Abstract:
Despite considerable progress in research and practice in the constructive transformation of intractable conflicts beginning in the 1970s, many terribly destructive conflicts have recently erupted. New circumstances have emerged that have resulted in regressions. The contributions in this book examine many of the new challenges and obstacles to the transformation of intractable conflicts. It also offers an array of new and promising opportunities for constructive transformations. The book brings together analyses of U.S.-based conflicts with those from many regions of the world. International, intra-state, and local conflicts are explored, along with those that have been violent and non-violent. The diversity in disciplines among the authors provides a wide range of theoretical approaches to explaining how a variety of intractable conflicts can be transformed. Case studies of local, national, and transnational conflicts serve to illustrate this new landscape. These analyses are complemented by conceptual discussions relating to new conflict systems, actors, dynamics and strategies. Policy implications of findings are also presented.

Abstract:
This book examines and analyses the concept, the process, and the consequences of conflict internationalization from the perspective of international law. In a world defined by the twin forces of globalization and fragmentation, very few armed conflicts remain isolated from foreign involvement and confined to the territory of one state. Instead, many begin as internal conflicts that gradually acquire international characteristics of varying degree and nature. This holds true for nearly all major conflicts that have shaped the post-Cold War era: ex-Yugoslavia, Rwanda, Afghanistan, Iraq, Libya, Ukraine, Syria, Yemen, and so on. Accordingly, this book searches for the tipping points that convert non-international armed conflicts into international armed conflicts. On that basis, it argues for a specific conceptualization of ‘internationalized armed conflict’ in international law, understood to comprise prima facie non-international armed conflicts, whose legal nature has transformed, thus triggering the applicability of the law of international armed conflict to them. The book then puts forward a comprehensive catalogue of modalities of the process of internationalization that includes outside intervention, state dissolution, and recognition of belligerency. Turning to the consequences of internationalization, the book highlights that the intra-state origin of internationalized conflicts provides for an uneasy match with many of the precepts of the law of international armed conflict, which has historically evolved as a regulatory framework for inter-state wars. Of those, the regulation of combatancy and the law of belligerent occupation are where the principal legal questions lie and which are examined in depth in this book.

Abstract:
The spread of workfare to Israel and elsewhere in the world is typically attributed to the power of a globalized neoliberal orthodoxy. This chapter demonstrates how, on the contrary, the introduction of new employment and social policies in Israel bearing the Wisconsin moniker was an attempt to resolve intra-state conflict regarding the goals and instruments of state intervention in the labor market. These conflicts were resolved through by importing new policy ideas. Via translation, it was possible to assemble a change coalition and advance domestic institutional change. Nevertheless, due to the persistence of intra-state conflicts over the goals and instruments of social and labor policies, workfare was implemented alongside existing institutions to create a new institutional layer. Layering was instrumental in overcoming opposition to the program, but also made it vulnerable to politicization. This politicization brought about the interruption of the program five years after its inception.

We know that since the end of the Cold War, conflicts in non-Western countries have been frequent, frequently violent, largely intra-state, and protracted. But what do we know about conflict management and resolution strategies in these societies? Have the dominant Western approaches been transplantable, suitable, effective, durable, and sustainable? Would conflicts in non-Western societies be better handled by the adaptation and adoption of customary, traditional, or localized mechanisms of mitigation? These and similar questions have engaged the attention of scholars and policy-makers. Indigenous Conflict Management Strategies: Global Perspectives is offered as a global compendium on indigenous conflict management strategies. It presents diverse perspectives on the subject. Fully aware of the tendency in the literature to over-generalize, over-romanticize, and over-criticize the localized and customary mechanisms, the book takes a slightly different approach. It presents a variety of traditional conflict management approaches as well as several cases of the successful integration of the indigenous and Western strategies in the contemporary period. The main features, strengths, challenges, and weaknesses of a multitude of indigenous systems are also presented.
