Abstract:
In the “Enrica Lexie” Incident case between Italy and India, two judicial organs, i.e. the International Tribunal for the Law of the Sea (ITLOS) and the Annex VII Arbitral Tribunal prescribed provisional measures. It is rare that ITLOS and the Annex VII Arbitral Tribunal prescribed different provisional measures in the same dispute. The “Enrica Lexie” Incident case provides an insight into the procedural law governing provisional measures under the UN Convention on the Law of the Sea. This article examines the provisional measures prescribed by ITLOS and the Annex VII Arbitral Tribunal in the “Enrica Lexie” Incident case focusing particularly on three issues: (1) the relationship between the request by Italy submitted to ITLOS and that submitted to the Annex VII Arbitral Tribunal, respectively, (2) the existence of the urgency of the situation, and (3) the legal effect of considerations of humanity.

Abstract:
The settlement of disputes between States is generally not regulated by municipal law and municipal courts but by international law regulated by treaty. Because States are not subject to the jurisdiction of international tribunals absent express consent, an important function of dispute settlement clauses in treaties is to indicate whether such consent is granted and, if so, with respect to which disputes before which tribunals. This chapter discusses the following: the obligation of states to settle disputes peacefully; the duty to arbitrate or adjudicate disputes under the United Nations Convention on the Law of the Sea (LOSC); choice of forum for compulsory settlement of LOSC disputes; nature of dispute; procedural and substantive limitations on jurisdiction under Section 2 of Part XV of the LOSC; and institutional constraints on the exercise of jurisdiction.

Abstract:
This chapter focuses on the role of the International Tribunal for the Law of the Sea (ITLOS) in global ocean governance. Established under the United Nations Convention on the Law of the Sea (UNCLOS), the jurisdiction of the ITLOS comprises all disputes and all applications concerning interpretation or application of the Convention and all matters specifically provided for in any other agreement which confers jurisdiction on the Tribunal. In the performance of its responsibilities, ITLOS has accumulated a body of jurisprudence which constitutes its contribution to the progressive development of international law of the sea and thus global ocean governance. The chapter discusses the most important examples of the ITLOS's contribution to the global ocean governance, such as dealing with contentious cases, requests for provisional measures, and prompt release cases as well as providing advisory opinions.

Abstract:
ITLOS has handed out in 2015 two provisional measures orders and an advisory opinion. The Provisional Measures Order of 25 April 2015, in the maritime delimitation case between Ghana and Cote d’Ivoire, was adopted by an ad hoc Chamber of the Tribunal. It accepts for the first time in ITLOS jurisprudence the “plausibility” test for the merits submission as a prerequisite of a provisional measures order In the Provisional Measures Order of 24 August 2015 on the Enrica Lexie incident between Italy and India, the provisional measure prescribed consists in that both parties suspend or refrain from initiating proceedings which might aggravate the dispute submitted to the Annex VII Arbitral Tribunal. The Advisory Opinion of 2 April 2015, upon the request of a West African fisheries commission, rejects the view that ITLOS in its full formation lacks advisory jurisdiction. It throws light on the obligations of the flag state of vessels fishing in the exclusive economic zone of another state and on the role of the European Union.
