There are several judgments of the Constitutional Court that have marked important precedents.These precedents contain a normative element, which determines the jurisdictional action in a great number of future acses.In this article, the author develops how the judgment of the case Vásquez Romero has set a precedent of great importance regarding access to the Constitutional Court. The author will analyze the impact of this precedent on the grounds for rejection of the constitutional grievance remedies as they are substantially equal cases.
Son diversas las sentencias del Tribunal Constitucional que han marcado importantes precedentes. Dichos precedentes contienen un elemento normativo, lo que determina la actuación jurisdiccional en un gran número de casos futuros.En el presente artículo, la autora desarrolla como la sentencia del caso Vásquez Romero ha marcado un precedente de gran importancia respecto del acceso al Tribunal Constitucional. La autora analizará el impacto de dicho precedente en la causal de rechazo de los recursos de agravio constitucional por tratarse de casos sustancialmente iguales.

Three archaeological cases from different areas of the Andes are employed to study the rise of social and cultural complexity in varying social and economic contexts, with the intention of distinguishing certain environmental and cultural factors in each case. The purpose also is to search not only for differences but for commonalities to be used for cross-cultural comparisons and to learn more about the developmental cultural history of the societies representing these cases.
En el presente trabajo se analizan tres casos de diferentes áreas de los Andes para estudiar el incremento de la complejidad cultural en contextos sociales y económicos variados con el fin de distinguir factores definidos de carácter ambiental y cultural en cada caso. El propósito final es el de la búsqueda de diferencias, así como de las características en común que se utilizan para hacer comparaciones culturales y para aprender más acerca de la historia del desarrollo cultural de las sociedades que representan estos ejemplos.

En el presente artículo se desarrollan las obligaciones laborales que surgen para las empresas que atraviesan procesos de reorganización. Adicionalmente, se precisan las principales disposiciones laborales relacionadas con el principio de continuidad, desde el punto de vista conceptual y normativo, producto del traspaso de trabajadores. Finalmente, se explica el contenido esencial de los convenios de transferencia de personal, en función a lo expuesto en forma precedente.

Abstract:
Desde el año 2006, se ha dividido el voto indígena entre el movimiento político étnico Pachakutik y el movimiento Alianza País (AP), liderado por Rafael Correa, actual presidente del Ecuador. Este artículo busca una explicación esta división del voto, examinando el comportamiento político de los comuneros de Otavalo y Cotacachi, municipios de la sierra norte de Ecuador, bastiones del movimiento indígena. El escrito sostiene que el respaldo a Correa puede explicarse por tres factores: primero, la antigua relación de los indígenas con el Estado; segundo, un comportamiento electoral que combina confianza en líderes étnicos y pragmatismo político, y tercero, la expectativa de mayor presencia del Estado. Para realizar este estudio se empleó observación participante en los dos cantones para captar las prácticas de la población en el proceso político, encuestas para captar sus percepciones y datos electorales oficiales para ver los resultados.
Since 2006 the indigenous political vote has split between Pachakutik and Alianza País (AP). The latter is a political movement led by Rafael Correa, currently president of Ecuador. The article seeks an explanation for this distribution of the vote, examining the political behavior of the indigenous people of the Otavalo and Cotacachico unties of the northern Ecuadorean highlands. It argues that the support for Correa can be explained by several factors: (1) the historical relationship between indigenous people and the State; (2) an electoral behaviour that combines trust in ethnic leaders and pragmatism; and (3) an expectation of «more state presence». The study is based on two surveys of leaders and local population, participant observation and interviews, as well as a document review.

Abstract:
The purpose of this paper is to explore the impact of international investment law rules in the Economic Constitutional Law, especially those included in investment chapters of Peruvian’s Free Trade Treaties. In particular, it is expected to demonstrate the following (i) International Investment Law is part of Peruvian Legal System; (ii) provisions of these laws are mandatory and should be applied domestically; and (iii) interpretation and implementation of this legal right should be executed consistently with domestic legal system and Peruvian international obligations. This agreed Interpretation between Investment Law and Economic Constitution will have a positive effect in rationalization of public entities actions avoiding abuses and maltreatment to investors, in order to improve investment climate as a key element forachieving country’s sustainable development.
Este trabajo tiene como objeto explorar el impacto que tienen las normas del derecho internacional de las inversiones, en específico aquellas de los capítulos de inversiones de los Tratados de Libre Comercio celebrados por el Perú, en el derecho constitucional económico. En concreto, se pretende demostrar lo siguiente: (i) el derecho internacional de las inversiones es parte del Ordenamiento Jurídico del Perú; (ii) las disposiciones de este derecho son obligatorias y deben aplicarse a nivel interno, y (iii) este derecho debe interpretarse e implementarse de manera coherente con el resto del ordenamiento interno y con las obligaciones internacionales del Perú. Esta interpretación concordada del derecho de inversiones y la Constitución económica tendrá un impacto positivo en la racionalización de la actuaciónde los órganos estatales, evitando arbitrariedades cuando sus medidas puedan afectar a un inversionista. De esta manera mejorará el clima de inversiones, el cual es un elemento necesario para lograr el desarrollo sostenible del país.

Abstract:
Lymphedema of the arm is a complication that occurs in about 10-20% of women treated for breast cancer. Breast cancer treatment can damage or disrupt normal lymphatic pathways, causing fluid to accumulate in the arm. This condition is called lymphedema. Swelling of the arm can be painful and disfiguring, negatively impacting the quality of life of afflicted individuals. Lymphedema is a progressive disorder that requires prompt diagnosis and treatment to prevent the occurrence of more serious complications, such as infection or severe disability of the arm. Past research have attempted to identify risk factors that influenced the development of lymphedema, however conflicting results were observed between studies. Therefore, a comprehensive literature review was conducted to identify studies that examined the effect of prognostic and/or personal factors on lymphedema. In the meta-analyses, results from each independent study were abstracted and pooled with other studies using the random-effects model. In an effort to examine additional factors that were not widely studied, a retrospective cohort study was conducted on women diagnosed with breast cancer in Iowa during 2004. A questionnaire was developed to collect information on arm activities, co-morbidity, and lymphedema-related symptoms. Eligible women were identified from the State Health Registry of Iowa and data were collected through computer-assisted telephone interviews. At the end of the interview, each woman was asked to measure the circumference of her right and left arm one hand width above and below the elbow crease. The meta-analysis found that mastectomy (as opposed to a lumpectomy), axillary dissection (as opposed to sentinel node biopsy), radiation therapy, presence of positive nodes, obesity (body mass index >30), low education (less than high school), presence of any co-morbidity, injury and infection increased the risk of developing lymphedema. The cohort study found that the presence of axillary dissection and radiation, cancer stage, positive nodes, large tumor size, high body mass index, and younger women increased the risk of lymphedema.

Abstract:
Managed funds have become a popular investment tool and possess a lot of advantages. However, in spite of their popularity, most past research findings on the evaluation of performance have suggested that managed funds were unable to do significantly better than a large unmanaged portfolio. The aim of this thesis is to evaluate empirically the performance of managed funds. The funds chosen are; UK equity, ethical unit trusts and US-based Dow Jones Islamic index -an index of Islamic ethical funds portfolio. We examine the performance of UK equity unit trusts which invest in UK equities, using monthly samples over the 1986 to 2001 time period. The study compares the return of these unit trusts with a three-factor model which takes into account their exposure to market, value and size risk. After controlling the risk factors, it is found that manager’s under-perfom the market. Contrary to the notion that small company shares offer abundant "beat the market" opportunities, we find that small company trusts are the worst performers. The performance persistence of unit trusts is also examined and it is found that good performance does not persist. There are investors who out of their concern regarding adverse changes in our environment, concerns for justice, and because of their opposition to the arms race, decline to purchase the securities of such enterprises that engage in what are termed unethical or socially irresponsible activities. Such activities usually include, but are not necessarily limited to, the production of armaments, alcohol and tobacco; engaging in activities that degrade the environment; and engaging in activities that treat people unfairly. Declining to invest in the securities of enterprises that engage in unethical practices is not only a form of social protest, but can also have the effect of diminishing the demand for a company's securities. A diminishment of demand may then have an adverse financial impact on a company. This may prove to be a crucial factor in influencing companies to change and become more socially responsible. The question therefore arises: has the investment performance o f ethical investors suffered in comparison to those who are not so responsible? To answer the above, a study has been done which encompasses 35 U K ethical unit trusts which cover the period of seven years tough 1996. The study presents a comprehensive evaluation o f managed funds performance by employing various single to multifactor benchmark models.The added value of introducing extra variables such as size, book to market, momentum and a bond index is explored by evaluating the performance using conditional information and comparing the investment performance of U K ethical unit trusts with unit trusts which are not ethical. After controlling for style tilts and allowing for time variation in betas and expected return, the results show that there is no significant difference in performance between U K ethical unit trust and their conventional peers. Within an unconditional setting SMB, HML and momentum factors are best able to explain ethical unit trust returns. Therefore, unconditional models perform much better than their conditional peers. Islamic ethical investors apply both Islamic ethical and financial criteria when evaluating investments in order to ensure that the securities selected are consistent with their value system and beliefs. Using monthly returns for the period starting from January 1996 to December 2003, the study is conducted to see the potential impact that Islamic ethical restrictions may have on investment performance by comparing the performance characteristics o f a diversified portfolio of Islamic screened stocks (Dow Jones Islamic index) w i t h conventional benchmark portfolio ( Dow Jones Index- Americas). Contrary to expectations, our findings indicate that application of Islamic ethical screens do not necessarily have an adverse impact on investment performance. Results actually show that expected returns of Islamic screened portfolios are higher than the expected returns o f conventional portfolios.

En el presente artículo se analizará la temática referente a la extinción de la responsabilidad sancionadora en los casos en que una persona jurídica desaparezca. Para ello, primero se analizará los supuestos que existen de transmisión de la responsabilidad en los casos que se refieren a la extinción de la personalidad jurídica. Finalmente, se analizará la legislación peruana existente sobre los contratos públicos y la transmisión de responsabilidades en los casos de extinción por fusión de las personas jurídicas.

Abstract:
How did the early colonial regime impact the potter’s craft in the Andes? How can documentary and material evidence of pottery production allow us to better understand that period? This article proposes a methodology to answer both questions. It suggests that it is necessary to use explicit analytic models about potters when dealing with ceramic evidence. In this context, several models about potters are proposed for the early colonial period, and three specific cases showing the diversity of strategies employed by artisans of that period are discussed.
¿Cómo el régimen colonial temprano afectó el oficio de alfarero en los Andes? Cómo la evidencia documental y material sobre alfarería nos permite comprender mejor ese periodo? Este artículo propone una metodología para responder ambas interrogantes. Con tal objetivo, se sugiere la necesidad de emplear modelos analíticos explícitos sobre alfareros cuando se estudia evidencia cerámica. En este contexto, se proponen algunos modelos alfareros para el periodo colonial temprano y se discuten tres casos específicos que muestran la diversidad de estrategias empleadas por los alfareros en ese periodo.

This paper proposes a generalized transmission index for spatial mechanisms, based on the transmission index introduced by Sutherland and Roth. This index is more general and welldefined in all the cases; it matches the virtual coefficient between the transmission wrench screw and the output twist screw exactly. A method is developed to compute the transmission wrench screw in spatial single-loop linkages. We illustrate the application of this index in a RSCR linkage.

Abstract:
This paper presents a new reactive power-based performance index of planar mechanisms. This index quantifies how much of the power introduced to a mechanism is transformed into motion. Generally, the mechanical advantage is used as an index to quantify the force or the velocity ratio between the input and the output link of a mechanism. However, this index is sensitive to the dimensions of the inlet and outlet of the mechanism so it cannot be used for the comparison of different types of mechanisms. To overcome the drawback of the physical inconsistency, the concept of reactive power is proposed to quantify the losses that occur in a mechanism and, based on this concept, the reactive power-based index is defined. The proposed approach is applied to various mechanisms and it is compared with the mechanical advantage to observe that the proposed index provides the same information as the mechanical advantage, but being dimensionally consistent for the analyzed cases (dimensionless in all cases), it can be used to the analysis, comparison and optimal design of different planar mechanisms.

Introduction: The evaluation of the intrathecal production of immunoglobulin G (IgG) can be useful in the evaluation of multiple sclerosis (MS) suspected cases and the most important test to verify it is the detection of oligoclonal bands (OCBs) in cerebrospinal fluid (CSF) and serum. Recent studies have reported that measuring CSF IgG free light chains (FLC), especially the Kappa Index, is comparable with OCBs as markers of IgG synthesis. It is still unknown if diagnostic sensitivity be increased by performing these two methods in parallel. Objectives: The aim of this study was to evaluate the results of the Kappa index and the oligoclonal bands (BOCs) in samples from patients with suspected MS. Methods: Patients with suspected MS underwent CSF analysis. Intrathecal synthesis of IgG was evaluated with BOCs, IgG index, Reiber nomogram, and kappa index. Results: One hundred and seventy-one serum and CSF samples were included, 76 of them had positive CSF BOC. Among the BOC+ cases, 48 (63.2%) were also positive with the Reiber nomogram, 53 (69.7%) were also positive with the IgG index, and 74 (97.4%) were also positive with the kappa index. Among the patients without BOCs, 5 (5.2%) cases had a positive Reiber, eight had a positive IgG index (8.4%), and eight (8.4%) had a positive kappa index. Conclusion: The Kappa index was the method with the highest association with BOCs, confirming that this method is at least as sensitive as the detection of BOCs. Positive kappa results found among cases without BOCs may be false positives but may also indicate false negative results with BOC. Therefore, it is possible that kappa index can help to diagnose cases of MS without detection of BOCs.

There is significant discussion in the academia and industry regarding over-regulation and under-regulation of the financial markets, in particular, banking markets. One of the key measures in such discussion is the intensity of the regulation. The aim of this paper is to contribute to the discussion with development of the overall Regulation Index by introducing the structure and parameters of such index. Authors review current approaches and perspectives of the assessment of the intensity of regulation and develop new Regulation Index. Index data are used from the World Bank’s prepared Bank Regulation and Supervision Survey and the Index of Economic Freedom database. Research methods employed are literature analysis, induction and deduction methods, synthesis, and mathematical analysis. Literature analysis revealed seven key components (building blocks) for the Regulation Index and modelling results revealed the most appropriate set of parameters for those components. Authors set the hypothesis that the order of countries in their stringency of regulatory requirements will be as follows: Germany, UK, USA, Russia. The hypothesis was confirmed in one case and rejected in other cases.

The image quality produced by an array of radial gradient-index lenses is generally calculated using a geometrical model. In some cases, the performance of individual rods is limited primarily by diffraction. The ideal image formed by an array of aberration-free gradient-index rods is examined. An explanation of the theoretical model is given and graphical data are presented for point spread, line spread, and modulation transfer functions. Several field points are studied and the effect of changing the rod spacing is shown.

This program developed a stress-corrosion cracking (SCC) protocol for use in assessing the likelihood of the conditions necessary for high pH SCC on individual pipeline segments and an SCC integrity management plan to assist operators in selecting appropriate remedial actions depending on whether SCC is located and the potential consequences. This protocol was developed as a conservative guideline based on existing knowledge at the time of development. This high pH SCC protocol was validated using data from 15 SCC service incidents collected during the conduct of this program and three test cases on pipelines without SCC available from another SCC protocol. An SCC Likelihood Index was developed that provides index values from 40 to 140.

This study, for the first time, combines the Coastal Engineering Resilience Index (CERI) and Buffer Width (BW) metrics to better understand the historic, current, and future resilience of the coastal system at Panama City Beach, Florida. After the construction of the US Army Corps of Engineers Coastal Storm Risk Management (CSRM) project at Panama City Beach, the CERI resilience metric has increased up to 21.3%, while negative storm impacts in the same have been less than 8%. The frequency of nourishment efforts moving forward is justified by a 24.3% increase in the BW metric when comparing cases that are nourished frequently with cases that are not nourished frequently. Moreover, there is a 129.2% increase in the BW metric when comparing the frequently nourished cases with the cases that are nourished only on an emergency basis. While the CERI and BW metrics have both been considered previously, their combined application provides an understanding of a broader temporal view of how storm events, CSRM projects, and nourishments have played a part in the resilience of the system at Panama City Beach over the last two decades and how they may play a role in the next half century.

Abstract:
Wide-angle parabolic equations (WAPEs) play an important role in physics. They are derived by an expansion of a square-root pseudo-differential operator in one-way wave equations, and then solved by finite-difference techniques. In the present paper, a different approach is suggested. The starting point is an extra-wide-angle parabolic equation (EWAPE) valid for small variations of the refractive index of a medium. This equation is written in an integral form, solved by a perturbation technique, and transformed to the spectral domain. The resulting split-step spectral algorithm for the EWAPE accounts for the propagation angles up to 90° with respect to the nominal direction. This EWAPE is also generalized to large variations in the refractive index. It is shown that WAPEs known in the literature are particular cases of the two EWAPEs. This provides an alternative derivation of the WAPEs, enables a better understanding of the underlying physics and ranges of their applicability, and opens an opportunity for innovative algorithms. Sound propagation in both motionless and moving media is considered. The split-step spectral algorithm is particularly useful in the latter case since complicated partial derivatives of the sound pressure and medium velocity reduce to wave vectors (essentially, propagation angles) in the spectral domain.

The population status of the sea-migrating trout is in many cases unknown. Where recruitment status is known, many of the populations are at low levels, especially in the Bothnian Sea. There is a need to obtain more knowledge to be able to manage sea trout sustainably in the long run, as the species is very popular among anglers. It has been suggested that “index streams” for sea trout should be established (Magnusson et al. 2020, 2023, Magnusson 2023), where data on recruitment, smolt migration and spawning migration are collected and analyzed. The purpose of this report is to gather and compile information on typical sea trout streams and to suggest index streams that may be suitable for data collection. In order to identify suitable index streams for sea trout, information has been collected from county board representatives and others with good local knowledge. This information has been compiled by county and is presented in this report. In addition, an attempt was made to identify potential index streams based on data from the Swedish database for electrofishing in streams (SERS) and Trout Habitat Score (THS) criteria. In Norrbotten, electrofishing sites in known sea trout streams are largely lacking, hence an attempt to identify potential trout streams was made by identifying riffle sections with the help of geographic information systems (GIS). As the results differ to some extent between the different methods, it is recommended that people with good local knowledge are involved in the establishment of index streams for sea trout. The report is based on analysis of electrofishing data in combination with interviews with experts carried out between October 2018 and January 2019, which has since been supplemented with further information.

Evidence from research on infectious diseases suggests that income inequality is related to higher rates of infection and death in disadvantaged population groups. Our objective is to examine whether there was an association between income inequality and the numbers of cases and deaths during the first wave of the COVID- 19 pandemic in European countries. We determined the duration of the first wave by first smoothing the number of daily cases, and then using a LOESS regression to fit the smoothed trend. Next, we estimated quasi-Poisson regressions. Results from the bivariate models suggest there was a moderate positive association between the Gini index values and the cumulated number of infections and deaths during the first wave, although the statistical significance of this association disappeared when controls were included. Results from multivariate models suggest that higher numbers of infections and deaths from COVID-19 were associated with countries having more essential workers, larger elderly populations and lower health care capacities.

This paper analyzes total factor productivity growth in agriculture in Latin America and the Caribbean between 1961 and 2007 employing the Malmquist Index, a non-parametric methodology that uses data envelopment analysis (DEA) methods. The results show that among developing regions, Latin America and the Caribbean shows the highest agricultural productivity growth. The highest growth within the region has occurred in the last two decades, especially due to improvements in efficiency and the introduction of new technologies. Within the region, land-abundant countries consistently outperform land-constrained countries. Within agriculture, crops and non-ruminant sectors have displayed the strongest growth between 1961 and 2001, and ruminant production performed the worst. Additional analysis of the cases of Brazil and Cuba illustrates potential effects of policies and external shocks on agricultural productivity; policies that do not discriminate against agricultural sectors and that remove price and production distortions may help improve productivity growth.

Structural and biomechanical parameters of Edible Frog, Pelophylax esculentus (Linnaeus, 1758), limb bones, namely, mass, linear dimensions, parameters of the shaft ’s cross-sectional shape (cross-sectional area, moments of inertia, radiuses of inertia) were investigated. Some coeffi cients were also estimated: diameters ratio (df/ds), cross-sectional index (ik), principal moments of inertia ratio (Imax/Imin). Coeffi cients of variation of linear dimensions (11.9–20.0 %) and relative bone mass (22–35 %) were established. Moments of inertia of various bones are more variable (CV = 41.67–56.35 %) in relation to radii of inertia (CV = 9.68–14.67 %). Shaft ’s cross-sectional shape is invariable in all cases. However, there is high individual variability of structural and biomechanical parameters of P. esculentus limb bones. Variability of parameters was limited by the certain range.We suggest the presence of stable norm in bone structure. Stylopodium bones have the primary biomechanical function among the elements of limb skeleton, because their parameters most clearly responsiveto changes in body mass.

Researchers have been studying wide-base tires for over two decades, but no evidence has been provided regarding the net benefit of this tire technology. In this study, a comprehensive approach is used to compare new-generation wide-base tires (NG-WBT) with the dual-tire assembly (DTA). Numerical modeling, prediction methods, experimental measurements, and environmental impact assessment were combined to provide recommendations about the use of NG-WBT. A finite element approach, considering variables usually omitted in the conventional analysis of flexible pavement was utilized for modeling. Five hundred seventy-six cases combining layer thickness, material properties, tire load, tire inflation pressure, and pavement type (thick and thin) were analyzed to obtained critical pavement responses. A prediction tool, known as ICT-Wide, was developed based on artificial neural networks to obtain critical pavement responses in cases outside the finite element analysis matrix. The environmental impacts were determined using life cycle assessment. Based on the bottom-up fatigue cracking, permanent deformation, and international roughness index, the life cycle energy consumption, cost, and green-house gas (GHG) emissions were estimated. To make the outcome of this research effort useful for state departments of transportation and practitioners, a modification to AASHTOWare is proposed to account for NG-WBT. The revision is based on two adjustment factors, one accounting for the discrepancy between the AASHTOware approach and the finite element model of this study, and the other addressing the impact of NG-WBT.
