Abstract:
Este trabalho apresenta a tese epistemológica de John Mitchell Finnis sobre a apreensão dos primeiros princípios da moral. Com base em uma interpretação específica de Aristóteles e Tomás de Aquino, Finnis sustenta que esses princípios são apreendidos pela razão através de atos de insight práticos sobre dados da sensibilidade e da razão teórica. A partir desses atos de insight práticos, a inteligência humana apreende uma série de primeiros princípios práticos que, de acordo com Finnis, são mais bem compreendidos através da concepção de lei natural de Tomás de Aquino. O presente texto se propõe a situar esse argumento dentro da teoria jusnaturalista de John Finnis e explanar os elementos que ele abarca, fornecendo uma visão jusnaturalista sobre como as faculdades humanas trabalham em conjunto com a experiência para a apreensão dos fundamentos da moral.

Abstract:
The contemporary natural law theory was grounded in the philosophical and the jurisprudential work of Australian legal and moral philosopher John Mitchell Finnis. He reaffirmed the natural law and also corrected some of false notions about it which were dominant through the history of legal philosophy. Finnis moral and legal philosophy could be understood by the specific theoretical figure - moral argument for law. This theoretical concept implies unity of two mutually connected moments which are necessary for a philosophical treatment of any socially relevant phenomena: methodological and epistemological as well as practical. The meeting point of these two philosophically relevant dimensions is theory of practical rationality exposed in the philosophy of John Mitchell Finnis. By grounding his concept of natural law on the theory of practical rationality, John Finnis historically contextualize it. He made some sort of specific anti metaphysical concept of natural law theory that is alternative to the classical natural law as well as to the legal positivism, which mainly exposed in the legal theories of Hans Kelsen and H.L.A Hart.

RESUMO Objetivo: O estudo objetiva compreender a lei natural e direitos naturais, baseado na aproximação entre direito e moral. Assim, objetiva perquirir sobre a teoria jusnaturalista de John Mitchell Finnis, a fim de aproximar o direito positivo e o direito natural com a condição basilar para o alcance do florescimento da sociedade e do próprio indivíduo. Metodologia:Para atingir os fins esperados, a metodologia utilizada será documental, utilizando-se o método dedutivo, com caráter bibliográfico. Para tanto, utilizou-se a revisão bibliográfica, adotando-se como marco teórico John Finnis, especialmente por intermédio da obra “Lei Natural e Direitos Naturais”. Resultados: Com alicerce na teoria jusnaturalista de Finnis, o artigo aborda a pesquisa científica, na medida em que aproximou-se o direito positivo e o jusnaturalismo, bem como demonstra que a saúde é um bem jurídico fundamental. Assim, apresenta como resultado o pensamento de Finnis, ao revelar os critérios utilizados por ele para a construção de sua lista de bens, que reside na compreensão de que os valores listados são perceptíveis, óbvios, manifestos, inquestionáveis e não precisam de demonstração, pois são objetivos; a mera observação da vida em sociedade é capaz de os identificar. Seus bens são a própria razão de qualquer ação moral ou racionalmente moral, além de outros critérios valorativos de cunho universal que alcançam culturas, instituições, ações e requisitos morais, enfim, um plexo de bens que permitam à pessoa sua realização no contexto coletivo, sem, contudo, hierarquizá-los. Por fim, ao resgatar a teoria defendida por John Finnis, resgata-se, por conseguinte, a importância que a saúde merece, pois é um integrante do bem básico da vida. Contribuições: A contribuição central do presente trabalho cinge-se em defender, argumentativamente, a possibilidade de entender a saúde como bem básico autônomo em Finnis, pois os bens básicos para ele têm um caráter pré-moral, prépolítico e pré-jurídico, ou seja, ainda não se transformaram em obrigações e, acreditase, sem a proteção do bem saúde seria praticamente impossível a uma sociedade alcançar o seu florescimento, que é propósito externado pelo filósofo em sua obra. Palavras-chave: Saúde; John Finnis; jusnaturalismo; direito e moral. ABSTRACT Objective: The study aims to understand natural law and natural rights, based on the approximation between law and morality. It aims to investigate John Mitchell Finnis' s jusnaturalist theory in order to bring positive law and natural law closer to the basic condition for achieving the flourishing of society and the individual himself. Methodology: To achieve the expected purpose the methodology used will be documentary, using the deductive method with bibliographic character. The bibliographic review was used adopting John Finnis as a theoretical framework, especially through the work “Natural Law and Natural Rights”. Results:Based on Finnis' s jusnaturalist theory, the article addresses scientific research as positive law and jusnaturalism approached, as well as demonstrating that health is a fundamental legal good. It presents Finnis's thinking as a result by revealing the criteria used by him for the construction of his list of goods, which lies in the understanding that the values listed are perceptible, obvious, manifest, unquestionable and do not need demonstration, as they are objective; the mere observation of life in society is capable of identifying them. Their assets are the very reason for any moral or rationally moral action, in addition to other universal valuation criteria that reach cultures, institutions, actions and moral requirements, in short, a plexus of assets that allow the person to perform it in the collective context, without , however, to rank them. Finally, when rescuing the theory defended by John Finnis, it is therefore rescued the importance that health deserves, as it is an integral part of the basic good of life. Contributions: The central contribution of this paper is to defend, arguably, the possibility of understanding health as a basic autonomous asset in Finnis, since the basic goods for him have a pre-moral, pre-political and pre-legal character, that is, they have not yet become obligations and, it is believed, without the protection of good health it would be practically impossible for a society to achieve its flourishing, which is a purpose expressed by the philosopher in his work. Formado na teoria analítica do direito, Finnis percebeu a falsa compreensão acerca do direito natural presente nesta tradição. A partir disso, seu principal mérito foi ter demonstrado o caráter infundado da resistência positivista à teoria do direito natural. A tese central desta teoria é a da existência, racionalmente cognoscível, de uma lei cuja normatividade independe da autoridade política ou da lei positiva. Sendo que a teoria de Finnis também destaca o papel dos bens humanos básicos para o florescimento humano. Nesse sentido, o objetivo do presente trabalho é analisar a teoria da lei natural em Finnis e como ela pode contribuir para um fundamento ético dos direitos humanos.

The paper interprets the arguments of Thomas Aquinas on natural law as a way to achieve the common good, which had a significant impact on John Finnis’ natural law theory. The author reveals the conceptual foundations of J. Finnis’ understanding the morally justified actions of people in the community aimed at the obtaining of basic benefits, and the debatable issues of his theory in modern philosophical and legal research. The author arrives to the conclusion that the reinterpretation of J. Finnis analysis of the grounds for ethically significant actions leads him to formulate an instrumental approach to natural law as a rational way to implement a decent life.

Natural law has made a comeback in legal philosophy. The revival of natural law thinking in the legal academy began about thirty years ago and has managed to gain a seat at the table in current jurisprudential discussions. Defining natural law, Brian Bix declares that it “claims that there are fundamental and evaluative connections between the universe, human nature, and morality.” These connections need not have a Christian or even a theistic foundation. A belief in moral realism, that is, the propositions that “(1) there is an objective reality, (2) human beings can know something about it, and (3) there are some things that everyone can, and some things that everyone ought to, do in response to what they know,” ties together theistic and non-theistic versions of natural law. Yet many prominent contemporary natural law theorists—J. Budziszewski, John Finnis, Robert George, and Russell Hittinger —are Roman Catholic. Despite the fact that Finnis and George develop their natural law arguments without reference to any metaphysical states of affairs or transcendent truth claims, natural law continues to be associated with Thomas Aquinas and the subsequent scholastic tradition. Thus, even standards that Finnis and George derive from the internal rationality of law strike some as disguised theology.

In the course of evolving an extensive theory of natural law, John Finnis declares that certain goods are self-evident. Among these basic values, the good of knowledge lends itself to a special argument—an argument directed against people who assail the ranking of knowledge as a good. Finnis maintains that anyone who seriously denies the goodness of truth or knowledge must contradict herself flagrantly in the act of putting forth her position. Skeptics therefore exclude themselves from participating genuinely in a debate over truth’s value. Although their self-disqualification never tout seul establishes the goodness of knowledge, it “should persuade the sceptic[s] to cut short idle doubting” (NLNR at 75; see also “Scepticism” at 267). Or so Finnis believes.

Abstract Laymen in general associate natural law theories to conservative moral conceptions, like traditional marriage of a man and a woman. That makes sense when we notice Catholic Church's position about matrimony or even academic marriage conceptions as the one claimed by John Finnis. But would be possible to defend the so called “marriage equality” in natural law grounds? This paper aims to answer this question affirmatively. Departing from a critical analysis of Finnis’ natural law theory and his marriage conception, I argue that a better matrimony conception needs to be grounded on a wide vision of human sexuality, which encompasses lesbian and gay couples. Instead of procreation (which is one of the marriage points in Finnis’ conception), human experience shows that sex is not limited to breeding - it is a way people can achieve pleasure and high levels of intimacy, regardless their sexual orientation. I conclude that this way of conceptualizing human sexuality is “far more evident” than the one suggested by Finnis and is also consistent with Germain Grisez's interpretation of Aquinas’ first principle of practical reason - with which Finnis himself agrees.

Este artigo almeja incentivar o leitor a aprofundar sua compreensão acerca dos elementos da Lei natural presentes no pensamento de John Finnis, principalmente no que concerne ao direito humano da liberdade religiosa. Isso se deve ao fato desse autor apresentar uma perspectiva única sobre a religião, de maneira a considerá-la como um dos bens humanos fundamentais básicos. Antes de ser um direito humano protegido em tratados internacionais e nas Constituições de diversos países, a religião, de acordo com sua teoria, é um bem humano que deve ser protegido. Tal proteção é imprescindível para o cumprimento de todas as potencialidades de cada ser humano, para que seja possível atingir o seu florescimento humano e, assim também, o bem comum. Dessa forma, será discutido neste trabalho se a liberdade religiosa, sob a ótica de John Finnis, é universal e se deveria assim, ser endossada e aplicada universalmente em todo o mundo, utilizando como exemplo, o documento do Concílio do Vaticano II – Dignitatis Humanae (1965). Ainda, será realizada uma análise bibliográfica das obras desse autor que versam sobre este tema a fim de identificar quais são, e se existem, princípios da liberdade religiosa que são universalmente aplicáveis no mundo inteiro e, principalmente no Ocidente. Dessa forma, a partir da identificação desses princípios será reconhecida a relevância da proteção e incentivo ao exercício desse direito no espaço público, diante do caráter natural relativo ao bem humano da religião, tendo em vista a teoria apresentada por John Finnis.

My aim in this paper is to think through the question of the detachability of Finnis's theistic explanation of the natural law from the remainder of his natural law view, both in Natural Law and Natural Rights and beyond. I argue that Finnis's theistic explanation of the natural law as actually presented can be, without too much strain, treated as largely detachable in the way that his readers have by and large supposed it to be; indeed, Finnis's account as actually presented really amounts to no explanation of the natural law at all, theistic or otherwise, and that fact accounts in part for the ease with which Finnis's natural law view can be detached from theism of that final chapter. Nevertheless, the considerations raised in that chapter militate in favor of a much more thoroughgoing, largely nondetachable theistic account. And it is just such an account that we find Finnis affirming in the development of his views after Natural Law and Natural Rights.

In this article the author examines recent case of the US Supreme Court Obergefell v. Hodges in which group of academics acted as amicus curiae in explaining natural law grounds for having traditional approach to marriage as a union between one woman and one man. Author shows connection between teachings of natural law legal theorist John Finnis and his work named 'Goods of marriage' and requests for keeping 'the marriage' reserved only for heterosexual couples. Heterosexual marriage, according to Finnis, protects the family, the Judeo-Christian concept of monogamy, and other social values that we have reached through social evolution.

John Finnis's powerfully and deservedly influential modern classic, Natural Law and Natural Rights, expounds a theory of law and morality that is based on a picture of “persons” using practical reason to pursue certain “basic goods.” While devoting much attention to practical reason and to the goods, however, Finnis says little about the nature of personhood. This relative inattention to what “persons” are creates a risk—one that Finnis himself notices—of assuming or importing an inadequate anthropology. This essay suggests that the “new natural law” developed by Finnis suffers in places from the inadvertent adoption of (or, more likely, acquiescence in) a flawed anthropology—an anthropology under the thrall of modern individualistic commitments. To explain this suspicion, this article discusses three difficulties (or so they seem to me) in his natural law theory: difficulties in accounting for the basic good of friendship, for obligations we owe to others, and for legal authority. These difficulties may seem disconnected, but this article suggests that they may all reflect an inadequate anthropology—one that Finnis does not exactly embrace (in fact, I suspect that he would reject it) but that is pervasive today and that in places may affect his theorizing.

The law and morality the interrelation issue has been the subject for many discussions, recent works in the philosophy field and law ethics of renowned authors as H. Hart, L. Fuller and J. Finnis, who contributed significantly to the topic. The key question about the moral content of law is examined within the polemics between theorists of legal positivism and natural law legal theorists. This article touches upon this issue by the example of the concept of John Finnis, one of the most brilliant contemporary law philosophers, his neo-naturalistic concept of natural law includes some ideas of modern positivism. J. Finnis claims natural law appears as a set of principles of practical reasonableness for the ordering of human life and the human community. Law acts as a method to ensure “the common good” of the community and is based on seven self-evident, as he believes the basic human goods necessary for the human flourishing. The requirements of practical reasonableness compose the content of natural law, contain recommendations on how to carry out these self-evident goods. For Finnis, the aim of law is to provide conditions, according to the requirements of practical reasonableness, in which these seven goods can be realized. It is outlined that J. Finnis regards law as a social institute which purpose is to regulate human affairs, and thus to promote the creation of a community where everyone could realize the seven fundamental goods for humankind.

La petición creada por un grupo de alumnos de la Universidad de Oxford para despedir a John Finnis generó múltiples reacciones en prensa y en redes sociales. Al hablar de discursos que hablaban a su vez de otros discursos anteriores, el estudio lingüístico desde la perspectiva de la polifonía y la argumentación en la lengua (Anscombre y Ducrot 1983) se muestra como el más adecuado para el análisis del tratamiento que los medios dieron al debate (Bednarek 2006, 2007, Fairclough 1988, Smirnova 2009). En este trabajo se han analizado las estrategias de (des)legitimación empleadas para introducir discurso ajeno. Joseph Raz famously argued that law necessarily makes moral claims. The present work evaluates that view, first looking briefly at problems raised by asserting that law ‘claims’ anything, but focusing primarily on the argument that law’s claim is ‘moral’. In particular, the article proposes that we take more seriously, as an alternative analysis, the idea that law makes (only or primarily) legal claims. It is a view with support (in various ways) from prominent figures like John Finnis, Matthew Kramer, and H. L. A. Hart, and it has the significant benefit of better reflecting the way we speak. The present work responds to objections raised to this view by John Gardner and others.

John Finnis é considerado o maior filósofo da nova teoria da lei natural, na teoria da lei natural, que renova a tradição da ética clássica de Aristóteles e Aquino, confrontando-os com os modernos, principalmente com Hobbes, Hume, Kant e Nietzsche. Este Artigo aborda, especificamente, a sua concepção metaética de razão prática. Para tanto, reconstitui a sua crítica ao emotivismo e ao ceticismo modernos, oriundos principalmente de Hume. Na primeira parte, trata do reducionismo da razão prática a mero instrumento de efetivação de desejos subracionais. Na segunda, articula a dimensão racional dos desejos, relacionando-os aos bens inteligíveis a que eles se voltam. Na terceira, analisa a integração do sentimento à razão prática, explorando a alegoria da máquina de experiências, proposta por Robert Nozick. Por fim, na quarta parte, a partir da natureza da deliberação, apresenta o argumento da autorrefutação como crítica principal ao ceticismo moral. Na conclusão, percebe-se a consistência da teoria moral de Finnis e se atenta para a consequência jurídico-político das teorias restritivas do bem humano, baseadas no emotivismo e ceticismo.
