Full textSexual violence today is, as in the past, widely used as a weapon of war and a means of ethnic cleansing. The analysis of international criminal jurisprudence highlights the difficulty of apprehending this new offense in relation to the existing legal categories. The nature of sexual crimes is not reducible to genocide, crimes against humanity, or war crimes. The international judge, through constant legal reasoning, was able to clarify the boundary between sexual offenses and other offenses, to show their scope and intensity to distinguish them from other crimes. This advance in jurisprudence gradually builds a foundation and legitimacy that define elements of the empowerment of sexual crimes under international law. The codification of international law through a new treaty specific to sexual crimes, with provisions defining this particular category of offense, its apprehension and its legal obligations will allow a better repression of this crime

Full textThis research focuses on sexual assaults committed by teenagers The specificity of this work is centred on the understanding of the quality of the psychic pare-excitation of the teenagers we have met for this study, especially regarding the victim’s status in their psychic economy and questioning some psychopathological personality characteristics: like pernicious or psychopathic tendencies. The research is based on the fundamental distinction between the assaults perpetrated individually and the assaults perpetrated collectively. This study was led on thirteen teenagers who were incarcerated in a unit for young prisoners located within a normal prison. All the teenagers were under 18 when the assaults were perpetrated (either individually or collectively). The attacks were qualified as rape and/or sexual assault. In order to test this hypothesis, a guide for an unguided interview as well as projective tests (Rorschach and TAT) have been used. Beyond the strict opposition between the individual and collective characteristics of the sexual assaults, there are significant similarities between the profiles of attackers who acted collectively (especially when they have endorsed a group leader position at some stage) and the profiles of attackers who acted on their own. Teenagers who acted alone and who do not show any sign of pernicious or psychopathic features seem to suffer from psychopathological tendencies on different levels (for instance: psychotic). These tendencies clearly surpass those of other young people (for example, teenagers who acted collectively but not as group leaders) and could be interpreted as part of the impact created by the adolescent process

Full textThis thesis is to study the evolution of the social reaction to sexual offenses from the 18th to the 21st century. We will initially emphasize the importance of sexual offenses at the end of the Ancien Régime. Indeed, sexual behavior remain largely under the control of the group and the law is permeated with morality. Therefore be defined sexual deviance offending and society's response to the ' lewd '. In a second step, we will focus on the breakdown provided by the French Revolution and the Enlightenment as the triumph of the individual will result in a number of implications for the repression of deviant sexual behavior. The pure moral law is in force. This will result in a limited public space surveillance, major concern of the criminal legislature of the nineteenth century. And we will look at the withdrawal of the law and the decriminalization of certain offenses such as homosexuality, prostitution and pimping will not be prosecuted but will be organized brothels. The withdrawal right is based on the consent of adults what is historically new. Protection of minors from sexual abuse will continue to grow (the importance and impact of age of consent). This phenomenon is accompanied by a change in the definition of rape and indecent assault. The probation system and the practice of criminal and criminal courts will be examined. The importance of the moral violence is increasing. The interference of criminal law in the domestic sphere will become more pronounced

Full textThis Ph.D. dissertation examines how Iraqi criminal law with regard to sex and sex-related crimes severely discriminates women in Iraq. It looks at this issue in light of ancestral traditions of prejudice and violence against women that are deeply rooted in Iraqi society. Honor is an extremely important notion in the mentalities of Iraqi people. Women are supposed to maintain chastity and sexual purity in order to be considered "honorable". Anything that compromises their chastity, including crimes of which they are victims such as rape, destroys their honor and along with it, that of their entire family. Many women in this situation find themselves killed, injured, or forced to marry their attacker in order to allow their families to recover their honor. This study shows how Iraqi legislation, case law and legal doctrine all contribute to encourage and perpetuate this problem, and suggests some possible solutions

Notwithstanding this noble common purpose, these criminal jurisdictions mark, through their fundamental texts and their practice, points of divergence and convergence.The circumstances of the commission of sexual crimes, the difficulties to identify the sexual crimes, to bring a reliable and credible proofs of guilt, the feeling of guilt developed by the victims, the quality and the personality of the author, the age and the vulnerability of the victims are so many matters which directed the present comparative study of French and international criminal jurisdictions.The admission and the appreciation of proofs become issues when the complexity of the affairs, the ambiguity as well as the imprecision of texts can join quickly the subjectivity of the judges who have to charge or acquit a person as soon as the conditions are suitable. The study attempted to compare, in terms of difficulties and gaps, divergence and similarity, the way in which these jurisdictions enforce sexual crimes while ensuring fair trials for all parties

Thanks to the collected data, this work will offer a perspective on cyberviolence, with an interest in the relationship between the offender and the offence, the victim, and cyberspace.
