Islomiy moliya asosan musulmon dunyosida butun o‘rta asrlarda qo‘llanilib, kreditning rivojlanishi bilan savdo va tadbirkorlik faoliyatini kuchaytirdi. Ispaniya va O‘rta er dengizi va Boltiqbo‘yi davlatlarida islom savdogarlari savdo faoliyati uchun ajralmas vositachilarga aylandilar. Darhaqiqat, islom moliyasining ko‘plab tushunchalari, texnikasi va vositalari keyinchalik Yevropa moliyachilari va tadbirkorlari tomonidan qabul qilingan. Aksincha, “Islom moliya tizimi” atamasi nisbatan yangi boʻlib, faqat 1980-yillarning oʻrtalarida paydo boʻlgan. Aslida, ilgari Islom tamoyillariga mos keladigan tijorat yoki tijorat faoliyatiga oid barcha havolalar “foizsiz” yoki “islomiy” bank ishi ostida qilingan. Maqolada islom banklarining moliyaviy vositachi sifatidagi roli va moliyaviy vositachilikning jamiyat uchun ahamiyati ta’kidlangan. Islom banklarining savdo, sanoat va qishloq xo‘jaligiga to‘g‘ridan-to‘g‘ri kirishi foydali emas, chunki bu moliyaviy vositachilik rolini boshqalarga qoldirishni anglatadi. Islomiy bank faoliyatining asosiy tamoyili ribo yoki foizning ta’qiqlanishi bo‘lib, bu islom olamidan tashqarida kamdan-kam hollarda qo‘llanilishi mumkinligi e’tirof etilgan, ammo uning ko‘plab asosiy tamoyillari ongli yoki ongsiz ravishda qabul qilingan. Bu tamoyillarning aksariyati oddiy axloq va sog‘lom fikrga asoslangan bo‘lib, ko‘plab dinlar, jumladan, islom dinining asosini tashkil etgan. Ayni paytda 300 dan ortiq islom banklari va boshqa moliya institutlari 300 milliard dollarlik mablag‘larni boshqarmoqda, ularning omonatlari 120 milliard dollardan oshadi va 48 mamlakatda faoliyat ko‘rsatmoqda. Qiziqishning oldini olish uchun Islom banklari o‘z resurslarini jalb qilish va safarbar qilishda foydani taqsimlash sxemalarini ishlab chiqdilar. Islom banklarining kredit siyosati ham, kreditlash tamoyillari ham tadbirkorlarni yaratish va rivojlantirish uchun ajoyib vositadir. Tadbirkorlarga nisbatan Islom bankining maqomi hamkor yoki investor maqomida bo‘lsa, an’anaviy banklar uchun ko‘proq kreditor-qarzdor munosabatlariga ega. Islom banklari bilan aloqada bo‘lgan tadbirkorlar ko‘proq axloqiy bo‘lishi va islom qonunlari bilan taqiqlangan biznes bilan shug‘ullanmasligi kutiladi.

Biz bu tadqiqotda 25 ga yaqin islom darchalariga doir yozilgan maqolalarni tahlil qildik. Tahlillarda asosan islom banki, islom darchasi va an’anaviy bank o’rtassidagi statistik tahlillar, ularning yutuqlari, kamchiliklari va xizmat ko’rsatish sifati to’g’risida ilmiy izlanish olib bordik va kerakli takliflarni berdik.

Abstract:
In spite of the undisputable significance of ethics in virtually all fields of human behavior, the lack of ethics in business is painfully obvious with respect to the current financial crisis. The dissertation focuses on the theoretical analysis of the complications inherent to any attempt of defining ethics and ethical behavior, as well as the analysis of the intricate connection between theory and practice. The analysis of Islamic ethics and the financial crisis draws on the preceding theoretical background and sheds some light on the problems related to tack of ethics in business and the indispensable necessity of substantially augmenting the relevance of ethics not only in business, but in all the fields interconnected with the subject matter of ethics, which requires resolving the aforementioned intricacy that characterizes the link between theory and practice.

Abstract:
Le Coran recommande aux croyants de prendre Muhammad comme beau modèle. Ses compagnons directs, leurs suivants, les ascètes et les soufis ont suivi ce conseil dans un sens spirituel. Dans cette étude, nous voyons ce qu'est le modèle muhammadien, comment il interagit dans la communauté musulmane primitive et en particulier chez les mystiques. Nous soulignons comment ce modèle est valorisé, puis exagérément idéalisé. Nous voyons comment cettte notion est introduite et pratiquée par certains mystiques. Nous observons comment chez d'autres mystiques, cette notion semble niée ou ignorée et pourquoi. Nous analysons la signification spirituelle profonde du modèle, sa nécessité pour ceux qui veulent s'approcher concrètement de Dieu. Nous voyons pourquoi il fut idéalisé au point d'être identifié à la lumière primordiale issue de Dieu, à Adam, à l'Homme parfait (notion ancienne systématisée par Ibn'Arabi). Nous voyons que le modèle muhammadien est nécessaire mais qu'il reste un moyen en vue d'une fin : Dieu seul<br>The Koran recommands to the believers to take Muhammad as a beautiful model. His direct companions, their followers, the ascetics and the sufis have followed this advice in a spiritual way. In this study, we'Il see what a muhammadien model is, how it interacts in the primitiv muslim community and in particular by the myticals. We stress how this model is valued, then overly idealized. We see how this notion has been introduced ans practiced by some mysticals. We observe how by some other mysticals, this notion seems to be denied or ignored and why. We analyse the deep spiritual meaning of the model, its necessity for those who wants to approach concretely God. We see why it was idealized at the point to be indentified to the light of God paramount issue, to Adam, to the perfect Man (an old notion systematized by Ibn'Arabi). We see that the muhammadien model is required but it remains a means to an end : God alone

Abstract:
This work is an investigation of the orthodox concept of exorcism in Islam. The main purpose of this study is to identify the orthodox Islamic viewpoint of spirit-possession of humans and its treatment (i.e., exorcism) based upon evidence from the Qur'An, the Sunnah, views of the sahabah (companions of Prophet Muhammad [4]) and the opinions of the early Sunnite scholars. This dissertation is comprised of an introduction, four chapters, a conclusion and two appendixes. The first chapter establishes the Islamic parameters of the spiritual world of created beings. The second chapter consists of a discussion of the orthodox understanding of spirit-possession and a delineation of the prophetic methodology of exorcism. The third chapter is devoted to a study of tabulated data from interviews with a sampling of modem-day, orthodox exorcists from various parts of the Muslim world and a brief presentation of exorcism according to Roman Catholicism. The fourth chapter consists of a comparative discussion of the second and third chapters, and it includes a conclusion in which the views of modem medicine are compared to exorcist tradition. Additionally, some questions concerning exorcism in Islam and other religions are answered.

Abstract:
Radicalism and its association with Islam have become a global concern due to the threats it poses to international peace and security. To understand this association and its dynamics, it is important to examine both the factors leading to the rise of radicalism and how it is related to Islam. To counter the radicalism associated with Islam, a comprehensive approach is needed that addresses both the underlying causes of radicalization and distorted interpretations of the religion. Examining the association between radicalism and Islam from a human rights perspective is essential to ensure that our responses to this problem are fair, effective and respect fundamental human rights principles. Government approaches to countering radicalism can often violate human rights. To protect and promote the fundamental rights of all individuals, it is essential to approach this issue with sensitivity, balance and respect for human rights.

Abstract:
19 ve 20 yüzyılın dünyasında birçok düşünce akımı ortaya çıkmıştır. Bu akımlardan biri sosyalizmdir. Sosyalizm, İslâm dünyasında dergi gibi yayın organları vasıtası ile tanınmıştır. Daha sonraları Müslümanların yaşadığı coğrafyada sosyalizm kavramına karşılık olarak “iştirâkiyye” kelimesi kullanılmaya başlanmıştır. Bu coğrafyada “İştirâkiyyetü’l-İslâm” kavramı İslâm Sosyalizmi olarak karşılık bulmuştur. Sosyalizm akımı ile alakalı olan önemli bir kavram mülkiyettir. Mülkiyet, sahibine eşya üzerinde en kapsamlı yetkileri sağlayan haktır. Klasik fıkıh kitaplarında mülkiyet ile alakalı birçok mesele bulunmaktadır. Geçtiğimiz yüzyılın değişen dünyasında mülkiyet kavramına bakış açısı da değişmiştir. Sosyalizm akımı bu dönemde mülkiyete bakış açısını etkileyen faktörlerden biridir. 20 yüzyılda Suriye bölgesinde yaşamış ve aynı zamanda bir dönem Şam Üniversitesi Hukuk Fakültesi’nde öğretim görevlisi olan Mustafa es-Sibai, Batı’da ortaya çıkan sosyalizm kavramından faydalanarak Batılı yaklaşımdan farklı şekilde İslam sosyalizmi teorisini oluşturmuş ve bu konuda “İştirâkiyyetü’l- İslâm” adında bir eser kaleme almıştır. Adı geçen eserde İslam sosyalizminin temellerinin İslam’da zaten var olduğunu belirten Mustafa es-Sibai kitabında eşitlik, adalet, işçi hakları ve mülkiyet gibi konular üzerinde değerlendirmelerde bulunmuştur. İslam sosyalizmi teorisini oluşturma iddiası ve mülkiyet kavramına yaklaşımı Mustafa es-Sibai’yi ayırıcı kılan unsurlardandır. Bu çalışmada önce sosyalizm ve İslam sosyalizminin gelişim süreci hakkında bilgiler verilecektir. Daha sonra da klasik fıkıh kitaplarında mülkiyet kavramının konumu ve tasnifine yer verilecek ve Mustafa es-Sibai’nin bu kavrama yaklaşımı incelenmeye çalışılacaktır.

Abstract:
Çevre, canlı ve cansız varlıkların içinde yaşadığı ve birbirleriyle ilişki içerisinde oldukları alandır. İnsanlar ve ilişki içerisinde oldukları her şey çevre kapsamında kabul edildiğinden çevrenin korunması tüm canlılar için önem arz etmektedir. İslam’da her şey bir denge üzerine kuruludur. Bu nedenle bireyler bu dengeyi tahrip etmemeli, korumak için çaba göstermelilerdir. Çalışmamız, çevre kirliliğinin bir türü olan hava kirliliği meselesini ele almaktadır. Günümüzde çevre konusu bağlamında küresel ısınma ve iklim değişikliği gibi problemlerin çözümüne yönelik birçok teşebbüsün olduğu bilinmektedir. Çalışmamızın hareket noktasını oluşturan Kyoto Protokolü de çevre problemlerinin çözümü için atılan adımlardan biridir. İslam hukukundaki mülkiyet anlayışı çerçevesinde Kyoto Protokolü’nde bulunan “emisyon ticareti” meselesini ele alan bu çalışma, protokolün sonuçları doğrultusunda çevre konusunda yapılması gerekenlere dair önerilere yer vermektedir. Bu önerilerden en önemlileri bireyler bazında sorumluluk anlayışının geliştirilmesi, kurumlar bazında ise yasal düzenlemeler yapılmasının gerekliliğidir.
