Abstract:
When the UN Security Council (UNSC) created the International Tribunals for the former Yugoslavia (ICTY) in 1993, and Rwanda (ICTR) in 1994, it had in mind that the Tribunals were ad hoc and should have a brief life, enough only to bring to justice those responsible for serious violations of international humanitarian law in those countries. In 2010, as a part of the Completion Strategy, the UNSC established the Mechanism for International Criminal Tribunals as a new ad hoc body, with the purpose of making sure that the Tribunals conclude their missions timely and successfully. The ICTR was of

Chapter 8 analyses post-World War II jurisprudence, national jurisprudence, the International Law Commission’s work, and International Criminal Tribunal for Rwanda (ICTR), International Criminal Court for the former Yugoslavia (ICTY), and the Special Court for Sierra Leone (SCSL) jurisprudence regarding what types of non-state entities might be involved in crimes against humanity. It argues that while the Nuremberg Charter and post-World War II jurisprudence, including national jurisprudence, were focused on state crimes, state involvement has rarely been considered a legal element of crimes a

Abstract:
Although it did not set about to do so, the ICTY played a key role in catalyzing the creation of Serbia’s war crimes chamber (SWCC) and position of war crimes prosecutor. Once this happened, the ICTY Prosecutor seized the opportunity that emerged, devoting substantial attention to capacity-building initiatives. The record of Serbia’s war crimes institutions is decidedly mixed, as this chapter elucidates. Serbia has gone farther in prosecuting wartime atrocities than would have been the case without the ICTY. Yet recent years have brought a significant reversal of early progress in the context

Abstract:
Created in 1993, the International Criminal Tribunal for the former Yugoslavia (ICTY) has operated longer than any war crimes tribunal in history. It thus offers a singularly important case study of how and why the local impact of an international criminal tribunal (ICT) evolves over time; the circumstances in which international justice can advance the normative, reparative, and other aims of transitional justice; and, more generally, the goals ICTs are either well-suited or unlikely to advance. The book explores the ICTY’s impact in Serbia, whose wartime leader plunged the former Yugoslavia

Abstract:
The International Criminal Tribunal for the former Yugoslavia (ICTY) has left a rich legal, institutional, and non-judicial legacy. Many of the classical juridical footprints of the work of the ICTY are covered in legal treatises or reflective volumes. This book sheds a broader light on some of the working practices, challenges, and critiques of the ICTY. It starts from the assumption that the notion of legacy deserves consideration from multiple disciplinary standpoints, and that there is not one, but at best multiple legacies. It explores (i) historic legacy, that is, the contribution of the

The author’s interviews with Bosnians generated a lengthy catalogue of frustrations with the performance of the International Criminal Tribunal for the former Yugoslavia (ICTY). Notably, Bosnian criticisms of the ICTY’s performance are widely echoed by international scholars and practitioners. Yet Bosnians who were interviewed, particularly Bosniaks (Muslims), are overwhelmingly glad the Tribunal was created because it provided justice, however flawed, for atrocious crimes. This chapter elucidates performance-related sources of Bosnians’ satisfaction with the ICTY on the one hand, such as land

This chapter discusses the nature and elements of common purpose liability under Article 25(3)(d) of the ICC Statute. It argues that Article 25(3)(d) represents a compromise that tries to combine opposition of state delegations to any form of anticipated (e.g. conspiracy) or organizational/collective liability (e.g. membership liability) with the need to have a form of individual participation in collective criminal enterprises, which is in line with the principles of legality and culpability. It distinguishes Article 25(3)(d) from the concept of joint criminal enterprise applied at other ICCs
