Abstract:
The article presents a historical itinerary of culture institutionality in Brazil, pointing out its challenges and dilemmas. Institutionality comprises multiple dimensions, including administrative, managerial, financial, legislative, organizational and occupational aspects. Since the study relies on current bibliography, some dimensions were prioritized due to fragility of available information. The study proposition is that the historical method may contribute to explain advances, setbacks and dilemmas of the culture institutionality in Brazil.

Abstract:
Purpose – The purpose of this paper is to illustrate and examine the effects of ultimate ownership, institutionality and their interactions on capital structure in a unified framework, based on evidence from China. Design/methodology/approach – Using six years of panel data of Chinese non-financial listed firms between 2004 and 2009, this paper estimates with correlation analysis and multiple regression analysis. Findings – This paper finds that debt financing facilitates the ultimate owner's expropriation behavior. The separation of control rights and cash flow rights is positively related to capital structure, while cash flow rights negatively affect it. Compared with private ultimate owners, state ultimate owners have less incentive to reap the benefits of expropriation, implying that the separation of control rights and cash flow rights has a smaller effect on the capital structure of state-owned firms. The improvement of institutionality can restrain ultimate owners' expropriation behavior, and regional institutional development is negatively related to capital structure. The separation of control rights and cash flow rights has a smaller positive effect on capital structure in regions with better-developed institutionality. Originality/value – This paper incorporates ultimate ownership and institutionality into a unified analytical framework of capital structure. It not only enriches related studies on capital structure, but also helps us understand the institutional roots of irrational capital structure behaviors in China. This paper also provides further evidence on ultimate owners' expropriation of minority shareholders through debt financing.

Abstract:
The article analyzes the linguistic peculiarities of the spatial representation of the concept of power in such types of institutional discourse as economic and legal. The interrelation of space of power which is thought as a category and the various discursive practices correlated with different spheres of communication is considered. Specification of representing the category of power is demonstrated through semantic analysis of dynamic prepositional group. Within the research, new constitutive components of the given discourses, text-forming units and components of the text are revealed, new interpretations of elements of the discursive structure and semantics are given. The examined group of dynamic prepositions undergoes derivational transformations presented in a generalized model of semantic modifications.

Abstract:
This article presents a contribution to the approach when with political parties at the sub-national level. After the political parties crisis of 1989-1993 the Peruvian political system was reconfigured. Within this framework, regional and municipal elections were held (2002-2014) and showed how regional movements became hegemonic electoral actors at the subnational level. However, these elections also exhibited a high party volatility, both for regional and national parties. Thus, the present work seeks to rethink our approach to the Peruvian party system and democratic institutionality, assuming that instability is its essential characteristic and, from this, to understand democratic consolidation under this scenario.
Este artículo presenta un aporte a la manera de abordar la problemática de los partidos políticos a escala sub-nacional. Luego de la crisis partidaria de 1989 -1993, se reconfiguró el sistema político peruano. En este marco, se desarrollaron las elecciones regionales y municipales (2002-2014), que mostraron cómo los movimientos regionales se volvieron actores hegemónicos electorales en el ámbito subnacional. Sin embargo, estas elecciones también exhibieron una alta volatilidad partidaria, tanto en los partidos nacionales como en los regionales. Así, el presente trabajo busca repensar nuestro acercamiento al sistema de partidos peruanos y la institucionalidad democrática, asumiendo que la inestabilidad es su característica esencial y, a partir de ello, comprender la consolidación democrática desde este escenario.

Abstract:
This thesis takes the case file of a Sri Lankan asylum seeker found in the archives at the Federal Court of Montreal in March of 2007 and submits it to a textual analysis. In so doing it operates on three levels. First, it elaborates something of the life of this person, the trials she faced both in Sri Lanka and Canada. Second, and most significantly, it observes the effect of the Immigration and Refugee Board of Canada on the telling of her story, its particular adjudicatory techniques. It is concerned with how this particular institution 'thinks'. Third and finally, it gestures at some possible implications of this analysis in jurisprudential terms. At its most abstract this thesis argues that institutionality is a key feature of the adjudicatory project which is too frequently overlooked.
Cette thèse est centrée sur le dossier d'une réfugiée Sri Lankaise, qui a été trouvé dans les archives de la cour fédérale de Montréal en Mars 2007 et fait ici l'objet d'une analyse de texte. Trois points ont été dégagés par cette analyse. Premièrement, celle-ci décrit quelques points de la vie de cette personne et les problèmes qu'elle a rencontré au Sri Lanka et au Canada. Deuxièmement, cela décrit l'influence du Commissariat de l'immigration de du statut de réfugié du Canada sur la manière dont son histoire est narrée, ainsi que les techniques juridiques de ce commissariat. Troisièmement, ce travail envisage les implications possibles de ce cas sur la théorie du droit. Au niveau le plus abstrait, cette thèse argumente le fait que l'institutionnalisme est un trait important dans les processus juridiques et qu'il est trop souvent négligé.

COORDENAÇÃO DE APERFEIÇOAMENTO DO PESSOAL DE ENSINO SUPERIOR
O trabalho analisa a institucionalidade do mecanismo de solução de controvérsias da OMC por meio de análise empírica dos 336 casos que passaram pelo mecanismo nos seuz dez primeiros anos de funcionamento (1995-2005). Os casos são divididos em cinco categorias - (1) em desenvolvimento vs em desenvolvimento; (2) desenvolvidos vs desenvolvidos; (3) desenvolvidos vs em desenvolvimento; (4) em desenvolvimento vs desenvolvidos; (5) mistos - observando-se padrões de resolução. O objetivo é verificar se os países em desenvolvimento são capazes de se beneficiar do uso do mecanismo, colhendo os frutos da ordem liberal de comércio. O regime de comércio internacional deveria servir a países desenvolvidos e em desenvolvimento do mesmo modo, mas assimetrias políticas e econômicas podem interferir, permitindo que os mais poderosos influenciem resultados, agindo em benefício próprio. O quadro teórico é marcado pela discussão entre realismo e neoliberalismo sobre o papel das instituições - instrumento dos mais poderosos ou ferramentas coletivas que permitem ganhos mútuos para seus membros e, ainda, em que medida questões distributivas são importantes.
The work seeks to assess the institutionality of the WTO dispute settlement mechanism through an empirical analysis of the 336 cases filed in its first ten years in practice (1995-2005). The cases are broke down into five categories of disputes - (1) developing vs developing; (2) developed vs developed; (3) developed vs developing; (4) developing vs developed; (5) and mixed - as patterns of dispute resolution are brought into light. The aim is to verify if developing countries are able to benefit from the mechanism, ultimately reaping the benefits of a liberal world trade order. The international trade regime is supposed to work for developed and developing countries alike but in a world of political and economical asymmetries, issues of power may interfere, allowing actors to influence dispute outcomes in the service of private interests. The theoretical background is provided by questions arising from the debate between realism and neo- liberalism about the role of institutions - a sheer instrument for the powerful or collective tools that allow mutual gains for their members, and also, just how important are distributional issues in this scenario.

The starting point of the research project was the hypothesis that the "principle of proportionality", which is fundamental to law, is related to the "economic principle". The resulting methodological similarities were intended to enable a cross-disciplinary bridge to be built, which would allow the findings of economic analysis to be made fruitful for legal issues. This was practically tested in three study areas in order to be able to better classify the performance of the analytical tools. The foundations for interdisciplinary bridge building are found in the rational-choice paradigm. In both disciplines, this paradigm calls for an examination of the relationship between the purpose-means-relations: among the design options under consideration, the one must be selected that is expected to be as (freedom- or resource-) sparing as possible, in other words, the most "waste-free" solution to the control problem.The results of the economic analysis can thus be "translated" in such a way that, within the framework of "necessity", they support the search for control instruments that are equivalent to the objective but less disruptive. supports. The core of the positive economic analysis is the motivational situation of those actors whose behavior is to be influenced by a changed legal framework. In this context, the classical behavioral model of economics proved to be too limited. It therefore had to be developed further in line with the findings of research in institutional economics into homo oeconomicus institutionalis. This behavioral model takes into account not only the consequentialist, strictly situational utility orientation of the model person, but also other factors influencing behavior, including above all those that are institutionally mediated. If one takes the motivational situation of the actors as the starting point for policy-advising design recommendations, it becomes apparent that an understanding of governance dominated by imperative behavioral specifications leads to less favorable results, both in terms of the degree to which goals are achieved and in terms of the freedom-impairing effects, than a mixed-instrument approach oriented toward the model of "responsive regulation." According to this model, the law can no longer simply assume that those subject to the law will "obediently" execute the legal commands. It must ask itself what other factors determine behavior and under what boundary conditions changes can be expected in the direction of the desired behavior. For this reason, too, it must engage with the cognitive program of the behavioral sciences. This linkage opens up new perspectives for interdisciplinary research on the consequences of laws.

After 390 years of Spanish colonialism, Puerto Rico was ceded by Spain to the United States, as a result of the Spanish-American War and the Treaty of Paris. At the dawn of the 20th century, the situation on the Island was one of extreme poverty, high unemployment, and widespread illiteracy. Federal programs alleviated the situation on the Island but began to institutionalize a major problem: the evil of passively waiting for economic aid from abroad, instead of seeking to solve the problems by its own initiative.

The Population Council’s Frontiers in Reproductive Health Program is a cooperative agreement with USAID to improve family planning and reproductive health service delivery through operations research (OR). Frontiers builds on more than 20 years of research to improve family planning service delivery programs. A major goal of Frontiers is to transfer skills in OR so that public and private agencies in developing countries can conduct OR and apply research findings to reproductive health programs and policies. OR addresses problems in operational effectiveness, access, quality, and efficiency by investigating facets of programs that managers can control and change. As concluded in this overview report, Frontiers seeks to institutionalize capacity building by increasing the number of service delivery organizations that use OR and increasing the number of research organizations capable of conducting and teaching OR. Investment in capacity building will ensure that OR will make a continuing, significant contribution to reproductive health and family planning programs and policies.

Whereas at the end of the 20th century there were still high expectations associated with the use of new media in terms of a democratisation of social discourse and new potential for citizens to participate in political decision-making, disillusionment is now spreading. Even today, the internet is often seen only as a technical tool for the transmission of information and communication, which serves as a structural supplement to "real" discourse and decision-making processes. In fact, however, the use of new media can open up additional, previously non-existent possibilities for well-founded and substantial citizen participation, especially at regional and supra-regional level. According to the results of this study, the informal, mediative procedures for conflict resolution in the context of high-risk planning decisions, which are now also increasingly used at the regional level, have two main problem areas. Firstly, in the conception and design chosen so far, they do not offer citizens direct access to the procedure. Citizens are given almost no opportunities to exert substantial influence on the content and procedure of the process, or on the solutions found in the process. So far, this has not been remedied by the use of new media. On the other hand, it is becoming apparent that the results negotiated in the procedure are not, or only inadequately, reflected in the subsequent sovereign decision. This means that not only valuable resources for identifying the problem situation and for integrative problem-solving remain unused, but it is also not possible to realise the effects anticipated with the participation procedures within the framework of context or reflexive self-management. With the aim of advancing the development of institutionally oriented approaches at the practice level, this study discusses potential solutions at the procedural level. This takes into account legal implications as well as the action logics, motives and intentions of the actors involved and aims to improve e-government structures. It becomes evident that opening up informal participation procedures for citizen participation at the regional level can only be realised through the (targeted) use of new media. However, this requires a fundamentally new approach not only in the participation procedures carried out but also, for example, in the conception of information or communication offerings. Opportunities for improving the use of the results obtained from the informal procedures in the (sovereign) decision-making process as well as the development of potentials in the sense of stronger self-control of social subsystems are identified in a stronger interlinking of informal and sovereign procedures. The prerequisite for this is not only the establishment of suitable structures, but above all the willingness of decision-makers to allow citizens to participate in decision-making, as well as the granting of participation opportunities and rights that go beyond those previously granted in sovereign procedures.

The Population Council has supported a series of studies to improve the quality of postabortion care (PAC) in Egypt. A 1994 pilot study in two Egyptian hospitals showed that upgrading PAC and training physicians in manual vacuum aspiration (MVA), infection control, and counseling led to significant improvements in the care of postabortion patients. The 1997 study, conducted by the Egyptian Fertility Care Society with support from the Population Council, sought to institutionalize improved postabortion medical care and counseling procedures in ten hospitals. Five senior physicians from each hospital attended a five-day training course in MVA, infection control, and family planning (FP) counseling. The physicians then supervised four months of on-the-job training of doctors and nurses at the ten hospitals. A case management protocol, including emergency medical treatment, pain control, and FP counseling, was also introduced. As reported in this brief, training providers and introducing a case management protocol led to improved PAC at ten government and teaching hospitals in Egypt.

The recently approved dissemination strategy of the Population Council's ANE OR/TA Project aims to improve the communication process for diffusing study results, enhance their utilization, and institutionalize the operations research communications methods in each of the ANE OR/TA countries. A communications needs assessment was conducted to re-examine the target audiences, define the type of messages each responds to best, identify the most appropriate mix of media for transmitting those messages, and consolidate linkages with other communications professionals working within related fields. This exercise was conducted in Egypt between January and March 1996. The methodology was based on conducting in-depth interviews with key informants from ANE OR/TA Project audiences, organizing a roundtable discussion to review reactions to past communications activities in Egypt, and exploring ways to improve the content, presentation, and production of future communications products. Findings revealed a broad sense of satisfaction with the ANE OR/TA dissemination activities among all of the project's constituencies in Egypt. This needs assessment report will strengthen the basis for implementing forthcoming dissemination activities.
