Abstract:
Deciding whether a contract of sale is an international transaction or not and according to which criteria is an inescapable task, not only for private international law (PIL) but also for the instruments aiming to create uniform substantive contract law. The paper reviews the different solutions from the 1930s to the development of the last decades, from the first drafts of the International Institute for the Unification of Private Law (‘UNIDROIT’) on international sales to the Draft Common European Sales Law. Of course, the Vienna Sales Convention (‘CISG’), as a successful international instrument, is also given special emphasis in this comparative and historical analysis. Although during the past century of unification, the definition of international character became clearer and simpler, much however depends on how broadly or narrowly legislators wish to define the scope of the uniform substantive law to facilitate the acceptance and ratification of an international convention. A further specific question is whether uniform law should apply to all international sales (universal application) or only to international transactions linked to Contracting States. The paper also analyses the different positions on this issue.Décider si un contrat de vente est une transaction internationale ou non et selon quels critères est une tâche incontournable, non seulement pour le droit international privé, mais aussi pour les instruments visant à créer un droit materiel uniforme des contrats. L’article passe en revue les différentes solutions depuis les années 1930 jusqu’à l’évolution des dernières décennies, des premiers projets d’UNIDROIT sur les ventes internationales au projet de droit commun européen de la vente. Bien entendu, la Convention de Vienne sur les ventes, en tant qu’instrument international couronné de succès, fait également l’objet d’une attention particulière dans le cadre de cette analyse comparative et historique. Bien qu’au cours du dernier siècle d’unification, la définition du caractère international soit devenue plus Claire et plus simple, beaucoup dépend toutefois de la manière dont les législateurs souhaitent définir le champ d’application du droit matériel uniforme pour faciliter l’acceptation et la ratification d’une convention internationale. Une autre question spécifique est de savoir si le droit uniforme devrait s’appliquer à toutes les ventes internationales (application universelle) ou seulement aux transactions internationals liées aux États contractants. Le document analyse également les différentes positions sur cette question.Die Entscheidung, ob ein Kaufvertrag ein internationals Geschäft ist oder nicht und nach welchen Kriterien, ist eine unausweichliche Aufgabe, nicht nur für das internationale Privatrecht, sondern auch für die Instrumente, die auf die Schaffung eines einheitlichen materiellen Vertragsrechts abzielen. Der Beitrag gibt einen Überblick über die verschiedenen Lösungen von den 1930er Jahren bis zu den Entwicklungen der letzten Jahrzehnte, von den ersten Entwürfen des UNIDROIT zum internationalen Kaufrecht bis zum Entwurf des Gemeinsamen Europäischen Kaufrechts. Natürlich wird auch das Wiener Kaufrechtsüberienkommen als erfolgreiches internationals Instrument in dieser vergleichenden und historischen Analyse besonders berücksichtigt. Obwohl die Definition des internationalen Charakters im Laufe des letzten Jahrhunderts der Vereinheitlichung klarer und einfacher geworden ist, hängt doch vieles davon ab, wie weit oder eng der Gesetzgeber den Anwendungsbereich des einheitlichen materiellen Rechts definieren will, um die Annahme und Ratifizierung eines internationalen Übereinkommens zu erleichtern. Eine weitere spezifische Frage ist, ob das einheitliche Recht für alle internationalen Verkäufe (universelle Anwendung) oder nur für internationale Transaktionen mit Verbindung zu Vertragsstaaten gelten soll. In dem Beitrag warden auch die verschiedenen Standpunkte zu dieser Frage analysiert.

Purpose – This paper aims at retracing changing attitudes toward Islamic financial products in international markets over the past three decades, thereby providing an account of their “unexpected” expansion outside of the Muslim world. Design/methodology/approach – This conceptual paper builds on an archival research – 969 news articles published in the UK from 1985 to 2014. Although emphasis is put on the decade of fast changing attitudes toward Islamic finance (IF) in global markets (2001-2011), the years prior to (1985-2000) and following (2012-2014) the target period are also investigated. Findings – Starting as an obscure set of practices often associated with religious fundamentalism before the mid-1990s, IF had become a “mainstream” alternative by the turn of the century. A second interpretive break then emerged with the advent of the subprime crisis in 2007-2008, which increasingly conferred to IF an ethical component. Interestingly, both narratives still exist concurrently in the media, even in post-crisis discussions. Social implications – The discussion in this paper allows us to explain the findings of the most recent surveys on this topic, which put forward the complex, and sometimes even contradictory, understandings of what IF stands for in global markets. Originality/value – This is the first archival research on the topic of IF in international markets. Besides bringing to the discussion an interesting historical perspective, it also draws attention to the growing importance of Islam-based financial products in traditionally secular markets.

AbstractThe author has taught international business negotiation in a wide variety of university courses and executive training programs throughout the world during the last three decades. He has taught international business negotiation both as an end in itself and as a means to teach law, an approach that he calls “the law in the shadow of negotiation.” This article examines three fundamental dimensions of that experience: pedagogical goals, course content and teaching methods. His principal pedagogical goals in international business negotiation courses have been three-old: better negotiation analysis, improved negotiation skills, and increased international business knowledge. Depending on the time available, the content of his international business negotiation courses covers three broad areas: the fundamentals of conflict analysis and the negotiation process, basic themes in international negotiation, such as the importance of negotiation, preparation and the management of internal negotiations, and the special obstacles faced in international business negotiation, such as cultural differences among the parties, the actual or potential role of governments in the negotiation process, and challenges to the stability of negotiated agreements. The author’s teaching relies heavily on experiential methods and materials, such as exercises, simulations and cases, although more didactic methods also have a role.

The last 40 years has yielded a vast body of literature on street children. In this article, we reflect on the knowledge accumulated by several generations of scholars and across two bodies of research. The article’s aim is twofold: 1) To conduct a meta-narrative review, mapping out the contours of Brazilian and Anglophone literature on street children since the 1980s until today. 2) To bridge these two bodies of literature through reflections on similarities and differences. In so doing, we identify some overall tendencies in which street children have been described, debated, and theorized and bridge the two bodies of literature that often remain separated.

Something has got to give. The Supreme Court has retreated from more than seven decades of personal jurisdiction analysis. After Goodyear Dunlop Tires Operations, S.A. v. Brown, the Court’s jurisprudence of general jurisdiction looked like an M.C. Escher print. If read fast enough, it appeared to make sense. Closer examination reveals an intellectual structure as impossible as anything that Escher could have drawn. Then the Court made it worse in Daimler AG v. Bauman. The Court seemingly has begun a project to rein in what it now regards as states’ unreasonable (and therefore unconstitutional) assertions of general jurisdiction over corporations. It has implicitly backed away from some of International Shoe’s minimum-contacts analysis that dominated the law of constitutional personal jurisdiction since 1945. Goodyear and Daimler create a far more restrictive concept of corporate presence. If the Court purports to retain International Shoe’s principle that jurisdictional exercises be fair and reasonable, it has implicitly but unmistakably undermined a jurisdictional basis that long antedates International Shoe and that the Court unanimously reaffirmed only two decades ago in Burnham v. Superior Court—individuals’ receipt of service of process while in the forum.

Many economists are accustomed to thinking about Federal Reserve policy in terms of the institution's “dual mandate,” which refers to price stability and high employment, and in which the exchange rate and other international variables matter only insofar as they influence inflation and the output gap—which is to say, not very much. In fact, this conventional view is heavily shaped by the distinctive and peculiar circumstances of the last three decades, when the influence of international considerations on Fed policy has been limited. In fact, the Federal Reserve paid significant attention to international considerations in its first two decades, followed by relative inattention to such factors in the two-plus decades that followed, then back to renewed attention to international aspects of monetary policy in the 1960s, before the recent period of benign neglect of the international dimension. I argue that in the next few decades, international aspects are likely to play a larger role in Federal Reserve policy making than at present.

PurposeThe research aims to assess the achievements and challenges of international branch campuses (IBCs) to date and to consider how IBC development may progress in the future.Design/methodology/approachThe article presents a review of the scholarly and grey literatures on IBCs. The commentary and discussion is structured around the objectives, perspectives and experiences of three key stakeholder groups, namely the institutions that own IBCs, students and host countries.FindingsSome IBCs have failed to achieve their student recruitment and financial targets, while others have been successful, often expanding and moving into new, larger, purpose-built campuses. In the last few years, several countries have announced their intention to become a transnational education hub, or at least to allow the establishment of IBCs. It may be reasonable to assume that when there is demand for a product, supply will eventually follow. IBCs will survive and prosper as long as they provide benefits to each of their main stakeholder groups (i.e. students, institutions and governments), and as long as the local demand for higher education places exceeds the total supply.Originality/valueThe article provides a comprehensive and up-to-date review of IBC developments and research during the period 2000–2020. The findings and conclusions will be of interest to both researchers and practitioners.

Abstract:
Temperature and precipitation largely determine the weather and climatic conditions at a place. These determinants are subject to a great change following the prevailing unsustainable developmental practices. Therefore, the present study analyses the temperature and precipitations conditions in a hilly terrain of one of the fastest developing regions in the middle Himalayan Mountains. The results reveal an increasing trend of 0.23ºC per decade and 0.64º per decade respectively in Tmax and Tmin between 1973 and 2022 in Ramgarh block of Nainital district, Uttarakhand, India. However, an overall increasing trend of decadal rainfall has been observed over the past five decades in the region. The study area recorded 131 days of high-intensity rainfall over the past 5 decades. These conditions have given rise to major threats no to subsistence farming systems and food and livelihood security in the densely populated rain-fed middle Himalayan Mountains.

Mathematics educators have been publishing their work in international research journals for nearly 5 decades. How has the field developed over this period? We analyzed the full text of all articles published in Educational Studies in Mathematics and the Journal for Research in Mathematics Education since their foundation. Using Lakatos's (1978) notion of a research programme, we focus on the field's changing theoretical orientations and pay particular attention to the relative prominence of the experimental psychology, constructivist, and sociocultural programmes. We quantitatively assess the extent of the “social turn,” observe that the field is currently experiencing a period of theoretical diversity, and identify and discuss the “experimental cliff,” a period during which experimental investigations migrated away from mathematics education journals.

The number of single person households has dramatically increased in Taiwan in the past several decades as it has elsewhere in the world, but this phenomenon has been largely neglected in the literature. This research explores the factors that affect the formation of single person households and their housing decisions. Taiwan¡¦s population census data for 1980, 1990 and 2000 are used. Some interesting trends can be found. First of all, people who are married or cohabiting have exhibited an increasing tendency to live alone census by census. This shows the increasing need in a modern society for the husband and wife to live separately due to employment or other reasons. Secondly, unmarried and widowed elderly persons have had an increasing probability of living alone over the decades. Thirdly, the number of female single person households has been increasing rapidly, and there is a higher probability that they are homeowners and also occupying a larger living space than their male counterparts. To sum up, the results of this study show that the demand for housing among single person households will continue to increase as their numbers increase. Their demand for homeownership and living space are also increasing.

The article focuses on analyzing Vietnam's international cultural integration guidelines and policies, clarifying the implementation process and achievements in different aspects. Since then, the limitations have been pointed out, and some solutions have been proposed to further promote the international cultural integration of Vietnam in the context of deepening cooperation.

Design/methodology/approach This paper traces three decades of temporary entry provisions in international trade agreements signed by the USA and Canada, beginning with their bilateral Canada–US Free Trade Agreement and culminating in the Trans-Pacific Partnership (TPP). Findings The paper finds that while many countries have continued to liberalize their temporary entry commitments in various trade agreements, the USA has reversed course in the previous decade, hampering international progress. Meanwhile, Canada has pursued ever greater labour mobility provisions with most of its trading partners. Practical implications The unique roles played by the USA, Canada and other trading partners in advancing a coherent international labour mobility agenda are considered. To continue to advance labour mobility in trade agreements moving forward, policy alternatives to the “all” or “nothing” approaches pursued by Canada and the USA are suggested. Originality/value To the author’s knowledge, this paper is the first to formally evaluate labour mobility in the TPP and the only paper to outline the evolution of temporary entry in the US vs Canadian trade agreements over three decades.

International practicum, or international field placements, create opportunities for social work students to address global social challenges in an international setting and prepare for social work practice. The landscape of international practica in social work has evolved and shifted over the last two decades. This article reports on the findings of a literature review that was conducted to understand how international practicum has changed over time. The study established search criteria that led to the inclusion of 70 publications, 16 in the first decade (2000 to 2010) and 54 in the second decade (2011 to 2020) utilizing the web of Science and Social Work Abstracts, as well as specific searches conducted on the University of Calgary Library Database, EBSCO host, ProQuest, and Google Scholar. The results of the literature review show that there were fewer publications in the first decade and the emphasis was on understanding international practicum and field models. During the second decade, the published literature on international practicum tripled, focusing predominantly on developing new field education models, engaging in critical reflection and theory, and how to create successful field placements for students through preparation, teaching, and discussion. International practicum opportunities are critical to fostering transformative learning in social work students, and post-secondary institutions will need to re-establish international field education programs after the COVID-19 pandemic.

The number of international students has drastically increased over a decade in Korea. And a psychological demand to make them successfully adjust their college life in Korea has also increased. Accordingly, it is necessary to explore how international student-focused counseling research has unfolded in Korea. To this end, this study provides research trend in Korea through a content analysis of 79 theses and articles published over recent two decades (1996-2016). Over 140 research contents are classified into 10 categories, including cultural adjustment, psychological health, and career and vocation as the main three categories. Frequency of conceptions or terms in each category, and relationship between those conceptions are analyzed. Based on the content analysis, a discourse map is finally drawn. Also, future research agendas are suggested.

Our books combine text with drawings and photographs made from our travels to places like Venice, Rome, New York, Copenhagen, Vienna, and London. We have also created pieces comparing our two countries, languages, and backgrounds. Our paper will recount a variety of themes, challenges, and methods of production that we have embraced while working together for two decades as ETC Press.

In the decades following the Korean War (1950–1953), support from Korea’s Jogye Order, the largest of Korea’s Buddhist sects, was instrumental for establishing Korean Buddhism overseas. However, in recent decades, Korean Buddhism has been facing a growing domestic crisis and the number of the Jogye Order’s annual monastic recruits has been declining steadily. This domestic membership crisis has affected Korean Buddhism abroad, as the order has lost over half its foreign temples over the last decade. Nevertheless, despite these downward trends, the nine international branches of the Hanmaum Seon Center, founded by the Jogye Order’s Seon Master Daehaeng, have remained strong. Given the successful example of the Hanmaum Seon Center’s international branches, the Jogye Order’s future efforts abroad might find success by focusing on lay-oriented modes of practice, while balancing their involvement both with local Korean émigré communities and with outreach to local non-Koreans.

Victor Papilian was born an artist, during high school he studied music in order to become a violinist in two professional orchestras in Bucharest. Later on he enrolled in the school of medicine, being immediately attracted by anatomy. After graduating, with a briliant dissertation, he became a member of the faculty and continued to teach in his preferred field. His masters, Gh. Marinescu and Victor Babes, proposed him for the position of professor at the newly established Faculty of Medicine of Cluj.Here he reorganized the department radically, created an anatomy museum and edited the first dissection handbook and the first Romanian anatomy (descriptive and topographic) treatise, both books received with great appreciation. He received the Romanian Academy Prize. His knowledge and skills gained him a well deserved reputation and he created a prestigious school of anatomy. He published over 250 scientific papers in national and international journals, ranging from morphology to functional, pathological and anthropological topics.He founded the Society of Anthropology, with its own newsletter; he was elected as a member of the French Society of Anatomy. In parallel he had a rich artistic and cultural activity as writer and playwright: he was president of the Transylvanian Writers’ Society, editor of a literary review, director of the Cluj theater and opera, leader of a book club and founder of a symphony orchestra.

Last December, in the university town of St Andrews, the British International Studies Association (BISA) celebrated its 30th anniversary conference. As it was a rather special occasion, BISA members took this opportunity to indulge in some reminiscences about its founding, some studies of the work that had been carried out since the founding of the Association and reflect upon the relationship of British scholarship in international studies to scholarship elsewhere. It has been customary for there to be, at the BISA conference, a plenary address given by a prominent British or overseas scholar or (on occasion) a practitioner. It has also long been a tradition that The Review of International Studies, the Journal of the Association produced in association with Cambridge University Press, publishes the plenary of the conferences. For the thirtieth anniversary, however, BISA commissioned three plenary lectures. In this edition of the Journal, therefore, we devote a section to the lectures that were given by Professors Chris Brown, Lawrence Freedman and Geoff Roberts. We will come on to the content of these lectures in a moment, but thought that, by way of introduction, it would be timely to reflect upon the circumstances in which BISA was born, and say something about the changes in the environment of British International Studies from the mid 1970s until today.

I am skeptical of our ability to predict, or even forecast, the future—of human rights or any other important social practice. Nonetheless, an understanding of the paths that have brought us to where we are today can facilitate thinking about the future. Thus, I approach the topic by examining the reshaping of international ideas and practices of state sovereignty and human rights since the end of World War II. I argue that in the initial decades after the war, international society constructed an absolutist conception of exclusive territorial jurisdiction that was fundamentally antagonistic to international human rights. At the same time, though, human rights were for the first time included among the fundamental norms of international society. And over the past two decades, dominant understandings of sovereignty have become less absolutist and more human rights–friendly, a trend that I suggest is likely to continue to develop, modestly, in the coming years.

In recent years, the world’s largest economies and traders – the United States, China, and Japan – have chosen to use measures affecting international trade as a means to achieve political objectives in contravention of the rules of international economic law and the practices of international trade established over several decades. Since the end of World War II, the world economy and international trade have rapidly expanded and prospered by achieving a degree of separation between international trade and political struggles under the rule-based international trading system, the General Agreement on Tariffs and Trade and its successor, the World Trade Organization. Thus, the recent misuses of trade measures by the world’s largest traders are alarming, because they undermine the stability of the world trading system, which has been maintained for the past several decades. AbstractThis paper explores the structural changes in the international organization of automotive production since the early 1990s. We apply descriptive network measures to international trade data for the period 1993–2013 for three automotive component groups with different technological intensity, with the aim of understanding (1) how the automotive international trade network has changed since the beginning of the 1990s; (2) whether regionalization has increased over time; (3) how the role that rising powers play within and between regions interacts with regionalization patterns. Our findings suggest that the structure of trade has changed significantly over the last two decades in all components. The network for electric and electrical parts and engines has evolved to become more hierarchical, with a cohesive core tied to hangers-on in the periphery, while the opposite has happened for rubber and metal. Regionalization patterns also show important differences across components. Finally, we have found an apparent association between the strengthening of regionalization patterns and the role played by traditional players and rising powers.

The International Drinking Water Supply and Sanitation Decade (1981-1990), has called for a whole new approach to water sector development. The spotlight is on communities - community participation, community management, community financing - and away from national and local government structures. In this paper it is argued that the Decade rhetoric has not created the capacity and infrastructural networks to achieve and sustain its objective of universal water and sanitation coverage. The result is a contradiction between strategy and structures. It is concluded that community participation and community management may be conducive to achieving the Decades target; but are not sustainable alternatives to strong local and national government institutions in the water sector.
