Critical illness is transformative. Patients and caregivers are traumatized and acquire new mood disorders and disability. These are costly and consequential. Knowledge of current rehabilitation theory may help to inform emerging models of care for our critically ill patients and families. The International Classification of Functioning, Disability, and Health (ICF) model is presented as a candidate construct for patients and families after critical illness. It highlights the complexity and interdependence of factors that determine outcome and incorporates multiple facets of the individual experience. ICF may facilitate the development of a novel framework of aetiologically neutral clinical phenotypes with distinct recovery trajectories after critical illness. This informs tailored interventions for distinct patient and family groupings, independent of initial diagnostic groups, and acknowledges the similar themes of ICUAW, cognitive dysfunction, and mood disorders following complex critical illness.

In the classic setup of the Condorcet Jury Theorem, voters decide by majority vote between two different options. The Competence Assumption is that all voters are more likely than not to identify the correct alternative with the same probability. The Independence Assumption is that the votes are statistically independent. The Sincerity Assumption is that the voters always vote for the alternative they believe to be correct. Two results follow if these conditions are met. First, the Non-asymptotic Result says that the probability of a correct decision increases in group size. Second, the Asymptotic Result says that this probability converges to 1. We show that this convergence happens very quickly.

The chapter begins with a consideration of mindfulness, the development of that skill on a daily basis, and how mindfulness might be useful in our approach to the interview. It considers motivations and expectations, both of us as candidates and of the examiner, not just during the interview, but if we are successful in getting the appointment. This chapter sets out an exercise in which we can learn how to ground ourselves in the moment and read our surroundings. Practising this technique on a daily basis will then allow us to read the interview room as second nature.

Much work in the ethics of war is structured around the distinction between jus ad bellum and jus in bello. This distinction has two key roles. It distinguishes two evaluative objects—the war ‘as a whole’, and the conduct of combatants during the war—and identifies different moral principles as relevant to each. I argue that we should be sceptical of this framework. I suggest that a single set of principles determines the justness of actions that cause nonconsensual harm. If so, there are no distinctive ad bellum or in bello principles. I also reject the view that whilst the justness of, for example, ad bellum proportionality rests on all the goods and harms produced by the war, the justness of combatants’ conduct in war is determined by a comparatively limited set of goods and harms in a way that supports the ad bellum–in bello distinction.

Managers are regularly confronted with unsolved problems. If a manager knows who can solve a problem, they can assign the problem to the correct person to have it solved under an ex ante contract or other form of agreement/commitment, inside or outside the organization. If they do not know who can solve it, they can crowdsource it, broadcasting the problem to an undefined set of people (the crowd) to self-select and solve it with no ex ante contract or other commitment. Although the practice of crowdsourcing goes back to at least the Longitude Prize of 1714, research on the phenomenon has only recently flourished, thanks, in part, to advances in information technology, globalization, and other macro-environmental factors. This chapter presents a crowdsourcing primer and framework with the goal of providing management scholars with some of the fundamentals needed to pursue their research interests in this compelling phenomenon.

Queller’s version of Hamilton’s rule (HRG), derived from the Price equation, states that the mean breeding value for a social character increases if and only if rb > c, where r is the coefficient of relatedness between social partners, b is the benefit conferred on recipients, and c is the cost incurred by actors. The value of HRG lies in its ability to provide an organizing framework for social evolution theory, helping us to interpret, classify, and compare more detailed models of particular scenarios. HRG does this by allowing us to classify causal explanations of positive change by their commitments regarding the sign of rb and c. This leads to a four-part taxonomy of explanations, comprising indirect fitness explanations, direct fitness explanations, hybrid explanations, and wholly or partially non-selective explanations. There are plausible instances of all four categories in the natural world.

This chapter completes the proposed normative framework for cross-border insolvency. It considers the problem of compliance with a cross-border insolvency system by countries and implementing institutions. The previous chapters have shown how the choice and use of certain international legal sources, such as customary international law (CIL), can strengthen the system, close gaps, and address biases that may otherwise impede the choices of optimal solutions. Yet, notwithstanding the pervasiveness and behavioural force of CIL, the observance of the norms is not guaranteed. Written instruments, even if precise and comprehensive, and designed effectively, do not assure compliance either. Even where so-called soft law is in fact hard in important ways, countries might still underperform. This chapter suggests how compliance can be induced, and discusses which measures can be more, or less effective in that regard, including in view of decision-making constraints.

Pensions in the EU are vulnerable to reduced economic growth, adverse developments in financial markets, and an increasing life expectancy. The increase of the old age dependency ratio contributes to concerns about the sustainability of pension systems. Nonetheless, the pension system in the Netherlands is one of the most sustainable in the world, ranking second in the Mercer Global Pension Index. The Dutch pension sector manages a significant EUR 1400 billion in assets for pensions that are primarily funded through legally compulsory schemes related to employment pension schemes. This chapter examines whether the development of a personal pension system in Europe and in the Netherlands coincide, and if the Dutch system can contribute to a policy framework for European personal pensions. It then considers the reasons why a European market for personal pensions has been proposed.

This chapter examines how the theoretical framework presented in this book fits with the substantive chapters. It argues that if the authors maintain their position about motivational agnosticism, they should reconsider whether “de facto authority” is the best label for the kind of impact of international courts (ICs) at various levels that concerns them. At times their claims seem to fit better with an aspiration to map the ICs’ power more generally. The chapter then questions the framework’s explicit bracketing of social legitimacy in the sense of actors’ beliefs about normative legitimacy. It concludes by suggesting one area for future research where scholarship on social and normative legitimacy may in fact be relevant to understand the politics and legitimation strategies of international courts with variable authority.

This chapter first theorizes as if each system leader has been similar in terms of the resource foundations it has brought to the arena and what it has been able to do with those foundations. Earlier leaders were much weaker than later leaders. What accounts for the difference? Our answer is that system leaders have had variable claims to leads in commerce, technology, and energy. When they combined all three, they became very powerful. The chapter then addresses one of the central issues of Big History: the swinging of the socioeconomic, military, and political lead from western Eurasia to eastern Eurasia and back to western Eurasia and North America in what is sometimes referred to as the “Great Divergence.” This oscillation was put in motion by the discovery of agricultural techniques that gave the West a lead to innovate all sorts of things. Gradually the East caught up, until at one point Rome and Han China were roughly equal. After Rome declined and the Han Empire fragmented, China came back in the Sui–Tang–Song dynasty period, while western Europe remained fragmented. However, the medieval Chinese lead did not persist. Ultimately, the West was able to forge ahead by combining new energy sources and technology. Now, China may be catching up once again.

This chapter discusses the use of multinational military units. Some European States, such as Germany, have incorporated large, if not most, parts of their national military forces in permanent multinational units. Many other States including the US are forming ad hoc military units for specific operations. The UN, NATO, and other international organizations are pursuing standby arrangements and high readiness commitments to allow for rapid response. In all these situations command and control issues are to be considered. While there are many different forms of multinational military cooperation, and Sending States will avoid regulating these matters in status-of-forces agreements (SOFAs) with the Receiving State, they are nevertheless relevant for the law and practice of Visiting Forces. This chapter draws some conclusions on the concept of multinational military operations for the North Atlantic Alliance, the European Union, and beyond.

This Chapter examines whether the ICC has managed to achieve an appropriate balance between two competing values: the accused’s right to liberty and the effective administration of international criminal justice. It analyses the Court’s case-law on interim release, comparing it to the jurisprudence of the ad hoc tribunals and human rights courts. It covers the allocation of burden of proof in interim release cases, as well as the three grounds for interim release provided by the Rome Statute and the Court’s jurisprudence: absence of the risk of flight, interference with the proceedings, and further commission of crimes; unreasonable length of detention; and exceptional humanitarian circumstances. The Chapter points out shortcomings in the current legal framework of the Court and suggests several amendments of the Rome Statute in order to ensure that the accused individuals can effectively challenge their detention.

Since the mid-twentieth century, the DSM has guided psychiatrists in categorizing disorders. Revisions have taken years, with work groups considering changes to the entire manual. A more timely and efficient approach to updating the DSM would involve continuous improvement of particular diagnostic categories, when and if supported by advances in the field. The aim is to avoid the delays in the incorporation of new knowledge that are inherent in updating at intervals of a decade or more. The American Psychiatric Association has therefore established a structure by which evidence-based proposals for changes to the DSM can be considered and adopted on an ongoing basis. This chapter describes how proposals will be considered and the standards to be applied to proposed modifications. Challenges include calibrating optimal rigor of the review process, pruning diagnoses that lack validity or clinical utility, and subjecting the process itself to iterative improvement.

This introductory chapter locates this book’s approach within the dominant approaches to studying the authority of international institutions. The scholarship on authority is vast; the chapter focuses on four key perspectives: legal formalist approaches; normative approaches, including legitimate or ideal authority; sociological legitimacy theories; and compliance studies and performative approaches. The framework developed in this book to measure de facto authority makes a number of bold conceptual claims that challenge these existing scholarships on international courts (ICs). Perhaps most controversially, the book separates the study of authority from the study of legitimacy and argues that IC authority can be identified and assessed by studying the practices of key audiences—litigants, similarly situated potential litigants, governments, judges, and other communities. Finally, the framework rejects a number of claims voiced in global governance debates which assume that IC authority is an all-or-nothing binary.

Theories of global justice fall into four main perspectives: realism, particularism, social contractarianism (society of states), and cosmopolitanism. But health justice remains largely unheeded in these justice theories. More recently, some theorists have turned to health; the perspective most frequently used to ground health obligations is the human rights view. Yet all these frameworks fall short of providing the necessary normative foundation for global health justice. Nor does global bioethics as a discipline address global health justice adequately. Health-sphere actors—global, state, and non-state—need to understand their interests more comprehensively. A more fully developed moral framework and ethical guidelines are essential if health-sphere actors are to tackle global health problems effectively.
