Abstract:
This chapter examines the issue of incidental question from a choice of law perspective. A case involving private international law may place a subsidiary issue, as well as a main question, before the court. The main issue should, under the English rules of private international law, be governed by a foreign law. This chapter first explains what an incidental question is before discussing its essential elements. It then considers two cases that illustrate the way in which an incidental question arises: Lawrence v Lawrence in England and Schwebel v Ungar in Canada. It also proposes a coherent a

Abstract:
In contrast to general intensive care units, the neurosciences ICU admits fewer cases of incidental overdoses with illicit or prescribed drugs than cases of adverse drug effects. Overdoses of illicit drugs can be seen in conjunction with traumatic brain injury and anoxic-ischemic injury. In fact, the illegal drug is often the main culprit in the acute brain injury. Alcohol intoxication remains frequent and the intoxication signs depressing brain function may merge with clinical signs of an acute structural brain injury. This chapter discusses toxins causing laboratory abnormalities, first trea

Abstract:
This chapter examines seven case studies of the macabresque during the twentieth century. The macabresque is portrayed within each by adopting the “vignette” as a narrative form. A vignette is a patch, a semiotic sign, representative of a “mentality” that endows genocide and mass atrocity with a “noble” cause or “moral” if not, indeed, a “sacred” purpose. Similarities across cases of the macabresque emerge; but contrasts also appear that demonstrate major political, cultural, ideological, and attitudinal differences. These contrasts are not incidental side effects of violence. They reveal the

Abstract:
The burgeoning literature in political philosophy about religious liberty includes a group of authors who are quite sceptical about exemption claims. The sceptics don’t reject all claims to religious liberty, but they don’t think that a defensible principle of religious freedom would guarantee much beyond neutrality. There is no claim to an exemption in the face of a neutral law that has the incidental effect of burdening somebody’s attempt to follow their religion. The chapter argues that balancing has a legitimate role to play in certain cases of legal justification. Once a role for balancin
