Abstract:
Policymakers and international relations scholars concur that prestige is critical to world politics because states having prestige enjoy greater authority. An examination of how policymakers assess their and other states' prestige, however, reveals that this traditional view of prestige is wrong, for two reasons. First, policymakers do not analyze their own states' prestige, because they feel they already know it. They use their feelings of pride and shame as evidence of their state's prestige. Second, political and psychological incentives encourage policymakers to explain another state's behavior in ways that make it unlikely that states gain prestige. Policymakers systematically discount the prestige of other states; a belief that their state has earned the respect and admiration of others is therefore illusory. Consequently, the justification for costly prestige policies collapses. In other words, states should not chase what they cannot catch. Evidence from the South African War supports this conclusion.

“The bearer was convicted of a sex offense against a minor, and is a covered sex offender pursuant to 22 United States Code Section 212b(c)(l).” International Megan’s Law (IML), passed in 2016, prohibits the State Department from issuing passports to individuals convicted of a sex offense against a minor unless those passports are branded with this phrase. The federal government's decision to brand its citizens’ passports with this stigmatizing message is novel and jarring, but the sole federal district court to consider a constitutional challenge to the passport identifier dismissed the plaintiffs’ First Amendment claim, deeming the provision government speech. This Note argues that this passport identifier is more appropriately analyzed as a form of compelled speech, triggering strict scrutiny review that the IML’s passport identifier would not survive.

A growing literature in international relations concludes that democratic states pursue distinctive foreign policies. Specifically, democracies do not engage each other in war and only rarely engage each other in serious disputes short of war. Scholars have offered three basic explanations to support these findings. Each of the three invokes a different explanatory variable: norms, checks and balances, and trade. None of the three, however, provides a convincing explanation of the peace that is said to prevail between democratic polities: the distinction between norms and interests is unclear; substitutes for checks and balances exists in nondemocracies; and trade can deter conflict only under restrictive conditions.

Are apologies and other acts of contrition necessary to reduce threat and build trust between former adversaries? This has become an accepted conventional wisdom, despite the fact that the effects of contrition have not yet been tested. This dissertation outlines and tests an "apology theory" of international politics, thus contributing to debates within international relations theory about the role of intentions in threat perception between states, as well as to policy debates about the role of contrition in peace building. The apology theory posits that a state's "policies of remembrance" affect perception of its intentions in the eyes of other states, and thus influence the degree to which others see it as threatening. According to the theory, apologies foster perception of benign intentions and thus reduce threat perception. I test the apology theory in two empirical case studies: South Korean threat perception of Japan and French threat perception of Germany, both since World War II. To determine whether my findings appear valid in other cases, I conduct three "mini-cases": Chinese and Australian perceptions of Japan, and British perceptions of Germany. The study has three principal findings. First, the Japan case shows that denial of past violence (unapologetic remembrance) is pernicious for bilateral relations; it fuels distrust and increases threat perception between states. Acknowledgement of past violence is vital for former adversaries to establish productive and friendly relations. Second, the European case shows that moving beyond acknowledgement of past violence--undertaking extensive policies of contrition--yields little benefit. When the French discuss their perceptions of
(cont.) Germany, they emphasize factors other than remembrance. Third, moving beyond a basic acknowledgement of past violence to policies of contrition may actually be harmful for relations. The case of Japan suggests that policies of contrition can trigger domestic backlash, which in turn alarms observers. The potential backlash effect from contrition is an important finding for academic and activist literatures on post-conflict peace-building, which often recommend policies of contrition, but have neglected to consider its potential negative effects.

Thesis is focusing on the analysis of the situation in Syria in the period since 2011 till present times. First part will present main theoretical thoughts on the international security such as Realist school, Liberalist school, Human and Collective security concepts and the most modern theoretical school of security- Copenhagen school. That was done in case to have a clear notion of the international security development and to chose the one theory which will reflect the best the situation in Syria. In the practical part I analyzing the actions and inter actions of the main international security actors, such as United Nations plus important actors in the region of the Middle East -- Arab League, and of course Syrian government and opposition. Also I will try to apply Copenhagen school of Security on the Syrian situation and to find out if that theory is good or not for that kind of analysis. After browsing actions taken by actors and opposition in the conclusion I found out that nowadays international security system cannot be called very successful and that Copenhagen school of Security its good explanatory theory but it pretty useless in case of conflict resolution.

The contemporary world often sees a contradiction between the actions of states to advocate their own interests and the interests of the international community in combating the most dangerous crimes. In the field of international criminal law, the problem of imbalance between interests of particular states (‘private’ interests), and the interests of the international community in general ‘public’ interests) is especially evident. This imbalance indirectly manifests in the occurrence of contentious situations during the criminalisation of international crimes in national law. This article covers the problem of the imbalance of interests, from its general philosophical underpinnings to specific manifestations in criminal law. This objective mediates the construction of the article according to the principle ‘from the general to the particular’: from the general problem of the relation of the interests of the state and the global community through the prism of international criminal law to the specific problems of criminalisation in domestic law. The article was prepared with the use of historical, comparative-legal, and formal-juridical methods. The ain provisions of the article are illustrated with examples from international and national law, supported by quotations from philosophers and contemporary scholars of the philosophy of international law. The author begins by exploring the development of ideas of sovereignty as a private interest of the state. Upon establishing that the evolution of sovereignty ideas has not led to its uniform understanding and consistency with the interests of international law, the author delves into the problems of international criminal law. The author adresses the problems occurring during the criminalisation of international crimes in the framework of domestic law. The author makes a conclusion regarding the possible ways of national law refinement for strengthening the interaction of states in the field of international criminal law.

The International Maritime Organization (IMO) plays a key role in the development and promotion of international standards for shipping ensuring their effective implementation through the member states. The ability to measure the performance of IMO member states in terms of implementation and enforcement of international legislation in maritime safety is critical. Here we discuss the benefits of the IMO Audit Scheme towards capacity-building and review the performance of flag states. An analysis and assessment of recent audit summary results is presented, demonstrating the contribution of the Audit Scheme towards better performance of member states. Finally, we will discuss areas for research, where additional actions/interventions could lead to future improvements in safeguarding global maritime safety.

China has been a rising power in East Asia for decades. The end of the Cold War and the increasing effects of globalization brought the country in the forefront of attention on the international scene. The economic importance of the East Asian giant cannot be denied. Its economic power has been translating into a powerful tool to upset the balance of power tremendously. China has been expanding its influence around the globe and challenging the status quo more than ever before. The United States, the strongest state in the current international system has to pay attention to the increasingly assertive China. The USA uses several strategies to mitigate the threat China poses to the world order that the USA built. The structural forces of the international system, the Covid-19 pandemic, and American domestic politics make the threat of rising China more challenging. In my paper, I try to identify the balancing strategies of the United States in the 21st century against China. In my opinion, the application of neoclassical realist school of international relations can foreshadow the possible paths of the conflict. The United States of America has to use a wide variety of balancing strategies in order to counter the threat. A heavier reliance on allies is inevitable for the United States if it wants to contain the increasing influence of China around the globe. The USA should increase its hard-, soft-, and asymmetrical balancing methods mixed with smart power strategies to remain on the top of the international system. In my opinion, the showdown between China and the United States of America will be inevitable in the medium term. If the USA uses its position right, the peaceful containment of Chinese ambitions is possible. The successes of the above-mentioned strategies will decide how the competition of these two countries shape the international relations in the coming decades.
