Abstract:
The concluding chapter reviews the book’s argument and argues that scholars have been confusing cause and effect in attributing the rise of the early Indian religions to a metahistorical distinction between “Brahmanical” and “non-Brahmanical” forces, rather than understanding this distinction as arising historically out of a process of identity formation. I have argued that by dropping the assumption of a fundamental dichotomy between Brahmanism and the śramaṇic tradition, and of the metahistorical priority of the former, we see more clearly how Brahmanical and śramaṇic identities arose in ancient India, and the chapter provides some speculations on the sort of historical model this new methodology might imply. Finally, it discusses the implications the new methodology has for modern Indian discourses and for our understanding of the origins of religious traditions around the world.

Abstract:
This chapter examines the constitutional framework for the resolution of inter-State river water disputes in India, considering whether water disputes are best resolved through political negotiation or through adjudication, how political agreements can be enforced and implemented, and how disputes are tackled substantively and procedurally. It discusses Article 262 of the Indian Constitution and the vesting of power in Parliament to adjudicate disputes regarding inter-State rivers or river valleys. It then provides a historical perspective on inter-State river water dispute resolution, starting from the Government of India Act 1919, and reviews two pieces of legislation enacted in 1956 to deal with inter-State river waters: the River Boards Act 1956 and the Inter-State River Water Disputes Act 1956. It looks at some of the major constitutional and legal debates that have surrounded inter-State river water disputes in India and analyses the Indian Supreme Court’s ruling in the Mullaperiyar Dam case.

One of the main institutional aspects of managing heterogeneity to preserve national unity is the structure of Indian federalism. This chapter traces some of the features of Indian federal institutions, focusing on their contribution to this ‘holding together’. It reviews the conceptual and analytical underpinnings of the role of federal structures in sustaining unity, and summarizes historical developments and current institutional structures in the Indian case. It assesses the role of federal dimensions of political, administrative, and judicial structures in the holding together function. It also examines fiscal federal institutions and their impacts, including distributional and growth issues. It also separately focuses specifically on the special treatment of what may be characterized as India’s periphery.

Abstract:
This chapter examines the constitutional status of tribunals in India and how the law and policy on tribunals have evolved since 1950. It presents a brief historical background on the evolution of tribunals in India, starting from the origin of tribunals and debates among law reform bodies from 1950 to 1975 to the Swaran Singh Committee report recommending the creation of tribunals to combat delays in the Indian legal system. It then reviews constitutional litigation over tribunals during the period 1985–2014, focusing on the Sampath Kumar and other cases after it, along with the National Company Law Tribunals. It also considers the debate over the ‘tribunalisation’ of the Indian legal system and the constitutional arguments that have been raised to challenge the validity of particular tribunals. Finally, it looks at recent criticism of the growth of tribunals by practicing lawyers and argues that calls for their abolition are impractical.

In 1939, an Ojibwe woman named Naynaabeak was involved in a conflict that shows some of the complexities that American Indians experienced throughout the history of settler colonialism in the United States. Her family did not live on a reservation, but they were Ojibwe people and tribal citizens and her home and fishing spot were historically Ojibwe places. The complex legal world defined by borders disrupted Naynaabeak’s ability to make a living, and her conflict was simply part of everyday existence for many Ojibwe women. This chapter considers the hurdles that Naynaabeak’s generation overcame in their determination to make a living, and how their efforts to remain on their lands, fishing grounds, forests, hills, and mountains—and especially their sacred places—enabled their descendants to maintain indigenous communities which still exist. The chapter reviews the literature about gender and labor in American Indian history to illuminate its major themes.

A critical review of public expenditure is imperative in ensuring optimal use of public resources for the maximization of welfare. The present book provides an empirical understanding of historical trends and composition of public expenditure at the central and the sub-national levels; the effectiveness of public expenditure control systems and accountability issues; the political economy of spending decisions; public expenditure reforms undertaken in India; and international best options that can guide the corrective process in India. Given the global shift in focus from ‘outlays’ to ‘outcomes’, it is important to put in place a sound framework to track the results of government expenditure programs to guide the informed expenditure decision-making process. The book documents the features of useful frameworks and steps involved in adopting a robust results framework. Fiscal management of Covid-19 is an important component of the book. The introduction reviews the historiographic problem of the relation between fire sacrifice (yajña) and image worship (pūjā), which have traditionally been seen as opposing ritual structures serving to undergird the distinction of “Vedic” and “Hindu.” Against such an icono- and theocentric approach, it proposes a history of the priesthood in relation to royal power, centering on the relationship between the royal chaplain (purohita) and astrologer (sāṃvatsara) as a crucial, unexplored development in early Indian religion. In order to capture these historical developments, it outlines a method for the comparative study of ritual forms over time.
