Abstrak: John Langshaw Austin menjadi terkenal sebagai filosof Lingkaran Oxford yang menekankan pentingnya tuturan performatif. Namun dalam artikelnya “Truth” (1950) ia menggunakan teori korespondensi dalam memahami masalah kebenaran. Austin mengkritik Strawson yang menggunakan teori deflasioner tentang kebenaran berdasarkan analisis mengenai pentingnya tuturan performatif. Dalam tulisan ini akan dijelaskan mengapa Austin lebih memilih teori korespondensi dari pada teori deflasioner dalam memahami kebenaran. Juga akan ditunjukkan sumbangan khas Austin yang membarui teori korespondensi umum yang menggunakan metafora “cermin” dan “peta” realitas dengan menekankan sifat konvensional ide korespondensi. Menurut penulis, hal ini merupakan suatu usaha yang serius dan berguna dalam mengartikulasikan cara kita menggunakan simbol-simbol bahasa yang ditentukan secara sewenang-wenang untuk merepresentasikan realitas dunia. Kata-kata Kunci: Kebenaran, teori korespondensi, teori koherensi, teori deflasioner, teori tindak-tutur, aspek ilokusioner bahasa, tuturan deskriptif, tuturan performatif, konvensi deskriptif, konvensi demonstratif. Abstract: John Langshaw Austin is an “Ordinary Language Philosopher” of Oxford, who is famous for emphasizing the importance of performative statements. In his article, “Truth” (1950), however, he used correspondence theory for understanding the problem of truth. Austin criticized Strawson, who uses the deflationary theory of truth that is compatible with the analysis of performative utterances. This article will explain why Austin chooses the correspondence theory of truth rather than deflationary one. It will also elaborate Austin’s specific contribution in changing the version of the correspondence theory, which uses the metaphor of “mirroring” or “mapping”’ the world, to a conventional correspondence theory. It is, in my opinion, a serious and notable attempt to articulate our use of arbitrary symbols in the representation of brute reality. Keywords: Truth, correspondence theory, coherence theory, deflationary theory, speech-act theory, the illocutionary aspect of language, descriptive utterance, performative utterance, descriptive convention, demonstrative convention.

Parto da hipótese de que Austin é um "desconstrutor". One of the standard criticisms of John Austin’s work is that his portrayal of law, as essentially the command of a sovereign to its subjects, does not fit well with the way law is practiced or perceived by lawyers, judges, and citizens; and since the theory “fails to fit the facts,” Austin’s theory must be rejected in favor of later theories that have better fit. Many influential modern approaches to the nature of law, including Joseph Raz’s exclusive legal positivism and Ronald Dworkin’s interpretivism, while they criticize the lack of fit of theories like Austin’s, themselves unapologetically offer characterizations of legal practice that deviate in significant ways from the way most people practice or perceive law. Thus, it appears that many contemporary legal theorists wish to have it both ways: they use the deviations from conventional understandings as grounds for dismissing some theories by other scholars, but forgive or overlook comparable deviations in their own theories. This article explores what general principles can be learned, or developed, regarding when or to what extent deviation from the way law is practiced and perceived can be justified in a theory of the nature of law by other theoretical gains. Additionally, the article considers whether, in light of the proper approach to fit and mistake in theory-construction, Austin’s theory of law might be a more viable alternative than is conventionally assumed.

It is a privilege for me to write this brief perspective on the transition of John B. Goodenough from Oxford to the University of Texas at Austin (UT Austin). While most people will tend to retire, Goodenough transitioned to UT Austin at the age of 64 in 1986 and has been making phenomenal contributions during the past 35 years, with a genuine passion for science and profound impact on the society at large. To highlight a few, the contributions at UT Austin include the following: chemistry and physics of high-temperature copper oxide superconductors; battery electrodes and electrolytes, including polyanion family of oxide cathodes, niobium titanium oxide anode, and Prussian Blue cathode; alkali-metal plating/stripping; solid-state batteries; flow batteries; oxygen reduction/evolution reaction catalysts; and solid oxide fuel cell electrodes and electrolytes. Finally, what distinguishes Goodenough more than anything else is his unique personal attributes.

Abstract:
Austin discusses the supposed opposition between performative and constative utterances in a paper delivered to a French audience in 1962 entitled Performative—Constative. It is his aim in this paper in a sense to recant his earlier views that such a distinction was clear. A translation of this paper made by G. J. Warnock appeared in 1972 in a collection of essays on the philosophy of language, edited by John Searle. Alongside this translation were criticisms and comments by P. F. Strawson and H. P. Grice. Taken altogether, I regard these papers as containing several important insights that have informed contemporary notions regarding meaning and communication, particularly as they are thought of by Brandom and Habermas. I follow the course of Austin's discussion in assessing the status of the distinction that gives his paper its name and consider its merits, as well as drawing upon some of Strawson's and Grice's thoughts on the matter. After these discussions, I hope that it shall be clear how indebted to these past thinkers are those important theorists of our time.

The goal of this paper is a reassessment of the contributions provided by John L. Austin’s book “How to Do Things with Words” to pragmatics. It discusses some assumptions belonging to the received reading of the volume, as regards its aim and structure, the conceptions of illocution and of perlocution, and the alleged exclusion of “non-seriousness”. Against the received reading, it is argued that “How to Do Things with Words” is structured as a proof by contradiction of the claim that all speech should be considered as action, that in illocution a major role is played by the conventionality of effects, that perlocution presupposes a conception of action as responsibility, and that Austin had reasons not to deal with “non-seriousness” in detail, albeit recognizing the issue as relevant to the study of the uses of language. In the conclusions, the tenets attributed to Austin are neither crtiticized nor defended, but an attempt is made to say what are their implications for research into language use and for philosophy.

Es bien sabido que su contenido ha tenido una gran repercusión en campos del saber diversos y que su influencia se extiende hasta nuestros días. En este artículo se estudia la pervivencia de dicha obra de Austin desde una perspectiva particular: el criterio utilizado es el empleo de variantes de la traducción española de su título (Cómo hacer cosas con palabras) en trabajos de distinta tipología y temática. Se concluye que, aunque la pervivencia del título constituye una prueba más de la influencia y vitalidad de los postulados austinianos, su recurrente empleo se debe también a aspectos formales.Abstract: The lectures given by John Langshaw Austin as part of the William James Lectures were published in 1962 after the author´s death under the title How to do things with words. It is well-known that their content has had a significant impact on different fields of knowledge and that their influence survives into the present age. In this paper we aim to handle the survival of the aforementioned work by Austin from a particular perspective: the criterion employed is the use of variants of the Spanish translation of the title (Cómo hacer cosas con palabras) in works of different types and topics. A conclusion is reached that, even though the survival of the title constitutes yet more evidence of the influence and vitality of Austin´s proposals, its recurrent use is also due to formal aspects.

Ini dimulai dengan mengumpulkan dan memisahkan data. Semua data dievaluasi menggunakan cara deskriptif, interpretatif, reflektif, inklusif, dan sintesis. Austin membandingkan keragaman alat dan cara dalam bahasa, serta bagaimana bahasa digunakan, banyaknya jenis kata dan kalimat dengan apa yang dikatakan ahli logika tentang struktur bahasa tempat pembaca dapat menafsirkan teks kata sebagai jembatan untuk dapat dipahami. Statemen Sari Roti menggunakan salah satu jenis bahasa biasa, yakni bahasa sehari-hari. Berdasarkan sudut pandang filsafat bahasa Austin, pengaruh statemen Sari Roti ini berakibat unhappy. AbstractEarly-Modern Irish Catholics exiled on the European continent are known to have often held prominent academic positions in various important colleges and universities. This paper investigates the hitherto unknown Scholastic legacy of the Dublin-born Jesuit John Austin (1717–84), a famous Irish educator who started his career teaching philosophy at the Jesuit college of Rheims in 1746–47, before returning to the country of his birth as part of the Irish Mission. These manuscript lecture notes provides us first-hand knowledge about the content of French Jesuit education in the middle of the eighteenth century, which does not correspond to its classical reputation of ‘Aristotelian’ scholasticism opposed to philosophical novelties. While stitching to a traditional way of teaching, Austin introduces positively elements from Descartes, Malebranche, Locke and Newton into the curriculum. The present paper focuses on his conception of philosophical certitude (certitudo), which he considered a necessary condition for the possibility of philosophical knowledge.

There are instructions from the theory of speech acts that in the initial period, there were differences of opinion among experts. Philosophy, just like the difference between Ibnu Sina and Thomas Hobbes, the first time to examine the problem firmly and complete namely research conducted by J.L. Austin (linguist). This library research intends to study whether two prominent writers in the field semantics namely John Lyons in his book "Linguistic Semantics" and Ruth Kempson in his book "Semantic Theory" involves Austin's ideas in discussion they. Based on the data obtained and the discussions that have been carried out, it can be concluded that the two semantic experts involved Austin ideas in their discussion in semantics. However, the way they involve ideas Austin in their discussion varies from one another, ha / this is in line with the development of social sciences which have never been constant including semantics, as mentioned in previous discussions. Furthermore, it can also be concluded that the two semantic experts took advantage of Austin's ideas in their discussion, even though sometimes their opinions are different from Austin.

The purpose of this research article is to compare the concepts of John Austin and Carl Schmitt on the definition of sovereign - finding the similarities and differences between them. The article analyzes the constitutional law of such states as the Russian Federation and the Vatican City State as a practical application of the results of comparing the concepts of determining the sovereign. In the analysis of the constitutional law of the Russian Federation, the results of the study of the concept of John Austin are used, and in the analysis of the constitutional law of the Vatican City State, the results of the study of the concept of Carl Schmitt are used. The subject of research, the definition of sovereign, is one of the most important topics of Theory of State and Law, therefore, everything stated in the article contributes to the development of understanding of statehood and legal systems and opens new opportunities for study and discussion in the scientific world.

Abstract:
Many hermeneutical approaches have been developed in response to interpretive difficulties arising from the reading of text, especially sacred writings. The linguistic ontology developed by John Langshaw Austin (1911-1960) might offer a novel perspective for “reading” such an utterance. For Austin, there are multiple kinds of speech effected in the instance of human uttering. A given action therefore results out of a person’s given speech. Austin terms “performative utterance” that action performed by way of speech. Further explicating his speech-act theory, Austin outlines that the action exemplified by a given speech are, in fact, three simultaneous acts—first the “locutionary act,” as the compilation of the particular words uttered; next the “illocutionary act,” as the force rendered by this given speech; then the “perlocutionary act,” as the effect consequentially achieved upon a speech’s audience. By proposing that Austin’s approach be deployed to interpret the Epistle of James, I consider a number of ways in which such an interpretation would be demonstrably enriched via speech-act theory. I contend that an interpreter of James’ letter must distinguish among the three kinds of acts being performed in the work of the epistolary author. The culminating aim, then, is to discern what outcomes might have been intended by the epistolary author, in relation to the letter’s original audience.

Abstract:
Hans Kelsen’s critique of John Austin has so far attracted little attention among legal theorists. This article argues that Kelsen’s attack on Austin anticipated the key elements of Hart’s rejection of the Austinian conception of law as sanction-backed sovereign command. At the same time, the way in which Kelsen presents his critique of Austin’s conception of sovereignty reveals important differences in purpose and intention between Kelsen’s Pure Theory of Law and Hart’s legal theory. The Pure Theory of Law is animated by an ideal of legality that is alien to purely descriptive jurisprudential approaches in the Hartian tradition.The article concludes that this difference between Kelsen and Hart merits further exploration and that it might help to show that the Pure Theory of Law is still relevant to contemporary legal theory.

RESUMO Este trabalho analisa o ato de tradução à luz da Teoria dos Atos de Fala, como proposta por John Langshaw Austin em How to do things with words, argumentando que o modo como Austin constrói sua teoria, de uma forma não linear, é adequado para uma teorização sobre a tradução. O trabalho também propõe que se considere o ato de tradução como uma entidade "êmica", ou seja, irredutivelmente cultural. Essa proposta se inspira, por sua vez, na afirmação de Kanavillil Rajagopalan em relação aos atos ilocucionários. Para esse autor, os atos ilocucionários são "unidades de análise indissoluvelmente culturais, compreensíveis tão-somente enquanto fatos institucionais, específicos de cada comunidade de fala" (1992a: 120).

The text deals with the difference between two types of defence in litigation: justifications and excuses. These two defences, according to John Austin (?A Plea for Excuses?, 1956-57), are mutually exclusive because justification means accepting responsibility for the act in question and claiming that it is not bad, while excuse involves accepting that the act in question is bad, but denies responsibility. I will present arguments against Austin?s viewpoint that are presented by Douglas Husak in ?On the Supplied Priority of Justification for Excuse? (2005) and Andrew Botterell in ?A Primer on the Distinction between Justification and Excuse? (2009). I will show that their reasons are inconsistent with the basic standards of self-defence, which is a paradigmatic case of justification.

Legal positivism is influenced by natural law from Ancient Greece, natural law comes from God to regulate human life. Humans were created by reason by God to make rules, John Austin stated that to make a rule sourced from orders or policies in the field of law by the king or parliament as the highest authority. This influenced the thinking of Hans Klesen with a pure legal theory that complies with hierarchical rules and sanctions, Hart's legal positivism explains that law comes from morals that regulate one's behavior. This paper is in the form of legal research in literature studies in the form of books and journals that discuss positivism legal policy, which is legal research, then analyzed using the John Austin doctrine. The advantage of the influence of natural law on legal positivism according to Austin is that it divides the law into two forms, namely the law from God for humans (the divine law), the law created by God for His creatures. Laws are compiled and made by humans, which consist of: Laws that are actually positive laws (properly so called), and laws that are not actually laws (improperly so called). 2. The doctrine of legal positivism, state power must be limited and controlled by law, the state must be constructed as a state of law and not a state of power. Every citizen is considered to have the same position, law enforcers to think and act legally formalistically, by placing legal justice as the goal of law.

En esta propuesta se analizará la reflexión del profesor Vicent Martínez Guzmán en su etapa inicial en la investigación filosófica. Es muy conocido todo su trabajo y reflexión en la filosofía para la paz, un fértil campo de estudio que inauguró en España en los noventa y que se ha ido consolidando como una materia en sí misma. Sin embargo, el trabajo filosófico inicial del profesor Martínez Guzmán, el que precisamente le llevó a ser pionero en la creación de una “filosofía para hacer las paces”, como finalmente le denominaba, no es tan conocido. Se trata de la reflexión desde la fenomenología lingüística, especialmente centrada en el filósofo John Austin, objeto de estudio de Martínez Guzmán en su tesis doctoral. El lenguaje ordinario, como ya preocupó a Austin, será el nicho oportuno para estudiar, lejos de una visión logicista del lenguaje, lo que hacemos cuando hablamos. Y en ese hacer que es el hablar hacemos también las paces.The aim of this paper is to analyze the reflection of Professor Vicent Martínez Guzmán in his initial stage in philosophical research. He is well known for all his work and reflection on the philosophy for peace, a fertile field of study that he inaugurated in Spain in the nineties and that has been consolidated as a subject in itself. However, the initial philosophical work of Professor Martínez Guzmán, which precisely led him to be a pioneer in the creation of a “philosophy to make peace”, as he finally called it, is not so well known. In the paper we will observe his reflection from the linguistic phenomenology, especially centered on the philosopher John Austin, object of study of Martínez Guzmán in his doc-toral thesis. Ordinary language, as Austin has already established, will be the appropriate niche to study, far from a logicist vision of language, what we do when we speak. And it is by talking that we also make peace.

The purpose of the research. This article analyses the main points of the legal teaching of the Australian jurist William Jethro Brown (1868-1930), which the authors of this study regard as forming one of the significant stages in the evolution of Anglo-American legal positivism. Along with his contemporaries, a New Zealand lawyer John William Salmond (1862-1924) and British jurists Thomas Erskine Holland (1835-1926) and John Mason Lightwood (1852-1947), Brown was among the first critics of the «command theory of law» of the founder of the analytical school of jurisprudence John Austin (1790-1859). The authors of this article prove that the ideas, including those of W. Brown, play the role of a link between the founders of the analytical school of law (J. Bentham, J. Austin), the teachings of William Markby, Sheldon Amos, and subsequent generations of English legal scholars of both positivist and neo-positivist direction. Many provisions of Brown's legal doctrine became the basis for criticism of Austin's command concept and legal understanding in the teachings of H. L. A. Hart, the central figure of English neopositivism of the 20th century. As a result of the research the authors conclude that there are comparative similarities between W. J. Brown's conception of «rules of external action», J. W. Salmond's idea of «ultimate legal principles» and H. L. A. Hart's legal doctrine on the «rule of recognition».

The present essay is no exception, and I learned much from it as a tour d’horizon of current thinking about neo-liberalism by social scientists. The observations that John makes about the ways in which current scholars view neo-liberalism as promiscuous, omnipresent, and omnipotent are spot-on.

The centenary of Maine’s death prompts the questions: why is he remembered and what is his significance for us today? In part the answer is simple. He wrote well, and his books such as Ancient Law are a pleasure to read. It is frankly a relief to turn to his works after reading the remarkable but laboured chapters of that other nineteenth century jurist, John Austin (1 790-1859).But going beyond his style and assessing his intellectual merits and the modern uses of his ideas is a more complicated matter. If his jurisprudential ideas are compared with those of, say, Bentham and Austin it is clear that there is an initial contrast in the way their respective theories are categorised. When the latter two thinkers are considered it is useful to refer to Benthamite and Austinian forms of jurisprudence.
