Abstract:
Collections devoted to culture form an important part of the National Museum collections. Especially those of the Czechoslovak Documentation Centre which were given to the National Museum by Vilém Prečan in 2003 are devoted to the Cultural and Political Opposition. These collections include a wide range of personal collections (Václav Havel, Milan Šimečka, Jiřina Šiklová, Ivan Medek and others). Institutional collections, such as Radio Free Europe, the Charter 77 Foundation or the Czechoslovak Documentation Centre own collections, are also important. The collections show how important cooperation between the dissent and exile culture was, especially during the period of so-called normalization and illustrate their interconnection at the same time.

LABURPENA: Egonkortasuneko Mekanismo Europarrean (EME) baldintzapena nola aplikatzen den aztertuko dugu artikulu honetan, Europar Batasunaren esparruan aitortuta dauden oinarrizko eskubideen ikuspegitik. Horretarako, giza eskubideen alorrean nazioarteko hitzarmenak aplikatzearen alde egin duten jarrera doktrinalak hartu dira erreferentziatzat, Nazioarteko Diru Funtsak (NDF) eta nazioarteko beste finantza-erakunde batzuek garapen bidean diren herrialdeekiko operazioetan txertatu duten baldintzapenari muga jartzeko. Europar Batasunaren eremuan 2009-2010 urteetako zor publikoaren krisiari erantzuna emateko sortu diren organismoek eta, batez ere, EMEk (euro eremuan egonkortasuna ziurtatzeko organismoak,) ordea, egiturazko elementu gisa sartu dute baldintzapena haien operazioetan, NDFaren antzeko filosofia hartuta, hau da, zuhurtziaren bitartez lortu nahi dute hazkunde ekonomikoa, eta, horren ondorioz, oinarrizko eskubide batzuk ezin izan dira behar bezala gauzatu. A tal efecto, se toman como referencia las posiciones doctrinales que han venido defendiendo la aplicación de los convenios internacionales en materia de derechos humanos como límite a la condicionalidad introducida por el FMI y otras instituciones financieras internacionales en sus operaciones con los países en desarrollo. Los organismos creados en el ámbito de la Unión Europea para dar respuesta a la crisis de la Deuda pública de 2009-10, y de modo singular el MEDE, organismo creado para garantizar la estabilidad de la zona euro, han introducido, sin embargo, la condicionalidad como un elemento estructural en sus operaciones, con una filosofía parecida a la del FMI, es decir, conseguir el crecimiento económico a partir de la austeridad, con lo que se ha visto perjudicado el ejercicio de diversos derechos fundamentales. Ello plantea la cuestión de la compatibilidad de tales políticas con los objetivos y principios de la Unión Europea, definida en su día como «Comunidad de Derecho» y fundada sobre los valores de los derechos humanos. La primera —y temprana— sentencia dictada al respecto por el Tribunal de Justicia (sentencia Pringle) dejó, sin embargo, en el aire la cuestión de la compatibilidad de la condicionalidad del MEDE con los objetivos y principios de la Unión Europea y el respeto de los derechos humanos. Parece, no obstante, que este criterio tiende a modificarse a partir del reciente fallo en Ledra Advertising, que ha abierto la puerta a invocar el derecho de propiedad para ser indemnizado por los daños causados por la aplicación de la condicionalidad. Con todo, será a partir de la transformación del MEDE en el Fondo Monetario Europeo, si éste se constituye como institución comunitaria, como puede hacerse efectiva la invocación de los derechos fundamentales para frenar o mitigar los efectos perjudiciales de la condicionalidad. Más aún, el control judicial de la condicionalidad en el FME podría servir como referente para otras instituciones financieras internacionales. ABSTRACT: This article analyses the application of conditionality within the European Stability Mechanism (ESM) from the perspective of the fundamental rights recognized within the EU. To this end, we take as a reference the doctrinal positions that have been defending the application of international conventions on human rights as a limit to the conditionality introduced by the IMF and another financial international institutions in their operations with developing countries. The public agencies created within the EU in order to meet the demands of the public debt crisis of 2009-10, and specifically the ESM, a body created to guarantee the Euro zone’s stability, have nonetheless introduced the conditionality as a structural element in their operations, with a philosophy comparable to that of the IMF, i.e. to achieve economic growth from austerity, thus impairing the exercise of several fundamental rights. That raises the question of compatibility of those policies with the objectives and principles of the EU, defined one day as a «community of law» and founded upon the values of fundamental rights. The first —and early— judgement delivered on this ground by the European Court of Justice (Pringle case) left nevertheless in the air the compatibility of the conditionality of ESM with the objectives and principles of the EU and with the respect to human rights. It seems however that this criteria tends to be modified by the recent judgment Ledra Advertising that opened the door to invoke the right to property in order to be compensated by damages caused as a consequence of conditionality. Even so, it will be after the transformation of the ESM into an European Monetary Fund, if this is constituted as a Community institution, that invoking fundamental rights shall be effective in order to stop or mitigate the adverse effects of conditionality. What is more, the judicial control over conditionality within the EMF might serve as a reference for other international financial institutions.

Abstract:
The article documents the relation of performance art, actions, interventions, happenings, and the democracy of capital for the ruling power through double optics. The first optics constitutes a niche within which art is treated as a crime, as in the case of e.g. the individual guerrilla action Black Peristyle (Crni Peristil) from 1998, the author of which was summoned for interrogation at the Department for Terrorism and War Crimes.The second optics constitutes a niche within the framework of which art engagingly views what is political, what is criminal, what is taking place in this Balkan planetarium of ours – thus demonstrating that personal is (indeed) political – on the example of the independent scene on the one hand (Močvara Club and ATTACK!; I only address the independent scene of Zagreb on this occasion), but also the concept of “Green Democracy” (whereby I used the syntagma by Vandana Shiva) on the example of the activist practice of Animal Friends, as well as the examples of the artistic practice of multimedia artist Ivan Mesek, who also sought to indicate the suffering of animals on the barbed wire (Hungarian-Croatian and Slovenian-Croatian borders). With the aforementioned examples from the niche of animal rights, I sought to document the refugee crisis on the Balkan Route through the optics of equalising speciesism (species-based discrimination) and racism.

En particular, se presta una particular atención a la posición mantenida por el Tribunal de Justicia de la Unión Europea respecto a la compatibilidad de la Carta de Derechos Fundamentales de la Unión Europea con el contenido de los programas económicos establecidos en los Memorándums de Entendimiento y especialmente, su aplicabilidad a las actuaciones de los Estados miembros de la eurozona y de las Instituciones Europeas, llevadas a cabo en el marco de la asistencia financiera del Tratado MEDE. ABSTRACT: This study deals with the impact on Fundamental Rights of citizens guaranteed by the EU Charter of Fundamental Rights and others international instruments of Human Rights, resulting from the implementation of strict austerity measures contained in the Memorandum of Understandings on Specific Economic Policy Conditionality to face the euro financial and economic crisis. In particular, one of the issue deserving of close attention is the position of the European Court of Justice about the compatibility of the EU Charter of Fundamental Rights with economic programmes established by the Memorandum of Understandings and its applicability to the Eurozone member States and to the European Institutions acting under the ESM Treaty.

Zehazki, aztertuko dugu zertan diren hauek guztiak: Europar Batasuneko Oinarrizko Eskubideen Gutuna betearazteko eta babesteko sortu den jurisprudentzia (oraindik parekatu gabea eta eskasa), Egonkortasunerako Mekanismo Europarraren esparru bakoitzean; estatu kideen gehiegizko defizit publikoek eragindako prozedura komunitarioak; finantza-zerbitzuak gobernatzeko Agentzia Europarrak; Europako Banku Zentralaren jarduna, Gainbegiratzeko Mekanismo Bakarrean, bai eta kontrol horren aspektu teorikoak ere, kontrola oraindik guztiz gauzatu ez bada ere, moneta-politikaren eta Ebazpenetarako Mekanismo Bakarraren testuinguruan. RESUMEN: Este artículo analiza el papel del Tribunal de Justicia de la Unión Europea (TJUE) respecto a la tutela de los derechos fundamentales en el ámbito de la Unión Económica y Monetaria (UEM). En particular, se examina la desigual y todavía escasa jurisprudencia generada en relación con la protección y observancia de la Carta de los Derechos Fundamentales de la UE (CDFUE) en los respectivos marcos del Mecanismo Europeo de Estabilidad (MEDE), de los procedimientos comunitarios por déficits públicos excesivos de los Estados miembros, de las Agencias Europeas de gobernanza de los servicios financieros, de la actuación del Banco Central Europeo (BCE) en el Mecanismo Único de Supervisión (MUS), así como los aspectos teóricos de ese control, aún no efectivamente ejercido, en el contexto de la política monetaria y en el del Mecanismo Único de Resolución (MUR). ABSTRACT: This article analyzes the role of the Court of Justice in the protection of fundamental rights in the field of economic and monetary union. It surveys the still scarce and unequal case law relating to the fulfilment of and the respect to the EU’s Charter of Fundamental Rights. Abstract:
The results of a comparative analysis of the novel “The Enchanted Wanderer” by N. S. Leskov and the novel “Hero of Our Time” by M. Yu. Lermontov are presented. Particular attention is paid to the image ofthe prince, parodic in relation to Pechorin and “superfluous people”, as well as the storyline of Ivan Flyagin, echoing the line of Maxim Maksimych. The novelty of the study is due to both the little study of the connections between Leskov the artist and the work of Lermontov, and the insufficient coverage of the issue of the historical existence of Lermontov’s novel. It is shown that stylistic tendencies that are stable for Russian literature of the 19th century differ among writers. Along with this, the question is raised about Leskov’s critical view of the Pechorin type; in his story in the foreground is the hero named Ap. Grigoriev “meek” as opposed to the demonic, “predatory” type. It is noted that in the plot of the novel “A Hero of Our Time” Maxim Makimych, personifying a folk character, takes a subordinate place, this is explained by Lermontov’s sympathy for a demonic personality. The author points out that in “The Enchanted Wanderer”, on the contrary, there is a change in the function of the hero; the prince turns into a marginal character, and the Russian righteous man takes the place of the plot center.

Abstract:
Aronia Medik., commonly known as chokeberry, is a genus of deciduous, multistemmed, rosaceous shrubs native to eastern North America. Three species of chokeberry are commonly accepted, A. arbutifolia (L.) Pers., red chokeberry, A. melanocarpa (Michx.) Elliott, black chokeberry, and A. prunifolia (Marshall) Rehder, or purple chokeberry. In Europe, a fourth species of human origin is recognized as Aronia mitschurinii A.K.Skvortsov & Maitul. In North America this type of Aronia is described as cultivars of A. melanocarpa, including ‘Viking’, ‘Nero’, and ‘Aron’. This species is characterized by near homogeneity of the population, tetraploidy, and a distinct morphology with more robust stems, wider leaf blades, and larger fruits than wild populations of A. melanocarpa. It has been proposed that this genotype originated from Russian pomologist Ivan Michurin’s early 20th century experiments involving Aronia × Sorbus hybridization. In this study we used amplified fragment length polymorphic (AFLP) markers to elucidate the relationships of A. mitschurinii to wild North American Aronia, ×Sorbaronia C.K. Schneid, Sorbus L., and six additional genera from subtribe Pyrinae (Rosaceae). Data from seven primer combinations were interpreted by the NTSYSpc software package into a similarity matrix using Jaccard’s coefficient. Clustering of AFLP similarity data using the unweighted pair group method with arithmetic mean (UPGMA) identified A. mitschurinii as distinct from wild Aronia, grouping it close to ×Sorbaronia fallax C. K. Schneid. and ×Sorbaronia ‘Ivan’s Beauty’. Non-metric multidimensional scaling (nMDS) also demonstrated a relationship between A. mitschurinii, ×Sorbaronia fallax, a ×Sorbaronia × Aronia backcross and compound-leaved Sorbus.

Karel Ančerl 1968-1973. A documentary monograph OBJECTIVES: The main objective of this thesis is to capture and describe the last five years (1968-1973) of life and artistic achievements of the conductor Karel Ančerl. This is a topic which has not been elaborated on an academic level yet. On the beginning of the captured period we find Ančerl to be a prominent member of the Czechoslovak music environment working as the chief conductor of the Czech Philharmonic. At the end of this period, Ančerl permanently lived and worked in Canada as the chief conductor of the Toronto Symphony. This fact is reflected in the two main topics of this thesis. First, there is the theme of process of following a qualitative change which the Toronto Symphony undertook during Karel Ančerl's leadership. Second, there is the relationship of the conductor to the Czechoslovak environment and its musical tradition. Main axis of the thesis is defined by a chronological following of the affairs of Karel Ančerl's life story in the given period. METHODOLOGY: Since the estate of Karel Ančerl has been missing, some of the important - maybe even the most important - documents still remain unknown. In the 1960s Czechoslovak Airlines (ČSA) set up offices in the countries to which they operated regular flights. ČSA branches abroad were to match high standards of other airlines premises. In those years travelling by air was still regarded a luxury. ČSA had to take these facts into consideration. The same group of architects, designers and artists who participated in the design of ČSA branch offices took also part in the outline of the new Prague Ruzyně international airport checking-in hall. This thesis aims to depict some former, now vanished, ČSA premises. In the 1990s ČSA closed down some offices abroad and the Prague Ruzyně international airport checking- in hall (now Terminal 1) was completely reconstructed. Press and other articles, archive documents, monographies as well as information provided directly by architects, designers and artists or their relatives were used in order to describe some previous ČSA publicly accessible premises and works of art that they included. On the basis of ascertained facts, it is obvious that in the 1960s ČSA offices abroad were not only to promote the good company reputation but further fulfilled a political role to create a positive picture of the Czechoslovak Republic. Abstract:
When faced with moral or environmental problems, the industrial culture searches for a set of rules that can guide us through a messy reality. Yet these codes arrogantly foreclose a complex reality and provide a false assurance of propriety; as such, they are ways of keeping the self buffered. Berry, following thinkers such as Ivan Illich and Charles Taylor, turns to the parable of the Good Samaritan for insight into the embodied, humble forms of love that would characterize a truly sustainable community. His essays practice such humility not by being deferential or meek, but by recognizing that the human condition requires us to choose and act from a position of irremediable ignorance. Worse still, we humans generally don’t act on the basis of our most careful, rational thought, but on a more gut level. The occasional, ad hoc nature of his essays evinces his efforts to walk along what he terms a “way of ignorance,” a way of approaching reality in light of our condition as finite persons. In addition, many of Berry’s essays are structured by binaries—boomers versus stickers, the industrial economy versus the Kingdom of God—that work to pry open the codes we use to foreclose reality.
