Abstract:
At the beginning of Derrida's ‘Before the Law’, a reading of Kafka's story with that title, is an epigraph from Montaigne's Essays: ‘… science does likewise (and even our law, it is said, has legitimate fictions on which it bases the truth of its justice)…’. Derrida again refers to this quotation in ‘Force of Law’, asking what a ‘legitimate fiction’ might be and what it would mean to establish the basis for the truth of justice. With reference to these writings on the status of narrative and the law, as well as to other texts by Derrida, this paper examines the story of the judge-penitent in C

Albert Camus' ironic judge-penitent, Jean-Baptiste Clemence, remarks to his compatriot in the seedy bar, Mexico City, in a shadowy district of Amsterdam, the mist rising off the canals, the fog rolling in, cheap gin the only source of warmth, “Somebody has to have the last word. Otherwise, every reason can be answered with another one and there would never be an end to it. Power, on the other hand, settles everything. It took time, but we finally realized that. For instance, you must have noticed that our old Europe at last philosophizes in the right way. We no longer say as in simple times: ‘

Abstract:
If a person has been duly sworn as a witness in a judicial proceeding, he must answer any relevant question put to him. If he does not do so, he risks being held by the judge to be in contempt of court and punished by being imprisoned or fined. The fact that the witness finds it repugnant to his sense of honour to give an answer which will break a confidence reposed in him by someone else does not excuse him from his duty. The public interest in the disclosure of all matters relevant to a judicial proceeding is regarded as so important that it prevails over any considerations of private honour

I den här uppsatsen analyserar jag protagonisten Jean-Baptiste Clamences moraliska utveckling i Albert Camus’ roman Fallet. Jag använder A.J.
