Abstract:
Previous historical studies of the care of the insane in nineteenth century England have been based in the history of medicine. In this thesis, such care is placed in the context of the English poor law. The theory of the 1834 poor law was essentially silent on the treatment of the insane. That did not mean that developments in poor law had no effect only that the effects must be established by examination of administrative practices. To that end, this thesis focuses on the networks of administration of the poor law of lunacy, from 1834 to 1870. County asylums, a creation of the old (pre-1834) poor law, grew in numbers and scale only under the new poor law. While remaining under the authority of local Justices of the Peace, mid-century legislation provided an increasing role for local poor law staff in the admissions process. At the same time, workhouse care of the insane increased. Medical specialists in lunacy were generally excluded from local admissions decisions. The role of central commissioners was limited to inspecting and reporting; actual decision-making remained at the local level. The webs of influence between these administrators are traced, and the criteria they used to make decisions identified. The Leicestershire and Rutland Lunatic asylum provides a local study of these relations. Particular attention is given to admission documents and casebooks for those admitted to the asylum between 1861 and 1865. The examination of the asylum documents, the analysis of the broader relationships of the administrators, and a reading of the legislation itself, all point up tensions between ideologies of the old and new poor law in the administration of pauper lunacy.

Leiba, Patrick Anthony. "Caretakers and the rights of the insane : an historical sociology." Thesis, University College London (University of London), 1997. http://discovery.ucl.ac.uk/10021735/.

Abstract:
This investigation grew out of my experiences while working as a mental nurse with people deemed to be insane. The behaviours which they presented and the medical and legal control exercised over them became of concern to me because I felt their rights were not being respected. A primary issue is the extent to which adherence to the medical-somatic view of insanity held by psychiatrists, lawyers and politicians has led to the exclusion of viable custody and treatment alternatives. The purpose of this research is to question the role and functions of mental nurses. It suggests that 'caretakers' might be a more suitable title for such workers with the insane. The hypothesis underlying the research links the work of 'caretakers' of the insane to changes in government policies and legislation; the thesis examines this hypothesis in the light of changes in the roles and functions of 'caretakers' over the period from 1890 to 1990. Research activities included the examination of primary sources, Hansard, newspapers, and professional journals. Interviews were also carried out with nine contemporary caretakers who have worked with the 1959 and the 1983 Mental Health Acts. These research methods provided an historical background to the debates in the Houses of Parliament when mental health legislation was discussed; information from the writings of the professionals who worked with the insane at the times of new mental health legislation; data on the public and media debate of these issues; and information on the perceptions and duties of caretakers working with the insane at the times of new mental health legislation. The research findings show that both those who cared for the insane and the insane themselves have been subjected to changes brought about by mental health legislation since 1890. These changes affected the working conditions of the caretakers and the social control and rights of the insane. The changes in the work of caretakers led to new directions in their education. Workers with the insane became a part of nursing by adopting the somatic approach to care. When this occurred, many of the care activities of keepers, attendants and mental nurses became redundant. Over time, there has been a move to, and then away from, the clinical-somatic model of nursing towards caretaking skills such as group work, therapeutic community skills, counselling skills and psychotherapy skills. These caretaking skills are seen by contemporary caretakers as going beyond their custodial and social control functions, towards providing a space in which people can be respected, encouraged, supported and be open to new insights.

Deitz, Charles. "'A Tomb for the Living': An Analysis of Late 19th-Century Reporting on the Insane Asylum." Thesis, University of Oregon, 2019. http://hdl.handle.net/1794/24206.

Full text
Abstract:
This study examines newspaper portrayals of the American insane asylum between 1887 and 1895. The focus is on the way the mental health system was represented to the public in the era of Nellie Bly, the stunt journalist who investigated a Manhattan insane asylum in 1887. The project reveals the ways in which the newspapers aggregated a variety of narratives around the insane asylum which ultimately presented the institution in such a way that served the needs of the press. For those without firsthand knowledge of the insane asylum, the newspaper was the primary source of information. In that medium, there was a system of knowledge created and disseminated, one that integrated and conflated the public answer to mental illness with other sociopolitical issues such as economics, crime, gender, and ethnicity. The content created a meaning in which the deteriorating asylum system was presented contradictorily as an ineffective yet permanent public reality. Furthermore, newspapers reinforced and augmented an existing shame around mental illness. Mental illness evolved from a private/family concern to one of public import over the course of the 19th century. Thus, mental affliction became more than a moral failing or a character flaw; it had been elevated to a social problem to be tended by the government. Therefore, the problem of the mentally ill fell under the jurisdiction of the metro newspaper, which often published articles relaying asylum expenses, investigations into the failing asylums themselves, or speculations as to the cause of a person's sickness.

Walton, Samantha. "Guilty but insane : psychology, law and selfhood in golden age crime fiction." Thesis, University of Edinburgh, 2013. http://hdl.handle.net/1842/7793.

Full text
Abstract:
Writers of golden age crime fiction (1920 to 1945), and in particular female writers, have been seen by many critics as socially and politically detached. Their texts have been read as morality tales, theoretically rich mise en scenès, or psychic fantasies, by necessity emerging from an historical epoch with unique cultural and social concerns, but only obliquely engaging with these concerns by toying with unstable identities, or through playful, but doomed, private transgressions. The thesis overturns assumptions about the crime novel as a negation of the present moment, detached and escapist, by demonstrating how crime narratives responded to public debates which highlighted some of the most pressing legal and philosophical concerns of their time. Grounded in meticulous historical research, the thesis draws attention to contemporary debates between antagonistic psychological schools – giving equal space to debates within psychoanalysis and adaptive neuroscience – and charts how these debates were reflected in crime writing. Chapter two explores the contestation of the M’Naghten laws on criminal responsibility in light of Ronald True’s case (1922), followed by readings of crime narratives in which perpetrators have ambiguous and controversial legal status in regard to criminal responsibility. At the intersection of psychiatric discourse and the popular literary imagination, a critical and ethical perspective developed which not only conveyed a version of psychological discourse to a wider public, but profoundly reworked the foundations of the genre as the ritual unveiling of deviancy and the restoration of the rational institutions of society. In similar vein, chapter three explores the status of the ‘Born Criminal’ in law and medicine, and looks at crime writer Gladys Mitchell’s efforts to expose both the pitfalls of categorisation, and competing discourses’ limitations in adequately accounting for crime. Chapter four, whilst maintaining close medical-legal focus, opens up the study to consider how understandings of deviant selfhood in modernist writing inflected crime writers’ representations of unconscious and epileptic killers. Finally, chapter five continues this intertextual approach by asserting that certain crime novels express an exhaustion with the genre’s classic rational and scientific heroes, and turn instead to the affective epistemologies and notions of subconscious synthesis concomitantly being celebrated in modernist writing. Altering the position of the authoritative detective in ways that profoundly alter the politics of the form, the chapter and the thesis in total propose a reading of golden age crime fiction more responsive to cultural, psychological and legal debates of the era, leading to a reassessment of the form as neither escapist nor purely affirmative of the status quo.

Sturdy, Harriet C. G. "Boarding-out the insane, 1857-1913 : a study of the Scottish system." Thesis, University of Glasgow, 1996. http://theses.gla.ac.uk/5511/.

Full text
Abstract:
The pioneering policy of boarding-out harmless, chronic insane patients in the community was implemented formally by the Scottish Board of Lunacy in 1858, following the passage of the Lunacy (Scotland) Act, 1857. Up to 25% of registered pauper and private patients were boarded-out under the terms of this Act. Despite the innovative nature of the system, the number of patients involved and its marked impact on Scottish lunacy administration, the policy has received little systematic attention this century. This study undertakes, therefore, a detailed assessment of the nature of boarding-out, the demographic and clinical characteristics of patients, the status, role and responsibilities of guardians, and the extent and effect of official supervision. The system was endorsed firmly by the Scottish Commissioners in Lunacy, who advocated its widespread adoption throughout the country. However, despite official encouragement, boarding-out came under sustained attack from certain medical and parish officials and from the general public. Facilitated by extensive recourse to contemporary medical journals, official lunacy reports and parish records, this study assesses the beneficial aspects of the system, and in addition offers a critique of prevailing shortcomings. Physicians from across the world came to see boarding-out in practice. The nature and success of international family care policies, and the extent to which the Scottish system was imitated overseas, therefore, are considered. Boarding-out continued to be utilised in the 20th century, albeit with a gradual transformation in its nature. The changing nature of boarding-out is examined, and its gradual decline, and replacement by the less closely organised policy of community care explored, thereby enabling tentative analogies to be drawn between the two systems.

Hurn, Juliet D. "The history of general paralysis of the insane in Britain, 1830 to 1950." Thesis, University College London (University of London), 1998. http://discovery.ucl.ac.uk/1349281/.

Full text
Abstract:
This thesis explores the history of ideas about, and responses to, general paralysis of the insane (GPI) - specifically in the context of the developing profession of psychiatry in Britain. It considers GPI as an objective disease entity whose subjective definition was nevertheless open to negotiation; for example, in deciding how central was overt insanity, or how GPI should be differentiated from the allied disease of tabes dorsalis. It explores how psychiatrists' interest in organicism and the science of medicine - and their attempts to raise the status of their specialty - both informed their understanding of GPI, and allowed them to promote it as a flagship disease for their profession. Nevertheless it draws attention to the gap between such claims and concrete practical advances which the disease fostered. The thesis considers changing causal explanations for GPI: first, in relation to the evolving image of the typical general paralytic patient; and second, in relation to the credence attached to different forms of causal evidence such as pathology, statistics, and laboratory medicine. It suggests how assessment of this evidence might have been informed both by professional aspirations and by pervasive cultural concerns such as fear of syphilis and degeneration theory. The thesis studies the use of malaria therapy to treat GPI in Britain, and uses this episode to explore a number of themes: early twentieth century ethical attitudes to heroic treatments; perceptions of 'cure'; and the change in emphasis from asylum care to community care. Finally, it considers ideas about the epidemiological history of the illness - from early twentieth-century theories about the evolution of infections, to Edward Hare's hypothesis of a neurotropic epidemic; and considers how the views of disease as objective entity, and disease as cultural construct, might be reconciled in the context of GPI.

Abstract:
Through an analysis of records from Broadmoor Criminal Lunatic Asylum, this PhD thesis sheds new light on current understandings of the asylum, masculinity and the relationship between medicine and the law in late-Victorian England and Wales. The material consulted includes a database containing the details of 2246 patients which was compiled from the Admissions Registers as part of this thesis, and the case files of 425 male patients. Newspaper reports, trial proceedings, Home Office records, and medical and legal publications are also consulted, as are publications that sought to define ideal behaviour for men. The sources are woven together to formulate accounts of the crimes committed, the subsequent trials, and defendants’ experiences in Broadmoor. Through an examination of new evidence, this thesis surveys the history of the asylum, its staff, treatment and patients. An examination of paternal child-murderers questions the assumption that it was only women who were thought to be going against nature if they killed their child. An analysis of discourses on jealousy highlights that whilst crimes of passion existed in theory and were common narratives in popular culture, jealous wife and sweetheart murderers were subjects of legal and medical contention. Additionally, the thesis adds to current histories on medico-legal conflict in the late-nineteenth century and highlights the haphazard application of the McNaughton Rules through the use of new examples. Finally, an examination of Broadmoor’s insane convicts, as well as the publications and Addresses of Broadmoor’s Superintendents, sheds new light on the question of the criminal, not only in theory but also regarding their treatment in a criminal lunatic asylum from the point of view of the press, Government, and Broadmoor’s staff and patients.

The publication of the law No.10.216 in 2001, the expected Psychiatric Reform Law, was a legal reference that has been extremely important in the fight against asylums. Based on securing the rights to dignity, autonomy and social integration of people with psychological distress, foresees the gradual institutionalization of users of the mental health system and seals prolonged hospitalization in mental institutions or analogous to these features. People with mental disorders who commit crimes, the offenders, are also included in this legislation, but what is observed is that on the legal field, until nowadays, there was a very little progress regarding the implementation of security measures. The judiciary psychiatric hospitals are still spaces of rights violations. Thus, this paper aims to identify where the idea of deinstitutionalization arises, as it was inserted in Brazil and has been introduced in judiciary psychiatric hospitals in the state of Rio de Janeiro. Beginning from the fact that the offender with mental disorders is doubly stigmatized, because of fear that hangs over the possibility of a reoffending, the main intention here is to evaluate the current condition of the places where these people are being sent. The research focused on the judiciary psychiatric hospitals, spaces historically recognized as producers and reproducers of isolation, neglect, mistreatment and torture, seeking informations about how the Psychiatric Reform Law has influenced the treatment of people with mental disorders that serve security measures and performing considerations about if the advances in the psychiatric field and the few examples that have occurred in the legal field effectively achieved offenders with mental disorders at Rio de Janeiro.

Joinson, Carla. "The Perception and Treatment of Insanity in Southern Appalachia." Digital Commons @ East Tennessee State University, 2012. https://dc.etsu.edu/etd/1212.

Full text
Abstract:
In the nineteenth century, the perceived ability of alienists (the early term for mental health specialists) to cure insanity eventually led to lavishly-constructed insane asylums supported by taxpayers. Simultaneously, the hope of a cure and a changing attitude toward insanity helped destigmatize mental illness and made institutionalization of the insane more acceptable. This regional study investigates insane asylums within Appalachia between 1850 and 1900. Primary sources include period articles from professional publications, census data, asylum records, period newspaper articles, and patient records. The study provides background on the medical environment of nineteenth-century Appalachia and investigates the creation and function of five Appalachian asylums. The institutions under examination appear to be as modern and enlightened as those in any other region. Contrary to most published theory, women were not committed to Appalachian asylums more often than men, nor does patient abuse appear to be prevalent.

Abstract:
The study maps different usages of three clinical adjectives: lame, insane and depressed by consulting the Corpus of Online Registers of English, the CORE. The study categorizes the usage with respect to clinical and non-clinical senses of the adjectives. It discusses the different usages of each adjective and what the adjective typically modifies, based on the data in the corpus. Further, the study aims to account for the non-clinical usages with the help of Fauconnier and Turner’s (2002) Conceptual Blending Theory. The study offers blending diagrams of generalized utterances containing one of the adjectives and a common modified. The study concludes that the adjectives are used in non-clinical ways in a majority of the data and that the blending diagrams had restricted function but could account for some parts of the blending process. Finally, the study states that uniting a usage-based approach and a cognitive linguistic approach to linguistic phenomena of this kind is a way to trace nuances in language use that otherwise would pass unnoticed.

Nilsson, Daniel. "Insane in the membrane: : Insertion of marginally hyrdophobic transmembrane helices and global analysis of membrane protein topology."

Full text
Abstract:
Proteins are responsible for carrying out most of the tasks in a living cell; transcription, translation, replication, movement, catalysis and communication to mention a few. A subset of proteins is the integral membrane proteins, IMPs, which play an important role in governing communication across membranes, whether it is the plasma membrane or an organelle membrane. As IMPs are often responsible for uptake of substances such as hormones and pharmaceuticals they are also very often prime targets in medical research. In order for an IMP to function correctly it must fold and insert into the membrane properly as well as display the correct motifs to its surroundings, on either side of the membrane. IMPs cannot spontaneously insert into the membrane, the insertion is assisted by the Sec-translocon machinery. The Sec-translocon creates a pore in the membrane enabling nascent polypeptides to translocate across the membrane. This thesis will cover both the insertion of IMP segments as well as an evaluation of different approaches on how to investigate the topology of integral membrane proteins. The first question to be addressed is whether there are any specific sequence motifs within the sequence context that can improve the co-translational insertion of a marginally hydrophobic transmembrane helix, mTMH, into the membrane. A mTMH is a protein segment that would not insert by itself into the membrane. It has however been shown that these mTMHs can insert effectively into the membrane using their neighboring helices and loops, referred to as its sequence context, to compensate for the unfavorable insertion of only the mTMH. We show for a number of mTMHs that disrupting the sequence context motifs, usually lowering the ΔG-values for insertion by introducing more hydrophobic residues through substitutions in the sequence context, does not by itself improve the insertion of a given mTMH. It can however be concluded that the positive inside rule is of great importance to improve recognition and co-translational insertion of these mTMHs as it provides an oriental preference of the subsequent helix. This oriental preference will enable the mTMH to insert. This means that the positive inside rule it stronger when followed by a transmembrane helix, at least for the insertion of mTMHs. The second question addressed is that of how to design a method to analyze the topology of membrane proteins in a high-throughput proteomic fashion. In order to extract information on membrane protein topology a protease can be used to degrade the exposed parts of the integral membrane protein, known as shaving. These peptides can then subsequently be degraded and analyzed using MS and bioinformatics. To compare different proteases, we first apply our shaving experiment on two over-expressed proteins and analyze the detected peptides using MS. Secondly; we run the same experiment on non-over-expressed Escherichia coli membrane proteins with known structure. Finally, the results from the above experiments were used to test the accuracy of a number of topology predictors. We can conclude that the use of the protease Thermolysin does show promising results when compared to for instance trypsin. Even though the two proteases show somewhat similar output on the proteins used in this study, Thermolysin does produce fewer peptides originating from the transmembrane region. This is most likely due to the milder, more native like reaction conditions combined with the shorter incubation time used for Thermolysin as compared to trypsin. These properties are believed to greatly improve the output and accuracy when applied on large scale global analysis.

Skagerström, Karl-Johan. "The “defiant but insane look of a species once dominant” – The Problems of Emancipation in Margaret Atwood’s Surfacing." Thesis, Stockholms universitet, Engelska institutionen, 2014. http://urn.kb.se/resolve?urn=urn:nbn:se:su:diva-104898.

Full text
Abstract:
Margaret Atwood’s novel Surfacing has received considerable critical attention on the issue of “a positive female identity” in a patriarchal society. However, given Atwood’s own stress on the fact that the novel is about the ways both genders work in relation to each other, this criticism has lacked in scrutiny of the novel’s male characters. With a relational approach to the female and male characters, this thesis argues that while creating a positive identity for its female protagonist, the novel effectively creates a rather negative one for its male characters. In order to examine certain sets of relations and the qualities which represent the most honored way of being a man in the novel, I apply the concept of “hegemonic masculinity,” which can be understood as the pattern of practices that explain male domination over women. It is indeed this hegemonic masculinity that the Surfacer rejects in her quest for emancipation. By looking at the hegemonic masculinity in Surfacing, I argue that the novel depicts very typically patriarchal characters in Joe and David and that the society is typically patriarchal. The thesis is divided into three main sections, each examining the most important sets of relations concerning Atwood’s female emancipation. First, I analyze hegemonic structures in the world of the protagonist, including the issues of power, emancipation, and complicity. Then I look into the sexual division of labor to show that the characters assume their default roles without much reflection. Finally, I scrutinize the characters’ relation to the Symbolic and how it affects their sense of identity. In each section, the analyses show that the male characters are reduced to tropes who only serve one function: to be stereotypically oppressive, patriarchal figures in order to facilitate the protagonist’s positive change and empowerment. I argue that Atwood’s failure to imagine male emancipation somewhat taints the development of female identity because the female emancipation becomes arrested.

Abstract:
The Pennsylvania Hospital for the Insane was built in the late 1830's in the countryside near Philadelphia. It was directed from 1840 to1883 by Thomas Kirkbride, who made ita pioneer in the humane treatment of the mentally ill. This thesis connects thetherapeutic work of Dr. Kirkbride to the rich artistic and photographic traditions of Philadelphia by examining the visual culture of the institution, with special attention to the systematic use of magic lantern shows. Frederick and William Langenheim, innovators in the negative-positive process in the United States, are especially important to this history. By focusing on a painting that was commissioned from Benjamin West, the first part opens the thesis in the heart of Philadelphia, at the Pennsylvania Hospital, and explores the background period leading up to the use of images at the Pennsylvania Hospital for the Insane. The second part details various aspects of the "reverse image"presented by the new hospital in the country and focuses on the cultural projectdeveloped during the period from 1841 to 1859. The third part looks closely at the development of outdoor spaces for the use of the patients. The collection of magic lantern slides, like a window open to the outside, is at the heart of this section. This collection of objects is exceptional due to its large scale, to the variety of techniques used in making the glass slides, and to the long period of its creation. It also bears witness to the innovative cultural practices which it records

Abstract:
In 1869 the General Assembly of the Commonwealth of Virginia passed legislation that established the first asylum in the United States to care exclusively for African-American patients. Then known as Central Lunatic Asylum for the Colored Insane and located in Richmond, Virginia, the asylum began to admit patients in 1870. This thesis explores three aspects of Central State Hospital's history during the nineteenth century: attitudes physicians held toward their patients, the involuntary commitment of patients, and life inside the asylum. Chapter One explores the nineteenth-century belief held by southern white physicians, including those at Central State Hospital, that freed people were mentally, emotionally, and physically unfit for freedom. Chapter Two explains the involuntary commitment of African Americans to Central State Hospital in 1874. Chapter Three considers patient life at the asylum by contrasting the expectation of “Moral Management” care with the reality of daily life and treatment.

The Hospital of Custody and Psychiatric Treatment- popularly known as the judiciary asylum - functions today as the main resource of treatment for those labeled by a court as "legally insane". This work will adopt this expression, "legally insane", so as to emphasize the ambiguity that encircles this category of criminal, in the sense that they are neither criminals, nor innocents, they are found not-guilty by reason of insanity, being insanity a form of punishment in itself. Studying this type of character, two laws become essential for fully comprehending its present situation. The first would be "Medida de Segurança", established by Penal Code of 1940, and still ruling. The second would be the Psychiatric Reform (nº 10.216/2001), established in 2001, following a new political programme for mental-health treatment, based mainly in a more humanized approach to the ones found in psychiatric wards. These two laws, by their very contradictory nature, collide and pose many problems. This dissertation was structured in three chapters. The first one focuses on the process by which the notion of criminality is founded, the social discourses that validate it and the institutions that use such rhetoric. The second one observes the history of the law in Brazil, and how cases from different countries influenced the recent changes in our Constitution. And the last one studies the current situation of those found in psychiatric wards in Distrito Federal, and how these many factors operate in their reality. My theoretical tools were driven out of the works and concepts of Foucault, where the historical roots are analyzed in order to create a panorama from which we can observe how crime, pathology, and social defense correlate to which other in a complex drapery that involves institutions, laws, and social stigmas. It was found that a large amount of those kept in psychiatric wards had already a history of earlier hospitalizations. This was the first visible pattern. The second was that many were single subjects, poorly schooled, and diagnosed with dysfunctions related to psychosis and schizophrenia. The crimes they committed ranged from thievery to homicide. This research also found similar data in other states, which authorized comparisons for purposes of further elucidations. By focusing on the essential conflict between the two laws and seeing which one would overcome the other, and also by trying to scrutinize the mechanisms behind such operation, this research had the purpose of posing a new debate over the current situation of those labeled "legally insane" and their treatment

The main objective of this work is to investigate the social representations on insane offenders elaborated by mental health workers. We assume that these representations are not built in a social vacuum, but are generated within interpersonal and/or intergroup relations and have a dialectic relationship with the environment and social practices. On the other hand, we understand social representations as being conceived as a network of knowledge, where their contents are interwoven. Therefore, the social representations about the insane offenders shall be understood as one of the links to a more complex representational system concerning madness itself, social violence, aggressive behavior etc. To achieve this goal, workers from two institutions that attend insane offenders will be interviewed. We will initially interview workers from Center for Psychosocial Care (CAPS); the first of which is situated in a rural area (Brasília), and the second, a mental asylum judiciary inside a penitentiary (Psychiatric Wing). The comparison of the results between these two institutions will allow us to establish correlations between the environment, the representational content described above, and the professional practices related to the care provided to insane offenders. Our initial hypothesis was supported; is that despite the fact that public policies concord with the psychosocial paradigm, we still have the knowledge and experience of mental health workers anchored in biological paradigm.

This present dissertation brings forward a reflection about the connection between the social representations built regarding crime and the proneness to commit crime in the attempt to apprehend if those representations implicate in the compound of practices carried on by professionals in the medical- legal field . This research, of quantitative purpose, has sought to know how the practice of professionals in the psychiatric-penal field has developed. Having the theoretical mark of Social Representations as support, and utilizing Moscovici´s approach, it has sought to understand the reality of Hospitals who take patients who are in criminal custody and the condition of the female population, calling out the attention to the role of these hospitals in the context of the Brazilian Psychiatric Reformation. The analysis undertaken has shown different and divergent opinions among experts and the multidisciplinary team, about the presentation of proneness to commit crimes. As for crime representation, some common subjects have been identified in both groups, specially on what relates to homicide and leads them to observe the circumstances in which it occurred, if it involved planning and/if it was practiced with daintiness cruelty.

Abstract:
This dissertation intends see the occurrence of the itinerary of souls ascension in the knowledge of truth and science, according to the description given in De libero arbitrio, with suport in the parallels lectures presents in the dialogues De ordine and De quantitate animae, composed in the Augustines Cassissiacum - Rome period (386-396 AD). Referring to intelectual ascension exposted in Book II of De libero arbitrio, and based on the notions of driving/guide and judgment/institution, in the rational way, we verified like the itinerary of the soul in probatory knowledge of divine reality shows, in addition to climbing \"hierarchical elevation\" of a sensibility to God, the knowledge of how the movement of factoring of reality known in eternity, as the reason rests and is founded on the eternal and unchangeable truth, and every cognitive act is driven/oriented and award/established by reason, which, ultimately, is equivalent to saying that eternity is known totals in this reality, precisely in the temporal instant that one recognizes any knowledge as true. For this purpose, it is to see how, at each level of knowledge on the rise, the next step is supposed to - actually contains and makes up reasons it - the previous, so that the subsequent necessary step and permanently, ratifies and awards the previous step. And just like the instant, by introducing the temporal totality, is like a previous or figuration of eternity, also knowledge and totals rising figure the absoluteness truthfulness through the immediate perception - and its perennially simultaneous factoring - the totality of universal and harmonious ordering of beings (De ordine); the functionality of the imaginative act in this concomitance observed between sensitives perceptions and interiority (De quantitate animae); as well as the aforesaid acts of conduct and judgment made in making of universal knowledge (De libero abitrio)

This dissertation aims to genealogically analyze the approach of legal and psychiatric discourses in defense of the insane criminal restraint in regard to security measure issues and they internment in Manicômios Judiciários (a Judiciary Mental Health Hospital), currently known as the Hospitals of Custody and Psychiatric Treatment (HCPT). Since the appearance of the psychiatrist in court, the figure of the insane criminal emerged as a freak that needs to be studied, treated and normalized. Thus, the knowledge of criminal psychiatry led health policies to approach the security policies as a way to suppress these dangerous individuals, removing them from the social living, legitimized by the concept of social dangerousness. Indeed, they were taken to the State custody, for the maintenance of order and the social welfare through the execution of the security measure. This work tried to investigate the technical procedures of power that produces a disciplinary control over the body, in regard to gestures, attitudes and behavior of insane criminals. From a study of the different historical phases of Manicômio Judiciário de Franco da Rocha, it was shown that the notion of dangerous individuals, and its proposal for the model of treatment / custody, changes in each current socio-political discourse

Abstract:
This paper proposes an introduction to the Kierkegaardian relation between freedom and truth. In order to do this, mainly paying attention to his Philosophical Fragments, it begins with the Socratic problem of acquiring truth. After this, it focuses on truth as the fruit of God’s free love, whence emerges the topic of freedom. Finally, this theme leads to the Kierkegaardian account of becoming, and specifically to the relation between possibility and reality. Throughout this exposition, the central concept that articulates this itinerary is the “instant”, understanding it as the point of convergence between the eternal and the temporal, stressing the paradox therein.

This work deals with the legacy of Søren Kierkegaard and Jacques Derrida. Our search is in the sense of examining possible perspectives of discussion in the thought of these two authors concerning to justice. In parallel to the development of this themes, they are connected in their content and also in the way that they cross themselves. Besides, they admit the contact with reflections of other philosophers like Lévinas, Heidegger, Hegel, Montaigne, Pascal and Rousseau. After the development of this discussions, possibilities are showed as coherent enough in Kierkegaard and Derrida which are really appropriated for approaching a discussion about Justice or, as it is announced in the title, about the justice of justice.

Cartography, inventing trajectories, giving way to affections and touch. Considering photography a method, this thesis project/process works as a device of luminous register, in the attempt of retorting the poetry of the instant. A Turner becoming, a tempest, wind, cloud becoming, wave. The luminous instant is cut out by the image register, and it draws a volume and contents a runaway point. Dissipating in order to constitute passages, real, physical and effective states, sensations. If it had to tell some happening, from which point would it leave? Or what point of view would be selected? What is the intensity of the narrative? Which device can be created to cope with the lived sensation? From these anxieties, I am invoked to create a method. The choice of recognizing and compounding a thesis as a device that allows the connection with the experience of the intensive. Making vibrate the sensation. Photographs, exhibitions, the constructing of narratives, fables, shapes that try to re-set not only the lived experience, but also the lived sensation. The cloud as a sensation being, the photograph that keeps inside itself the time of the light, the luminous intensity of the instant of a day. A child s play. A child-becoming , inventing shapes with clouds. New shapes, inconstant shapes that are transfigured by the winds, taking us to other territories. Simulacra of existence, a universe of possibilities

Qual a intensidade narrar?

The main task in the implementation of criminal proceedings for the application of coercive measures of a medical nature - to provide real guarantees for the protection of the rights and legitimate interests of insane (limitedly sane) persons. At the same time, it is fundamentally important for the person in charge of the case to be aware of their responsibility for compliance with the law in the pretrial investigation and court proceedings against this category of persons, proper exercise of their powers, which should be lawful and reasonable decisions. The first section examines the legal nature and grounds for criminal proceedings for the application of coercive measures of a medical nature. The International Standards have been analyzed and it has been established that they are subject to fuller implementation in proceedings concerning the application of coercive measures of a medical nature. The second section examines the change in the general procedure of pre-trial investigation in criminal proceedings concerning the application of coercive measures of a medical nature. Attention is paid to the procedural status of the person in respect of whom the application of such measures is envisaged, the procedure for completing the pre-trial investigation in a certain category of cases is analyzed. The third section is devoted to court proceedings in criminal proceedings concerning the application of coercive measures of a medical nature. The court's decision on the application of coercive measures of a medical nature and the procedure for appealing it on appeal are described. The scientific novelty lies in the fact that the study examines the problematic issues of legal regulation and criminal proceedings for the use of coercive measures of a medical nature. The work is performed using modern software and computer technologies of information processing, namely: the design of the text part of the work is performed in the text editor MS Word; the necessary scientific-theoretical, statistical and analytical materials are partially obtained from the Internet. The main provisions and conclusions of the work were discussed at the round table "Legal system of Ukraine: the modern dimension". The main results of the study are set out in 1 scientific work.

Abstract:
Based on the reading of Mínimos, múltiplos e comuns, by João Gilberto Noll, this work seeks to undertake a study on the relationship between the artist writing and the time in the figure of "fictional instants, noting the issue of the micro-relate and the fragmentary requirement (cf.P. Lacoue-Labarthe and Jean-Luc Nancy), in the view of the unfinished / unit, which casts a whole constellate hypothesis on the writing of João Gilberto Noll. Initially, a reflection on some important topics that are recurrent in the critical fortune of the writer is carried out with the intention of finding out how they reverberate in his writings; then, the fragment and its aesthetics perspectives of incompleteness and wholeness are treated with respect to time; finally, it is observed how, from these issues, the critical metaphor of the fictional instant takes place. The critical readings used as operators have been guided by the notions of the fragment (romantic), and Event which is related to the conceptual pair Cronos / Aeon Deleuzian

Ethical, legal, and technical limitations compromise the studies of human anatomy. Vieria et al (2013) and Marrey Neto (2006) show that a high maintenance cost, the difficulty in obtaining bodies and the risk that conservation materials present to the health of those who come in contact with them in anatomical laboratories constitute obstacles to the study of anatomy through traditional methods. Still, a scenario analysis based on interviews with healthcare professionals, identified that synthetic anatomical models sometimes do not have the realism desired for certain applications. It is within this context that resides the research project centered on the development of solutions for training and diagnostics in the healthcare area from prototyping processes. In order to transform the idea into a business, the project was based on the Design Thinking methodology. In order to understand the relationship of individuals with the problem, interviews were conducted based on the Value Proposition Canvas, and the conversion of the problem into a business was done using the Business Model Canvas. With the purpose of validating the proposals elaborated, three products were developed for evaluation by clients and professionals of the area. From the feedback received, it could be concluded that the proposed products and services have market adherence and represent a potential innovation in the way of teaching, practicing, planning and conducting health procedures.

Abstract:
The poetic theories of inscape and sprung rhythm developed by British poet Gerard Manley Hopkins (1844-89) have baffled critics for years. Most critics have relied upon the published poems for clues to their significance. This study advances the analysis further by revealing the genesis of the theory of inscape to be Hopkins’ undergraduate notes on the pre-Socratic philosopher Parmenides and is influenced by commentaries on Parmenides’ work “On Nature.” A study of Hopkins’ letters to fellow poets Robert Bridges and Richard Watson Dixon reveals that sprung rhythm emanates from his overarching theory of inscape; sprung rhythm is, thus, the application of inscape to the metrical patterns of poetry. After determining a working definition of both poetic theories, this study applies these terms to the manuscripts to determine to what extent Hopkins’ adhered to and developed the theories when writing two of his canonical poems: “God’s Grandeur” and “The Windhover.” It thus fits in the field of genetic criticism, a critical approach developed in France and centered at the Institut des Textes et Manuscrits Modernes (ITEM). Most analyses conducted have thus been done on French works and to prose. Deletions, additions, and substitutions, as well as the consistencies from one version to another, reveal Hopkins’ priorities as he strove to attain the desired effect. Therefore, this study endeavours to unveil the meaning of Hopkins’ poetic theories by determining their geneses and their application to two of his best known poems, “God’s Grandeur” and “The Windhover, ” through the practice of genetic analysis. It contributes to genetic criticism in applying it to works written in the English language and to poetry rather than prose. The hope is to renew interest in Hopkins as a viable poet to study and to incite further appreciation in his prowess as both poetic theorist and poet.

From 1937 on, the literature of Graciliano Ramos has a significant esthetic turn, after ten months in prison. Though almost all of his books have been created from a short story, after his release, the writer has begun to produce, organize and criticize short stories. The texts produced during that period were gathered in Insônia (Insomnia), 1947, although some of them have also been published in Dois dedos (Two Fingers), 1945, and in Histórias incompletas (Incomplete Stories), 1946, each having an esthetic proposal that would only become more consistent in his later book. Then, the structure of the short story serves as a guideline to Graciliano’s creative activity, which leads him to leave the novel and to seek a reasonable form to critically express the tensions between man and society. Furthermore, the writer organically embodies some procedures of artistic tendencies inherited from the historic vanguards, not in a conciliatory way, but through critical and differential appropriations instead. Thereby, Graciliano elaborates esthetic-narrative strategies to create Insônia, which becomes fundamental to the writing of Memórias do cárcere, considering the aspects of some chapters and the short stories called here “Noturnos” (Nocturnes). The symbolic categories of “nocturnity” and “insomnolence” also become important to develop the concept of memory in Graciliano Ramos, one of the most decisive components to build the book of the prison. Therefore, the thesis aims at proving the importance of Insônia to the creation of Memórias do cárcere, and the articulation of the living substrate with the esthetic reconfiguration of Graciliano Ramos’ literary project and his short story production

Abstract:
Never before in the history of humanity has so much content been created. According to Eric Schmidt, Google CEO, every two days now we create as much information as we did from the dawn of civilization up until 2003. Most of this information will either live entirely or partially on the digital realm, according to, in the next 8 years, more than one-third of all digital information created annually will either live in or pass through the cloud. A series of problems emerge when a persons needs to deal with all of this data like, photos, songs, videos, blog posts, emails, their virtual possessions. They are not limited by space and are difficult to curate; It is difficult to create the sense of value on virtual things; They lack uniqueness; and last, but not least; the main tools used to manage this data are still based on metaphors made popular by Microsoft MS-DOS in the 80’s: Files and Directories. In my degree project, I have explored possible alternatives for maintaining and bequeathing virtual possessions. The project was conducted in 24 weeks (51-22) using a Goal-Directed Design (GDD) process with strong focus on Design Ethnography, Prototyping and an extra bit of Philosophy.

Abstract:
Multi-instance (MI) learning is a variant of supervised machine learning, where each learning example contains a bag of instances instead of just a single feature vector. MI learning has applications in areas such as drug activity prediction, fruit disease management and image classification. This thesis investigates the case where each instance has a weight value determining the level of influence that it has on its bag's class label. This is a more general assumption than most existing approaches use, and thus is more widely applicable. The challenge is to accurately estimate these weights in order to make predictions at the bag level. An existing approach known as MILES is retroactively identified as an algorithm that uses instance weights for MI learning, and is evaluated using a variety of base learners on benchmark problems. New algorithms for learning instance weights for MI learning are also proposed and rigorously evaluated on both artificial and real-world datasets. The new algorithms are shown to achieve better root mean squared error rates than existing approaches on artificial data generated according to the algorithms' underlying assumptions. Experimental results also demonstrate that the new algorithms are competitive with existing approaches on real-world problems.
