affected in the slaughterhouses arises in the context of redefining the missions of the State and the evolutions of the food safety policy contribute sometimes to make emerge health at work, to overshadow it by leaving aside the question of the future of those officials whose missions evolve and whose profession is liable to disappear. At the crossroads between the sociology of professions, occupational health and the sociology of public action, the analysis framework proposes to articulate the regulations related to health and working conditions to those of the activity and the profession of inspector himself

Full textThe scientific expertise, produced for the Codex Alimentarius by international committees of the FAO and the WHO, has a growing central role in the regulation of food production and international trade. It is this role and the questions arising from the relation between science and policy that this research work explores by analyzing the “credibilization processes” of expertise. The theoretical framework articulates Sociology of organizations, Sociology of science as well as central concepts of political sociology. The relationship between science and policy is known to be unstable. The FAO-WHO’s expertise is even more unstable with regard to its participation in the international normalization/standardization which has an enforceable power over national regulation systems. This dissertation demonstrates that the “credibilization processes” in which different actors are involved (experts, institutions, regulators, industries, consumers…) enables to reduce this instability. By engaging in these processes, actors obtain the resources to negotiate their position in the relationship to their advantage, and are able to avoid criticism at the same time. We consider the “credibilization processes” as a set of strategies aiming at strengthening “the subject’s ability to state and to take action”, a notion that exceeds the limits of “authority” and “legitimacy”, other central notions. Processes are grasped by analyzing strategies and behavior of institutions as well as experts in their transnational networks and in the course of FAO-WHO collective expertise. The “credibilization processes” rest upon three interdependent dimensions: a procedural credibilization, a collaborative credibilization and a deliberative credibilization. This research illustrates an expertise that is inseparable from the “credibilization processes”. The credibilization is both the result of interdependencies along the expertise, and a prerequisite for interdependencies to exist in order to produce an expertise. The “credibilization processes” analysis unveils a plural expertise, more specifically in between a “traditional” model and a “precautionary” model. Finally, this dissertation questions the relevance of maintaining science and policy separated; a separation always reasserted by national and international authorities, but remaining however implicitly adjusted in practice
