Abstract:
The 2008–11 Icelandic financial crisis involved the collapse of all three of the country’s major banks. All domestic assets were transferred to new public-owned domestic versions of the banks, while leaving the foreign parts in receivership and liquidation. The Icesave case relates to the dispute between Iceland, on the one hand, and the United Kingdom and Netherlands, on the other, over the protection of depositors with the UK and Dutch branches. A few years later, in Cyprus, a €10 billion international bailout by the Eurogroup, European Commission, European Central Bank, and International Monetary Fund was announced, in return for Cyprus closing its second-largest bank, the Cyprus Popular Bank, and imposing a one-time bank deposit levy on uninsured deposits of the Cyprus Popular Bank and the Bank of Cyprus. This chapter discusses the two cases, focusing on their impact and the lessons learnt in relation to deposit insurance arrangements.

Abstract:
The small, open economies of Nordic Europe are hailed as paragons of good governance, adapting flexibly to rapid, technological change and shifting patterns of economic competition. But they have also made strikingly poor policy choices and suffered devastating economic crises, as evidenced by the Finnish and Swedish banking crises of the early 1990s, Finnish dependence on Nokia, and Iceland's financial meltdown. Good Governance Gone Bad argues that the reasons for these two, seemingly contradictory phenomena is one and the same. The dense, cohesive relationships that enable these countries to adapt to economic crises with radical reform and restructuring render them vulnerable to policy overshooting and overinvestment. After examining the rise and decline of heavy industry in postwar Sweden, the emergence and disruption of the Finnish ICT industry, and Iceland's impressive but short-lived reign as a financial powerhouse, this book tests the argument against ten similar and contrasting cases in Europe and North America. In doing so, it demonstrates how small and large states alike can learn from the Nordic experience.

Abstract:
This book provides authoritative analysis of current practice in international banking and the law that applies to it. Topics covered include: syndicated loans, security structures, derivative products, and mis-selling claims. The book tackles areas which have particular relevance to current practice. Amongst these are cross-border matters such as worldwide freezing injunctions, foreign disclosure orders, the bankers' duty of confidentiality, and the impact of sanctions on banking transactions. In particular, the book provides examination of various matters arising out of the Lehman collapse and the failure of the Icelandic banking system. This second edition reviews a significant accumulation of case law in these areas. Reflecting the continued growth of the Islamic finance market, there is also a section on this highly specialized but increasingly important area. The new edition provides consideration of the new UK and EU regulatory regimes, analysing the respective responsibilities of the UK Prudential Regulation Authority (PRA) and the UK Financial Conduct Authority (FCA), and the establishment of new banking authorities in the EU. A separate chapter examines the new capital adequacy and liquidity regimes that will apply to banks in the wake of Basel 3. It also reflects on the impact of the crisis following on from the initial assessments made in the first edition. The book examines the new regimes for ‘ring-fencing’ of retail banking business and for the resolution of failing banks, introduced at both the UK and EU levels. The text also includes a new chapter examining the challenges that the banking system would face in the event that a Member State elected to withdraw from the Eurozone — a fate which appeared to hang over Greece during the crisis and which could recur if the single currency zone faces renewed strains.
