Abstract:
This chapter considers two main topics. It first examines the provisions of the EU’s Copyright in the Information Society Directive, which sets out to amend some provisions of copyright law better to fit the realities of an online world. It then looks at some of the issues associated with enforcement of copyright, considering the extent to which intermediaries such as Internet Service Providers (ISPs) might be held liable for infringing acts committed by their users. Attention is increasingly paid to the possibility that rights owners might proceed against users whose actions infringe their rights. In many cases this will require the cooperation of ISPs and a major component of the Digital Economy Act 2010 is concerned with the manner in which this process might be managed.

Abstract:
Blood transfusions are necessary to improve or save the lives of children with severe anemia, mothers in obstetric emergencies, patients with hemoglobinopathies, cancer patients, transplant patients, patients with chronic age-related diseases, such as bleeding caused by vascular problems and orthopedic surgeries, people injured in accidents, among other causes. Supply and access to safe blood for transfusions are closely related to the organization and degree of development of blood services, with the governance and participation of society through voluntary unpaid donation. Since 2004, the Pan American Health Organization (PAHO) has been collecting and publishing indicators related to blood supply in the countries of Latin America and the Caribbean. In 2014, the countries of the Region of the Americas reaffirmed their commitment to universal health through the approval of the Action Plan for Universal Access to Safe Blood 2014-2019, approved by the 53rd Directing Council held in October 2014 (CD53.6), this plan promotes universal access to safe blood for transfusion in the region, through unpaid voluntary donations, the organization of blood services, the implementation of quality and safety standards and the implementation of governance actions. The data presented here allows monitoring and reporting on progress and limitations in the implementation of the Action Plan for Universal Access to Safe Blood. Furthermore, it is hoped that these data will promote the analysis and evaluation of the indicators at the national and subregional levels, and that strategies that improve blood safety and accessibility to transfusions will be strengthened or modified. The information was provided by the authorities of the countries and corresponds to the years 2016 and 2017.

This chapter examines the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE). It first assesses the legal position prior to the introduction of the Acquired Rights Directive 2001, which is the source of TUPE. It then analyses the principal implications of TUPE and its provisions. It considers the circumstances when TUPE will apply and the extent to which TUPE has been interpreted progressively to include economic transactions and arrangements which transcend the transfer of an organization’s business and assets. The chapter also examines the impact of TUPE on the contract of employment, and discusses the information and consultation obligations imposed on transferors.

Abstract:
Despite cultural differences, privacy tends to be rather universally viewed as important in protecting some realms of life that are seen as off limits to society more generally. Yet privacy has also been the cause of significant global issues over the years. In the late 1960s and early 1970s, government agencies and private sector organizations increasingly adopted computers to maintain records, precipitating a concern with the rights of the individuals who were subjects of that data and with the responsibilities of the organizations processing the information. During the 1980s, international and regional bodies recognized that domestic laws could affect the flow of personal information into and out of a country, bringing scholarly and policy attention to the issue of transborder data flows. Somewhat paralleling the principally business dominated debate and analyses over transborder data flows was a broader discussion about privacy issues resulting from global communication and information systems, particularly the internet, during the 1990s. The focus in policy and scholarship was less on variations in national laws and more on two features of networked communication systems: first, the technical infrastructure supporting the flow of information; and second, the globalization of communication systems and information flows. Later on, the privacy landscape and discourse changed dramatically throughout the world after the terrorist attacks in the US on September 11, 2001. Concerns about privacy and civil liberties were trumped by concerns about security and identifying possible terrorists.
