The chemical nature of the Transfer Film (T.F.) or Third-Body Layer (T.B.L.) formed at the friction interface of an automotive friction brake during off-brake motoring has been studied using Energy Dispersive X-ray (E.D.X.) analysis and Scanning Electron Microscopy (S.E.M.). Although these third-body layers are deposited on both mating surfaces of the friction couple, special attention has been paid to those formed on the disc brake rotor surface. Concurrently, detailed investigations have been undertaken examining the temperature-dependent, physico-chemical interactions of friction material constituents with each other, atmospheric oxygen and countermember materials using X-Ray Diffraction (X.R.D.).Evidence is presented relating the tribological performance of the friction pair to both the transfer film thermochemistry and the friction material composition. Among those characteristics describing the tribological performance of the friction couple, particular attention has been applied to the generation of Disc Thickness Variations (D.T.V.) induced by Off-Brake or Non-Braking Wear (O.B.W. or N.B.W.). The critical role of solid lubricants and abrasive friction modifiers and their effectiveness over a range of contact pressures / temperatures has received particular attention. Information obtained using various surface analytical techniques combined with detailed dimensional assessments of the affected triboelements has been used to show the considerable significance of abrasive particle size in determining the overall tribological behaviour of the friction pair, especially with respect to the wear regime and extent encountered at the surface of the countermember during O.B.W.Wear mechanisms are described for the generation of off-brake wear, these varying with friction material formulation. Dynamic and temperature-dependent influences on the level of in-service disc brake rotor runout are named as causes for particular forms of disc thickness variation generated by aggressive friction materials. Vibrações de baixa frequência, conhecidas por judder, figuram entre as maiores reclamações de consumidores para problemas originados pelos sistemas de freio automotivos, uma vez que penalizam o conforto do veículo. Em freios a disco, o judder procede de divergências dimensionais que resultem na variação da espessura do disco ao longo de sua circunferência, o chamado DTV (disc thickness variation). Como consequência deste fenômeno são observadas variações no torque de frenagem (BTV ou brake torque variation) e flutuações na pressão do fluído de freio (BPV ou brake pressure variation), ambas induzindo vibrações em frequências proporcionais à rotação das rodas e que são percebidas principalmente no volante, no pedal de freio ou no assoalho do veículo. Durante o desenvolvimento de sistemas de freio, ensaios em bancada e em veículo monitoram o desenvolvimento do DTV ao longo de sucessivas frenagens. A medição do DTV, que não passa de algumas dezenas de micra, exige a utilização de sistemas de precisão que, por sua vez, estão sujeitos a erros inerentes ao procedimento de montagem e desmontagem ou ainda da própria vibração das bancadas de ensaio onde são instalados. Por outro lado, as medições de torque e pressão estão menos sujeitas a estas interferências, podendo servir como parâmetros de avaliação do freio. No presente trabalho, discos em diferentes níveis de DTV foram preparados e montados em um veículo instrumentado para a medição de vibrações. Um procedimento de frenagens em diferentes pressões foi executado com cada disco, de forma a determinar a condição a partir da qual o judder se torna crítico. Em continuação, ensaios em um dinamômetro inercial simularam o mesmo procedimento, de onde se buscou medir o BTV e o BPV nos diferentes níveis de variação de espessura de disco. Como resultado foi observado que a medição do BTVRelativo, bem como a do BPVMáximo, em frenagens com pressão entre 30 e 50 bar, demarcam patamares que permitem determinar se o disco de freio se encontra com um DTV acima do limite admissível para a não-ocorrência de vibrações consideradas desconfortáveis. Desta observação, conclui-se que os procedimentos de ensaio em bancada podem ser incrementados de frenagens em pressão da ordem de 40 bar, em etapas estratégicas do teste, onde a medição do BTVRelativo e/ou do BPVMáximo podem fazer parte dos critérios de aprovação para o freio em avaliação.<br>Low frequency vibrations, also known as judder, are one of the major customer complains on brake system issues, since they bring a penalty for vehicle comfort. Regarding disc brakes, judder is originated by dimensional faults resulting in the disc thickness variation (DTV) along its circumference. As a consequence of this phenomenon, brake torque variations (BTV) and brake pressure variations (BPV) are observed, both resulting in vibrations that can be felt in the steering wheel, brake pedal and vehicle floor, at frequencies proportional to the wheel speed. When developing a new brake system, vehicle and bench tests are performed in order to monitor the DTV growth along successive snubs. In measuring DTV, which in most cases does not overcome several tens of micron, high precision measuring devices are required which, by the way, are subjected to measurement errors due to assembly/disassembly of sensors or affected by the vibration of the test bench itself. On the other hand, the brake torque and pressure measurements are less influenced by these interferences and might be useful parameters on brake evaluation. As part of this study, discs in different levels of DTV were prepared and assembled in a vehicle instrumented to the measurement of the vibrations. A test procedure with snubs at different pressures was performed over each disc, as a way to access the condition for critical judder. After that, a inertia dynamometer was employed to simulate the same test procedure, were the BTV and DTV were measured against the different levels of DTV. As a result it was observed that the BTVRelative measurement, as well as the BPVMaximum measurement, in snubs with pressure between 30 and 50 bar, present well defined levels which permit to identify if a brake disc DTV is above the acceptable limit for non-generation of vibrations classified as uncomfortable. From this observation, the conclusion is that brake test procedures can incorporate additional snubs with pressure of around 40 bar, in strategically defined stages, where the BTVRelative and/or BPVMaximum measurements may figure as part of the criteria for brake approval.

Hot spotting of automotive disc brakes is an undesired thermal localisation phenomenon, which is a challenge for numerical modelling in terms of both accuracy and efficiency especially for complex disc geometry. In this research, the aim was to develop a computationally efficient finite element (FE) approach for 2-piece pin-mounted ventilated disc hot spot prediction with acceptable accuracy enabling parametric studies to contribute to the knowledge of the complex mechanisms. A time reduction strategy for the simulations was established by incorporating an axisymmetric brake pad assumption with material scaling factor and the friction characteristics were defined by a user-subroutine. The computing accuracy and efficiency of this method were then verified by comparing with traditional FE models. 2D in-plane, 2D out-of-plane, and 3D models were performed to investigate the effects of ventilated disc hot spotting, radial hot spot/band migration, and hot spotting of realistic complex disc geometry respectively. Both 2D and 3D results were validated using experimental results based on a laboratory dynamometer and showed good correlation. The results suggested that adequate modelling of friction pair contact pressure distribution and the subsequent non-uniform heat generation is essential for hot spot simulation; speed was identified as the determinant for the number of hot spots, whereas hot spot temperature was determined by energy level. Furthermore, recommendations for vent design, pins, disc run-out, cooling, material selection, wear rate, pad length and loading distribution were given. Finally, hot spotting and hot band migration cause-effect chains were established based on the results and discussion.

L’impôt joue un rôle important dans les relations de pouvoir en Judée aux époques hellénistiques et romaines, non seulement par son poids économique, mais aussi et surtout par ses aspects idéologiques. Car imposer une population revient à s’en prétendre maître. Or, en Judée, une première lecture des sources laisse croire que beaucoup voyaient d’un mauvais œil le tribut étranger, alors que le temple de Jérusalem prélevait déjà des impôts censés revenir à Dieu, seul véritable maître d’Israël. Un examen plus attentif montre l’aspect polémique de cette déclaration : cette opposition dialectique entre les prélèvements du temple et ceux revenant aux étrangers est une construction idéologique, dont le but est de fournir une légitimation de l’opposition politique. Apparue à l’époque des Maccabées et participant à l’argumentation théologique de leur soulèvement, cette rhétorique se repère, avec quelques variations, dans chaque mouvement contestataire jusqu’à Bar Kokhba. Mais les sources dissimulent quelques indications qui montrent que tous ne partagent pas cette vue, et que dans les faits, l’offrande n’est pas plus joyeusement payée que le tribut. L’objet de cette thèse est de mettre en avant cette construction représentationnelle en la confrontant aux données brutes, et d’en souligner les implications sociales, économiques, financières et politiques, depuis la conquête de la Judée par Antiochos III jusqu’à la disparition de la province de Judée en 135 apr. J. C<br>Taxes are important matters for understanding relations of power in Hellenistic and Roman Judaea, not only because of its economic burden, but above all because of its ideological sides: to tax a population means to pretend being its master. In Judaea, a first look to the sources let believe that many saw with a bad eye the foreign tribute, while the temple of Jerusalem exacted some revenues supposed to return to God, the sole proper master of Israel. However, a close examination proves the polemical sides of such a declaration: this dialectical opposition between the revenues of the shrine and the ones returning to foreigners is an ideological construction, whose purpose is to furnish a legitimation to the political opposition. Appeared at the time of the Maccabean uprising and used for theologically founding the war, this rhetorical instrument is visible, with some variations, in each protest movement until Bar Kokhba. But the sources hide some indications that let see that not everyone shared this view, and that, in the facts, the “offering” is not more cheerfully paid that the “tribute”. The purpose of the present dissertation is to underline the social, economical, financial and political implications of this representational construction, since the conquest of Judaea by Antiochos III, until the disappearance of the Judaea in 135 C.E

Over the past decade vehicle judder caused by Disc Thickness Variation (DTV) has become of major concern to automobile manufacturers worldwide. Judder is usually perceived by the driver as minor to severe vibrations transferred through the chassis during braking [1-9]. In this research, DTV is investigated via the use of a Smart Brake Pad (SBP). The SBP is a tool that will enable engineers to better understand the processes which occur in the harsh and confined environment that exists between the brake pad and disc whilst braking. It is also a tool that will enable engineers to better understand the causes of DTV and stick-slip the initiators of low and high frequency vibration in motor vehicle brakes. Furthermore, the technology can equally be used to solve many other still remaining mysteries in automotive, aerospace, rail or anywhere where two surfaces may come in contact. The SBP consists of sensors embedded into an automotive brake pad enabling it to measure pressure between the brake pad and disc whilst braking. The two sensor technologies investigated were Thick Film (TF) and Fibre Optic (FO) technologies. Each type was tested individually using a Material Testing System (MTS) at room and elevated temperatures. The chosen SBP was then successfully tested in simulated driving conditions. A preliminary mathematical model was developed and tested for the TF sensor and a novel Finite Element Analysis (FEA) model for the FO sensor. A new method called the Total Expected Error (TEE) method was also developed to simplify the sensor specification process to ensure consistent comparisons are made between sensors. Most importantly, our achievement will lead to improved comfort levels for the motorist.

Målet med uppsatsen är att ge förståelse för hur Westboro Baptist Church kan med hjälp av retoriken knyta samman sin gemenskap, och överleva när hela världen står emot dem. Genom Bergers teori om nomos och den klassiska retorikens tre grundpelare ämnar uppsatsen ge en bild av hur rörelser kan med hjälp av retorikkonsten hålla en rörelse levande trots att de står ensamma mot världen.<br>In this exam paper I seek a deeper understanding of how the Westboro Baptist Church views human life and how the Westboro Baptist Church tries to convince the world through their rhetoric. The paper is based on open letters by the church which have been published on their website. In the letters Westboro Baptist Church write about, what they think, are the most sinful parts of a human’s life, and they give guidelines as to how people should correct their habits and live a good Christian life. These letters of correction are sent out to people in the social arena, both big and small. The goal of the paper is to give a deeper understanding of how Westboro Baptist Church can keep their congregation alive through its rhetoric, and survive when the whole world is against them. With the help of Peter Berger’s theory of nomos and the three basic focal points of classical rhetorical analysis, this exam aims to give a better picture of how a closely knit group can remain functional when the whole world hates them.

In Canada, we regularly incarcerate accused persons while they are still legally innocent. By the turn of the century, the growing number of accused held in pre-sentence custody had become a concern for provincial/territorial governments, and, by extension, the federal government. In an effort to address the problem, Bill C-25 - ‘The Truth in Sentencing Act’ - was passed into law. Adopting a quantitative as well as qualitative methodology, this study uses a randomly selected sample of 110 cases to examine the implementation of Bill C-25 as a case study of how Canadian judges respond to legislation which likely created friction between the political and judicial social spheres. Analyses suggest that there is strong evidence to support the notion that judges did not fully implement the legislation as intended by the federal government. Instead, it appears that judges may have been motivated to resist the implementation of Bill C-25 in order to protect fundamental principles of justice that were ignored in the drafting of the new law.

Many regard the last five chapters of the book of Judges (chs. 17-21) as problematic and out of place in the overall context of the book. Various theories have emerged to explain how the narratives in these chapters made their way into the book of Judges. The 1970s and 1980s saw a shift in the academic discipline of biblical studies toward synchronic or literary approaches to biblical interpretation. Although this literary tum has had a significant impact on the interpretation of Judges, questions regarding the place and function of chs. 17-21 still remain. Leveraging work from literary studies and hermeneutics, this dissertation re-examines Judges 17- 21 with the aim of uncovering the strategies of ending which are at work in these chapters. This dissertation identifies a number of strategies of ending in Judges 17-21 including the strategy of circularity, the strategy of completion and the strategy of entrapment. Moreover, the temporal configuration of Judges and particularly the nonlinear chronology which chapters 17-21 expose receive due attention. All of this offers fresh insights into the place and function of chs. 17-21 in the context of the whole book.

This research compared physical characteristics of bodybuilders to judges' rankings, and compared the judges' rankings across three levels of judges: Elite, Trained, and Untrained. Twenty-nine male and nine female bodybuilding athletes consented to anthropometric and circumference measurements. The independent variables in this study were bodyfat, fat-free weight, and proportionality of muscle. Three groups of judges ranked male and female athletes in the Open, Novice, Collegiate, and Masters divisions. The measurements of proportionality of muscle, bodyfat, girths, and fat-free weight were analyzed using simple and multiple regression. The judges' rankings in each class were compared using reliability coefficients, correlation, repeated measures analysis of variance, and the generalized theory for inter-rater reliability. There were significant correlations between the Elite judges' rankings and bodyfat in the Men's Open lightweight class. The Trained and Elite judges' rankings were significantly correlated with bodyfat in the Women's Novice class. Fat-free weight was significantly correlated with the Untrained and Elite judges' rankings in the Women's Novice division. Proportionality of muscle was significantly correlated with the Elite and Trained judges' rankings in the Men's Open lightweight class. Elite and Trained judges' rankings were significantly correlated with bodyfat and proportionality of muscle. All three groups of judges' were significantly correlated with the Overall rankings. The Trained judges' rankings were more correlated and more reliable with the Elite judges. The inter-rater reliability scores were higher for the Elite and Trained judges than for the Untrained judges. When fat-free weight was substituted for body weight in the calculation of proportionality of muscle, prediction of ranking was enhanced. Hellenistic philosophy in general, and Stoicism in particular, exerted a profound influence on the pseudepigraphal Jewish work 4 Maccabees. This thesis is devoted to a broad discussion of this influence, exploring the philosophical underpinnings of 4 Maccabees and its background in Jewish law and tradition. We conclude that Stoicism, though not the only element in the background of 4 Maccabees, was the dominant element, and that the work may therefore justifiably be called Judaeo-Stoic. Chapter 1 consists of an overview of the history of the Stoic school and its ethical system so as to provide a baseline against which to measure 4 Maccabees. Chapter 2 introduces 4 Maccabees, attempting to shed some light on questions such as the work’s authorship and audience. Ultimately, the work should be regarded as a "successful failure" in light of its internal success but its lack of any substantial influence on subsequent Jewish thought. Os dados coletados foram analisados através de uma perspectiva etnográfica e sociolingüística interacional. Foi apresentada uma descrição da coleta de dados e do layout da sala de audiências. A estrutura organizacional do evento foi descrita, assim como os papéis desempenhados pelos participantes. O evento foi identificado como sendo estruturado em atividades distintas coordenadas pelo representante da instituição: o juiz. No decorrer destas atividades o juiz decide quais tópicos podem ser discutidos e em que ordem podem ser abordados. O padrão pré-determinado de perguntas e respostas favorece o direito do juiz de fazer perguntas e constrange os depoentes a fornecer respostas. Interações que mostram juízes formulando perguntas desafiadoras e, ao mesmo, tempo tentando manter uma aparência pública de neutralidade, foram descritas. Enquanto procedem o questionamento, os juízes demonstraram estarem atentos e aparentemente neutros as respostas dos depoentes mediante turnos curtos com uso de continuadores ou ao repetir a resposta dos depoentes, quando estes forneceram respostas curtas. Quando os depoentes responderam as perguntas dos juízes de forma mais complexa, os juízes demonstraram sua atenção às respostas dos mesmos ao formular um resumo da fala anterior dos depoentes. Questões de formulação de moralidade, por parte dos juízes, também foram encontradas, apesar da preocupação destes em demonstrar neutralidade. Também é formulada pelos juízes a insatisfação dos mesmos devido a desconformidades dos depoentes no que diz respeito aos procedimentos dos tribunais. Juízes não deixam passar desapercebidos momentos em que os depoentes não comportam-se de acordo com os procedimentos dos tribunais, apesar dos depoentes não estarem familiarizados com os mesmos. É observado que uma das principais tarefas do Judiciário não é apenas certificar-se de que a justiça é feita, mas certificar-se de que as pessoas estão vendo a justiça ser feita. A publicidade das atividades dos tribunais transformam as atividades do Judiciário em uma "cerimônia de justiça".

En droit judiciaire privé, la distinction du fait et du droit est censée fonder la répartition des rôles entre les parties et le juge sur la matière litigieuse et la délimitation du contrôle de cassation. Au premier abord, cette distinction, historique et adoptée par de nombreux systèmes juridiques, semble évidente voire élémentaire. Du point de vue de la théorie du droit elle trace une frontière entre le fait, au sens d'évènement, et la norme selon un critère de normativité. Cependant, cette simplicité n'est qu'apparente car, en droit judiciaire privé, il n'existe pas une mais plusieurs distinctions. Afin de s'adapter à la réalité processuelle, en matière d'office du juge, elle devient la distinction des domaines du droit et du fait, le premier comprenant les activités juridiques, qui portent sur les règles de droit, et le second les activités factuelles ayant pour objet les éléments de faits. En matière de cassation, elle devient la distinction entre les questions de fait, qui portent sur l'appréciation des faits, et les questions de droit qui concernent l'application du droit. Pourtant, la multiplication des niveaux de distinction ne suffit pas à la rendre opérante : le juge joue un rôle dans le domaine factuel tandis que les parties ont des obligations dans celui du droit ; la Cour de cassation contrôle des questions de fait tandis qu'elle abandonne certaines questions de droit. Puisque la distinction est dépourvue de fondement normatif, il convient de s'en détacher pour revenir aux textes qui déterminent précisément le rôle de chacun dans le procès civil et réalisent un équilibre des rôles. At first, this historical distinction, adopted by numerous legal systems seems obvious, and even elementary. In terms of the theory of law, it draws a border between the fact, meaning the event, and the norm according to a criterion of normativity. However, this simplicity is only apparent,as, in Private Judicial Law, there is no single distinction, but several differentiations. In order to adapt to the processual reality, as regards the judge's function, it becomes the distinction between sectors of the law and the fact, the first sector including the legal activities, which deal with the rules of law, the second sector refering to the factual activities aiming at the matters of facts. As far as cassation is concerned, it becomes the distinction between the question of fact which focus on the appreciation of the facts and the question of law which deal with the enforcement of the law.Yet the multiplication of the levels of distinction is not sufficient to make it operating : the judge plays a part in the factual field whereas the parties have some obligations in the fields of law ; the Court of Cassation controls questions of fact whereas it gives up certain questions of law. Since the distinction is devoid of normative basis, it is necessary to break away to come back to the texts which precisely determine the role of each party in the civil trial and achieve a balance of the roles. Inspired by Michael Foucault’s "technologies of the self" and Jacques Rancière's idea of the politics of aesthetics, specifically, his concept of "the distribution of the sensible", this thesis examines two groups of people who actively pursue creativity in China today: first, a group of Chinese youth who seek their identity as creative writers through their participation in the Xin Gainian Zuowen Dasai, or the New Concept Writing Competition, held by Mengya magazine since 1998; second, a group of men and women who are grouped together under the name of "Dafen painters", who pursue their creative identities as oil painters either for their own artistic dreams or for better lives. Through these two cases, this thesis explores the relationship between creative practices and individuals’ identity formation, and attempts to achieve a better understanding of how the formation of these identities relate to broader desires for creative identity in China’s society today.
This paper argues that an individual's own desire for creative expression and recognition in fact acts to diminish their ability to engage in truly creative expression, and that the attempts at recognition reconfigure groups to block individuals from finding opportunities to express their creative identities.

Wer aufmerksam durch unsere Stadt geht, wird auf dem Fußweg der Moritzburger Straße die so genannten Stolpersteine entdecken. Spätestens dann drängt sich bestimmt die Frage auf: Wie erging es eigentlich den in Radebeul ansässigen Juden während der Zeit des Nationalsozialismus, während der Zeit des „Dritten Reiches“? Heute, mehr als 60 Jahre nach Kriegsende, ist über diesen Teil unserer Stadtgeschichte manches leider nicht mehr gegenwärtig.
Wie viele jüdische Familien, wie viele jüdische Mitbürger/-innen Anfang der 30er Jahre des vorigen Jahrhunderts in unserer Stadt lebten, vermag man heute nicht mehr mit absoluter Sicherheit zu sagen. Wohl aber ist bekannt, dass mehrere in der Zeit von 1933 bis 1945 in Konzentrationslager verschleppt wurden und dort umgekommen sind. Andere konnten noch rechtzeitig auswandern oder untertauchen. Die Diskriminierung und Verfolgung der jüdischen Menschen hat auch nicht vor Radebeul Halt gemacht!
Die Verfasser der vorliegenden Broschüre, Ingrid Lewek und Wolfgang Tarnowski, haben sich, nachdem die Erstauflage des Büchleins im Jahre 2004 schnell vergriffen war, dankenswerterweise weiter auf Spurensuche begeben. Sie gingen Hinweisen und weiterführenden Informationen nach und konnten so ihre Abhandlung überarbeiten und erweitern.
Als Ergebnis ihrer jahrelangen Arbeit liegt uns jetzt ein unschätzbares Werk vor, welches zugleich Erinnerung und Zeitzeuge des Geschehens der Jahre 1933 bis 1945 in unserer Stadt ist. Die aktuellen Ereignisse in unserem wie auch in benachbarten Ländern zeigen, wie wichtig es ist, immer wieder darum zu ringen, dass die damaligen Zeiten, die damaligen Geschehnisse nicht in Vergessenheit geraten! Der Respekt vor der Freiheit des Andersdenkenden, der Respekt vor der Freiheit des Andersgläubigen sind nicht nur Grundlage unseres Grundgesetzes, sondern vor allem Grundvoraussetzung des friedlichen menschlichen Zusammenlebens. O objetivo desta tese de doutorado é verificar a presença judaica em textos diversos de Jorge Amado (1912-2001), sobretudo em romances, abrangendo suas duas fases, em articulação com sua leitura de mundo. Quanto ao método, a verificação se dá por meio de rastros/indícios do judeu na obra amadiana, considerando que a presença judaica em seus textos aparece mais como referência ou assunto do que personagem. O pensamento analógico é a tônica da tese. As reflexões têm como gatilho o rastro do judeu no texto, nas quais se articulam parte e todo, em mútua influência. Em relação aos resultados, a presença judaica nos trabalhos de Jorge Amado está ligada a um modo bastante monolítico de ver o judeu. Em geral, figuras judaicas são associadas à militância comunista, assim como se relacionam a um plano mítico/profético sobre o qual a cosmovisão amadiana também se assenta. A forma da obra de Jorge Amado, calcada em diálogo com expressões populares, guarda ecos da cultura judaico-cristã, com ênfase no pensamento escatológico e soteriológico. A conclusão é a de que o judeu no texto amadiano tem função metonímica, algo que se relaciona tanto com sua posição ideológica quanto com sua cosmovisão. Portanto, há um feixe de significados na presença judaica em Amado: de contestação à revelação.<br>The aim of this thesis is verify the Jewish presence in various texts produced by Jorge Amado (1912-2001), focusing in his novels, also covering the two moments of his career. This will be approached through his worldview. As for the method, the analysis is based on trails/signs of the Jew in Amados works as the Jewish presence in his texts comes up more as reference or subject than representation. The analog approach is applied in this thesis. Trails/signs of the Jew in the texts function as the triggers for the analysis, in which all the elements, being central or peripheral, are in mutual influence. As for the results, the Jewish presence in Amados works is related to a monolithic view of the Jew. In general, Jewish traces/characters are linked to Communist militancy, as well as they are related to a mythical/prophetical level on which Jorge Amados worldview also is based. Authors style pays tribute to popular expressions, reverberating Jewish-Christian culture, with emphasis on the eschatological and soteriological thinking. As for the conclusion, the Jew in Amado works function as a metonymy, something that is related to both his ideological position and his worldview. Therefore there are a number of meanings in the Jewish presence in Amado: from subversion to revelation.

The importance of the family in ancient Near Eastern society is so frequently recognized that it has become a truism. It is therefore surprising that in a work of identity-making such as the Bible, the influence of family on the texts' formation has been under studied. Such an omission may be because the discussion on family in the Bible has largely concentrated upon reconstructing day-to-day life as background to our reading. Scholars have not seen family loyalty as an essential component in the narratives' meaningfulness. In my dissertation, I examine family and identity in the Book of Judges. I argue that the family is the dominant locus of identity for people throughout the first millennium BCE and that Judges' social communication depends upon acknowledging this dynamic. The meaning of the local folklore gathered together in Judges relies upon an appreciation of the values held by the society from which it comes and distinguishes this core material from the editorial framework. This perspectival dichotomy also raises questions about the book's redactional methodology. Identity is revealed through socio-relational dynamics; hence, my thesis takes a social-scientific approach to the texts. Following an introduction, the first chapter discusses family and identity with particular reference to the localized structures of first-millennium BCE Palestine. The next four chapters present texts from Judges in which I employ four socio-anthropological theories. I begin with the tale of Jael and Sisera in Judg 4 and 5, to which I apply the concept of social space. I then compare the stories of Abimelech in Judg 9 and Jephthah in Judg 11 in light of ascribed social status. The wedding of Samson in Judg 14 forms the third study for which endogamy and the socio-economic autonomy of the household are relevant theories and I end by discussing hospitality and social distance in the eventful journey of the Levite in Judg 19. I conclude that the 'nationalizing' of these folktales by the editorial frame must nevertheless respect their familial perspective to maximize the success of Israel's identity-making.

This dissertation identifies and addresses key issues in Septuagint lexicography using case studies from the Greek version of Judges. The first chapter outlines the state of the question on the textual history of Judges in Hebrew and Greek, and also presents my lexicographical method and related matters. Chapter two surveys the history of Septuagint lexicography. I demonstrate how data about the meaning of Septuagint vocabulary has been insufficiently or in appropriately derived, expressed, and/or documented. I also highlight debates over the nature of post-classical Greek and the language of the Septuagint, which has predisposed scholars against viewing the Septuagint corpus as part of post-classical Greek in general. By pointing out methodological flaws that have plagued Septuagint lexicography-as well as theoretical problems in a Hebrew-priority view of the language-I argue for a Greek-priority view that evaluates Septuagint vocabulary in light of contemporary sources and emphasizes the importance of documentary evidence. The following chapters provide case studies from Greek Judges that demonstrate the benefits of a Greek-priority view. Many cases of consistent vocabulary disagreement in the textual history of the book cannot be explained on the basis of the Hebrew text nor given the data available in current lexicons. Examination of post-classical Greek evidence demonstrates that the motivation for the language change is multifaceted, but clearly includes matters of style and semantics in Greek independent from the source text. Chapter three focuses on παρατάσσω and παράταξις; chapter four on παιδάριον, παιδίον, νεανίας, and νεάνισκος; and chapter five on ἀπάντησις and συνάντησις. Each chapter concludes by discussing the relevance of the evidence for Septuagint lexicography, the motivation underlying the revision of Greek Judges, and the potential of Septuagint vocabulary to inform Greek lexicography in general. Chapter six summarizes my lexical analysis and discusses the benefits of a Greek-priority approach and its value for Septuagint lexicography. I posit a time-frame for the translation and revision of Greek Judges based on linguistic evidence. I conclude by emphasizing the need for renewed efforts in Septuagint lexicography to incorporate literary and nonliterary post-classical Greek sources. To address this need, I provide several sample lexicon entries for words discussed in the preceding study.

There are many facets of impeachment that warrant examination. The impeachment inquiries of individual presidents and federal judges have all been studied in depth, but one aspect of impeachment still remains fundamentally unexplored: Under what circumstances will the House of Representatives vote to impeach a federal judge? This thesis is a systematic, empirical study of the impeachments of federal judges. All 65 impeachment inquiries brought against federal judges over the last 209 years are studied in order to assess a number of factors across every federal judicial impeachment inquiry in order to draw conclusions about the conditions under which federal judges are impeached. I will test six hypotheses and draw conclusions from the results in order to determine if any of these factors help explain why the House of Representatives has voted to impeach some federal judges but not others.

As digital evidence grows in both volume and importance in criminal and civil courts, judges need to fairly and justly evaluate the merits of the offered evidence. To do so, judges need a general understanding of the underlying technologies and applications from which digital evidence is derived. Due to the relative newness of the computer forensics field, there have been few studies on the use of digital forensic evidence and none about judges' relationship with digital evidence.
This study addressed judges' awareness, knowledge, and perceptions of digital evidence, using grounded theory methods. The interaction of judges with digital evidence has a social aspect that makes a study of this relationship well suited to grounded theory. This study gathered data via a written survey distributed to judges in the American Bar Association and National Judicial College, followed by interviews with judges from Massachusetts and Vermont.
The results indicated that judges generally recognize the importance of evidence derived from digital sources, although they are not necessarily aware of all such sources. They believe that digital evidence needs to be authenticated just like any type of evidence and that it is the role of attorneys rather than of judges to mount challenges to that evidence, as appropriate. Judges are appropriately wary of digital evidence, recognizing how easy it is to alter or misinterpret such evidence. Less technically aware judges appear even more wary of digital evidence than their more knowledgeable peers.
Judges recognize that they need additional training in computer and Internet technology as the computer forensics process and digital evidence, citing a lack of availability of such training. This training would enable judges to better understand the arguments presented by lawyers, testimony offered by technical witnesses, and judicial opinions forming the basis of decisional law. A framework for such training is provided in this report.
This study is the first in the U.S. to analyze judges and digital forensics, thus opening up a new avenue of research. It is the second time that grounded theory has been employed in a digital forensics study, demonstrating the applicability of that methodology to this discipline.

A rebours d’une vision de l’Empire carolingien défini comme une entité homogène, la société carolingienne se caractérisait par sa diversité ethnique, culturelle et religieuse. En plus de faire face à l’altérité à l’intérieur de l’Empire, les souverains carolingiens étaient confrontés à populations très diverses en périphérie de celui-ci : à l’image des Juifs, des Musulmans ou des Espagnols. Cette thèse s’intéresse plus précisément aux Juifs du territoire carolingien, sous le règne des rois et empereurs carolingien (entre 750 - 900). Cet objet de recherche, souvent abordé, n’a jamais fait l’objet d’un traitement systématique. A partir d’un corpus de sources normatives, ce travail analyse comment les autorités séculières et ecclésiales traitaient des Juifs ou du Judaïsme dans leurs législations. Dans un premier temps, il opère une analyse systématique de chaque source, afin de dresser un tableau de toutes les facettes des traitements des autorités chrétiennes (séculières et ecclésiales) à l’égard des Juifs et du Judaïsme. Dans un deuxième temps, il s’attachera à définir la place de cette minorité juive au sein d’une société carolingienne qui se veut chrétienne. En confrontant l’idée du Juif réel avec celle Juif ou du Judaïsme imaginaire ou imaginé et celle du « juif herméneutique », concept introduit par Jeremy Cohen donnant aux Juifs dans les textes théologiques un rôle de figure ajustable à l’argumentation, cette thèse propose les concepts de « Juif historique » et de « Juif politisé » comme clé de lecture de la place des Juifs ou du Judaïsme dans les sources législatives<br>Contrary to the belief that the Carolingian Empire was a homogenous entity, Carolingian society was in fact characterized by its diverse ethnic groups, culture, and religion. As well as facing otherness within Europe, Carolingian rulers confronted very diverse populations along its empire’s boundaries: such as the Jews, Muslims, and Spaniards. This thesis concentrates particularly on the Jewish population at the time of the Carolingian Empire, between 750 and 900 AD. There are many articles referring to the Jewish population during that time period, however there is no focused systematic or methodological research on this minority population. Using a corpus of normative sources, this work presents an analysis on how secular and ecclesiastical authorities applied their legislation to the treatment of Jews or Judaism. In the first part, each source undergoes systematic analysis, thus leading to the compilation of a table that outlines the Christian authorities, (secular or ecclesiastic), guidelines on how to treat Jews and Judaism. The second part has the mission to define the place that this Jewish minority had within this Christian Carolingian society. It confronts the notions of the “real” Jew against the “imagined” or “imaginary” Jew or Judaism at that time period, as well as presenting Jeremy Cohen’s concept of the “hermeneutical Jew” which gave the Christian authorities the ability to adapt or change the Jewish image according to their other concerns. This thesis introduces the concepts of the “historic Jew” and that of the “political Jew” as the key to the place the Jews or Judaism had in legislative sources

Através do levantamento de obras, escritas entre 1920 e 1940, foi elaborada a pesquisa, que procura identificar elementos e personagens que compõem o judaísmo e/ou à cultura judaica. Paralelamente à pesquisa bibliográfica, também são estudadas as obras escritas por Gilberto Freyre no período, procurando-se visualizar o ponto de vista do autor sobre os judeus na história do Brasil. Para uma melhor compreensão da pesquisa e da obra de Freyre, foi traçado um panorama histórico da presença judaica no Brasil e da literatura brasileira a partir dos movimentos modernista e regionalista.<br>This research was developed through a survey of works which were written between 1920 and 1940. It aims to identify elements and characters that belong to the Judaism or to the Jewish culture. At the same time, it covers the works written by Gilberto Freyre in the same period by analyzing the author\'s point of view on the Jewish participation in the Brazilian history. In order to better understand the research and Freyre\'s works, it was presented the picture of the presence of the jews in Brazil as well as the Brazilian literature (considering the \"Modernism\" and \"Regionalism\" as starting points).
