Purpose – The purpose of this paper is to analyse the driving factors of e-books’ illegal downloading and price acceptance from a theoretical perspective that embraces ethical and technological aspects. The diffusion of e-readers and tablets has led to a spate of pirated copies of books. Design/methodology/approach – The proposed model holds that normative and value consciousness, as well as the self-efficacy, the usefulness and the use of the new technology, are determinants of the trend towards free downloads and the maximum acceptable price for e-books. Data are collected from a sample of 227 users of e-book reader devices. Findings – The results provide evidence that individuals are inclined towards piracy when they use and control the technology, whereas value consciousness mitigates illegal downloading and is basic to the individuals’ acceptance of a higher price. Implications – Bearing in mind that the spread of electronic devices has led to an increase in downloads, raising awareness of the norms among individuals is essential if piracy is to be curtailed. In addition, actions aimed at endowing electronic books with value would encourage consumers to pay a higher price for them. Originality/value – Few attempts have been made to apply ethics theories and the technology acceptance model to the context of e-books’ piracy, and even less effort has been devoted to analyse consumers’ price acceptance in the e-book industry.

This article analyses the phenomenon of downloading audio-visual content –movies and television series– which is habitually practiced by university students via the Internet; their attitudes towards illegal downloads; and the education/training that they have about the legal status of this activity. These issues are a frequent reality but are little discussed in our academic context. Data was obtained from a questionnaire designed ad hoc. This was administered to students enrolled in different university degrees (Audio-visual Communication, Primary Education and Social Education). We believe that these college degrees require ethical and legal training on the issues regarding downloading of content from the web. This education is an urgently needed training for young people who will work in educating and informing the citizens of the 21st century. The study results show that university students habitually consume a high percentage of online content from the audio-visual industry (films and television series). Students have clearly favourable attitudes towards this form of consumption. However, students show little regards to the ethical and legal issues surrounding downloading from the Internet. In addition, they have a very low degree of education and training on these issues. The results suggest the need to implement training programs and to conduct information campaigns to improve their information and digital literacy. El presente trabajo analiza el fenómeno de las descargas de contenidos audiovisuales –películas y series de televisión– que habitualmente practican los universitarios a través de Internet; sus actitudes ante las descargas ilegales y la formación que tienen en relación a la situación legal de las mismas. Estas cuestiones conforman una realidad que aunque a priori parece ser demasiado frecuente, se encuentra todavía muy poco explorada y es escasamente tratada desde una perspectiva científica en nuestro contexto. Los datos se obtuvieron a partir de un cuestionario diseñado ad hoc, administrado a estudiantes de tres Grados universitarios (Comunicación Audiovisual, Educación Primaria y Educación Social), por considerar que se trata de titulaciones en las que un conocimiento de base ético y legal ante las descargas de contenidos en la red es urgente y necesario para unos jóvenes que se están preparando con el propósito de dedicarse a la formación e información de los futuros ciudadanos del siglo XXI. Los resultados del estudio muestran cómo el consumo de contenidos procedentes de la industria audiovisual (televisiva y cinematográfica), es una práctica asentada entre los universitarios, que tienen actitudes claramente favorables hacia ella pero que prestan escasa importancia a cuestiones éticas y legales ante las descargas no legales, además de tener muy baja formación en estas cuestiones. Los resultados sugieren la necesidad de poner en marcha acciones educomunicativas para mejorar sus competencias informacionales y digitales.

A survey conducted in the fall of 2015 at American University in Washington, DC shows that rising textbook prices similarly affect students at an expensive private university as those at community colleges and state schools. Research on high textbook costs that has demonstrated corollary unwanted behavior changes in students, including not purchasing the book, resorting to illegal online downloads, and poor study habits, were confirmed at American University as well. Solutions that have been proposed to this problem of prohibitive textbook prices, including Open Educational Resources (OER), could have an equally profound impact at American University, and potentially similar private universities, as has been demonstrated at less selective and more affordable counterparts.

This study seeks to reveal the attitudes of the Lithuanian adult population on using digital books and illegally distributed books and seeks to provide possible solutions to Lithuanian publishers and other institutions combating this phenomenon. A quantitative survey of 322 respondents was conducted. The analysis of the results was based on the Technology Acceptance Model, the theory of self-efficacy and the theory of planned behaviour. The results show that the ability to use digital technologies encourages the use of digital books. The perception of digital books as having value reduces the tendency to download them from illegal distribution channels. Legislative regulation does not have a significant impact on the intention not to use digital books from illegal distribution channels. It is likely that a negative assessment of the phenomenon in the immediate environment will have a greater impact on refusing to use illegally distributed books. In order to compete with illegal distribution channels, the channels for legally distributed books need to be more convenient and provide more content.

With the success of e-books in the last decade, e-book piracy has become increasingly prevalent. This is a significant threat to the publishing industry, publishers and authors alike. Despite efforts to inhibit illegal downloading of e-book files, unauthorized download platforms have not lost much popularity. One of the underlying problems is a limited understanding of the determinants that drive consumers in their choice between legal and illegal download options. This article identifies and critically evaluates the key product attributes in the decision-making process of consumers downloading e-books from legal and illegal sources. By providing consumer insights, the publishing industry and e-book sellers can be guided to meet consumer demand better and design marketing plans to attract consumers towards legal download sources and discourage e-book piracy. The consumer choice between legal and illegal e-book download platforms is analysed using the multi-attribute theory for consumer decision making. 23 attributes were tested using an online questionnaire and analysed by logistic regression. Three attributes were found to be significant in determining the choice of download platforms: A low perception of the importance of copyright compliance, dissatisfaction with the security of download platforms and dissatisfaction with e-book prices in online stores.

Dieses Zukunftsszenario ist bis dato noch nicht eingetreten, aber wird dies überhaupt passieren? Wird der Kauf von physischen Musikdatenträgern und digitalen Musikdateien dank der immer stärker ansteigenden Streaming Aktivitäten komplett eingestellt? Oder können beide Formen nebeneinander existieren? Um diesen Fragen auf den Grund zu gehen, wurde im Rahmen dieser Arbeit eine Umfrage mit 1.661 Studenten der Technischen Universität Dresden durchgeführt. Die Ergebnisse geben Aufschluss über die Nutzungshäufigkeiten von kostenfreien und kostenpflichtigen Streaming Anbietern sowie von CDs / Schallplatten und MP3 Musikdateien. Zudem wird aufgezeigt, dass eine geringe Zahlungsbereitschaft bei den Studenten besteht. Es werden bereits selten mehr als 5 € in Musik investiert, doch seitdem die Studenten Streaming Dienste nutzen, geben sie nach eigenen Angaben noch weniger Geld für Musik aus als zuvor. Diesem Negativtrend steht die Erkenntnis gegenüber, dass die Probanden seit der Nutzung von Streaming Angeboten weniger Musik illegal herunterladen. Auch wenn der Großteil weniger Musik kauft, so ist es etwa der Hälfte aller Befragten sehr wichtig, Musik zu besitzen, vor allem in physischer Form. Zudem wurden Nutzungsmotive der Möglichkeiten des Musikhörens erfasst, um deren Stärken und Schwächen aufzuzeigen. Die Ergebnisse verdeutlichen, dass die kostenfreie Variante des Streamens zwar häufig genutzt wird, sich die traditionellen Musikdatenträger und Musikdateien jedoch immer noch großer Beliebtheit erfreuen. Von einer kompletten Verdrängung des Kaufens von Musik kann demnach nicht ausgegangen werden.

Video game developers have implemented multiple measures to combat piracy throughout history. One of these measures, defined in this study as in-game anti-piracy measures, prevents player progression on unauthorized copies by degrading gameplay or drastically increasing the difficulty.This study conducts a content analysis research on textual data gathered from the world wide web to assess the public perception in regards to this type of anti-piracy measures. The data gathered for this study consists of 425 statements in the form of comments and forum posts that have been coded, divided into themes and then analyzed inductively to generate findings that can be linked to Moshirnia’s (2012) previous research.Even though no clear results occurred that can confirm Moshirnia’s (2012) findings, this study has discovered a potential connection between in-game anti-piracy measures promoting piracy. The findings also suggest that the unique “broke features” might lead to the popularization of games modded to let legitimate users experience them too.

The Australian music industry is growing and developing yet specific information about the ways in which distribution systems develop is limited. In this study I examined the growth and change of the Australian music value chain. This includes the development of digital distribution systems and the effect that peer-to-peer technology has on system development, specifically the disintermediation between consumers and artists to the detriment of the multinational value chains. The drivers of this change are broken into social and technical elements in order to describe the growth and change occurring. The method used included a comprehensive literature review and use of secondary data from key music industry associations. The Australian music industry is a subset of the global industry and is led by foreign markets and their methods in which music content moves from the creators to the consumers. The consumption patterns of Australian music consumers are changing. The overall value of the music industry is dropping as the new digital downloads market emerges and the overall volume of sales increases; this reflects similar trends in foreign markets. CD single sales have dropped and digital single sales (in MP3 format) have increased. However, there needs to be a balance in the future development of Australian music distribution systems between the needs of music consumers and the sustainability of music companies, where there is both connectivity and steady revenue flow. There are technical elements that have caused a movement away from the traditional forms of music distribution as new technologies facilitate the change, such as Apple's iPod and broadband Internet connections. Advancement of distribution systems has increased piracy levels and the response has been the implementation of digital rights management (DRM), which prevents connectivity. There are also social elements that affect growth and change such as connectivity, or the consumers freedom to choose when, where and how to listen to their music. When music product has a restriction placed upon it its value to the consumer drops. Multinational music companies have failed to recognise the value users place on the freedom to pick and choose and have tried to control rather than to co-develop systems that meets both parties needs.

A indústria musical tem vindo a desenvolver-se desde que foi criada no século XIX, e atravessa nos últimos anos um período de mudança em relação à sua organização. Com esta dissertação, pretende-se estudar a forma como os consumidores portugueses encaram e utilizam uma das novas formas de distribuição de conteúdos musicais, a venda através de canais electrónicos.
Através de um estudo estatístico descritivo e da utilização de testes de hipóteses a uma amostra de consumidores de música identificaram-se, entre vários factores intrínsecos ao produto estudados, aqueles que mais contribuem para a escolha da plataforma ou loja no ato de compra de música. São eles a qualidade, o preço, a disponibilidade e a confiança no vendedor. Para além destes, foram também analisados factores independentes como a faixa etária e as habilitações literárias, que também parecem exercer alguma influência.
Dos factores intrínsecos ao produto, foi feita também uma análise estatística a quais aqueles que os consumidores consideram mais benéficos na compra de música online. Entre os quatro referidos anteriormente, concluiu-se que o preço e a disponibilidade são mais benéficos para o consumidor de música online, a qualidade é semelhante entre os dois tipos de loja e a confiança é maior nas lojas físicas.
Por fim foram criadas algumas linhas de orientação, com base em tudo o que foi estudado, de forma a perceber as implicações desta dissertação e alguns passos que se podem tomar, tendo em conta a mesma.<br>The musical industry has being developed since its creation in the XIX century, and in the last years, is over a shift period in its structure. With this dissertation, I intend to study the way that the Portuguese consumers look to one of the new music supply networks, the online stores.
With a descriptive statistic study and some statistical hypothesis testing to a sample of music consumers, were identified, between the product factors, the ones that contribute the most to the consumer choice of store or platform when buying music. They are the quality, price, availability and trust. Some other independent variables were studied, like the age group and the academic degree, that can also influence this choice.
From the first group of factors, it was also statistically studied which ones were more beneficial for the online consumer. From the four that were referred before (price, quality, trust and availability), the more beneficial in the online market, when compared with the physical market, were the price and availability, the quality is seen as good as in both the online and physical store, and the trust is worst in the online markets.
Ultimately, based on everything that was studied in basis, it was created some orientation lines for the market, so that the players involved can better understand the implications of this dissertation, and some steps that can be taken in the future.

Smart phone software commonly known as App brings huge business opportunities. Free App trial version like computer software, provides users a simple function of the trial, after the trial satisfied through pay to enjoy the full functionality. However, some smart phone users because of economic constraints or friends’ sharing, spawned acts of illegal downloading. For consumers, these acts itself does not need to spend any money to enjoy the services of paid-for App; for developers, these acts against their own interests cause damage of intellectual property rights.
This study adopts the perspectives of perceived usefulness and perceived ease of use, combined with consumer ethics, technology readiness, as well as the mode of software piracy model such as cost and penalty, to explore the possible factors which influence the consumers’ intention to freely download the paid App.
In this study, survey method was conducted by questionnaire and the subject focused onsmart phone users A total of 201 subjects were collected and the results found that perceived usefulness, perceived ease of use and consumer ethics are significant factors influencing the downloading behavior of illegal App be significant.

However, with the convenience of Internet comes many illegal behaviors, and one of these behaviors is illegal downloading of unlicensed digital music that is most serious among junior high school students. The personality development of junior high school students is still a working process at this stage of their life, so there may be the behavioral intention to download illegally digital music when they find the digital music to their fancy. This study served the following purposes: (1) explore the current status of the behavioral intention to illegally download digital music in junior high school students; (2) investigate the difference in the personal background, economic bounteous, Internet self-efficacy, knowledge about intellectual property rights, subjective norm and idolatry in various junior high school students in terms of the behavioral intention to illegally download digital music ; and (3) examine the implication of the factors that have influence on the behavioral intention to illegally download digital music. Hopefully the results provide an insight for the parents and teachers of these students and school counselors to help them correct junior high school students’ behavior to illegally download digital music.
The questionnaire was designed based on review on previous literatures. A survey was conducted, the questionnaires were sent to 320 students, and 272 respondents were valid. The data collected was analyzed using descriptive statistics and one-way analysis of variance.
The following results were obtained. For personal background, the behavioral intention to illegally download digital music was significantly higher for third grade students than in first grade ones, and also higher for students in northern Taiwan than in southern Taiwan. However, no significant difference of this intention was found in junior high school students of difference genders. For economic bounteous, the behavioral intention to illegally download digital music was significantly higher for the group with high score in economic allowance than the one with low score. For Internet self-efficacy, the behavioral intention to illegally download digital music was significantly higher for the group with medium score in economic allowance than the one with high score. For knowledge about intellectual property rights, no significant difference was found for junior high school students with different knowledge about intellectual property rights. For subjective norm, the behavioral intention to illegally download digital music showed no significant difference for the test subjects due to difference in subjective norm. For idolatry, the behavioral intention to illegally download digital music was significantly higher for the group with high score in idolatry than the one with low score.

The Jurisdictional Challenge arises as civil disputes, criminal cases, and regulatory action span different countries, rising questions as to the international competence of courts, law enforcement, and regulators. From a technological standpoint, geography is largely irrelevant for online data flows and this raises the question of who governs “YouTubistan.” Services, communication, and interaction occur online between persons who may be located in different countries. Data is stored and processed online in data centres remote from the actual user, with cloud computing provided as a utility. Illegal acts such as hacking, identity theft and fraud, cyberespionage, propagation of terrorist propaganda, hate speech, defamation, revenge porn, and illegal marketplaces (such as Silkroad) may all be remotely targeted at a country, or simply create effects in many countries. Software applications (“apps”) developed by a software developer in one country are seamlessly downloaded by users on their mobile devices worldwide, without regard to applicable consumer protection, data protection, intellectual property, or media law. Therefore, the internet has created multi-facetted and complex challenges for the concept of jurisdiction and conflicts of law. Traditionally, jurisdiction in private law and jurisdiction in public law have belonged to different areas of law, namely private international law and (public) international law. The unique feature of this book is that it explores the notion of jurisdiction in different branches of “the” law. It analyses legislation and jurisprudence to extract how the concept of jurisdiction is applied in internet cases, taking a comparative law approach, focusing on EU, English, German, and US law. This synthesis and comparison of approaches across the board has produced new insights on how we should tackle the Jurisdictional Challenge. The first three chapters explain the Jurisdictional Challenge created by the internet and place this in the context of technology, sovereignty, territory, and media regulation. The following four chapters focus on public law aspects, namely criminal law and data protection jurisdiction. The next five chapters are about private law disputes, including cross-border B2C e-commerce, online privacy and defamation disputes, and internet intellectual property disputes. The final chapter harnesses the insights from the different areas of law examined.
