The rest of Section 1—added in 1910 and after—established, defined, and modified powers of citizens’ initiative and veto referendum. Section 3 defines the terms of senators and representatives and imposes term limits. Section 32 defines appropriations bills subject to the governor’s line-item veto, and Section 21 protects that veto power. Sections 20, 22a, and 22b require committee consideration of all bills but also prevent committees and caucus positions from killing bills. Sections 44–48.4 define and empower commissions to redistrict congressional and legislative seats.

In this chapter, the content sophistication (legislative-executive and techno-economic conception and implementation) of the R&amp;D Law No. 5746 of Turkey is analyzed by the constructed general framework of reference for content sophistication analysis with respect to the framing principles of neo-classical (optimizing) and evolutionary (adaptive) policy making and policy implementation approaches (Metcalfe, 1995) through their distinct underlying conceptions and implementations regarding to the “nature of technology,” “using, creating, diffusing technology and knowledge,” “specificity, variety, and mode of transfer,” “externalities,” and “risk/uncertainty” (Lall &amp; Teubal, 1998). According to the results of the analysis, it is shown that, for the time being, the R&amp;D Law No. 5746 of Turkey exhibits features of neo-classical (optimizing) policy making frames from conception to implementation in legislative-executive and techno-economic spheres of research and technology development. In comparison to these neoclassical features, features of evolutionary (adaptive) policymaking frames in other economies around the world are exemplified separately. By concentrating on “Iter Legis”: “path that a law takes from its conception to its implementation,” this chapter aims to contribute to discussions and recommendations on “Lex Lata”: “the current law” and “de lege Ferenda”: “future law” for R&amp;D and innovation in any country where “the future cannot be predicted, but futures can be invented” (Gabor, 1963) through legislative-executive terms of techno-economic demand and imagination.

This chapter highlights five complex member lawsuits against legislative processes which resulted in mixed outcomes for the member-litigants. First is the deficit-reduction case surrounding the 1985 Balanced Budget and Emergency Deficit Control Act, known after its sponsors as the Gramm–Rudman–Hollings Act (GRH), where plaintiffs ostensibly won back power but Congress opted to delegate again. Second is a multiplaintiff suit against executive enforcement of a base-closing commission decision that required supermajorities to override. This chapter shifts from separation-of-powers features of the state constitutions that have no equivalent in the federal constitution (the plural executive and line-item vetoes) to a separation-of-powers topic that arises under both the state and federal constitutions (administrative law). It examines a distinct aggregation-of-power issue in the executive branch, the growth of administrative agencies. Few at the founding contemplated this utility-player branch, which consolidates executive, legislative, and judicial powers about a single subject in one agency. Here, too, many states have marked their own paths. In contrast to the federal courts, state courts frequently prohibit their legislatures from delegating policymaking power to agencies, and frequently curb the power of agencies to interpret state laws or altogether reject the Chevron-deference model used by the federal courts.

Abstract:
Health exports have increased to 100 billion dollars per year and it has become an important item in service exports all over the world. Demographic structures are changing with the old population in developed countries, and health tourism among countries has increased. This chapter aims to study health tourism in European Union, aiming to create a single market with member countries and with free movement of people among member countries. EU policy permits member countries' citizens to get health service from any other member country. A literature review shows that the differences between member countries' national health systems is one of the main issues to be resolved and that the countries with old populations who need health care affect health tourism from developed countries with old population countries to countries with young population like Spain. Along with the legislation, ethical, social issues, and standard international rules accepted by all countries covering all aspects of health tourism must be set by international organisations like the WHO to avoid potential risks for the patients.
