Abstract:
On October 22, 2014, the Italian Constitutional Court rendered a decision on the constitutional legitimacy of certain domestic norms that required Italy’s compliance with the rule on state immunity sanctioned by the International Court of Justice (ICJ) with the Judgment Jurisdictional Immunities of the State (Germany v. Italy: Greece Intervening). The Constitutional Court declared that the international customary obligations on state immunity from jurisdiction can be applied automatically within the Italian legal order only as long as they are in conformity with the fundamental rights contained in the Constitution.

Abstract:
The balanced budget principle was introduced with the fiscal compact at the European level to pursue the aims of the European project also with an accounting and financial instrument. This principle was constitutionalized in Italy in 2012 with Article 81. The budget variance was seen as an exceptional event to be avoided at all costs, and until 2020, events never required a budget variance. This entailed some economic sacrifice and an abrupt adaptation of Constitutional Court jurisprudence aimed at placing more emphasis on the accounting principle over the rights of certain categories of citizens. This emergency approach, over 2020 and 2021, led to as many as five budget slippages. In March 2021, the Russian invasion of Ukraine began, a fact that destabilized all political and economic relations worldwide. By November 2022, the economic situation had become so unsustainable that on November 9, Parliament authorized a budget deviation to the amount of 9.1 billion. It can be said that, in the last two years, the exception clause of Article 81 Const. has been used for objectively exceptional events (pandemic and Ukrainian conflict), so that the use of the budget deviation is perfectly justified by the events. This fact, therefore stands to mean that so far, budget slippages have not negatively impacted the original rationale of the rule: to use monetary and financial leverage to evolve the European Union project.

Abstract:
AbstractPhilips Angel's Lof der schilder-const (In Praise of Painting, 1642) is one of the few pieces of writing we have as a source of notions on the theory of painting in the Netherlands. Yet it was not intended as an art-theoretical treatise: Angel read the text at a St. Luke's feast as part of the activities that were being undertaken to acquire guild rights for Leiden painters. In order to assess the value of the theoretical notions on which the paper is based, it is therefore necessary to analyse as far as possible the circumstances of its writing. First the Angel family is examined. Orginally from Antwerp, the Angels moved north in the 1590s, probably because of the Eighty Years' War, settling in Middelburg and Leiden. They were fairly prosperous middle-class citizens, mostly schoolteachers, painters and small shopkeepers. Both the Middelburg and Leiden branches produced painters called Philips Angel. The Middelburg Philips, almost certainly identical with a painter called Philips Angel who was active in Haarlem, is known to have produced quite a lot of paitings. Only one small etching by the Leiden Philips has survived; nothing is known of any paintings by him. The Leiden Philips, the author of Lof der schilder-const, had a turbulent career. He joined the painters who pressed for guild rights in Leiden, to which end he held his speech in 1641. As early as 1645, though, he gave up painting and travelled as an employee of the United East-Indian Compary to Indonesia. From there, promoted to the high rank of chief merchant, he was sent to Persia. He was dismissed on grounds of embezzlement, but managed to procure the post of court painter to the Shah. By 1656, however, he was back in Batavia (Jakarta), where he again obtained a number of highly regarded positions. Fired again for mismanagement and defalcation, his end was inglorious. The Lof der Schilder-const shows evident signs of a general tendency among Dutch painters of the mid-seventeenth century to claim a higher status for their profession. The text is duly meant less as a theoretical treatise than as a rhetorical amplificatio of the painter's profession. The author seems to have been reasonably well-read, although by no means scholarly; nor was he very conversant with the Italian art theory of his day. Scrutiny of the text reveals his superficial and undiscerning paraphrases of the few sources at his disposal (mainly Karel van Mander's Schilder-boeck and the Dutch translation of Franciscus Junius' De pictura veterum). Much of his eulogy is a summing-up of the distinguished characteristics a painter ought to have. The remarkable thing is that not one of those characteristics provides specific insight into the professional practise of the Leiden painters around 1641. As far as they are at all relevant to what was being painted in Leiden at that time - take the Leiden 'Precise School' of Gerard Dou's circle -, his remarks provide little more insight than a superficial consideration of the paintings would arouse in any layman.

Abstract:

Abstract:
Purpose: This study aims to estimate the cost-minimization strategy of a preventive testing strategy destined to relatives of patients with BRCA mutated cancer versus a no test strategy in Italia. Methods: A BRCA testing pathway was designed by a panel of experts based on the MSTM Excel (2010) tool; the analysis was carried out considering the perspective of the Italian National Health Service. Two alternatives were considered: 1) preventive BRCA testing for relatives of patients affected by ovarian cancer carrying a BRCA1/BRCA2 mutation; 2) no test. Cost and effectiveness data, derived from literature and published sources validated by a Board of experts, were discounted using a discount factor equal to 3%. Probabilistic sensitivity analysis was performed. Results: Considering an average cost of therapy for breast and ovarian cancer major of €90,000.00 per case, the economic impact related to the preventive testing strategy are equal to –€17,814,767.25. The sensitivity analysis confirms these results in the totality of the simulations performed. Conclusions: Preventive genetic testing in relatives of patients affected by ovarian cancer is cost-effective and represents a sustainable cost for the National Healthcare System in Italia, also in the light of its reference values.

The biocenosis of coarse sand and gravel exposed to bottom currents (SGCF) is the typical habitat of the amphioxus Branchiostoma lanceolatum (Pallas, 1774). This species and the habitat where it lives are threatened, and there are few reports of this biocenosis in the Italian and European waters. During a sampling survey carried out along the eastern Sicily coast (Ionian Sea) the macrozoobenthic community associated with this biocenosis was investigated. In this work, we report the presence of “Amphioxus sand” habitat in the Ionian Sicilian coast and the first record of the amphipod Megamphopus katagani Bakir, Sezgin and Myers, 2011 in the Italian waters.

Full text
Abstract:
The objective of the work is to describe how food and beverage cost reporting can be developed in the restaurant industry. The description of available techniques is completed by their application in the case-study of an Italian food chain. The work starts with an introduction of the topic of the so-called “food cost”, which represents a relevant cost component for all restaurants, and must therefore be analysed carefully. Due to the insufficiency of the Income Statement to analyse food and beverage cost other methodologies must be employed, which must be specifically adapted to the restaurant industry. Menu Analysis is the suggested technique to obtain information about the food cost and the overall contribution margin for each menu item. Variances’ Analysis is instead suggested to analyse properly all food and beverage cost’s components. A case-study has been described to offer a detailed practical example of how the analyses can be implemented. Lastly their usefulness is discussed and further improvements are proposed.

GIOLITTI, Anna. "An empirical analysis of efficiency in the Italian water service." Doctoral thesis, Università degli studi di Bergamo, 2015. http://hdl.handle.net/10446/32142.

Full text
Abstract:
The following empirical work examines the impact of a potential restructuring of the Italian water industry, considering a sample of 37 companies and 22 contiguous hypothetical mergers providing water in Italy from 2005 to 2009. With particular attention to the water industry cost efficiency is analyzed by using a parametric methodology: a Translog cost function has been estimated through the SURE model, in order to evaluate the behaviour of returns to scale. Small companies seem to benefit of economies of scale, while the biggest operators encounter diseconomies of scale. Focusing thus on a hypothetical consolidation of the sector, for a sample of 22 contiguous mergers, we apply the not-parametric Data Envelopment Analysis (DEA) in Bogetoft and Wang (2005), corrected for the bias through bootstrapping, to examine the potential efficiency gains from mergers. By decomposing the merger gains into a technical effect, a harmony effect and a scale effect, the results show – on average - high efficiency improvement potentials and relevant scale economies for small mergers. The lowest size to have diseconomies of scale is almost similar in the two applications (45930 users for DEA-VRS bias-corrected model, 37000 users for the Translog cost function estimate for 37 Italian water companies).

Edh, Nina, and Mattias Jönegård. Thesis, Jönköping University, JTH, Industrial Engineering and Management, 2008. http://urn.kb.se/resolve?urn=urn:nbn:se:hj:diva-7980.

Full text
Abstract:

The thesis has been written as a part of the Bachelor degree in Industrial engineering and management at the School of Engineering in Jönköping. The work is focused on the part of Husqvarna AB’s supply chain that is associated with the lorry transports to Italy. Husqvarna AB has approximately ten Italian customers, whose delivery patterns have been studied from January 2007 to July 2008. Some of the customers have a low delivery frequency and small amounts of goods that they therefore have not been fully analyzed in this report. The main focus has been put on the two largest customers.

The main goal of this thesis is to analyze how the lorry transports to Italy can be made more cost-effective with maintained or increased customer service level. In addition, it is intended that the result of this thesis will become applicable for the transports to the rest of the European countries. To structure the work and to reach the main goal, it has been fragmented into three sub targets.

Today, Husqvarna AB works with two fixed departure days per week to Italy. Exceptionally there can be more frequent deliveries in case of enough goods to fill up a lorry. The costs for the transports are regulated by the agreement Huqvarna AB has with DHL. To reach the result of this thesis a data collection was made as an introduction, to gather all the information regarding the shipments which had departed during the investigated period. Each customer was put in a separate Excel sheet, where the costs were calculated for the current situation as well as for the different solutions that were introduced by the authors. To assure that consideration was taken to the customer service a structured written interview was distributed to representatives from the two largest customers.

The result shows that changes can take place in several steps. It is estimated that the most cost-effective solution would give a reduction of the transportation costs by over 40 percent. However, the authors do not hold this solution as implementable, as it gives a too low delivery frequency to keep an acceptable customer service level. The alternative which the authors would like to recommend the thesis submitter Husqvarna AB gives a reduction of the transportation costs by 13.7 percent and involves lowering the delivery frequency to departures once a week, or more often if there are enough goods to fill a lorry. Furthermore the solution implies a usage of the rules in the agreement with DHL, which allows mixed consignments to customers within the same zone. The authors do not think that this solution will affect the customer service level in a noticeable way, but if further research should show that that is the case, the authors have stressed a number of small changes in the discussion chapter. They do for example concern improvements of packing and loading.

Abstract:
Abstract This study examines the Comenius exchange project between Da Vinci, Kattegattgymnasiet in Sweden and Liceo Scientifico F. Vercelli in Asti, Italy from both a qualitative and a quantitative angle. This exchange project was working with immersion. The purpose of this essay is to investigate to what extent second language learning is achieved in an immersion project. The essay aims to answer the following thesis questions:   What are the learning outcomes of this exchange project, focused on immersion? What are the advantages, and disadvantages of an exchange project, focused on immersion?   To undertake this study, I travelled to Asti and distributed a quantitative questionnaire to the students in this project. Qualitative interviews were conducted with the two main teachers and the students, as well. The data was then processed and analyzed, along with my theoretical framework: second language acquisition theory and immersion.   The results show that the Swedish students were better at speaking; the Italian teacher focused more on grammar, that the objectives sometimes were unclear and that language development occurred. The study also provides the data that tells us that there might be challenges with your colleagues and that it is time-consuming.   For further research I suggest a focus on why language development features in a project like this. It would also be interesting to analyze a project like this by observations of the linguistic content of the lessons and the specific differences between Italy and Sweden.   Key words: Immersion, Second language acquisition, input, exchange project, language instruction

Dalla, Pozza Petra <1993&gt. "Development of a combined environmental and socio-economic costal vulnerability index: assessing vulnerability to inundation scenarios in the Italian coast." Master's Degree Thesis, Università Ca' Foscari Venezia, 2018. http://hdl.handle.net/10579/13830.

Full text
Abstract:
Rising sea levels and extreme events related to climate change are causing serious threats to coastal areas, affecting both natural and human systems. Moreover, there is growing evidence that socio-economic dynamics (e.g. unplanned urbanization, land use and demographic changes) would increase coastal flood risk in the next decades. In this setting, coastal zones of the Mediterranean region represent highly vulnerable areas to climate-related impacts, as they are characterized by gentle slope environments, especially prone to be inundated by storm surge flooding events and rising sea level. In particular, when considering the geo-physical and morphological features of the Mediterranean shorelines as a whole, the Italian coastal area appears to be remarkably vulnerable to potential risks arising from future climate change scenarios due to its low lying and retreating shorelines, often lacking protection to erosion or storm surge events. Moreover, Italian coastal areas usually result highly populated and occupied by economically valuable assets, thus exposing people, infrastructures and businesses to potential climate-related damages. Understanding how natural and human-induced drivers will contribute together to rise the vulnerability and risks in coastal areas is of paramount importance for mainstreaming effective climate adaptation and risk reduction policies into coastal zone management. Moving forward traditional approaches for coastal vulnerability appraisal, an advanced Coastal Vulnerability Index, integrating a composite set of physical, environmental and socio-economic indicators (hereafter combined-CVI), is proposed in this Thesis in order to rank Italian coastal provinces according to their relative vulnerability to extreme sea level scenarios. In particular, hazard-prone areas potentially inundated by sea level rise and extreme water levels (under the RCP8.5 climate scenario) were combined with indicators of geomorphic vulnerability (e.g. elevation, distance from coastline, shoreline evolution trend) and adaptive capacity (e.g. sensible segments of the population, GDP, land use patterns). According to the temporal resolution of the available data, the methodology was applied by considering two different timeframe scenarios: a baseline representing current climate and land use condition, and a future scenario for the 2050, integrating both climate projections and data simulating potential evolution of the environmental and socio-economic systems. Results from the application of the combined-CVI in the Italian coast case study, including GIS-based vulnerability maps and related statistics, showed that most vulnerable provinces are located along the North Adriatic coast, the Gargano area and in the Southern part of Italy, due to the very high vulnerability score assumed by climate-related indicators, in both baseline and future scenario. Moreover, the number of provinces assuming higher vulnerability score is expected to increase in the future due to the worsening of climatic conditions, as well as the rising vulnerability linked with changes in the environmental and socio-economic conditions (e.g. land use variations and increase of the elderly population). Despite constraints posed by data availability, the resulting outputs of the performed analysis represent a useful screening tool about potential impacts induced by climate change and sea-level rise scenarios in the area of concern. Specifically, by providing a relative ranking of most vulnerable coastal provinces, they can be used by coastal managers and environmental planners to identify regions where inundation risk may be relatively higher, considering both environmental and socio-economic features, as well as to draw some considerations about the potential measures required to increase the resilience of coastal communities to sea-level rise and storm surge flooding scenarios, undertaking a sustainable adaptation pathway.

GIMELLI, NADIA.

Full text
Abstract:
L’art.
Article 19 of Italian Constitution guarantees freedom of religion in its traditional aspects, i.e. freedom of confessing and disseminating one’s faith and of following the worship. However, before considering every single right recognized by article 19 of Italian Constitution, it’s necessary to ask oneself what is meant by “religion” and in particular whether atheism can be accounted in the religion nomen iuris or not and if, missing any other law that sanctions it, atheism happens to be automatically regulated by the law about the freedom of religion in a determined juridical system. Once asked if “morality”, only restriction expressly set by the Italian Constitution, refers exclusively to rites performing or applies both to faith profession and dissemination, it’s highlighted the different sphere of action compared to the analogous restriction belonging to article 21 of the Italian Constitution about the freedom of opinion. Another issue here debated is whether the freedom of religion has to be subjected to public order limitations. Eventually, it’s analysed the institution of conscientious objection with special regard to military service, abortion, wording of the oath in trials and animal testing.

E' meglio smaltire in discarica i rifiuti residui o bruciarli?
This thesis aims to contribute to the empirical analysis of the cost structure of municipal solid waste management in a sample 534 Italian municipalities, for a period of seven years, from 2004 to 2010. After giving an overview both of the various phases of the MSW service and of the functioning of the sector in Italy in the first chapter, the second chapter reviews the cost function studies, with particular emphasis on recent years including also the very few Italian papers on the topic. This topic of the third chapter the study of the presence of scale and density economies in the Italian waste sector using a translogarithmic specification estimated with the SUR method. The last chapter aims to provide answers to very actual questions as: is the door to door collection more expensive? Is it better to burry residual waste or to incinerate it? Given a certain amount of garbage, is there an optimal quantity to be incinerated? Moreover, given that many communities use contemporaneously different dumpsites, which is the perfect number of disposal sites for unsorted waste?

CHIESI, GIAN MARCO.

Abstract:
This work analyses the techniques to assess the cost of equity of Italian banks in the light of two antithetical investment policies: international portfolio diversification and ownership concentration directed to hold large blocks of shares. Financial market integration and European Monetary Union involve using a broader index, referred to the Euro area, as the proxy for the market portfolio pointed out by CAPM. The analysis carried out on a sample of Italian banks shows this change brings about a reduction of both the estimated Beta and the cost of equity. This is due to the limited contribution that domestic market index makes to the systematic risk of the Euro portfolio. The control of the decision-making process enables the holders of large blocks of shares to extract private benefits and to obtain extra returns compared with other investors. This can explain an investment policy directed to wealth concentration. That causes a higher equity cost of equity.

Abstract:
The Coast Guard is an organization committed to safeguarding the marine environment, that requires specialized personnel. Therefore, it is necessary to integrate the "basic" preparation, with "specialist" training in compliance with the high standards of a Q.M.S. of training, which uses teaching methods advanced, classroom and lessons, case studies, but also practice in the field. The latter methodology plays an important role since learning by doing, even more than theory, guarantees the effectiveness of learning, emotional involvement and the formation of experiential memory of learners.

Abstract:
Austro-Hungarian coastal fortifications on the Italian border at Istria and Dalmatia from the studies on the eastern areaRight after the Unification of Italy, land’s topography, with landscape acquisition and restitution through explorations across borders, and in particular regarding Austro-Hungarian fortification on the Italian land and sea border, were immediately observed by Major State’s officials. In early 1900 the long and jagged stretch of Dalmatian coast between Pola and Cattaro, full of natural ports and coastal canals formed by many islands sometimes arranged in multiple orders along the coast, and in the past defended by many works which are now mostly radiated or abandoned (except for S. Nicolò fort, near Sebenico), can count on some works realized in Lussinpiccolo (Monte Asino): Ragusa wall has been entirely unarmed and defensive organization of Cattaro’s cannons is only maritime, in fact, for the part towards the land the Austrians provided to organize the defensive arming against neighboring Montenegro; Pola maritime square instead includes a sea front and a land front, so it can obtain protection by gulf, city’s arsenal and Fasana Canal. Archive’s material consulted in Kriegsarchiv of Vienna, historical cartography of Austro-Hungarian fortification system detected by Italian officers during Major State journeys on a side, together with many Memories on Austrian maritime fortifications between Cattaro and Pola, published by Major State Command, operations Division, allow to investigate and deepen Austro-Hungarian forts system along Italian coast, in Istria and Dalmatia.
